February 26, 2014 through Center Court Judgement annulled the decision of the National Commission of Financial Market nr. 46/2 of 27.09.2013 "on the results of the monitoring of the settlement concerning the theme AS" MOLDOVA-ASTROVAZ has instrumented files based on damage international insurance certificates "green card" issued by national Offices of engines from abroad "(Official Gazette of the Republic of Moldova, 2013, no. 228-232, 1511).
At the same time, in order to resolve the dispute amicably, the date of 06.05.2014 the Court of appeal conducts confirmed the transaction reconciliation, resulting in being approved the decision of the Commission to National Financial Market nr. 27/11 of 16.05.2014 "on the amendment and completion of the judgement of the National Commission of Financial Market nr. 46/2 of 27.09.2013 "(Official Gazette of the Republic of Moldova, 2014, no. 127-133, 686). Subsequently, the decision of the Court of appeal from the Chișinău 06.05.2014 annulled by decision of the Supreme Court of Justice in 15.10.2014.
Concluding from the exposed, to execute the judgement in the Court of 26.02.2014, maintained in force by decision of the Court of appeal from the decision of Chisinau and 25.11.2015 the Supreme Court of Justice in 23.03.2016, as well as in the context of judicial acts referred to in article 1(1), article 3, article 4, article 8 b), art. 21 para. (1) and article 25 paragraph 1. (2) of law No. 192-XIV of 12.11.1998 "Concerning the National Commission for financial market" (republished in the Official Gazette of the Republic of Moldova, 2007, nr. 117-126 BIS), the law on administrative courts no. 793-XIV of 10.02.2000 (republished in the Official Gazette of the Republic of Moldova, a special release from 03.10.2006), NATIONAL BOARD of FINANCIAREHOTĂRĂŞTE MARKET: 1. it cancels the Decision of the Commission to National Financial Market nr. 46/2 of 27.09.2013 "on the results of the monitoring of the settlement concerning the theme AS" MOLDOVA-ASTROVAZ has instrumented files based on damage international insurance certificates "green card" issued by national Offices of engines from abroad "and the Decision of the National Commission of Financial Market nr. 27/11 of 16.05.2014 "on the amendment and completion of the judgement of the National Commission of Financial Market nr. 46/2 of 27.09.2013 ".
2. Control over the execution of the given decision is put in charge of the General legal assistance and insurance surveillance Directorate-General.
3. this decision shall enter into force on the date of its adoption.
