On the nomination of Our Minister of Education, Culture and Science of 14 January 2004, no. AP/PSW/2003/63316 (B49), Directorate for Labour Market and Personnel Policy, made on behalf of our Minister of Agriculture, Nature and Food Quality;
Having regard to Article 4.5, 2nd paragraph of the Law on Higher Education and Scientific Research ;
The Council of State was consulted (opinion of 12 February 2004, No. W05.04.00371/III);
Having regard to the further report by Our Minister of Education, Culture and Science, of 26 March 2004, No AP/PSW/2004/12690 (B49), Directorate for Labour Market and Personnel Policy, released on behalf of Our Minister of Agriculture, Nature and Food Quality;
Have found good and understand:
1 The arrangements for benefits arising from unemployment, sickness and incapacity arising from or pursuant to this Decision for the staff of an institution, remain on benefits which have been or should have been granted before the date of expiry of the (i) the competent authority of the institution has established rules in the area concerned and they enter into force, subject to the duration of the benefit.
2 The arrangements not referred to in paragraph 1 which are to lapse in respect of the staff of an institution by or pursuant to this Decision shall continue to apply until the competent authority of the institution has rules in the area in question. It has been adopted and these rules enter into force.
3 The claims resulting from the rules maintained in paragraphs 1 and 2 shall apply from the date of entry into force of this Decision, or as much later as a claim to the competent authority of the institution.
This Decision shall enter into force from the day following the date of issuance of the Official Journal in which it is placed.
Charges and orders that this Decision will be placed in the Official Journal by means of the note of explanatory note accompanying it.
