Law of 3 February 2005 supplementing the General Law governing the administration of complaints concerning the handling of complaints about administrative bodies by an ombudsman, as well as related amendments to the Law of National Ombudsman, of the Law of the Council, of the European Parliament Provincial Law, the Water Law and the Common Regulations Act (Law on External Complaintlaw)

All of them, who will see or hear these, saluut! do know:

In this regard, we have taken into consideration that, having regard to the Articles 78a, third paragraph , and 107, second paragraph, of the Constitution would be desirable General administrative law to supplement the provisions relating to the treatment of complaints by an Ombudsman, and to provide for a national system of external complaints for complaints and to make changes in the context of the Community's external action plan. Law National Ombudsman , the Municipal law , the Provincial Law , the Water law and the Common Arrangements Law ;

In this way, we, the Council of State, and with the mean consultations of the States-General, have been well-regarded and understood to be right and to be understood by the following:

Within five years of the entry into force of this Law to the States General, our Ministers of Internal Affairs and Kingdom Relations and of Justice shall send to the States General a report on the effectiveness and effects of this law in practice.

  • 2 With regard to the administrative bodies of provinces, municipalities, waterboards and common rules for the entry into force of the Article II of this Act , the Law National Ombudsman does not apply, the National Ombudsman does not investigate in so far as it relates to conduct that occurred before Article II of this Act had entered into force.


Article X

The articles of this Law shall enter into force on a date to be determined by royal decree, which may be determined differently for the various articles or parts of such articles.

This law is cited as: External complaint law.

Burdens and orders that it will be placed in the Official Gazette, and that all ministries, authorities, colleges and officials who so concern will keep their hands on the precise execution.
