Designation of animal and plant species Flora and faunal law

The Secretary of State for Agriculture, Nature Management and Fisheries,

Having regard to the Treaty on the Conservation of wild animals and plants and their natural environment in Europe (Trb. 1979, 175);

Having regard to Directive No 83 /129/EEC the Council of 28 March 1983 on the importation into the Member States of hides and skins of certain seal pups and products made thereof (PbEG L 91);

Having regard to Regulation (EEC) 3254/91 of the Council of 4 November 1991 prohibiting the use of leghold traps in the Community and the introduction into the Community of pelts and products made from certain wild animal species originating in countries where they are imported into the Community and originating in the Community Use is made of the leghold trap or other catch methods that do not comply with international humane trapping standards (PbEG L 308);

Having regard to Directive No 92 /43/EEC of the Council of the European Communities of 21 May 1992 on the conservation of natural habitats and of wild fauna and flora (PbEG L 206);

Having regard to Regulation (EC) 338/97 of the Council of the European Union of 9 December 1996 on the protection of species of wild fauna and flora by regulating trade therein (PbEC 1997, L 61);

Having regard to the Article 3, second paragraph , 4, third member , and 5, 2nd paragraph, of the Flora and Faunal Law ;

Decision:


Article 1

For the purposes of this arrangement:

a. Act:

Flora and Faunal Law ;

Basic Regulation:

Regulation (EC) 338/97 of the Council of the European Union of 9 December 1996 on the protection of species of wild fauna and flora by regulating trade therein (PbEC 1997, L 61);

c. Directive 92 /43/EEC :

Directive No 92 /43/EEC of the Council of the European Communities of 21 May 1992 on the conservation of natural habitats and of wild fauna and flora (PbEG L 206);

Regulation (EC) No 1007/2009:

Regulation (EC) 1007/2009 of the European Parliament and of the Council of the European Union of 16 September 2009 on trade in seal products (PbEU L 286).

As a protected indigenous plant species as intended Article 3, second paragraph, of the Act designated the Annex 1 plant species referred to in this arrangement, including the footnote accompanying this Annex.

As a protected indigenous animal species as intended Article 4, third paragraph, of the Act designated the Annex 2 species listed in this scheme.


Article 4

  • 1 As a protected exotic animal and plant species as intended Article 5, second paragraph, of the Act To the extent that the species referred to in Article 5, first paragraph, part a, of the Act -and with the exception of the protected species of indigenous species which are protected therein, designated:

    • (a) the species listed in Annex A to the basic Regulation, taking into account the observations on their interpretation of that Annex;

    • b. The species listed in Annex IV to Directive 92 /43/EEC , where these types do not fall within the meaning of the basic Regulation,

    • c. the species mentioned in Annex 3 This scheme.

  • 2 As a protected exotic animal and plant species as intended in Article 5, second paragraph, of the Act To the extent that the species referred to in Article 5, first paragraph, part b, of the Act and to the extent that these species are not already covered by Article 4, first paragraph , it is appropriate to apply this scheme:

    • (a) the species listed in Annexes B, C and D to the basic Regulation, subject to the observations on its interpretation and with the exception of protected indigenous species of fauna and flora which are included in the said Annex;

    • b. Castor canadensis (Canadian beaver), Canis latrans (Coyote), Martes zibellina (sabelmarter), Procycon lotor (raccoon), Ondatra zibethicus (musk rat), Martes pennanti (Canadian marter), Taxidea taxus (Canadian das) and Martes americana (American) Margin);

    • c. Sea dog as referred to in Article 2, first part, of Regulation (EC) No 1007/2009.

An amendment to Annex IV to Directive 92 /43/EEC shall apply as from the day on which the relevant amending Directive is to be implemented.


Article 6

This arrangement shall enter into force at the time of its entry into force. Article 3, second paragraph , 4, third member , and 5, 2nd paragraph, of the Flora and Faunal Law Enter into force.

This arrangement is cited as: Scheme designation of animal and plant species Flora and faunal law.

This arrangement will be set out in the Official Gazette, together with the explanatory notes and annexes.
