    Secretary communal Council Rotunda, Edineț, informed the Central Election Commission about the death of Alderman Plîngău V elected on the list of the Democratic Party of Moldova, has forwarded the resignation of Alderman John Allen on the list of the same party, as well as the documents necessary for the assignment of counsel to the following alternate candidates.
The set of documents presented also include the decision No. 7/4 of 31 October 2016 communal Council Rotunda which, in examining the material, it was found to be done with the material because it exceeded the jurisdiction, contrary to the provisions of art. 5 para. (3) of law No. 768-XIV of 2 February 2000 on the status of local public servant's term of Office, the Council raised in the hearing upon request Mo Vasile resignation filed by him, but jurisdiction in this respect is the responsibility of the Central Electoral Commission. In order to comply with the legal framework in force and taking into account the decision of the local Council, as act issued outside the competence, invalidity, is struck by the Commission recommended the Council Round to communal and repeal decision No. 7/4 of 31 October 2016.
On the basis of electoral documents held by the Central Electoral Commission, the terms of the communal Council of their Round alternate candidates S. Boudreau Boudreau and Margarita on the list of the Democratic Party of Moldova, confirmed by A decision of the Court of 8 July 2015. The award of the mandate was taken in consideration the sentence of condemnation of the candidate alternate Ronak, issued by A Court on 26 April 2016 and has become irrevocable under decision of the College of criminal justice of the Supreme Court of 25 January 2017.
Pursuant to article 1. 18 paragraph 1. (2), art. 22 paragraph 1. (1) (a). u) and lit. v), art. 133 paragraph 2. (12) of the electoral code no. 1381-XIII of November 21, 1997, art. 5 para. (2) (a). f), d) and lit. (g)), para. (3) of law No. 768-XIV of 2 February 2000 on the status of local elected officers, and in accordance with section 20, section. 23 and item 29 of the Regulation in respect of the seizure and the validation of mandates of Councillor, approved by the decision of the Central Election Commission no. 1931 of 23 April 2013, the Central Electoral Commission h a t â â t e r, and others: 1. To be declared vacant a counselor assigned to the Democratic Party of Moldova in the communal Council Rotunda.
2. Amounts in connection with resignation, mandate adviser John Vaillancourt elected democratic party list in the Municipal Council Rotunda.
3. assign mandates to the Parish Council Rotunda, Edineț, alternate candidates S. Boudreau Boudreau and Margarita on the list of the Democratic Party of Moldova.
4. preavizează S. Boudreau Boudreau advisors and Margarita on the obligation to comply with the time limit of 30 days to remove the incompatibility condition in the event of its occurrence.
5. It is recommended that the communal Council Rotunda, Edineț, to rescind decision No. 7/4 of 31 October 2016.
6. this decision shall enter into force on the date of its adoption, shall be published on the official website of the Central Election Commission and the Official Gazette of the Republic of Moldova.
