Under Article 7 para. (1) b) Article 38. (3) and Article 62 para. (2) b) of the Water Law no. 272 of 23 December 2011 (Official Gazette of the Republic of Moldova, 2012, no. 81, art. 264), as amended and supplemented, the Government DECIDES:
1. The Regulation operating-type reservoirs / dams (attached).
2. Holders of accumulation lakes / ponds, regardless of legal form will take the actions necessary to operate under their own regulations, made under the Model Regulations approved.
March. Holders reservoirs / dams that do not have their own regulations for exploiting reservoirs / dams will ensure their issuance until 31 December 2017.
4. Until 31 December 2017 Data Sheet lake / pond (annex 1 of the Regulations type of exploitation of reservoirs / dams) will have the status of Regulation and will be presented by the holders reservoirs / dams in to obtain the environmental permit for the special use of water.
May. Failure to comply with the provisions of section 3 by holders reservoirs / dams which obtained an environmental permit for the special use of water under item 4 will serve as grounds for withdrawal of authorization.
June. Holders reservoirs / dams will provide water access to other users for placement and / or use water intake conditions established by its regulations for exploiting lake / pond. Access to special use of water from lakes / ponds will be given to water users according to priorities established under the law.
July. Control over the execution of this decision is the responsibility of the Ministry of Environment.
August. Government Decision is repealed. 807 of 16 October 2013 "On approval of the Regulations on the use of water from water reservoirs for community needs, irrigation and fish farming" (Official Gazette of the Republic of Moldova, 2013, no. 238-242, art.917).
