Arrangement of the State Secretary for Infrastructure and the Environment and the State Secretary for Finance dated 30 March 2016, no. IENM/BSK-2015/209791, laying down rules on projects located in the Netherlands which are in the interests of environmental protection (green projects scheme 2016)

The Secretary of State for Infrastructure and the Environment and the State Secretary for Finance,

Acting after consultation with the Minister for Economic Affairs;

Having regard to Article 5.14, third paragraph, part a, and eighth paragraph, of the Income Tax Act 2001 ;

Chapter 1. General

Article 1

For the purposes of this arrangement:

  • Audit opinion: A certificate issued by a chartered accountant or an accountant-administration consortium;

  • General Block Exemption Regulation: Regulation (EU) No 651/2014 of the Commission of 17 June 2014 declaring certain categories of aid compatible with the internal market in application of Articles 107 and 108 (PbEU 2014, L 187);

    existing project:

  • biomass: biomass as referred to in Article 2 of the General Groepsexemption Regulation;

  • Building Decision: the building decision in force at the date of application of the green declaration;

  • Gross floor area: Area measured at floor level along the outside perimeter of ascending separation structures that enclose the area or group of spaces;

  • gross grant equivalent: gross grant equivalent as referred to in Article 2 of the General Group Exemption Regulation;

  • Sustainably produced wood: wood complying with the Dutch Procurement Criteria for Timber in respect of sustainable forest management and the trade chain, according to the accompanying assessment method, as established by the Minister of Housing for Housing, by letter of 24 July 2008, Spatial Planning and Environmental Management (Kamerpieces II 2007/08, 30 196, nr. 35);

  • Sustainable dairy farming: the holding of dairy cows in a sustainable manner with an integral sustainable livestock farming system in accordance with a sustainable milk stock market that is sustainable based on the Articles 3.31 or 3.42a of the Income Tax Act 2001 was designated by the Minister for Infrastructure and the Environment as a means of business in the interests of the Dutch environment;

  • Owner-occupant: natural person who owns or obtains a property and has, or will have, a main residence in it, or the owner, the fruit user or the entitled to an apartment as intended in Article 106 of Book 5 of the Civil Code , in so far as these rights relate to a dwelling;

  • energy index: measure of the energy performance of existing homes based on a calculation method that complies with the National Assessment Directive ' Methods for calculating the energy use of buildings and the energetic and financial impacts of buildings. energy saving measures ' (BRL 9501), as established by the Central College of Experts of the Quality Assurance Installation Foundation on 6 December 2006;

  • Energy performance coefficient: Coefficient indicating the energy performance of a new building or building building on the basis of the standardised calculation as laid down in the Construction Decision;

  • Energy performance certificate: A certificate that is tailored to a building:

    • a. Not older than 10 years;

    • b. in which the result of the calculation of the amount of energy deemed necessary for the different needs associated with a standardised use of that building, including heating, hot water supply, cooling, ventilation and lighting;

    • c. showing reference values capable of comparing and assessing the energy performance of the building; and

    • d. This is accompanied by recommendations for cost-effective improvement of energy performance;

  • Green Chest Label: Horticultural crops used for the production of horticultural crops with a lower environmental load and which, in technical terms, corresponds to a horticultural greenhouse that is based on the Articles 3.31 or 3.42a of the Income Tax Act 2001 was designated by the Minister for Infrastructure and the Environment as a means of business in the interests of the Dutch environment;

  • Green statement: in writing, by the Minister for Infrastructure and the Environment, as referred to in Article 5.14, third paragraph, part a, of the Income Tax Act 2001 , stating that a project is in the interest of protecting the environment, including nature and forest;

  • SME: small, medium-sized and micro-enterprises within the meaning of Annex 1 to the Agriculture Groepsexemption Regulation;

  • Agriculture Block Exemption Regulation: Regulation (EU) No Commission Regulation (EEC) No 702/2014 of 25 June 2014 providing for certain categories of aid in the agricultural and forestry sector and in rural areas under Articles 107 and 108 of the Treaty on the Functioning of the European Union market is declared compatible (PbEU 2014, L 193);

  • agriculture sector: agriculture sector as referred to in Article 2 of the Agriculture Groepsexemption Regulation;

  • Sustainable Livestock Farming and Aquaculture: livestock farming used for the holding of dairy animals and which is in technical compliance with an animal husbandry established on the basis of the Articles 3.31 or 3.42a of the Income Tax Act 2001 was designated by the Minister for Infrastructure and the Environment as a means of business in the interests of the Dutch environment;

  • project: technically, functionally and at the time coherent set of assets and activities located in the Netherlands;

  • project manager: the person for whose account and risk a project is being developed and maintained;

  • Project ability: ability required for the financing of fixed assets and for the work of placing the fixed assets, as necessary for and serving only as a service to the establishment of a project;

  • recycling: recycling as referred to in Article 2 of the General Group Exemption Regulation;

  • Utility building: building for which an energy performance requirement is laid down in the Construction Decision, except dwellings;

  • improvement project: (i) a project aimed at a substantial change in an existing project, creating a change in the design, nature or scope of the project, making the project considerably more valuable to the environment, including nature and forest;

  • house: building, intended for habitation, which is permanently available as a main residence to one or more natural persons and per unit of residence, is provided at least with its own access, toilet, bath or shower facility, as well as of a permanent residence. power connection, intended for a cooking device to prepare a meal.

Chapter 2. Project Categories

Article 2

  • 1 The Minister of Infrastructure and the Environment, in agreement with the Minister of Finance and after consultation with the Minister for Economic Affairs, may issue an evergreen statement for projects in the category of nature, which shall be aimed at:

    • (a) development and conservation of forest, excluding fruit trees, gusts of wind, plantings, trees intended to serve as Christmas trees and farming well or for the production of energy and commercial use of forests; forest where a project consists of a contiguous area with an area of at least five hectares;

    • b. the development of additional urban green, provided that this does not concern past due maintenance and:

      • 1 °. this leads to an increase in areas of urban green and urban green at least partly an op-ed character;

      • 2 °. the project will see the construction of urban green within a builtup bowl or within a 500 metre zone for the builtup of the builtup; and

      • 3 °. in so far as the project involves planting, new planing is only achieved on existing roads;

    • c. the development and conservation of nature and landscape values in areas designated as Natura 2000 site, Protected Natural Monument, or Wetland on the basis of the Nature protection law 1998 , or in National Parks or areas which are part of the Nature Network of the Netherlands including robust ecological link zones;

    • d. the development and conservation of natural and natural territorial and cultural historical values within the boundary of the National Landscapes, with the exception of stables;

    • (e) the development and maintenance of new natural and landscape values of open estates as intended for: Article 7, first paragraph, of the Settlement Order Natural-law Law 1928 , with the exception of stables;

    • f. the development and conservation of new natural and scenic values that have been eligible for subsidy under the national format of the provincial subsidy scheme Quality Impulse Nature and Landscape SKNL Nature Management;

    • g. the development and conservation of natural and scenic values that have come into account for subsidy under Chapter 3 of the Provincial Eligibility of Eligibility for Nature and Landscape Management 2016;

    • h. the development and conservation of nature and scenic values that meet the requirements that are included in Annex 1 ;

    • (i) promoting and maintaining biodiversity, provided that this does not concern economic activity, by the construction of:

      • 1 °. fishing guidance systems for the removal of artificial barriers;

      • 2. terrestrial animal guidance systems for the removal of artificial barriers; or

      • 3 °. bird-warning systems or alarm systems to prevent the impact of birds with non-natural obstacles; or

    • j. nature and environmental education focused on indigenous nature, provided that the whole of work does not concern an economic activity, education is a primary and demonstrable objective of the project and is not part of the mainstream educational curriculum.

  • 2 The projects referred to in the first paragraph, introductory wording and parts c, d and e shall not be carried out by an undertaking operating in the agricultural sector.

The Minister of Infrastructure and the Environment may, in agreement with the Minister of Finance and after consultation with the Minister for Economic Affairs, issue a green declaration for projects in the category of organic farming, which shall be aimed at:


Article 4

The Minister of Infrastructure and the Environment may, in agreement with the Minister of Finance and after consultation with the Minister for Economic Affairs, issue a green declaration for projects in the category of agriculture, which shall be aimed at:

  • a. The commercial cultivation of crops in a Green Label Kas, with level A according to the relevant certification scheme Green Label Kas at the time of submission of the application, provided that:

    • 1 °. there are no facilities available for cooling the heat generated; and

    • 2 °. at least 10% of the total energy use of the greenhouse consists of self-produced or self-won renewable energy as intended for the purposes of the Articles 7, introductory wording and parts c, d, e and g , and 8, chapeau and part a , or renewable energy as referred to in Article 7, introductory wording and part f; or

    • 3 ° less energy is used at least 50% than in a reference greenhouse; or

  • (b) a permanent dairy farm, which is provided with a certificate A in accordance with the certification scheme of the Sustainable Livestock and Aquaculture measure, part of MDV dairy herds at the time of the submission of the application.

The Minister of Infrastructure and the Environment, in agreement with the Minister of Finance and after consultation with the Minister for Economic Affairs, may issue a green declaration for projects in the renewable raw materials category, which are aimed at the industrial processing of biomass to products not suitable for human or animal consumption, with the exception of the processing of those substances to energy or energy carriers, provided that this process is not a typical process for the Netherlands combination of raw material to product, and this leads to a reduction in degradation of the environment.

The Minister of Infrastructure and the Environment, in agreement with the Minister of Finance and after consultation with the Minister for Economic Affairs, may issue an evergreen statement for projects in the recovery and recycling category, which are aimed at reducing environmental pressures and reducing the use of primary raw materials for products by applying:

  • a. Not yet common processes for recovery of materials, products or raw materials, other than energy or energy carriers, from streams for which a low-value processing is prevalent, limiting the use of primary raw materials ;

  • b. Processes to the processing of tormable dredging specie into raw materials, which can limit the use of primary raw materials; or

  • c. A pyrolysis plant, intended for the thermal decomposition of waste under oxygen-poor or oxygen-free conditions, not suitable for recycling, but incinerated in accordance with the minimum standard in the Landful Waste Management Plan 2009-2021 or landfills, where the free-coming solid, liquid or gaseous reaction products are used as feedstock for new products or materials, other than fuels.

The Minister of Infrastructure and the Environment may, in agreement with the Minister of Finance and after consultation with the Minister for Economic Affairs, issue a green declaration for projects in the renewable energy category, which shall be aimed at:

  • a. The realisation of a biogas value installation intended for the production of gas of natural gas quality, with the addition of gases derived from biomass or from manure as energy input, except that Installations used for the production of food-based biofuel or for which a supply or by-blending obligation applies;

  • (b) the realisation of a biofuel production plant, intended for the production of liquid or gaseous renewable fuels from wood-like or cellulose-like compounds by:

    • 1 °. High pressure decomposition;

    • 2 °. High temperature decomposition;

    • 3 °. use of the Fischer-Tropschprocess or a similar process; or

    • 4 ° cellulose fermentation, with the exception of mesophilic and thermophilic fermentation;

  • c. The generation of electric energy by means of a wind turbine certified in accordance with European safety standards IEC 61400-1, Ed. 3 or IEC 61400-22;

  • d. The generation of electric energy using photovoltaic cells, possibly in combination with the storage of the electricity generated;

  • e. the use of solar thermal equipment by means of solar collectors, where appropriate in combination with any of the following heat pumps:

    • 1 °. a heat pump with water/water systems, a coefficient or performance of at least 4,0, in a condition of W10/W45 in accordance with standard EN 14511; or

    • 2 °. a heat pump with for brine/water systems a coefficient or performance of at least 3.2, with a condition of B0/W45 in accordance with standard EN 14511;

  • f. The extraction of geothermal heat; or

  • g. inducing electric energy from water or hydro power, provided that the hydroelectric power plant complies with Directive 2000 /60/EC of the European Parliament and of the Council of 23 October 2000 establishing a framework for Community action in the field of water policy (PbEG 2000, L 327) and in so far as the project is provided for in order to protect the Community's biodiversity, and with the exception of the generation of energy using steam turbines.

The Minister of Infrastructure and the Environment may, in agreement with the Minister of Finance and after consultation with the Minister for Economic Affairs, issue a green declaration for projects in the energy saving category, which shall be aimed at:

  • a. Upgrading low-value heat to high-quality heat using heat pumps and a closed bottom heat exchanger or aquifer in such a way that the high quality of heat is useful, by means of:

    • 1 °. a heat pump with water/water systems, a coefficient or performance of at least 4,0, in a condition of W10/W45 in accordance with standard EN 14511; or

    • 2 °. a heat pump with for brine/water systems a coefficient or performance of at least 3.2, with a condition of B0/W45 in accordance with standard EN 14511;

  • b. Cooling by means of a heat pump in which the heat is used simultaneously for at least 50% of the heat pump within the holding;

  • c. The creation of low-energy outdoor lighting intended to illuminate public roads, public squares, public buildings, bridges, public parks, parking areas, paved areas of business or sports accommodations, and consisting of masts, LED lamps and fixtures specifically suitable for those lamps, and where applicable, electronic ballast and associated lighting management systems;

  • d. The creation of low-energy outdoor lighting intended to illuminate public roads, public squares, public buildings, bridges, public parks, parking areas, paved business areas or sports accommodations where demonstrably a energy saving is achieved by an increase in the system efficiency in lumen/Watt of at least 30% in relation to the average energy use at similar standard installations, and consisting of masts, lamps and luminaires, and if of application electronic ballast and associated lighting management systems;

  • e. the installation of heat distribution networks and the construction of heat buffers for heat utilization, of at least 80% from one or more of the following sources:

    • 1 °. residual heat from installations in the industry not generating electricity and waste incineration plants for municipal waste;

    • 2 °. residual heat from power generation plants with an electric return of at least 30% and a minimum power of 20 MW;

    • 3 °. an earth heat source; or

  • f. the creation of cold distribution networks where the cold comes from a renewable source, residual heat from installations in the industry where no electricity is generated or waste incineration plants for municipal waste.

The Minister of Infrastructure and the Environment, in agreement with the Minister of Finance and after consultation with the Minister for Economic Affairs, may issue a green statement for projects in the sustainable building category, where, if wood is the use is made exclusively of sustainably produced wood, and shall be aimed at:

  • a. The realisation of newly built dwellings, of which:

    • 1 °. The energy performance coefficient does not exceed 65% of the requirement under the Construction Decision; or

    • 2 °. the coefficient of energy performance is equal to 0;

  • b. The repuration of buildings without housing function of new dwellings, of which:

    • 1 °. the coefficient of energy performance shall be at least equal to the level required for new construction dwellings immediately prior to the entry into force of the current energy performance requirement; and

    • 2 °. the soundproofing between dwellings is at least equal to the level required for new dwellings;

  • c. Redestination of buildings without a residential function and with the status of Rijks-or Municipal emonth of the building of new dwellings, of which:

    • 1 °. the coefficient of energy performance of the realised dwellings is at least equal to the level prescribed for new buildings before the previous energy performance requirement entered into force; and

    • 2 °. the soundproofing between dwellings is at least equal to the level required for new dwellings;

  • d. the renovation of existing dwellings by the owner-occupant, using energy-saving measures, which lead to an improvement of the energy index of the dwelling:

    • 1 °. at least 0,6, where the energy index of the dwellings after renovation is not more than 1,4;

    • 2 °. at least 1,3, where the energy index of the dwellings after renovation is not more than 1,4;

    • 3 °. at least 1,5, where the energy index of the dwellings after renovation is not less than 1,2; or

    • 4 °. to zero;

  • e. the renovation of existing dwellings by others than the owner-occupant, using energy-saving measures leading to an improvement in the energy index of the dwelling as referred to in the chapeau and below 1 °, 2 °, 3 °, or 4 °.

  • f. the realisation of sustainable utility buildings, for which an energy performance requirement has been included in the Construction Decision and which meet the requirements specified in Annex 2 in this arrangement and where:

    • 1 °. the energy performance coefficient of the building is at least 30% lower than that required under the Construction Decision; or

    • 2 °. The energy performance coefficient of the building shall be 0;

  • g. renovating existing utility buildings, for which an energy performance requirement has been included in the Building Decision and which comply with Annex 3 of this scheme and where the energy index has improved after renovation:

    • 1 °. at least 0,6;

    • 2 °. at least 1,2;

    • 3 °. at least 1,8; or

    • 4 °. to zero;

  • h. the realisation of durable buildings with an industrial function, for which the building decree lays down requirements for the thermal insulation, with the exception of buildings with a light industrial function, and of which:

    • 1 °. The sky drainage system is disconnected from the sewage system; and

    • 2 °. The energy performance coefficient is less than or equal to 0; or

  • (i) the renovation of existing buildings with an industrial function, for which the building decision lays down requirements for thermal insulation, with the exception of buildings with a light industrial function, and whose energy index is less than or equal to 0.

The Minister of Infrastructure and the Environment, in agreement with the Minister of Finance and after consultation with the Minister for Economic Affairs, may issue an evergreen statement for projects in the category of sustainable mobility, which shall be aimed at:

  • a. the realization of:

    • 1 °. detached or increased cycle paths hardened with asphalt and which connect living or living areas with workspaces or residential cores with more than 50,000 inhabitants, or which are the reachability by bicycle of transferia, P&R areas, OV-stations or r/o staging points, offices or business areas, schools, medical and healthcare establishments or tourist attractions, or which are part of the national cycle route network; or

    • 2 °. covered bicycle tours or the purchase of bicycles for non-commercial use; or

  • b. The acquisition of:

    • 1 °. Non-rail-based durable vehicles for transport, capable of passenger transport of more than eight passengers, on the public road or in outdoor business areas, with an electric or fuel cell drive system, or running on the open air Hydrogen, (bio-) LNG or (bio-) CNG, or a combination of the above techniques; or

    • 2 ° sustainable inland waterway vessels equipped with a diesel-electric, battery-electric or fuel-cell system for propulsion, or exclusively on hydrogen, (bio-) LNG or (bio-) CNG or a combination of the above techniques or fuels, or are equipped with dual-fuel engines for the combination of (bio-) LNG or (bio-) CNG and diesel, whether or not combined with a hull-optimisation process, except that when used with (bio-) LNG or (bio-) CNG as a fuel it shall be shown that the methane slip is not higher than 3 grams per kWh.

The Minister of Infrastructure and the Environment, in agreement with the Minister of Finance and after consultation with the Minister for Economic Affairs, may issue a green statement for projects in the sustainable water sector category:

  • a. The aim of which is to:

    • 1 °. segregated and infiltrated, with the exception of depth infiltration, of rainwater, cases on paved surfaces within the built-up bowl;

    • 2 °. separated and stored for use as process water, except for use in agriculture and horticulture, of rainwater, cases on paved surfaces;

    • 3 °. segregated for discharge to surface water from rainwater, cases on paved surfaces within the builtup bowl;

  • b. Those aimed at the underground storage of fresh water or rainwater, situated at a minimum of five and a maximum of 75 metres under the mower field and suitable for use in agriculture and horticulture; or

  • c. Those focused on water treatment in an innovative and sustainable manner and intended for:

    • 1 °. preparation of drinking water;

    • 2 °. preparation of drinking water based on waste water flows; or

    • 3 °. the treatment of waste water for the realization of a closed water system within the establishment, with the exception of the prevailing techniques for feeding water in horticulture to replace non-closed systems;

    • 4. treatment of waste water intended for the recovery and reuse of the substances present in the waste water, replacing an existing system which operates without such recovery and reuse;

    • 5 °. treatment of waste water, or preparation of drinking water, where a reduction of at least 50% is achieved in the use of energy in relation to the existing or replaced installation, if permanent or improved Purification results; or

    • 6 °. specific treatment of endocrine and medicinal effluents or treatment of waste water contaminated with priority substances, with a reduction of at least 50% of the effluent value of these substances the effluent value of these substances from the existing plant or plant to be replaced.

The Minister of Infrastructure and the Environment, in agreement with the Minister of Finance and after consultation with the Minister for Economic Affairs, may issue an evergreen statement for projects in the climate adaptation category which are aimed at:

  • a. the construction and establishment or repair of retention areas to prevent water nuisance at regional or local level provided that the retention areas are known to be a natural component;

  • b. Building-related waterberging in urban area, located on, in or under the building, with the exception of parking garages;

  • c. the construction of vegetation roofs and vertical gardens in urban areas; or

  • d. crop production of crops on silver soil, where the crop is selected and adapted to the salt content of the soil and the groundwater.

Chapter 3. The application for a green declaration

Article 13

  • 1 A green statement is requested by and issued to a credit institution or investment institution as referred to in Article 5.14, 2nd paragraph, of the Income Tax Act 2001 , which intends to contribute significantly to the provision of credit for a project within the meaning of that article or the direct or indirect investment of assets in the project.

  • 2 An application is submitted by means of the application form at the National Service for Education Netherlands.

  • 3 A request may be made to an applicant to make a statement of auditors showing the accuracy or plausibility of the information given in the application.

  • 1 The Minister for Infrastructure and the Environment decides, in agreement with the Minister of Finance and after consultation with the Minister for Economic Affairs, on a full application within eight weeks of its submission.

  • 2 A complete application is an application where no additional information is required for its assessment.

  • 3 A copy of the decision shall be sent to the project manager.

  • 2 A green declaration shall not be issued for projects as referred to in the Articles 6, part c , 9, parts h and i , and 12 For which a green declaration is requested within six months of the entry into force of this scheme, which has already been started for the entry into force of this procedure.

  • 3 A green declaration shall not be issued if the applicant, having received a request to do so, does not provide the information which may be relevant for the assessment of the project within the time limit set.

  • 2 The green statement shall enter into force for a maximum of nine months after its issue.

  • The green statement shall state the nature of the project, the project capacity, the date on which the green declaration enters into force and the period covered by the green declaration.

  • 5 Detailed rules may be laid down in the green declaration.

Chapter 4. The project's ability

  • 1 In respect of a project as referred to in Article 2, introductory wording and first paragraph, part g , for an evergreen declaration, an amount of up to € 5,000 per hectare shall be eligible for projects as referred to in Chapter 3 of the Provincial Eligibility for Nature and Land Management 2016.

  • 4 The project ability with regard to a project as intended Article 4, introductory wording and part a , is capped at € 100 per square meter of cash surface, excluding the cost of simultaneously generating heat/power, a heat pump, heat and cold storage, and geothermal energy.

  • 9 In respect of a project as intended Article 9, introductory wording and parts b and c , for an evergreen statement, an amount of € 1,000 per square metre gross floor area of the part of a property with residential use, up to a maximum of € 100,000 per realized property.

  • 10 On a project as intended Article 9, introductory wording and parts d and e , the following table shall apply:

    • a. An amount of up to € 600 per square metre gross floor area for projects that meet the requirements as referred to in Article 9 (f) (1) ; or

    • b. An amount of up to € 1,000 per square metre gross floor area for projects that meet the requirements, specified in Article 9 (f) (2) .

  • 12 On the subject of a project relating to an Utility building as intended Article 9, part g The following shall be considered to be a green declaration:

    • a. Maximum of € 300 per square metre gross floor area if the project meets the energy index intended in Article 9, part g, below 1 ° , or up to a maximum of € 600 per square metre of gross floor area if the project is also designated as a Rijks or Municipal emoner;

    • b. maximum of € 450 per square metre gross floor area if the project meets the energy index intended in Article 9, part g, below 2 ° , or up to a maximum of € 600 per square metre of gross floor area if the project is also designated as a Rijks or Municipal emoner;

    • c. maximum of € 600 per square metre gross floor area if the project meets the energy index intended in Article 9, part g, below 3 ° , or up to a maximum of € 750 per square metre of gross floor area if the project is also designated as a Rijks or Municipal emoner; or

    • d. Up to € 750 per square metre gross floor area if the project meets the energy index intended in Article 9, part g, below 4 ° , or a maximum of € 1,000 per square metre gross floor area if the project is also designated as a Rijks or Municipal emoner.

  • 13 In respect of a project relating to a building with an industrial function as intended in Article 9, part h , an amount of up to € 400 per square metre of gross floor area shall be eligible for a green declaration.

  • 14 In respect of a project relating to a building with an industrial function as intended in Article 9 (i) , for a green declaration, an amount of up to € 300 per square metre of gross floor area shall be eligible.

  • 17 If the project's capacity exceeds the amount of 35,000,000, the Minister of Infrastructure and the Environment can limit the project's project capacity to € 35,000,000.

If a project for which an evergreen statement is provided is awarded a financial advantage of more than € 500,000, or a project as defined in the Articles 2, first paragraph, introductory wording and parts f, g or h , 3 , as far as the production of agricultural products is concerned, 4 , 11, chapeau and part b , or 12, introductory wording and part d , for which a green declaration is granted a financial advantage of more than 60,000 € 60,000, the Minister for Infrastructure and the Environment is the information given in Annex III of the General Group Exemption Regulation and the Agriculture Block exemption Regulation, from the beneficiary public.

  • 1 The Minister of Infrastructure and the Environment, in agreement with the Minister of Finance and after consultation with the Minister for Economic Affairs, may withdraw the Green Declaration if:

    • (a) the information provided in this connection appears to be incorrect or incomplete, that another decision would have been taken on the application if the assessment of that information had been the subject of correct or complete information;

    • (b) it appears that the project's implementation deviates significantly from the project description under which the green statement has been issued;

    • c. shows that the project manager does not separately administer the project's capital state;

    • d. the requirements laid down in the Green Declaration are not met; or

    • e. the notification, specified in Article 20 , not without delay.

  • 2 The decision to revoke may have retroactive effect.

  • 3 The decision to revoke shall be sent to the applicant. A copy of the decision shall be sent to the project manager and to the Inspector of the Tax Office.

Where the execution of a project changes, the credit or investment institution providing capital for a project for which an green declaration has been issued shall notify it without delay to the Minister of Infrastructure and the Environment.

For the purpose of establishing an evergreen statement in respect of the credit or investment institution, Article 5.14, 2nd paragraph, of the Income Tax Act 2001 , and the project manager Chapter VIII, Section 2, of the General Law on State Taxation apply mutatis mutandis to the provision of the relevant data and the rights and obligations attached thereto. The obligations imposed on the inspector are also subject to the persons designated by the Minister for Infrastructure and the Environment.

Paragraph 1. General

  • 1. This Annex is cited as: Measures of agricultural nature management with great impact.

  • 2. The agrarian is the project manager, referred to in the Scheme green projects 2016.


Section 2. Requirements

To qualify for a green statement, a project as intended in the Article 2, introductory wording and first paragraph, part h , subject to the following requirements:

  • 3. An agrarian performs at least the management activities described in the Management Package Overview 1 On grounds which the agrarian has used for:

    • a grassland with a rest period of 12 weeks or less;

    • b inundation of at least four weeks;

    • c herbal-rich grassland;

    • d botanically valuable grassland;

    • e winter food akker;

    • f bird-aacker;

    • g arable land for hamsters;

    • h herb-rich akker;

    • i herbal cultivation edges;

    • j insect-rich grassland management;

    • k insect-rich grassland edge.

  • 4. In writing, it is stipulated that an activity as referred to in 3 is carried out for a minimum of five consecutive years.

  • 5. In the case of an activity referred to in point 3 (a) to (d), (j) or (k) or a combination of these activities, a project shall be eligible for a green declaration only if:

    • a. the parcels concerned were also eligible for subsidy under Chapter 3 of the Provincial Eligibility of the Eligibility of the Eligibility Of Natural Resources for Nature and the Land Management 2016; and

    • b1. the activities are carried out at at least 5% of the area of land in use by the agrarian and at least two different activities; or

    • b2. The activities shall be carried out on at least 20% of the surface area of land used by the agrarian.

    The application for a green declaration shall be accompanied by the grant decision ANlb2016 and the contract between the agrarian and the grant recipient ANlb2016.

  • 6. In the case of an activity as referred to in paragraph 3, introductory wording and points e to i, or a combination of these activities, and if the parcels concerned have also been eligible for subsidy under Chapter 3 of the Provincial Council, Grant Regulation Nature and Landscape Management 2016, a project will be eligible for an evergreen statement only if the activities are carried out on at least 5% of the area of land in use by the agrarian. The application for a green declaration shall be accompanied by the grant decision ANlb2016 and the contract between the agrarian and the grant recipient ANlb2016.

  • (7) In the case of an activity as referred to in paragraph 3, introductory wording and points (e) to (i), and if the parcels concerned have not been eligible for subsidy under Chapter 3 of the Provincial Fund for the Eligibility of the Agricultural And Land-owned Agricultural Products 2016 shall not be subject to the percentage of the land on which the activities are carried out. Upon application of a green declaration, the contract between the agrarian and the organisation that has a certification scheme as intended. Article 2.19 of the Implementing Regulation CAP direct payments and have been appointed by the Minister as such.

  • 8. If there is a requirement that activities be carried out on at least 5% or 20% of the land in use by the agrarian, this percentage shall apply only when the green declaration is applied for.

  • 9. The size of a project is limited to the area on which an activity as referred to in 3 is carried out.

  • 10. The project ability is limited to the carrying amount of the land on which an activity as referred to in 3 is carried out.

  • 11. The term of an evergreen statement is limited to 31 December 2021.
