On the nomination of the State Secretary for Education, Culture and Science of 11 March 2010, No WJZ/196024 (3827), Management Committee and Legal Affairs, done on behalf of Our Minister of Agriculture, Nature and Food Quality;
Having regard to the Articles 29 and 60 of the Secondary Education Act ;
The Council of State heard (opinion of 29 April 2010, No W05.10.0086/I);
Having regard to the further report of the State Secretary for Education, Culture and Science of 17 August 2010, No WJZ/216485 (3827), Management Committee and Legal Affairs, released on behalf of Our Minister of Agriculture, Nature and Food Quality;
Have found good and understand:
1 The amendments Article I, Part D, Parts 4 and 5 , apply in Article 26a of the State Examending Decision to apply from the 2016-2017 school year application to candidates who have prior to the entry into force of those amendments:
a. in at least one of the subjects of Dutch language and literature, English language and literature or mathematics A, mathematics B or mathematics C have done and obtained as a final digit 4 or above; or
b. Final exam at a school as intended in the Law on secondary education have been made and rejected for that reason and who, after having entered into force the amendments mentioned in the introductory sentence, have Article 10, first and fourth paragraph, of the State Examination shall be exempted from the examination in at least one of the subjects of Dutch language and literature, English language and literature or mathematics A, mathematics B or mathematics C.
2 The amendments Article II, Part E, Parts 4 and 5 , apply in Article 50 of the Eindex Decision shall, as from the fourth year following the entry into force of those amendments, apply to candidates who, before the entry into force of those amendments:
a. in at least one of the subjects of Dutch language and literature, English language and literature or mathematics A, mathematics B or mathematics C partial and secondary education in general adult education as referred to in Article 7.3.1, first paragraph, part a, of the Education and Vocational Education Act have been done and have achieved this as a final figure 4 or more; or
b. Final exam at a school as intended in the Law on secondary education have been made and rejected for that reason and who, after having entered into force the amendments mentioned in the introductory sentence, have Article 9, first and third paragraphs, of the Eindex Decision shall be exempted from the examination in at least one of the subjects of Dutch language and literature, English language and literature or mathematics A, mathematics B or mathematics C.
3 The amendments Article II, Part E, Parts 4 and 5 , apply in Article 49 of the Eindex Decision Do not apply to candidates who, in the school year prior to the entry into force of the said amendments, comply with:
a. Article 37a of the Eindex Decision of the shall be admitted to the central examination in the penultimate year; or
b. Article 59 of the Eindex Decision have a central examination in one or more of the subjects of Dutch language and literature, English language and literature or mathematics A, mathematics B or mathematics C, and which for that is the final figure of twice 5 or more than once 4 or more and once and for of more than four or more years, and who, in the year following the entry into force of these amendments, take the central examination in the other subjects.
This Decision shall enter into force on a date to be decided by Royal Decree, which shall apply to the various articles or parts thereof and to the different types of school, learning pathways or parts of learning pathways within the secondary education system. may be varied.
Charges and orders that this Decision will be placed in the Official Journal by means of the note of explanatory note accompanying it.
