BE IT enacted by the Seri Paduka Baginda Yang di-Pertuan Agong with the advice and consent of the Dewan Negara and Dewan Rakyat in Parliament assembled, and by the authority of the same, as follows: short title 1. This Act may be cited as the Malaysian Red Cross Society Act (change of name) order 1975.
Interpretation 2. In this Act, unless the context otherwise requires — "incorporation Act" means the Act of the Malaysian Red Cross Society (incorporation) Act 1965 [Act 47 1965];
"Corporation" means the Malaysian Red Cross Society was established as a body corporate pursuant to section 3 of the Act of incorporation.
Name changes 3. (1) when this Act comes into force, the Corporation shall be known as "the Malaysian Red Crescent Society" or, in English, "the Malaysian Red Crescent Society"; and all the sound in any written law of the Corporation shall be construed accordingly.
6 laws of Malaysia ACT 162 (2) change of name provided by subsection (1) shall not prejudice any right or obligation of the Corporation or render defective any legal proceedings brought by or against it; and any legal proceedings that may be continued or commenced by or against it before this Act comes into operation can be continued or initiated under its new name.
The use of the symbol and the word 4. (1) without prejudice to the rights of others, when this Act comes into force, the right to use the Red Crescent symbol background color white, as described in the schedule, and the words "Red Crescent" or, in teased, "Red Crescent", shall be vested in the Corporation, and the Corporation shall use the symbol.
(2) when this Act comes into force, section 10 incorporation Act shall cease to have effect, and the rights vested in the Corporation by that section to use the Red Cross emblem background color white and the words "Red Cross" and "Geneva Cross" shall cease to be vested in the Corporation, and the Corporation shall cease to use the symbol and that Word.
Prohibition of use of a symbol without permission 5. (1) unlawful law to any person, other than the Corporation and its employees, officers and members, to use for the purpose of trade or business, or for any other purpose whatsoever, in the Federation without the consent of the Minister, the Red Crescent symbol background color white, as described in the schedule, and the words "Red Crescent" or, in teased, "Red Crescent".
(2) if any person contravenes subsection (1), he commits an offence and, on conviction a fine not exceeding three hundred dollars; and any goods thereon or in connection therewith a symbol or Word, as the case may be, has been used can be dilucuthakkan.
The Red Cross Association of Malaysia (change of name) 7 (3) where an offence committed by a body corporate or organization proved to have been committed with the consent or left by any Director, Manager, Secretary or other officer of the body corporate or organization that, then Director, Manager, Secretary or other officer as well as the body corporate or Corporation, shall be deemed to be guilty of that offence and may be prosecuted and sentenced accordingly.
