    In accordance with the provisions of art. 37 para. (3) (a). the broadcasting code), President of CCA, Dinu CIOCAN was United States Agency in respect of the broadcasting of the tv station "Euro TV" at 18.01.2016, 00:04:14, artistic film "Border Lost".
Pursuant to the provisions of art. 37 para. (3) (a). the broadcasting code), the Council of TV monitoring CCA has conducted monitoring programe service channel "Euro TV" on 18 January 2016.
The results of monitoring have confirmed that the tv station "Euro TV" broadcast on 18 January 2016, 09:04:14 (duration: 01:41:22), Lost film "Border" (the lost Frontier), accompanied by the AP logo, which contains scenes with foul language, obscenities and proliferate through Romanian subtitles (hours: 9:10:52, 09:44:18, 09:11:58, 10:12:06, 10:17:09, 09:17:21, 10:17:35, 10:26:09, 09:27:03, 09:27:19, 09:27:44). The report is attached.
As a result of the dissemination of artistic film "Border Lost" (the lost Frontier), the tv station "Euro TV" committed derogations from the provisions of articles: • 6 paragraph 1 (2) of the broadcasting code, which stipulates: "it is forbidden to broadcast programmes which may seriously affect the development of the physical, mental or moral development of minors, in particular programmes containing pornography, excessive violence or obscenities".
• The provisions of art. 6 lit. b) of decision CCA No. 98 from 19.07.2012 concerning classification of audiovisual programmes in order to protect children, which stipulates: "Broadcasters will not broadcast between 6:00-23:00 showing audiovisual works: b) sex scenes, obscene language or behavior."
• The provisions of art. 9 lit. BCC Decision k) from No. 98 from 19.07.2012 concerning classification of audiovisual programmes in order to protect children, which stipulates: "general criteria for that license holders airtime shall be taken into account in classifying audiovisual productions are the following: quality and language typology."
• The provisions of art. 12 of CCA Decision nr. 98 from 19.07.2012 concerning classification of audiovisual programmes in order to protect children, which stipulates: "broadcasters have an obligation to inform the public, sound and vision before the start of the broadcast, with respect to audiovisual production genre and, where appropriate, with respect to the viewing restrictions according to the criteria laid down in article 21. 11, the length of the notice shall not be less than 10 seconds. • The provisions of art. 3 paragraphs 1 and 2. (1) (a). m) of law No. 30 of 07.03.2013 concerning the protection of children against the negative impact of information, which stipulates: "it is not considered information with negative impact on children's information accessible to the public: using foul language and indecent gestures".
• The provisions of art. 5 para. (3) (a). b) of law No. 30 of 07.03.2013 concerning the protection of children against the negative impact of information, which stipulates: "the mass media may not broadcast between 6.00 and 23.00-productions that presents: b) sex scenes, obscene language or behaviour".
Pursuant to the provisions of art. 38 para. (7) of the broadcasting code, the CCA has asked television station position "Euro TV" regarding the dissemination of artistic film "Border Lost".
By letter f/No. of 29 January 2016, "MEDIA RESOURCES" S.R.L., owner of the license for television station Euro TV, "said media watchdog CCA that on 18 January 2016, 09:00, the" Euro TV "broadcast the film" Border "and" Loft border patrol S.U.A., "a production by the action, but without aggressiveness, obscenities or erotic scenes that would entail limiting age.
Present at the meeting, the representative of the public television station Euro TV, "said that at the beginning of the year was purchased a new pack of page and the person responsible has not been careful at selecting the film aired on the post, as well as the content of the translated text on burtieră. 3. (2) of the broadcasting code, art. 6 lit. b), art. 9 lit. k), art. 12 of CCA Decision nr. 98 from 19.07.2012, art. 3 paragraphs 1 and 2. (1) (a). m), art. 5 para. (3) (a). b) of law No. 30 of 07.03.2013), in accordance with article 5. 38 para. (2) (a). b) and para. (3) (a). the broadcasting code) (PRO-(8)-UNANIMOUS hammer, Iu. CARLSON, a. CASTILLO, born DAMASCUS, o. GUŢUŢUI, c. MÎŢU, m. OBI-HADIRCA, and d. VALENTINI).
4. In accordance with the provisions of art. 38 para. (8) of the broadcasting code and decision No. APPROX. 17.10.2008 from 96 at the time of bringing to their attention (receipt by registered mail of the decision), the tv station "Euro TV" will execute this decision will remove certificates and waivers will communicate to the public the reasons for and the purpose of the penalty, in the formulation of the legislation in force.
