Village Council Secretary Tabani, Briceni, the Central Election Commission submitted the resignation of councilor elected on the list Gutu Michael political party "Party of Socialists of the Republic of Moldova" and documents necessary mandate advisor award next alternate candidate. The set of documents contains no decision. 3/1 Council of 16 October 2015 Tabani village.
When examining the documents submitted were found to decision no. 3/1 Council of 16 October 2015 Tabani village was adopted by overcoming the material competence because, contrary to Art. 5 paragraph. (3) of Law no. 768-XIV of 2 February 2000 concerning the status of local elected council raised the mandate held by Mr Gutu Michael invoking the theme resignation submitted by him. In order to comply with current legal framework and considering that the local council's decision as an act beyond the powers given is invalid, the Commission recommends to the Council to repeal the village Tabani decision no.
3/1 of 16 October 2015. Based on the electoral documents that it holds the Central Election Commission, the office of councilor Tabani village lies Gutium Ivan alternate candidate on the list of political party "Party of Socialists of the Republic of Moldova" confirmed by Briceni Court's judgment of 29 June 2015. under Article
. 18 para. (2) art. 22 para. (1) u), art. 133 par. (12) of the Election Code no. 1381-XIII of 21 November 1997 art. 5 paragraph. (2) f) and para. (3) of Law no. 768-XIV of 2 February 2000 concerning the status of local elected and in accordance with section. 11:29 p.m. of Regulation on the procedure of lifting and validation of the mandates adviser, approved by CEC Decision no. 1931 of 23 April 2013, the Central Election Commission decides:
1. Amounts in connection with the resignation, the mandate of the elected list Gutu Michael political party "Party of Socialists of the Republic of Moldova" in Tabani Village Council.
2. Is assigned counselor Village Council mandate Tabani, Briceni, Ivan Gutium alternate candidate on the list of political party "Party of Socialists of the Republic of Moldova".
March. It preavizează Gutium councilor Ivan the obligation to comply with the deadline of 30 days to remove the incompatibility if it develops.
4. Village Council recommended Tabani, Briceni, to repeal Decision no. 3/1 of 16 October 2015.
May. This decision shall enter into force upon adoption, will be published on the official website of the Central Election Commission and in the Official Gazette of the Republic of Moldova.
