Having regard to Article 125, first paragraph, of the Civil Service Act and Article 12, of the Military Staff Act 1931 as well as Article C1 of the General Military Pension Act;
The Council of State heard (opinion of 16 December 1999, No W07.99.0546/II);
Having regard to the further report of the State Secretary for Defence of 21 January 2000, No P/1999008870;
Have found good and understand:
For the purposes of this Chapter, the following definitions shall apply:
a. Military:
the military official in the sense of: Article 1 of the Military Staff Act 1931 that has been appointed to the professional staff, as well as the spiritual caregiver appointed in civil public service to be engaged in the armed forces of the armed forces.
b. person concerned:
1. the military officer with a lower rank than Vice Admiral or Lieutenant General who is in real service on 1 December 1999;
2. the civil defense official who is entitled to a salary according to Annex B or Article 7a of the Act on civil servants ' defence and which is in the service of the Ministry of Defence on 1 December 1999;
3. the civil defence official referred to in Article 1, third paragraph, of the Beatmaking Decree civil servants ' defence which is in the service of the Ministry of Defence on 1 December 1999;
4. the former military officer with a lower rank than Vice Admiral or Lieutenant General who is in the enjoyment of waiting money on 1 December 1999, as intended in Article 22 of the Unemployment Order Defence Staff , or benefit from the benefit of the Military former military personnel enjoy;
5. the former civil defense official who had claim on salary according to Annex B or Article 7a of the Act on civil servants ' defence and which on 1 December 1999 is in the enjoyment of waiting money, as intended in Article 22 of the Unemployment Order Defence Staff Or a benefit based on the Decision on benefits due to functional age-dismissal civil servants defence .
c. Calculation basis:
1. remuneration for the month of December 1999 in accordance with what is understood by the Military personnel revenue decision ;
2. the salary received in December 1999 according to what is understood by the Remuneration decision civil servants defence ;
(3) the waiting money or benefit under any of the under-b payments for the month of December 1999; 4 and 5 (i) decisions have been taken after application of the reduction in or in respect of income from or in connection with employment or business.
1 To the person concerned, intended to Article XXIV, point (b) , 1 to 3 , a one-off benefit is granted in December 1999, which is 6,48% of the calculation basis for which it is based.
2 To the person concerned, intended to Article XXIV, point (b) , 4 and 5 , in December 1999, a one-off benefit is granted to the size of 6% of the calculation basis for which it is based.
3 The one-off benefit does not have a general character and is not included in the remuneration or salary for the purposes of the remuneration. The one-off benefit does not form part of the revenue and emoluments referred to in Article C1 of the General Military Pensions Act, which were claimed by the former military pension scheme or in the case of the former would have had.
This Decision shall enter into force from the day following the date of issuance of the Official Journal, in which it is placed, subject to the following:
a. Chapter 1 shall work back to 1 June 1999;
(b) Chapter 2 shall be working back to 1 August 1999;
c. Chapter 3 reworks until 1 January 2000, with the exception of Article XIII, Part B operating back to 1 October 1999;
ed. Article XIX, part A shall work back until 1 January 1999 and Part B shall work back to 1 January 2000;
e. Article XX, Part C , D and E back to and including 24 December 1997.
Charges and orders that this Decision will be placed in the Official Journal by means of the note of explanatory note accompanying it.
