Law of 30 July 1953 on the granting of compensation to bodies treated as public and to be treated as bodies governed by public law in respect of damage caused by the act of 31 January 1 February 1953 having had storm surge

We JULIANA, at the grace of God, Queen of the Netherlands, Princess of Orange-Nassau, etc., etc., etc.

All of them, who will see or hear these, saluut! do know:

In this regard, we have taken into consideration the need to introduce legislation relating to the granting of compensation to bodies treated as public and to be treated with a body governed by public law in respect of such claims. as a result of the storm surge due to take place on 31 January/1 February 1953;

In this way, we, the Council of State, and with the mean consultations of the States-General, have been well-regarded and understood to be right and to be understood by the following:

For the purposes of this Act, 'Windstorm' shall mean any damage caused to goods in the Netherlands as a result of flooding resulting from the storm effect on 31 January/1 February 1953, on the understanding that the damage caused to the damage caused by flooding has been caused by the flooding of the not including damage, which reveals itself after a time set by us for an area. For the compensation of claims arising out of the storm effect of 31 January/1 February 1953, the Law Financing Reconstruction Public Bodies shall apply mutatis mutandis, subject to the following derogations:

  • a. Where the act is referred to in that law of war damage is read as a result of storm-flood damage;

  • b. Article 1 (1) a, and Articles 11 to 13, 16 and 17 of the animal law shall not apply;

  • Article 14 of the animal law reads as follows: 'Claims arising from the war and occupation' are replaced by the words ' Claims arising from the storm surge which occurred on 31 January/1 February 1953.

This law, which can be cited under the title "Law Financing Stormflood Damage Public Bodies", enters into force with effect from the day following that harer's termination.

Burdens and orders, which are in the State Sheet will be placed, and that all Ministerial Departments, Authorities, Colleges and Officials, who so concern, will keep their hands on the precise execution.
