Secretary City Council Briceni Briceni, conveyed the Central Election Commission request to resign advisers Gnatiuc Michael Duck Cristina, Bodrug Vladislav elected on the list of Democratic Party, Bandalac Efimia selected list Liberal Democratic Party of Moldova and Gorodinschii Vitalii chosen list Political Party "Party of Socialists of the Republic of Moldova", and the documents required following the award mandates councilor candidates.
When examining the submitted documents it was found that no decisions. 3/9 of 19 August 2015 and No. 4/22 of October 5, 2015 the Town Council Briceni, which were raised Gorodinschii mandates advisers Vitalii, Gnatiuc Michael Bandalac Efimia, respectively advisers and duck Bodrug Vladislav Cristina, were taken to overcome the substantive jurisdiction, contrary to the art. 5 paragraph. (3) of Law no. 768-XIV of 2 February 2000 concerning the status of local elected officials having indicated therein as the basis for lifting the resignation respective mandates advisers. To respect the current legal framework and considering that such decisions of the local council, as documents issued outside the jurisdiction, are void, the Commission recommends City Council to repeal Briceni.
Based electoral documents that it holds the Central Election Commission mandates advisor in their respective Briceni Town Council Vyacheslav Popov alternate candidates, Baraliuc Elizabeth Pavliuc Stanislav on the list of Democratic Party, Michael Bors on the list of the Liberal Democratic Party Iusip Anatolii from Moldova and from the list of political party "Party of Socialists of the Republic of Moldova". Lists of deputy candidates were confirmed by the Court's judgment of 29 June 2015 Briceni
Pursuant to art. 18 para. (2) art. 22 para. (1) u), art. 133 par. (12) of the Election Code no. 1381-XIII of 21 November 1997 art. 5 paragraph. (2) f) and para. (3) of Law no. 768-XIV of 2 February 2000 concerning the status of local elected and in accordance with section. 11:29 p.m. of Regulation on the procedure of lifting and validation of the mandates adviser, approved by CEC Decision no. 1931 of 23 April 2013, the Central Election Commission decides:
1. Amounts in connection with requests for resignation, mandates advisers Gnatiuc Michael Duck Cristina, Bodrug Vladislav elected on the list of Democratic Party, Bandalac Efimia selected list Liberal Democratic Party of Moldova and Gorodinschii Vitalii elected on the list of the political party "The Party of Socialists Moldova "in Briceni town Council.
2. It assigns mandates of councilor in the Town Council Briceni Briceni, alternate candidates Popov Vyacheslav Baraliuc Elizabeth Pavliuc Stanislav on the list of Democratic Party, Bors Michael from the list of Liberal Democratic Party of Moldova and Iusip Anatolii on the list of political party " Party of Socialists of the Republic of Moldova ".
March. Vyacheslav Popov is preavizează advisers, Baraliuc Elizabeth Pavliuc Stanislav, Anatoly Iusip Bors Michael and the obligation to comply with the deadline of 30 days to remove the incompatibility if it develops.
4. It warns Secretary city council Briceni the need to respect the deadline set pt. 23 of the Regulation on the procedure for lifting and validation of the mandates adviser, approved by CEC Decision no. 1931 of 23 April 2013.
May. Briceni Town Council is recommended to repeal decisions no. 3/9 of 19 August 2015 and No. 4/22 5 October 2015.
June. This decision shall enter into force upon adoption, will be published on the official website of the Central Election Commission and in the Official Gazette of the Republic of Moldova.
