Taking into account the reports submitted by BC "SOCIAL BANK" SA National Bank of Moldova in accordance with the Instruction on compilation and submission of reports by banks for prudential purposes (approved by Decision of the Council of Administration no.279 of 01.12. 2011) and Instruction on FINREP financial statements at individual level, applicable to banks (approved by the DCA of NBM no.292 of 15.12.2011) as of 09.30.2015, Information note by the Executive Committee on banking Supervision Department of the National Bank of Moldova no .09-02106 / 30 of 10.15.2015 on the situation BC "SOCIAL bANK SA", shows that BC "SOCIAL bANK" SA is insolvent, since:
- bank indebtedness is. As of 30/09/2015, current BC "Banca Sociala" (2003.7 mil. Lei) cover its obligations (16485.8 million. Lei), which shows that the bank is in insolvency laid down in Article 38 para. ( 3) b) of the Law on financial institutions no.550-XIII of 21.07.1995;
- The amount of regulatory capital of the bank is less than 1/3 of the amount minimum required capital (200.0 mil. Lei), established by article 14 of the Law on financial institutions no.550-XIII of 21.07.1995 and section .9 of Regulation on risk weighted capital adequacy (HCA approved by the NBM no.269 of 17.10.2001). As of 30.09.2015, the bank's regulatory capital is less 15446.7 mln. Lei, which shows that the bank is in insolvency laid down in Article 38. (3) c) of the Financial Institutions Act No. 550-XIII of 21.07.1995.
Despite the application of remedial and special administration procedure of the bank it was not possible to restore the financial situation of the bank.
Under the provisions of Article 27, Article 75 para. (1) e) of Law No. 548-XIII of 21.07.1995 on the National Bank of Moldova, Art. 10 (1) lit .B) and k), para. (11) and (4), art. 11 (1) and (2), Article 38 para. (1) letter h), para. (3) b) and c), art.381 para. (1) of the Law on financial institutions no.550-XIII of 21.07.1995, the Executive Board of the National Bank of Moldova

DECIDES:

1. Retires from October 16, 2015 21:00 license to perform financial activities of BC "SOCIAL BANK SA", registered in the register of licensed banks and re-registered with No. 3 of 11/09/1991 to 17/07/1996.
2. It starts from October 16, 2015 21:00 process of forced liquidation of BC "Banca Sociala"
March. Banking Supervision Department shall immediately notify in writing BC "SOCIAL BANK SA", the Deposit Guarantee Fund in the Banking System, the State Tax Inspectorate about the withdrawal of the license to perform financial activities of BC "Banca Sociala"
4. Service Communication, Press and Protocol will be published within 7 days of the adoption of this decision a notice of license revocation BC "Banca Sociala" in newspapers of general circulation and in newspapers in cities where the bank has separate divisions.
May. This decision shall enter into force upon adoption and shall be published within 7 days from the adoption in the Official Gazette of the Republic of Moldova.
