Scheme of the State Secretary for Infrastructure and the Environment, from 15 March 2013, No IENM/BSK-2013/28348, laying down provisions on the provision of subsidy to the Knowledge and Development Centre Mainport Schiphol Foundation for the years 2013 to 2017 (SubsidierScheme KDC 2013-2017)
The State Secretary for Infrastructure and the Environment,
Having regard to the Articles 2 and 3 of the Framework Law Grants Traffic and Water State ;
Decision:
The following definitions shall apply:
a. Minister: Minister for Infrastructure and the Environment;
b. KDC: the Knowledge and Development Centre Mainport Schiphol Foundation;
c. plan of approach: plan of approach management foundation Knowledge and Development Centre Mainport Schiphol for the financial year for which the grant is requested.
2 The plan of approach is identified as an activity plan as referred to in Article 4:61, first paragraph, part a, of the General Administrative Law .
The Minister may, upon application by financial year, grant grant to KDC for the management and administrative support of carrying out research and development programmes and projects in the context of the development of a Common European Airspace and the implementation of the Aviation Note and the Air Space Vision.
The 4:61 to 4:63 , 4:65 , 4:66 , 4:68 and 4:72 of the General Law governing law shall apply.
The total grant available for the years 2013, 2014 and 2015 amounts to a total of up to € 130,000. The total amount available for the years 2016 and 2017 is a total of up to € 100,000.
1 KDC addresses the grant application to the Minister, for the attention of the Director-General Bereikbility, Postbus 20904, 2500 EX The Hague.
2 The application shall be lodged before 31 March of the financial year for which the grant is applied for.
3 The application shall contain the amount of the grant requested and shall be accompanied by a signed declaration as recorded in Annex 1 This scheme demonstrates compliance with the conditions of de minimis aid as referred to in Article 3 (2) of the EC Treaty. Regulation (EC) 1998/2006 from the European Commission of 15 December 2006 on the application of Articles 87 and 88 of the Treaty to de minimis aid (PbEU 2006, L 379).
Eligible costs are considered to be the costs incurred by KDC for the purposes of the management and administrative support of KDC.
The Minister may refuse, in whole or in part, the grant if:
a. the plan of approach to the judgment of the Minister is not in accordance with the Articles 2 or 6 ;
b. is not satisfied Article 5 , or
c. KDC power has been formed by the base of the Subsidy scheme KDC 2010-2012 (i) grant of this scheme.
The Minister shall decide within 13 weeks of receipt of the grant application concerning the grant of the grant.
1 The decision on the grant of subsidy shall state the date on which the activities for which a grant is granted must have been carried out.
2 The decision on the granting of the grant of subsidies shall also specify the date on which the subsidy is to be fixed ex officio.
3 At the same time as the grant of the grant of the grant of subsidy, a decision to grant aid is granted at the rate of 100% of the grant.
The grant shall be granted subject to the following conditions:
a. The budget of the expenditure and revenue of the Ministry of Infrastructure and the Environment (XII) shall be made available to the public for the year in question;
b. The remaining part of the budgeting costs of KDC will be provided annually by third parties with sufficient funds.
The subsidy shall be subject to the following obligations:
a. Once it is plausible that the activities for which the grant has been granted will not be carried out in a timely or non-complete way, or whether or not entirely of liabilities associated with the grant will be fulfilled, KDC shall report this without delay in writing to the Minister, for the attention of the Director-General of Bereikbility, Postbus 20904, 2500 EX The Hague,
On presentation of documents to be given in the decision to grant the grant, KDC shall show that the activities for which the subsidy has been granted have been carried out and that the aid has been paid to the subsidy. Obligations.
1 This arrangement shall enter into force from the day following the date of issuance of the State Official Gazette in which it is placed and shall operate back to 1 January 2013.
2 This arrangement shall expire with effect from 1 January 2018.
3 This scheme shall continue to apply to the financial settlement of grants, granted on the basis of this scheme, which have been granted before the expiry date and any objection and review procedures in respect of those subsidies.
This arrangement is cited as: SubsidierScheme KDC 2013-2017.
This arrangement will be set out in the Official Journal.
