Published: 31.12.2015 in Official Gazette No. 370-376 art no: 2730 considering double quality of the audiovisual Coordinating Council, the guarantor of the public interest and the single regulatory authority in the field of broadcasting, taking into account the tasks incumbent upon them by law to issue decisions which are of regulatory rules for the exercise of powers laid down by the broadcasting code, in accordance with the obligations incumbent on the Republic of Moldova in the wake of the ratification law No. 69-XVI of 27 March 2008 the final documents of the RRC-06 and the execution of the national action plan for the implementation of the Association Agreement Moldova-European Union for the years 2014-2016, from March 20, 2015 the audiovisual Coordinating Council has adopted decision No. 6/34, which conceptually approved the draft regulation on the procedure and conditions for issuing licences for digital broadcasting and retransmission authorisations for use of digital multiplexurilor.
The draft regulation on the procedure and conditions for issuing licences for digital broadcasting and retransmission authorisations for use of digital multiplexurilor was posted on the website of the electronic media watchdog CCA: http://www.cca.md/, and interested parties were asked to submit suggestions and recommendations against this document, including the following e-mail address: office@cca.md. At the same time, the project in question was sent to State institutions for consultation.
In the following period, the project in question has been modified taking into account the opinions of the Ministry of information technology and communications, the Ministry of finance and the employers ' Association of broadcasters in the Republic of Moldova. It was amended and the name of the regulation, which is nominated for the title.
Based on the letter of the Government of Moldova nr. 3704-18 of 21.08.2015, the text of the regulation were excluded provisions related to the request "copy of recent (released during the last 3 months) extract from the State Register of enterprises and organizations with respect to Enterprise Manager, types of activity, the founders (associations) and capital".
Changes have been introduced in the basis of the opinion and the Directorate-General for human rights and the rule of law of the Directorate for information society and fight against Crimes of information society, prepared by the Secretariat on the basis of opinions by the independent expert of the Council of Europe, Mr. Jean-François Furnemont.
At the same time, account has been taken of the objections and suggestions expressed in the public debates which have taken place in the premises of APPROX. 13 November 2015, which was attended by representatives of State institutions, civil society and broadcasters.
After examining the suggestions and recommendations received, taking as a basis the provisions of the broadcasting code no. 260-XVI of supervised, of the law on transparency of the decision-making process no. 239 from 13th 2008, the status of the CCA, CCA DECIDES: 1. To approve the regulation on procedure and conditions for issuing licences and permits relay for using digital terrestrial capacity multiplexurilor (PRO-(6) d. CAMERON, Iu. CARLSON, A. CASTILLO, M. OBI-HADIRCA, B. DAMASCUS, C. MÎŢU; CONS-1. GUŢUŢUI).
2. control of the execution of this decision, it shall exercise Direction control and digitalization and direction and rules.
3. This decision shall be published in the Official Gazette of the Republic of Moldova and in the web page of the CA.
