BE IT enacted by the Seri Paduka Baginda Yang di-Pertuan Agong with the advice and consent of the Dewan Negara and Dewan Rakyat in Parliament assembled, and by the authority of the same, as follows: part I preliminary short title and application 1. (1) this Act may be cited as the Pension Fund Act The Statutory authorities and local 1977.
(2) this Act shall apply throughout Malaysia.
Interpretation 2. In this Act, unless the context otherwise requires — "retirement benefits" means an award or grant payable under this Act;
"salary" means the monthly salary includes any pensionable allowance payable in accordance with the salary scales of the new scheme;
Law Malaysia6 ACT 185 "final salary received" means salary drawn in accordance with the salary scales of the new scheme;
"employer" means a statutory authority or local;
"Minister" means the Minister responsible for the pension;
"employee" means a person who works with a statutory authority or local and who by reason of opsennya shall be bound by the new scheme or who are appointed under the new scheme;
"pensionable employee" means an employee who has been included in pensionable employment or who are deemed to have included such;
"services" means services in civil positions, with the Government of any State Government or by any statutory authority or local;
"statutory authority or local" means a statutory authority or local in scope new scheme;
"the pensions authority" means the Director General of the public service or any officer authorized by him in writing to act on his behalf;
"the relevant authorities" means authorities or bodies pension managers a statutory authority or local;
"new scheme" means the salaries and terms and conditions of service have been amended for employee statutory and local authorities in accordance with the recommendation of the Royal Commission appointed by the Yang di-Pertuan Agong [P.U. (B) 202/1971].

PART IV of the RETIREMENT BENEFITS for EMPLOYEES RETIREMENT pensions, etc., not as the right 11. (1) no employee has the right to get compensation for past service or get any pension, gratuity or other award under this section.
(2) If an authority have been proved to the satisfaction of the Minister that an employee is guilty of negligence, misconduct or irregularity, is valid in law for the Minister to reduce or hold a pension, gratuity or other award that the employee should have been entitled to if not for this section.
Pensions, etc., charged on the consolidated fund 11A. All pension, remuneration and other benefits granted under this Act shall be charged on the consolidated fund.
Case in which pensions, etc., can be given 12. There are no pension, gratuity or other award may be granted under this section to a worker until the worker has retired from statutory authority or local — (a) upon or after attainment of age * fifty five years;
* NOTE — forced retirement age as provided for in the Pension Act authorities and local 1980 [Act 239] was amended to "fifty six" – see Pensions Act the statutory and local Authority (Amendment) Act 2001 [Act A1125].
Law Malaysia8 ACT 185 (b) on or after attaining the age of fifty years in the case of an employee is male, or forty five years in the case of an employee female and an employee of Fire Service Officer rank low and down, with prior consent from the relevant authorities;
(c) based on the doctor's evidence acceptable to the relevant authorities that it is unable to perform the duties of his Office, due to the weakness of mind or body that may be permanent;
(d) when his post deleted; (e) upon the termination of her employment in the public interest; (f) when forced to retire for the purposes of that organization's statutory authority or local where he works is easily repaired and thus the resulting efficiency or more keekonomian; or (g) on the ground of national interests with the needs of the Government.
Retirement in the public interest 13. If the service of an employee is terminated on the ground that, in view of the conditions of service, the employee uses services and all other circumstances of the matter, such termination is necessary in the public interest, and pension, gratuity or other award may not be in another conferred upon him under this Act, the Minister may, if he thinks fit, give any pension, gratuity or other award as he may deem fit and proper But however cannot exceed the amount that the employee should have been entitled to if he retired from the service in the circumstances described in paragraph 12 (c).
Entering into pensionable employment 14. (1) an employee is entitled to be included in pensionable employment when it comes served not less than ten years provided that the following periods shall not be taken into account except with the approval of pension authorities — (a) any past service external links due to stop work on a voluntary basis; and * NOTE — forced retirement age as provided for in the Pension Act authorities and local 1980 [Act 239] was amended to "fifty six" – see Pensions Act the statutory and local Authority (Amendment) Act 2001 [Act A1125].

Pension contributions 15. (1) when an employee is included in pensionable employment, the employer shall pay monthly contributions to the consolidated fund in accordance with the applicable rate as specified in the second schedule.
(2) the Minister may, with the agreement of the Minister of finance, by order, amend the rates in the second schedule.
Past service that can be included into account

16. (1) The retirement of an employee who is entitled to obtain the services of the previous Government, any State Government or any local authority or statutory is entered into account as a service for pension purposes provided that the following periods shall not be taken into account except with the approval of pension authorities — (a) any past service external links due to stop work on a voluntary basis; and (b) any past service with the Government, any State Government or any statutory authority or local than he has dipersarakan.

Option for employees with pension upon retirement 17. The retirement of an employee who is a contributors to the employees Provident Fund or any other fund employees established by any statutory authority or local can choose when to retire either — (a) to receive a full pension and gratuity or reward he or she deserves to regain it provided that payments made to the Fund of an amount equal to the contribution and the amount of interest paid by the Government or any State Government or the employer to the employees ' Provident Fund or other Provident Fund established by statutory authorities or local on his behalf in any past service period that can be included into account as referred to in section 16; or (b) release the pension and gratuity or reward, if not released, should have been accrued in respect of services in time he became contributors to the employees Provident Fund or other Provident Fund established by statutory authorities or local credit and taking his savings fund instead.
The maximum pension of 18. (1) a pension granted to an employee under this part shall not exceed half of final salary he received.
Retirement fund Statutory authorities and local 11 (2) for the purposes of subsection (1), the allowance is granted in respect of disaster or illness shall not be taken into account but if the employee is given such allowances, that amount together with the amount of his retirement shall not exceed two thirds of final salary he received.
Pension rate 19. The retirement of an employee who retires under section 12 after it comes served not less than ten years are eligible to receive a pension calculated according to the rate of one per six hundred of the final salary he received for every one month due a service can be included into account.
The remuneration rate of 20. The retirement of an employee who retires under section 12 is entitled to remuneration calculated according to the rate of one per twenty of the final salary he received for every one month due a service can be included into account.
Pensions, etc., cannot be assigned 21. Pension, gratuity or other award is given for under this section are not assignable or transferred or detained, separated or levied for or or with any debts or claims except for the purposes of — (a) settle the debt due to the Government, any State Government or any statutory authority or local; or (b) discharge the order of the Court so that periodically paid a sum of money for a living for his wife or former wife or child who is a minor, whether valid standard or not, employees who have been granted a pension, gratuity or other award.
Pensions, etc., halted when bankrupt 22. (1) no pension, gratuity or other award may be granted under this section to an employee may be granted such if, at the date he retired from the service, an employee is sentenced to bankrupt or declared as poor according to the judgment of a court and the worker has not got relief from judgment or declaration.
Law Malaysia12 ACT 185 (2) if any employee who has been granted a pension or other award under this part sentenced to bankrupt or declared as poor according to the judgment of a court, the award or pension shall cease immediately.
(3) in any case where a pension, gratuity or other award is not given to an employee by reason of the adjudged bankrupt or declared as needy or if pension or other award stalled because the pensioners condemned bankrupt or declared as needy, is valid in law for the Minister from time to time, a person is alive, or within the period or periods shorter either continuous or otherwise as the Minister thinks fit , cause all or any part of the money that such person is entitled to receive as a pension, gratuity or other award if he was not sentenced bankrupt or not as needy, so paid to or used for maintenance and assistance or benefits themselves, all, or any, by excluding people or others, of the following persons, that is, in pension itself and any wife , child or children, at any rate and manner as may be considered appropriate by the Minister, and the money will be paid or used properly and the money used to settle debts, employee or in pension shall be, for the purposes of this subsection, be deemed to be used for its benefits.
(4) If a person who has not given pensions or other award or pension or other award has been halted under this section, the full and proper relief from bankruptcy or not berkemampuannya, pensions or other award shall be given back to him from the date of the release.
Pensions, etc., was halted on conviction 23. (1) if any person who has been granted a pension or other award under this Part applies the death penalty or a sentence of slavery or imprisonment for any period by any court for any offence, the Minister may direct the retirement fund Statutory authorities and local 13 that pension or other award is stopped immediately and thus pension or other award that was halted with appropriate : provided that pensions or other award shall be provided with effective back in the case of a person who at any time after convicted get forgiveness.
(2) where a pension or award ceases under subsection (1) the Minister shall cause to all or any part of the money the pensioners should be entitled to a pension or other award as paid to or used for the benefit of any wife, child or children of such pensioners, or after the expiration of his sentence, also for the benefit of retired itself in the same way and subject to the qualifications and the same restrictions as in the case of bankruptcy and inability to pay.
Pensions, etc., can be stalled upon receipt of employment in certain companies or when participating in certain jobs to benefit 24. (1) if any of the retirees who have been granted a pension under this Act, be either a Director of any company that is a major part of its business is in any other manner directly related to or work with any such companies in Malaysia or taking part in any employment to obtain profits in Malaysia without the prior written consent of the Minister , is invalid in law for the Minister to direct that the award of pensions or stopped accordingly: provided that it is legally binding laws for Minister having satisfied that in pension, may be his retirement any direction has been given, is no longer a Director of the company or is no longer working with any such companies in Malaysia or no longer taking part in the job , as the case may be, provide instructions so that the pension is given again, with strong power back if it thinks fit, to such date as he may and pension shall be given back accordingly.
Law Malaysia14 ACT 185 (2) subsection (1) shall not apply for a person retiring has been dipersarakan of the services for a period of not less than five years or who has reached the age of sixty years.
Pension or reward issue where an employee dies in service or after retirement

25. (1) Where an employee dies in service and she is supposed to be a pension or reward if he retired at the date he died in circumstances described in paragraph 12 (c), the Minister may give to any person as his dependants as the Minister thinks fit, pension or gratuity issues appropriate to the case, or if the event no person as his dependants , giving personal representative in law, a reward issue; and if the pension issue is given, the issue of pension can be paid for a period of not more than twelve and a half years from the date of the next immediately following the date the employee is dead.
(2) If an employee who has retired with a pension from the die within twelve and a half years from the date of his retirement, the Minister may give his widow or widows and his minor or his minor derivative pension equal with a lesser amount of pension paid or payable to the retirement in pension because, for a term of not more than the difference between the twelve and a half years with the duration of the pension paid or payable to in pension it.
(3) If a derivative pension granted under this section to any person the liability in respect of death of an employee pensions such rendered shall take into consideration the compensation granted under any written law for the time being in force relating to workers compensation or other social security benefits.
(4) where a person who is not entitled to dependant's compensation or social security benefits is entitled to choose whether to receive derivative pension under this section or receiving pensions or allowances under any written law for the time being in force, the pension issue under this section by the Minister shall only be determined if the dependants elect to release the retirement fund Statutory authorities and local 15 pension payment or allowance under the law such a force.
(5) a widow in respect of which derivative pension granted under this section shall not be entitled to receive the pension when they remarried.
(6) a child who is a minor in respect of which derivative pension granted under this section shall not be entitled to receive the pension when the child reaches the age of eighteen years or when it married under the age of eighteen years.
Part V GENERAL Retirement forced 26. A the appropriate authority may require a worker retired from the Authority — (a) when it reaches the age of * fifty five years; (b) based on the doctor's evidence acceptable to the relevant authorities that it is unable to perform the duties of his Office, due to the weakness of mind or body that may be permanent;
(c) when his post deleted; (d) upon the termination of her employment in the public interest;
or (e) for the purposes of that organization's statutory authority or local where it worked the easy repairs and thus the resulting efficiency or more keekonomian again.

The power to make regulations 28. The Minister may make regulations for the purpose of carrying out or giving effect to any provisions of this Act. * NOTE — forced retirement age as provided for in the Pension Act authorities and local 1980 [Act 239] was amended to "fifty six" – see Pensions Act the statutory and local Authority (Amendment) Act 2001 [Act A1125].

Winding up the pension scheme Fund 30. (1) a Fund of a pension scheme or local statutory authority shall be wound up on a date determined by the Minister of finance by notification in the Gazette for every particular case, and once wound up the Fund, all assets must be transferred, and all liabilities charged to the consolidated fund.
(2) Notwithstanding the provisions of any written law to the contrary, having wound up the funds of a pension scheme is a statutory authority, or local authority pension shall exercise the powers and perform the duties of the appropriate authority for the pension scheme.
(3) no nothing in this Act can drain the amount of pension, gratuity or other benefits that an employee is eligible to regain it if not for this Act.
The winding up of the Fund established under Act 30A. Following the deletion of part III, action shall be taken to start winding up the Fund established under this Act and all assets must be transferred, and the liability of being charged, in the consolidated fund.
Action 44 31. Action by any person or authority on behalf of the Fund in providing and properly to implement any of the provisions of this Act and any expenses incurred in relation thereto in anticipation of the proclamation of this Act shall be deemed to have been authorized by this Act; and all rights and obligations acquired or apply on behalf of the Fund than anything made or any such expenses incurred shall be, when this Act comes into force, be deemed to have rights and obligations of the Fund.
