Published: 30.12.2016 in Official Gazette No. 478-490 art No.: 1491 Government DECIDES: regulation on completion, authentication, issuance and control subsequent preferential certificates of origin of goods, approved by Government decision No. 761 of 17 September 2014 (Official Gazette of the Republic of Moldova No. 2014, 275-281, 809), with amendments and additions thereto, shall be amended and shall be completed as follows: 1), points 1 and 2 shall read as follows : "1. This Regulation shall be drawn up in accordance with law No. 112 of 2 July 2014 for ratification of the agreement establishing an association between the Republic of Moldova, on the one hand, and the European Union and the European Atomic Energy Community and their Member States, of the other part (Official Gazette of the Republic of Moldova No. 2014, 185-199, art. 442), law No. 120-XVI of 4 May 2007 amending for the ratification of the agreement and accession to the agreement of the Central European free trade agreement (CEFTA) (Official Gazette of the Republic of Moldova , 2007, no. 70-73, art. 330), law No. 201 of 27 September 2012 for ratification of the agreement on free trade area (Official Gazette of the Republic of Moldova, 2012, no. 228, art. 728), law No. 111 of 28 may 2015 for Moldova's accession to the regional Convention on rules of origin in preferential pan-euro-Mediterranean (Official Gazette of the Republic of Moldova, 2015, no. 166-176, art. 350), law No. 49 of 31 March 2016 to ratify a free trade agreement between Republic of Moldova and the Republic of Turkey (Official Gazette of the Republic of Moldova , 2016, no. 114-122, article 227) and international laws governing the procedure of the add-in, authentication, release and subsequent control of preferential certificates of origin of goods.
2. the Customs authorities shall certify the origin of goods exported to non-Member States of the European Union-the parties to the agreement establishing an association between the Republic of Moldova, on the one hand, and the European Union and the European Atomic Energy Community and their Member States, on the other hand, in the Member States to the Central European free trade agreement (CEFTA) or in the States-parties to other free trade agreements ratified by the Republic of Moldova that provide that type of proof of origin EUR.1 certificate, in accordance with the provisions of the Protocol on the definition of ' originating products ' and methods of administrative cooperation in the context of the agreements, which require proof of origin type of certificate EUR.1 movement certificates and issue of EUR.1. 2, 3 and 5) shall be repealed;
3) point 8 shall read as follows: "8. the movement certificate EUR.1 is a voucher that confirms the univocally in the country of origin of goods exported to the States referred to in paragraph 2. ';
4) point 12 shall read as follows: ' 12. The movement certificate EUR.1 shall be issued shall be authenticated and where the goods to be exported can be considered originating, in accordance with the agreement mentioned in point 2 and meet the criteria of origin laid down by the provisions of the agreement mentioned in paragraph 2. ';
section 5) C, points 19 to 24 shall be repealed;
6) in section 34, the words "in cases where the goods to which it refers are intended for export" shall be replaced with the words ' as soon as the export of the goods to which it relates is carried out or provided ";
7) point 41 shall be completed in the final text "or where the exporter is established/has its production/maintenance of the goods. ';
8) in section 42, the words "in cases where the goods to which it relates are exported" shall be replaced with the words ' as soon as the export of the goods to which it relates is carried out or provided ";
9) in points 45 and 47, the words "transport/Licensing certificate EUR.1" in case the corresponding grammar, are excluded;
10) in point 46, the words "and transport certificates EUR.1" are mutually exclusive;
11) 55 points and 56 shall read as follows: "55. Moldovan customs bodies shall carry out post-clearance preferential origin certificates, declarations of origin for the goods exported from the Republic of Moldova in the framework of preferential trade regime in accordance with the procedures laid down in the Protocol on the definition of ' originating products ' and methods of administrative cooperation to the agreement referred to in paragraph 2 of this regulation.
56. The customs bodies of the Republic of Moldova subsequently control of preferential origin certificates issued for goods exported from the Republic of Moldova in the framework of unilateral preferential arrangements in Member States which granted the generalized system of Preferences, in accordance with the procedures established by regulatory acts relating to these preferential arrangements, and of this regulation. 12 57) shall be repealed;

14) point 62 shall read as follows: "62. For the purposes of subsequent verification, the Customs authorities of the requesting State shall surrender the certificate of origin and the invoice, if it has been submitted, or possibly copies. ";
15 66) shall read as follows: "66. The control results shall be made known later in the form of documents, reports and determining that the certificate in question, the Declaration of origin or invoice declaration relates to the de facto and exported goods if the goods can be considered as originating in the Republic of Moldova, according to the criteria of origin laid down in international agreements mentioned in paragraphs 55, 56 and 59. "
