Arrangement peripherappliances and radio equipment

The Secretary of State for Transport and Water,

Having regard to Directive No 1999 /5/EC of the European Parliament and the Council of the European Union of 9 March 1999 on radio equipment and telecommunications terminal equipment and the mutual recognition of their conformity (PbEG L 91), to Decision No 17 of the European Parliament and of the Council of 9 March 1999 on the granting of the Decision No 6/4/2000 of the Commission of the European Communities of 6 April 2000 establishing the first classification of radio equipment and telecommunications terminal equipment and the corresponding marking (PbEG L 97), on Article 3, second paragraph and the Sectoral Annex on radio equipment and telecommunications terminal equipment of the Agreement on Mutual Recognition between the European Community and the United States of America (PbEG 1999/L31), Article 2 (3) and the Sectoral Annex on radio equipment and telecommunications terminal equipment of the Agreement on Mutual Recognition between the European Community and Canada (PbEG 1998/L280), Article 2, second paragraph and the Sectoral Annex on radio equipment and telecommunications terminal equipment of the Agreement on Mutual Recognition of Conformity Assessment, Certificates and Markers between the European Community and Australia (PbEG 1998/L229) and Article 2, second paragraph and the Sectoral Annex on radio equipment and telecommunications terminal equipment of the Agreement on Mutual Recognition of Conformity Assessment between the European Community and New Zealand (PbEG 1998/L229) and on the Articles 1, part i , 5, third member , 11 , 13 , 14, third member and 21 of the Decision peripherappliances and radio equipment ;

For the purposes of this arrangement:

a. Decision:

Decision peripherappliances and radio equipment 2007 ;

b. Decision No 2000 /299/EC:

Decision No 2000 /299/EC of the Commission of the European Communities of 6 April 2000 establishing the first classification of radio equipment and telecommunications terminal equipment and the corresponding marking (PbEG L 97);

c. Decision No 2000 /637/EC:

Decision No 2000 /637/EC of the Commission of the European Communities of 22 September 2000 on the application of Article 3 (3) (e) of the EC Treaty Directive 1999 /5/EC of the European Parliament and of the Council on radio equipment falling within the regional control of radiotelephone service on inland waterways (PbEG L 269);

d. Decision No 2004 /71/EC:

Decision No 2004 /71/EC of the Commission of the European Communities of 4 September 2003 on essential requirements with regard to radio equipment intended to be used on non-SOLAS vessels to participate in the global maritime emergency and Safety system (GMDSS) (PbEU L 16);

e. Decision No 2001 /148/EC:

Decision No 2001 /148/EC of the European Communities of 21 February 2001 on the application of Article 3 (3) (e) of Directive 1999 /5/EC on avalanche beacons (PbEG L55);

f. Decision No 2005 /53/EC:

Decision No 2005 /53/EC of the Commission of the European Communities of 25 January 2005 on the application of Article 3 (3) (e) of Directive 1999 /5/EC from the European Parliament and the Council on radio equipment intended to participate in the Automatic Identification System (AIS) (PbEU L 22);

g. Decision No 2005 /631/EC:

Decision No 2005 /631/EC of the Commission of the European Communities of 29 August 2005 on essential requirements as referred to in Article 1 of the Treaty establishing the European Community. Directive 1999 /5/EC of the European Parliament and of the Council to ensure access to alert services via the Cospas-Sarsat emergency beacons (PbEU L 225);

h. Agency Telecom:

Agency Telecom of the Ministry of Economic Affairs, Agriculture and Innovation.

Article 2

  • 2 Information on radio characteristics of radio equipment specified in Article 4, second paragraph, of the Decision Subject:

    • a. The intended use or intended use of the radio equipment;

    • b. The frequency band or the frequency bands in which the radio equipment can be used;

    • c. the standard or other technical specification according to which the radio equipment has been produced;

    • d. The type of modulation;

    • e. The channel grid or the bandwidth;

    • f. the transmitting power;

    • g. The temporary transmission time in relation to a full period time or access protocol;

    • h. The duplex distance, where applicable; and

    • i. The type of antenna, as necessary for the intended use or destination of the radio equipment.

  • 3 The notification provided for in paragraph 1 shall also contain the name and address of the person intending to place the radio equipment on the market in the Netherlands, and the name and address of the radio-device manufacturer, and the type- party or serial number of the radio device concerned, making it possible for the person intending to market the radio equipment in the Netherlands or to identify the manufacturer.

  • 1 Radio appliances as referred to in Article 1 and Article 2, first paragraph, of Decision No 2000 /637/EC comply with Article 2 of this Decision.

  • 2 Radio appliances as referred to in Article 1 of Decision No 2004 /71/EC shall comply with Article 2 of this Decision.

  • 3 The provisions of Article 1 of Decision No Laceons as referred to in Directive 2001 /148/EC comply with Article 2 of this Decision.

  • 4 Radio appliances referred to in the first paragraph of Article 1 of Decision No 2005 /53/EC complying with Article 1, second paragraph , from this Decision.

  • 5 Radio appliances as referred to in Article 1 of Decision No 2005 /631/EC comply with Article 2 of this Decision.


Paragraph 4. Markings and information

The marking, intended in Article 10, first paragraph, of the Decision is the CE marking referred to in Annex VII (1) of this Regulation. Directive No 1999 /5/EC .


Article 5

  • 2 The proportions of the products listed in Annex VII (1) Directive No 1999 /5/EC The figure shown shall be taken into account, even if the image is reduced or increased.

  • 3 The height of the CE marking shall be at least five millimetres, unless this is not possible in view of the nature of the periphery or radio devices.

  • 1 The in Article 4 The CE marking referred to shall be affixed visibly, legibly and indelibly.

  • 2 The visibility, legibility or recognisability of the CE marking shall not be reduced by other markings affixed to the edge devices or radio devices.

If in the case of conformity assessment procedures, Article 7 of the Decision , one or more notified bodies are involved, the Article 4 'CE' marking referred to as 'CE' shall be accompanied by the identification number of this notified body, notified bodies or notified bodies.


Article 8

In the Article 4 The CE marking provided for, as well as in the instructions for use or in the manual and in other documents relating to the periphery or radio equipment, which accompany these devices, shall be the one responsible for placing the devices on the periphery or radio equipment on the market. shall bring the reference number of Directive No 1999 /5/EC , as published in the Official Journal of the European Communities.

  • 2 Without prejudice Article 10, third paragraph, of the Decision the marking referred to in paragraph 1 shall be affixed to radio equipment which is subject in one or more Member States to the use of such apparatus or to which is subject in one or more Member States, under Article 9 (5) of the EC Treaty, to the use of such apparatus, Directive No 1999 /5/EC rules governing the placing on the market of such appliances.

  • 3 The marking referred to in paragraph 1 shall be visible, legible and recognisable and must have the same height as the in Article 4 'CE' marking.


Paragraph 5. Designation of notified bodies and conformity assessment bodies

An application for designation as intended Article 11 of the Decision shall be submitted to the Telecom Agency and shall contain:

  • (a) information showing that the body covered by the application has shown, as evidenced by accreditation, that it complies with the EN standard EN 45011 or in the EN standard EN 45012 standard; and

  • b. The categories of edge apparatuses or radio equipment and the conformity assessment procedures or the components thereof, to which the application relates.

  • 2 The application referred to in the first paragraph shall contain:

    • a. Data showing that the body covered by the application complies with the application or Article 12a of the Decision Certain;

    • b. The categories of equipment to which the application relates.

The Minister for Economic Affairs, Agriculture and Innovation only designates an entity as a conformity assessment body as intended by Article 12a, first paragraph, of the Decision for a country listed in column 2, where the provisions in column 4 of the agreement have been fulfilled in column 3.

  • (a) the Agreement on Mutual Recognition between the European Community and the United States of America (PbEC 1999, L 31);

  • (b) the Agreement on Mutual Recognition between the European Community and Canada (PbEG 1998, L 280);

  • c. the Agreement on Mutual Recognition of Conformity Assessment, Certificates and Markers between the European Community and Australia (PbEG 1998, L 229);

  • d. the Agreement on Mutual Recognition of Conformity Assessment between the European Community and New Zealand (PbEG 1998, L 229);
