The Minister for Housing, Spatial Planning and the Environment,

Having regard to Directive No 97 /68/EC of the European Parliament and the Council of the European Union of 16 December 1997 on the approximation of the laws of the Member States relating to measures against the emission of gaseous and particulate pollutants from internal combustion Internal combustion engines, mounted in non-road mobile machinery (PbEG 1998, L 59), and Directive No 2000 /25/EC of the European Parliament and the Council of the European Union of 22 May 2000 (PbEG L 173) on measures to combat the emission of gaseous and particulate pollutants from engines intended for the propulsion of agricultural or forestry tractors, and on the other Change of Directive 74 /150/EEC of the Council and of the Council Articles 1 (e) , 5, third and fourth members , 6, third member , and -Air pollution tractors and engines for mobile machinery 7, third paragraph ;

For the purposes of this arrangement:


Article 1a

A change of Directive 97/68 -shall apply as from the date of implementation of the amending Directive concerned, except where a ministerial order published in the Official Journal of the European Union provides for a change of time. 3.


Article 2

The Road Traffic Service shall be designated as an inspection body for the purpose of this Regulation. Article 1 of the Decision . The designation does not cover inland waterway vessels and rail vehicles.


Article 3

The inspection, intended to Article 3 (a) of the Decision shall be carried out in compliance with Directive 97/68.


Article 4

The prohibition, intended to Article 3 of the Decision , does not apply:

  • a. to 30 September 2014 in engines of category R. If the engine is manufactured before 30 September 2014, the prohibition shall be: Article 3 of the Decision , not applicable until 30 September 2016;

  • b. Until 31 December 2014, on engines category P, if the engine is produced before 31 December 2011;

  • c. Until 31 December 2015, on engines category Q, if the engine is produced before 31 December 2013.

  • 1 A type-approval for a compression-ignition engine as referred to in Article 9 of Directive 97/68 shall be refused if the engine does not meet the requirements laid down in Directive 97/68, including in any case the limit values are to be used; referred to in Article 9 of that Directive in conjunction with Annex I to that Directive.

  • 2 A type-approval for an electrical ignition engine referred to in Article 9a of Directive 97/68 shall be refused if the engine does not meet the requirements of Directive 97/68, which must in any case be understood to be: limit values referred to in Article 9a of that Directive in conjunction with Annex I to that Directive.

  • 3 For the purposes of paragraph 1, an auxiliary engine of inland waterway vessels with a power of more than 560 kW shall comply with the same requirements as propulsion engines.

  • 4 By way of derogation from the first paragraph, a replacement engine other than a replacement engine for an engine train, a locomotive or inland waterway vessel, shall be type-approved if the engine meets the limit values applicable to it pursuant to Directive 97/68 on the vehicle for the purpose of a replacement engine. The moment that the engine to be replaced was placed on the market.

  • 5 By way of derogation from the first paragraph, a type-approval shall be granted for a replacement engine for an engine train body or a locomotive which does not meet the limit values if:

    • a. in any case:

      • 1 °. the swap engine complies with the phase IIIA-norm;

      • 2 °. the replacement engine shall replace an engine for an engine train set or a locomotive that does not meet the stage III A standard, or meets the stage III A standard, but does not comply with the stage III B standard; and

      • 3 °. the use of a swap engine that meets the requirements of the most recent applicable emission phase in the engine train setting or the locomotive will be associated with significant technical difficulties; or

    • b. in any case:

      • 1 °. the replacement engine shall be used to replace an engine for an engine train without a control which is not capable of moving on its own, and

      • 2 °. the medium of exchange shall meet at least a standard which is not less stringent than the standard to which engines fitted in existing engine trains of the same type satisfy, and

      • 3 °. the use of a swap engine that meets the requirements of the most recent applicable emission phase in the engine train setting or the locomotive will be associated with significant technical difficulties.

A type-approval granted for one stage of emission limit values shall end with the mandatory implementation of the limit values of the next phase.


Article 5b

If an engine type or engine family for the final date specified in the Articles 4 and 5 , in conjunction with Directive 97/68, compliance with the emission limit values may be indicated on the label that the engines meet the emission limit values for the dates specified.

The person to whom the type-approval was granted:

  • a. makes available the relevant regulations as well as requirements, specifications and documentation relating to the materials and components to be used within the company, and keeps these documents accessible to the staff;

  • (b) ensure that measures and procedures referred to in Annex I, Part 5, Regulations 8.3.2.4, 8.4.4, 8.4.7.2, 8.5.3, of Directive 97/68 and of Appendix 1, Regulation 2.4.6.1 of Directive 97/68 provide for effective control in order to ensure that engines produced are in conformity with the approved type;

  • c. performs an efficient and sound administration, providing insight into the various phases that are going through during and after manufacture;

  • (d) transmit the approval authority in accordance with Article 6, third and fourth paragraph, of Directive 97/68 a list of the full range of identification numbers for each engine type, intended for mounting in a mobile machine or mounted in a mobile machine;

  • e. designating within the organisation a person responsible for the provisions of parts (a) to (d).

  • 1 The supervision shall be carried out by a staff member designated by the approval authority and shall be established in an establishment to be established by agreement with the manufacturer.

  • 2 In the establishment, referred to in paragraph 1, a covered and well-lit space shall be provided with a heating system.

  • 3 The area referred to in paragraph 2 shall be of such dimensions and shall be so arranged that the engines subject to supervision in such space can be drawn up in such a way that they are easily accessible from all sides.

  • 4 In the context of a sample, cooperation shall be provided for: Article 7, second paragraph , in any case, of the Decision:

    • (a) arrange for a control system for the availability of engines for the sample, in consultation with the approval authority;

    • (b) immediately make available, at the request of the official of the inspection body, the type-approval concerned;

    • c. providing assistance in carrying out the verification.

  • 1 After a type-approval has been granted, it shall be reviewed at least once a year, or are still being fulfilled Directive 97/68 .

  • 2 Where the quality level proves to be insufficient or the specifications for the emission of pollutants referred to in point 4.1.2 of Annex I to this Regulation are necessary, or Directive 97/68 The procedure set out in Section 5.3.2 of Annex I of this Regulation shall be carried out. Directive 97/68 Followed.

  • 3 If the sample referred to in point 5.3.2 of Annex I establishes that an engine does not conform to the type for which the approval was granted, the official of the approval authority shall draw up a report on this subject. of which the manufacturer receives a copy.

  • 4 There is a lack of agreement with the approved type or family if abnormalities are detected on the approval form and/or in the information package and if these deviations are not permitted on the basis of Article 5, third paragraph, of Directive 97/68 .

This arrangement shall enter into force from the second day following the day of the day of the Official Journal in which it is placed.

This scheme is cited as: Scheme implementing Decision type assessment air pollution engines for mobile machinery.

This arrangement will be published in the Official Journal.
