Căuşeni Territorial Office of the State Chancellery has informed the Central Election Commission about the incompatibility counsel Tatiana Gojan selected list of Democratic Party in Firladeni Communal Council, Causeni. Referral, registered at the Commission under no. CEC 7/14605 of 28 December 2015, the Council Decision is attached. 2/2 8 September 2015 that Ms Tatiana Gojan was elected as deputy mayor of the commune Firladeni, contrary to Art. 7 paragraph. (1) a) of Law no. 768-XIV of 2 February 2000 concerning the status of local elected officials, which states that local elected mandate is incompatible with the status of a dignitary person.
In examining the complaint, Mayor Firladeni informed the Commission by letter registered at the Commission under no. CEC 7/14694 of 12 January 2016 that on October 16, 2015 Căuşeni Territorial Office of the State Chancellery notified the mayor about the incompatibility of the above named counselor. As a result, on October 19, 2015 Ms. Gojan Tatiana submitted to council resignation from the post of deputy mayor, but the council meeting of 8 December 2015, which also examined the resignation, which is voted on, not accumulated the required number of votes and therefore was not possible to issue a decision within the meaning of Gojan Ms Tatiana from the position of deputy mayor.
Subsequently, the board's decision No.1 / 3 of 15 January 2016, Ms Tatiana Gojan was dismissed from the post of deputy mayor. Thus, the situation that was the subject of referral Căuşeni Territorial Office of the State Chancellery is consumed.
Considering that over the admissibility of referral Ms Tatiana Gojan removed the incompatibility provided for in art. 7 paragraph. (1) a) of Law no. 768-XIV of 2 February 2000, pursuant to art. 18 para. (2) of the Electoral Code no. 1381-XIII of 21 November 1997, the Central Election Commission er S're hot:
1. Take note of the decision no.1 / 3 of 15 January 2016 the municipal council Firladeni, Causeni.
2. Rejecting the notification Căuşeni Territorial Office of the State Chancellery about the fact that the situation was the subject it is consumed.
March. Resolves this decision Căuşeni Territorial Office of the State Chancellery and Firladeni Village Hall.
4. This decision shall enter into force upon adoption, will be published on the official website of the Central Election Commission and in the Official Gazette of the Republic of Moldova.
