BE IT enacted by the Seri Paduka Baginda Yang di-Pertuan Agong with the advice and consent of the Dewan Negara and Dewan Rakyat in Parliament assembled, and by the authority of the same, as follows: part I preliminary short title and commencement 1. (1) this Act may be cited as the veterinary surgeons Act 1974 and subject to subsection (2) shall come into operation on such date as the Minister may, by notification in the Gazette, but that date shall not be earlier than the date of the notification published in the Gazette.
(2) the Minister may set a different date for part VII commencement and that date cannot be earlier than the date specified under subsection (1).
Interpretation 2. In this Act, unless the context otherwise requires — "Member" means a member of the Malaysian Veterinary Council;
Laws of Malaysia ACT 1478 "register" means the register of veterinary surgeons Malaysia required maintained under section 11;
"registered" or "registered" means registered under section 12;
"veterinary surgeons" means a person who holds any approval specified in part I and part II of the second schedule;
"Director General" means the Director General of the veterinary services, Malaysia;
"Council" means the Veterinary Council established under section 3;
"Minister" means the Minister responsible with respect to veterinary matters;
"practice of veterinary medicine" means — (a) diagnose, treat, correct, change, relieving or preventing disease, disability, injury kecenanggahan animals or physical or mental condition of the other; include specifies, provide or use a drug, medicine, biologik, tools, appliances and dope or anything or terapentik or diagnosis techniques, and the use of any manual or mechanical procedure for pemanian insemination, to test whether bunting or not, or to cure infertility or infertility, or to give advice or recommendation with respect to any referred to above, or do any act which is recognised as a task of a veterinary surgeons;
(b) make representations directly or indirectly, to the public or to private parties, the ability and willingness to do an act described in paragraph (a) above;
(c) use of a nickname, shorthand, words, or letters in a manner or in circumstances which would have led to the belief that people are using it is a veterinary surgeons;
Veterinary surgeons 9 "annual practice certificate" means a certificate of annual practice referred to in section 17;
"Registrar" means the Registrar of veterinary surgeons referred to in section 10;
"public service" has the meaning assigned to it by Article 132 of the Federal Constitution and includes services of a local authority or service of a statutory authority which exercise of the powers vested on him by federal law or the laws of the State;
"veterinary medicine" includes veterinary medicine alone-eyes, obsteriks surgery, breeding and all branches or other veterinary medical expertise;
"President" means the President of the Malaysian Veterinary Council appointed under subparagraph 1 (1) of the first schedule.
SECTION II COUNCIL of the MALAYSIAN VETERINARY establishment and membership of the Council 3. (1) a body corporate called the Malaysian Veterinary Council a perpetual hereby established and shall have a common seal.
(2) the Minister shall appoint the members of the Council consist of — (a) the Director General;
(b) the head of the Veterinary Department of Sabah veterinary surgeons or a person in the public service to be named by him;
(c) the veterinary department Sarawak or a veterinary surgeons in the civil service, called by him;
(d) two members nominated by veterinary surgeons registered in part I of the register from among their number;
(e) two members nominated by veterinary surgeons registered in part II in the register from among their number;
Laws of Malaysia ACT 14710 (f) a veterinary surgeons from amongst the staff of the Faculty of veterinary medicine and animal science, Universiti Putra Malaysia, named by the Council of the University; and (g) two veterinary surgeons to be named by the Minister.
(3) No person shall be nominated and appointed as a member under paragraph (2) (d) to (g) unless such person is a citizen and he is a registered veterinary surgeons.
(4) No person shall serve as a member in more than one position at a time.
(5) a person may be nominated and appointed as a member under paragraph (2) (d to (g) even once he has become a member under any other paragraph of subsection (2).
(6) a Member referred to in paragraph (2) (d) to (g) shall hold office for a term not exceeding three years, but they can be re-appointed if eligible under this Act.
(7) a person to be a member pursuant to the provisions of any of paragraphs (2) (d) to (g) may resign his Office at any time by sending a letter to the President.
(8) If a person who is a member in accordance with any provision of paragraph (2) (d) to (g) die before the expiration of his Office, or resigns, or otherwise ceases to be a member by reason of a provision of this Act, a person shall be nominated and appointed in its place in accordance with the provisions applicable to the person who died or resigned or ceased to be a member of it for the remaining period of that person may have been holding the posts if he is dead or does not resign or does not stop being Member: provided that when a member named under any of paragraphs (2) (d) to (g) dies or resigns within twelve months before the expiry of Office shall be filled the vacancy for the remaining period of the posts.

(9) If any veterinary surgeons group referred to in paragraph (2) (d) to (f) shall not nominate a person to be a member of the Council within three months from the date of the posts becoming vacant; The Minister shall appoint in lieu thereof a person qualified to named and such person appointed shall be deemed to be a member as if he has been named the successful completion by the veterinary surgeons group.
(10) immediately after this Act comes into force and until the members referred to in paragraph (2) (d) to (f) named and appointed, the Minister shall appoint in lieu of their respectively any person who is qualified to respectively named and appointed such and such person appointed shall be deemed to be a member as if they were named and appointed the successful completion under paragraph (d) to (f) above.
(11) a veterinary surgeons are not eligible for named and appointed as a member under the provisions of any paragraph (2) (d) to (g) — (a) if he was found guilty by the Court upon an offence in respect of fraud, dishonesty or moral turpitude or for an offence punishable with imprisonment (sentence of imprisonment only, or in addition to a penalty or in lieu of a fine) for more than two years; or (b) if he is a bankrupt that has not been released.
(12) If a member has been named and appointed under the provisions of any paragraph (2) (d) to (g) are no longer eligible to be named and was made so by reason of a provision of this Act, he shall be deemed to have vacated his seat.
Duties and powers of the Council 4. The Council shall perform such duties and functions and exercise such powers as may be provided under this Act or under any regulations made thereunder.
Laws of Malaysia ACT 14712 Protection public authorities 5. Public authorities Protection Act 1948 [Act 198] shall apply to any action, suit, prosecution or trial of the Council or of any Member, officer, agent or servants of the Council regarding any act, neglect or default made or done by him on the nature of it.
Public servants 6. All members of the Council, while performing their duties as a member of the Council, shall be deemed to be public servants within the meaning of the Penal Code [Act 574].
The First Schedule 7. (1) the provisions of the first schedule shall apply to the Council and its proceedings.
(2) the Minister may, from time to time, after consultation with the Council, amend the first schedule by order published in the Gazette.
Minister's power to issue instructions 8. The Minister may, from time to time, issue general instructions that are not inconsistent with the provisions of this Act and the Council shall give effect to such directions.
Statement 9. The Council shall give the Minister all returns and information required by the Minister from time to time in respect of the activities of the Council.
PART III REGISTRATION Of VETERINARY SURGEONS: Practice VETERINARY MEDICINE Registrar 10. For the purposes of this Act, there shall be a Registrar of veterinary surgeons who are appointed by the Minister.
Veterinary surgeons 13 Express veterinary surgeons Malaysia 11. (1) the Registrar shall cause to be maintained in the prescribed form a register called the register of veterinary surgeons, veterinary surgeons Malaysia and shall contain the particulars prescribed.
(2) the Registrar shall be responsible for the maintenance and storage of Register in accordance with the provisions of this Act and the regulations made thereunder.
(3) the register shall be kept in two parts as follows: (a) part I is concerned with the person who holds the approval set out in the third column in part I of the second schedule, provided by the institutions set out in relation to the approval of the second space in the schedule; and (b) part II is concerned with the person who holds the approval set out in the third column in part II of the second schedule, provided by the institutions set out in relation to the approval in the second column of the schedule.
(4) the register shall be deemed to be a public document within the meaning of the evidence Act 1950 [Act].
Person who is entitled to be registered as veterinary surgeons 12. (1) a person who holds any of the approval set out in the third column in part I of the second schedule, provided by the institutions set out in relation to the approval in the second Table is entitled to be registered in part I of the register on application made to the Registrar in the prescribed form and any person who holds any of the approval set out in the third column in part II of the schedule , given by the institution specified in the second column of the Schedule shall have the right to be registered in part II in the register on application made to the Registrar in the prescribed form.
(2) any person who holds any of the approval set out in the third column in part I and also a laws of Malaysia ACT 14714 approval set out in the third column in part II of the Schedule shall be entitled to be enrolled in both parts of the Register to pay such surcharge as may be prescribed.
(3) the Minister may from time to time, after consultation with the Council, add, delete or amend Part I and part II of the second schedule by order published in the Gazette.
Temporary permit to practice 13. (1) Notwithstanding anything to the contrary contained in this Act, the Council with the approval of the Minister may, on written request, issue to a person registered veterinary surgeons elsewhere outside Malaysia a temporary permit to practice as a doctor of veterinary medicine subject to such conditions and restrictions as may be specified by the Council in the permit for a period of not more than six months.
(2) the holder of a temporary permit to practice that, in the time the permit is still in force and subject to the restrictions and conditions specified in the permit, be deemed to be a registered veterinary surgeons.
(3) the Council may at any time cancel a temporary permit to practice granted under this section and the cancellation of the expired permit it.
(4) for the purposes of subsection (1), a doctor of veterinary medicine including someone who holds approval in veterinary medicine from institutions other than those specified in part I and part II of the second schedule.
Evidence of approval shall be granted prior to the entry made in the register 14. (1) no degree or approval may be recorded in the register, either on first registration or addition to a registered name, unless the Registrar is satisfied by such evidence as he may deem fit that people who claimed to have a degree or approval is entitled to it.
Veterinary surgeons 15 (2) every person registered under this Act who obtain a veterinary approval, in addition to the approval which allows he is registered, may apply to the Council to amend the amended in so far as that Register relates to the approval of the person, and on the application of the Council shall, if satisfied that the applicant is entitled to approval in respect of which the application is made and that approval would have sufficient status to it is recorded in the register , cause to Express the amended accordingly by inserting in the venue details of the approval.
(3) the Council has the power to decide what degree and an additional approval acceptable to recorded in the register.
Application for registration 15. Application to be registered under this Act shall be made in such manner and form, and shall disertaikan with any documents, photographs, details and costs as may be prescribed by the Council, and evidence of the introduction of the satisfaction of the Registrar shall be also given.
Restrictions on registration 16. (1) If a person applying for registered — (a) found guilty at any time on an offence in respect of fraud, dishonesty or moral turpitude or for an offence punishable with imprisonment (whether imprisonment only, or in addition to a penalty or in lieu of a fine) for a term of two years or more; or (b) obtained by the Council, after conducting a reasonable investigation, guilty for behaving badly from anything in terms of profession or otherwise do not have names and good behavior, the Council may direct the Registrar to register the name of that person in the register.
(2) the Registrar shall immediately notify in writing to the person concerned about the directions of the Council which does not allow person's name is recorded in the register.
Laws of Malaysia ACT 14716 (3) in an investigation conducted under paragraph (1) (b), the applicant shall be entitled to appear before the Council and be heard personally or by advocates and lawyers how.
Certificate of experience annual 17. (1) a registered veterinary surgeons who wish to practise veterinary medicine after thirty-one days in the month of December each year, shall be not less than one day in December of that year, make an application in the prescribed form and shall pay the prescribed fee to obtain a certificate for the practice of veterinary medicine in the following year.

(2) upon receipt of the application and the fee, the Council, if satisfied that the premises in which and circumstances in which the applicant's practice or proposing to practice veterinary medicine suitable to practice that, shall direct the Registrar to issue a certificate (named "certificate of practice annual") which allows the applicant to carry out the practice of veterinary medicine in the premises in the year for which the certificate was issued.
(3) subject to the provisions of this Act, the annual practice certificate shall become effective until thirty-one days in the month of December in the year for which the certificate was issued.
(4) a registered veterinary surgeons who do not apply for a certificate of practice annual in the manner and within the period specified in subsection (1), may, upon application in the form and pay an extra sebagaißmana set, given the certificate of practice of the year for the following year, if the application is made in the month of December in any year, or for the balance of the year, if the application is made on or after a day of January in each year.
(5) Notwithstanding the provisions of the previous section, if a person applying for a certificate of registered veterinary surgeons practice of the year for the first time after registration, the application shall be made in the prescribed form and may be made at any time during the year, and the applicants shall, when explaining the prescribed fee annual practice certificate, given for the remainder of the year the application is made.
Veterinary surgeons 17 (6) a certificate of adoption of annual and an application for the certificate shall state the address of the principal place of practice and all the other practices of the applicant, and any Exchange about such address shall diberitahukan by practitioners to the Registrar and a note about the changeover in the annual practice certificate obtained from the Registrar within thirty days after the Exchange.
(7) if the Council is of the opinion that a person dissatisfied with veterinary surgeons registered practice veterinary medicine in a premises or in a situation characterized by the Council as unfit to carry out the practice, the Tribunal may direct that an annual practising certificate is cancelled, and practitioners with such directions, the certificate shall cease to have effect and nothing further annual practice certificate can be issued to the practitioner either for the remainder of the year or any other year except as provided in subsection (8).
(8) where a veterinary surgeons that its annual practice of certification has been revoked under subsection (7) and he made an application in the prescribed manner and pay laid down, the Council may, after considering the matter, directing that a certificate of practice annual released to the veterinary surgeons.
(9) a registered veterinary surgeons who practice veterinary medicine and which — (a) does not have certificate of practice annual effect for himself;
(b) share with someone registered veterinary surgeons who do not have the certificate;
(c) have worked with it a registered veterinary surgeons who do not have the certificate; or (d) employed to conduct a veterinary surgeons on behalf of a person who does not have the certificate, be guilty of an offence against this Act and he shall not be entitled to claim any costs, wages, expenses or costs incurred when he or any other person as aforesaid does not have certificate of practice annually.
Laws of Malaysia ACT 14718 Broadcasting list of registered veterinary surgeons to whom issued the certificate of practice annual 18. (1) the Registrar shall as soon as may be after one day of January every year prepare and publish in the Gazette a or several list containing the name, address, approval, the date of approval and the date of registration all veterinary surgeons to whom a certificate has been issued with annual practice for that year and any that list may be amended at any time during the year.
(2) the publication of the list shall be prima facie evidence of the particulars contained therein.
(3) If a person's name is not on the list shall be prima facie evidence that the person has not issued a certificate of annual pemgamalan to him and are not allowed to practice as a registered person.
(4) a certificate signed by the Registrar on the particulars appearing in the register in respect of a person be conclusive evidence about the details.
Notification of change of address of permanent residence or practice 19. Every registered veterinary surgeons shall notify any change of permanent address of residence or practice to the Registrar within thirty days after the Exchange.
Council's power to make a specific endorsement by the name appearing in the register 20. If the Council is satisfied that a person whose name is present in the register have been dying or ceasing to practice veterinary medicine in Malaysia Council shall make an appropriate pengondorsan with his name appearing in the register.
Registration of people who become mentally halted 21. (1) if the Registrar is satisfied that a veterinary surgeons registered under this Act inserted or veterinary surgeons 19 detained in a mental hospital under the provisions of any law that veterinary surgeons shall thereby be deemed to have ceased to be registered as such, and an endorsement to be made accordingly appearing with his name in the register.
(2) a veterinary surgeons who cease to be registered under this Act in accordance with subsection (1) shall not be registered again unless he is the satisfaction of the Tribunal that the circumstances of the mentalnya allow he is registered again.
Changes in the register of 22. (1) the Registrar shall, from time to time, enter into Express — (a) any changes which may be known by him about the name or the address of a person who is registered under this Act;
(b) any change of the approval, the approval of additional and such other particulars as may be required be varied under this Act.
(2) the Registrar shall, from time to time cut from the register the name of any person who is required to be deducted under this Act.
Veterinary surgeons registered privileges and restrictions against people who are not registered 23. (1) every registered veterinary surgeons and who holds a valid annual practising certificate reserves the right, in accordance with his approval, the practice of veterinary medicine in accordance with the provisions of this Act and in the ordinary course of law reasonable charges due assistance, advice, visits, surgery or professional service and value of any appliance given or made or supplied by him to his patients.
(2) subject to section 13, no person is entitled to claim in any court any charges referred to in subsection (1) unless at the date of payment is accrued he was a registered veterinary surgeons and has a certificate of annual practice in force.
Laws of Malaysia ACT 14720 veterinary Certificate 24. No certificate or other document required by any law or otherwise in order to be signed by a qualified veterinary surgeons are properly given after this Act comes into force may be valid unless signed by a registered veterinary surgeons.
Definition of 25. The word "veterinary surgeons qualified in law" or "qualified veterinary surgeons are properly" or any word which means a person recognized in law as a qualified veterinary surgeons are to be interpreted as meaning that a registered veterinary surgeons, when used in any written law in respect of that person.
Pemameran certificate of registration and certification of the annual practice 26. (1) every registered veterinary surgeons shall cause to be displayed in a conspicuous place in the premises of any place he practice veterinary medicine, except as an officer in the civil service, the current annual practising certificate issued to him.
(2) where a registered veterinary surgeons carrying out veterinary practices as is mentioned in two or more address, he shall cause to the current annual practising certificate originally displayed as aforesaid premises in its key practice areas and a certified copy of the certificate for each premises in every other practice areas, the certified copy shall be diperolehnya for the purpose of the Registrar by making application in writing in the prescribed manner and by paying the prescribed fee for him.
(3) where a registered veterinary surgeons contravenes or fails to comply with subsection (1) or (2) he commits an offence against this Act.
Veterinary surgeons 21 (4) any person who shows, or permits be shown any premises an annual certificate of practice or a certified copy of any one such certificate containing his name at any time when its name is not available in the Express or while he does not hold a valid certificate of practice annual, as the case may be, commits an offence against this Act.

Practitioners who practice veterinary medicine shall give details of those who practice veterinary medicine at each place of practice 27. Someone registered veterinary surgeons who practice veterinary medicine shall give to the Registrar, the name, address, approval and details of the certification or registration and details of current annual practising certificate and such other information as may be prescribed with respect to those who practice veterinary medicine in the place he's running good, and if he fails to do so he commits an offence against this Act.
Inspection of premises used for veterinary 28. (1) is valid for — (a) the Director General;
(b) the officer responsible for the administration of veterinary services in a State; or (c) any authority approved by the Minister for the purposes of this section, appoint examiners for the purposes of this Act and to authorise the examiner, with the writing — (i) to enter and inspect at any time any premises used or proposed to be used or in respect of which there is reasonable cause to believe that it is being used to practice veterinary medicine; and the laws of Malaysia ACT 14722 (ii) to investigate and make the person or authority who appointed them on the State in which the reporting practices of veterinary medicine is being or proposed to be conducted.
(2) an inspector appointed shall enter or inspect any premises showing the power of writing given under subsection (1).
(3) a report made by an inspector under subsection (1) shall be made in the prescribed form and shall be the duty of the authority that the inspectors have appointed sends the report to the Council not later than fourteen days after the date of the examination.
PART IV DISCIPLINARY PROCEEDINGS disciplinary jurisdiction of the Council 29. (1) the Council shall have disciplinary jurisdiction over all veterinary surgeons registered under this Act.
(2) the Council may exercise disciplinary jurisdiction over someone veterinary surgeons registered — (a) has been convicted in Malaysia or in any other place on an offence which could be law by imprisonment (whether imprisonment only, or in addition to a penalty or in lieu of a fine);
(b) has been guilty for behaving badly from anything in terms of the profession;
(c) has secured registration by fraud or misrepresentation;
(d) shall not be entitled to be registered at the time he registered; or (e) the name was removed from a register of veterinary surgeons maintained in any place outside Malaysia.
Veterinary surgeons 23 disciplinary punishment 30. (1) in the exercise of its jurisdiction, the Tribunal may impose any of the following penalties: (a) order that the name of the registered veterinary surgeons cut from the register;
(b) order that the name of the registered veterinary surgeons suspended from the register for such period as he thinks fit;
(c) order the registered veterinary surgeons dicela; or (d) make an order as aforesaid but suspend implementation, subject to such conditions as the Council may think fit, for something or several period amounting to not more than two years, and may, in any case, make such order as the Council thinks fit with respect to the payment of the cost of the Registrar and the cost of a person of the complainant or the cost of the registered veterinary surgeons , and any costs awarded may be claimed as a civil debt.
(2) if the name of the person registered veterinary surgeons ordered by the Council so that the cut or suspension from register, that person shall within five days after such order made lodge with the Registrar a certificate of its current annual practising certificate of practice annual inclusive something new that may have been diperolehnya of the Registrar and also a certificate of its registration: provided that if the veterinary surgeons or advocates and lawyers how not to appear before the Council at the time the order is made , The Registrar shall give notice to the veterinary surgeons with writing on the order made by the Council and require in the notice so that the veterinary surgeons registration certificate and deliver to him the certificate of adoption of its current annual practising certificate including a new annual that may have been obtained from the Registrar within seven days after the notice is deposited at the registered address, or at his laws of Malaysia ACT 14724 end known if the address is different from the registered address and if in the opinion of The presentation of the Registrar in person will be more effective.
(3) if the registered veterinary surgeons does not deliver its current practice certificate including a certificate of adoption of new annual that may have been diperolehnya of the Registrar and also certificate of registration within the period provided in subsection (2) he commits an offence against this Act.
(4) the Registrar shall publish in the Gazette the name of the person that is removed from the register or suspended from practice under the provisions of this section either — (a) upon the expiry of one month laid down in section 31, if that person does not make an appeal against the decision of the Council; or (b) immediately after the decision is made by the High Court to support the decision of the Council, if veterinary surgeons that submit an appeal against the decision of the Council, as the case may be.
(5) No person whose name has been removed from the register under the provisions of this section is entitled to subsequently apply so that registered under the provisions of this Act, but the Council may, if he thinks fit in any case, upon the application of the person in question order that person's name to the register; and if the person's name has been suspended from the register for limited period only, that person shall be entitled after the expiry of such period, but not earlier than that, apply so that the certificate of registration and certificate of practice annual (if the period for which it was issued are still unexpired) returned to him.
(6) an application under subsection (5) shall be made in such manner or form and accompanied by such documents, photographs, details and costs as may be prescribed.
Veterinary surgeons 25 appeal against an order or decision of the Council 31. (1) a veterinary surgeons aggrieved by an order made therefor by the Council in the exercise of its jurisdiction or by a decision of the Council in the proceedings related to it under subsection 16 (1) or subsection 30 (1) or with the issuance of its name from the register under any of the provisions of this Act except part VII or with any refusal or failure of the Council register or re-enter your name to the register (unless the production the failure or refusal, caused by failure of such person to get a certificate of practice or due to the cancellation of the certificate) may appeal to the High Court, and the High Court can thus confirm, reverse or vary the order or decision appealed against that or can provide any direction that it considers appropriate in the matter; the costs of the appeal it is up to the discretion of the High Court.
(2) the decision of the High Court on appeal is final.
(3) the procedure relating to an appeal shall be subject to the rules of the applicable court in the High Court: provided that the High Court did not have authority to hear the appeal against an order made under section 30 unless notice of appeal is given within one month from the date the order is made or, if the proviso to subsection 30 (2) applies , within one month after the order is delivered as specified in the proviso.
(4) any person aggrieved by the refusal of the Council to issue to that person a certificate of practice or the cancellation of the annual practising certificate at its annual may appeal to the Minister and the Minister's final decision, and no such action or proceeding may be maintained in any Court of law in respect of the refusal or cancellation.
Laws of Malaysia ACT part V Registration GENERAL 14726 fraudulently 32. Every person who obtain or try to obtain by fraud that him or any other person to be registered by making or submit, or cause to be made or produced, any false declaration or statement or fraud, whether orally or in writing, commits an offence against this Act.
Error 33. (1) a person who is not registered or is not exempted from registration under this Act — (a) bersengaja and false pretending as registered under this Act or as qualified to practice veterinary medicine;
(b) bersengaja and in false wearing or using the name or title of veterinary practitioners, veterinary, veterinary surgeons, doctors of veterinary medicine, veterinary science or Bachelor Bachelor of veterinary surgeons;

(c) bersengaja and in false wear or use a name, title, addition or description that giving understand that he is registered under this Act, or that he is recognised by law as a veterinary doctor or that he holds to cure or treat diseases of animals either by veterinary medicine or in any other manner of any type or description;
(d) bersengaja and in false wear or use a name, title, addition or description, or using a tool, intended to induce a person to believe that he is qualified to practice veterinary medicine;
(e) the practice of veterinary medicine;
(f) use the word "infirmary" or "veterinary dispensaries" or "veterinary hospital" or a word 27 veterinary surgeons the equivalent to this word in any other language on signage at the point of application in practice by purporting to practice veterinary medicine as a person registered under this Act; or (g) use a symbol designed by the Council for the use of registered veterinary surgeons only, be guilty of an offence against this Act.
(2) for the purposes of subsection (1) — (a) the application or use of the word "veterinary" or "veterinary practitioner" or "veterinary surgeons" or "doctor of veterinary medicine" or "Bachelor of veterinary science" or "Bachelor of veterinary surgeons" or "infirmary" or "veterinary dispensaries" or "veterinary hospital" or a word equal to that word in any other language in relation to the practice of veterinary medicine shall be deemed to , as the application or use of a name, title, addition or description intended to induce a person to believe that he is qualified to practice veterinary medicine unless the contrary is proved;
(b) the use by a person in the practice of veterinary medicine any tools or materials used specifically by a person qualified to practice veterinary medicine shall be deemed to be, for the use of a tool that is intended to induce a person to believe that he is qualified to practice veterinary medicine unless the contrary is proved; and (c) If a person, other than a registered veterinary surgeons or a trader tools and veterinary tools, have in his possession any one or more of the tools and equipment that are commonly used in the practice of veterinary medicine, he shall be deemed to be, as bersengaja and in false pretense as registered under this Act and as qualified to practice veterinary medicine unless the contrary is proved.
Laws of Malaysia ACT 14728 Under 34. (1) a registered veterinary surgeons that allow a person not registered practice veterinary medicine premises used by or under the control of the registered veterinary surgeons in performing his professional duties commits an offence against this Act.
(2) a registered veterinary surgeons of its presence, support, his counsel, pertolongannya, or kerjasamanya has knowingly allow a person who is not registered, whether alleged as an Assistant or otherwise practice medicine veterinary commits an offence against this Act.
(3) a registered veterinary surgeons who practice veterinary medicine in the premises in which a person not registered practice veterinary medicine known to veterinary surgeons registered commits an offence against this Act.
(4) nothing-nothing in this section may in effect prohibits a person in the public service who are employed for the purpose of carrying on the practice of veterinary medicine from running code within the meaning of the practice of veterinary medicine if the procedure is carried out within the person's work and under the supervision of a veterinary doctor in the public service.
Offences registered veterinary surgeons who describes his career in false 35. Someone registered veterinary surgeons or bersengaja in fake pretending to be a bersengaja or wearing or using any name or title or description which in itself or in the event that the word is used to provide understand that the registered veterinary surgeons have or hold an approval to practice in addition to the actual approval is owned or held by him commits an offence against this Act.
Prosecution 36. (1) a prosecution for an offence against this Act may be instituted by — (a) the President or an officer appointed by him or by the Council for that purpose in writing;
Veterinary surgeons 29 (b) the officer responsible for the administration of veterinary services in a country or a person appointed by him for that purpose by writing; or (c) the authority referred to in paragraph 28 (1) (c) or an officer nominated by the authority in that behalf in writing.
(2) in respect of an offence against section 33, any police officer may arrest without warrant any person who, as a person who is not a registered veterinary surgeons, practice or believed to practice veterinary medicine in any street or public place.
37. Exemption There is nothing in this Act shall be in force prohibit — (a) coaching veterinary students in the practice of veterinary medicine under the supervision of a registered veterinary surgeons in a veterinary hospital, veterinary clinic or veterinary school, approved by the Minister for that purpose;
(b) the owner of an animal and a regular full time employee of the owner of the preserve or treat animals belonging to the owner unless ownership of the beast has been dipindahmilikkan for the purpose of avoiding this Act;
(c) any person carrying out the bona fide scientific research requires a reasonably pengujikajian involving animals from doing acts otherwise prohibited or restricted by this Act or by any regulations made thereunder;
(d) an employee of the Government owing;
(e) a person from giving advice on the Act or from doing an act that has been set by the Council as a livestock management practices received;
(f) any person who has been approved by the Council from running pemanian insemination.
Laws of Malaysia ACT 14730 Penalty General 38. (1) any person who commits an offence against this Act may, on conviction — (a) for the first offence, to a fine not exceeding one thousand dollars; and (b) for the second time or time then, to a fine not exceeding two thousand ringgit or to imprisonment for a term not exceeding six months or both of each.
(2) in respect of an offence continues that person shall be liable to a further penalty of fifty dollars for each day the offence continues in addition to their respective penalty under paragraph (1) (a) and (b).
PART VI regulations regulations 39. (1) subject to the provisions of this Act, the Council may, with the approval of the Minister, make regulations for prescribing anything that is required to be prescribed under this Act, and in General, to carry out the objects and purposes of this Act.
(2) in particular and without prejudice to the generality of the powers mentioned earlier, the regulations may specify — (a) the duties of the Registrar;
(b) the form of register, the manner in which it is maintained and also its contents;
(c) payment shall be paid on application and proceedings under this Act and on certification and other documents issued under this Act and provide for such exceptions as the Council may think fit;
(d) the form and manner in which applications for registration and for the annual practice certificate shall be made;
Veterinary surgeons 31 (e) the form of a certificate or any other document required to carry out the purposes of this Act;
(f) the methods of proof approval in veterinary medicine;
(g) property management Council and auditing its accounts;
(h) appointment of Secretary and duties shall be exercised by him;
(i) production of veterinary certificate on sick or healthy;
(j) the manner in which the Council seek legal advice, it organised a legal adviser for the Council, approval and the functions of the legal adviser and the remuneration to be paid to them;
(k) the receipt of complaints or information about a disciplinary matter can be investigated by the Council and the establishment of a Preliminary Investigation Committee to carry out a preliminary investigation in respect of the complaint or information on a matter of discipline that can be investigated by the Council and to decide whether or not an inquiry should be held by the Council;
(l) prohibition against a member of the Preliminary Investigation Committee, which also became a member of the Council from attending a meeting of the Council at the time of the Council carry out investigation in respect of a complaint or information, in which he took part in the initial investigation; and (m) procedures to be followed in respect of — (i) the submission of complaints and information to the Preliminary Investigation Committee;
(ii) the initial investigation of any complaint or information by the Preliminary Investigation Committee;
(iii) the formation of charge arising out of complaints and information;

Laws of Malaysia ACT 14732 (iv) perujukan to the Council by the Preliminary Investigation Committee of cases arising out of complaints and information;
(v) the disciplinary inquiry held by the Council.
The abolition of 40. (1) section 29 in the animals Ordinance 1953 [Ord. of 1953] is hereby repealed and any licence issued thereunder shall be after one months from the commencement of this Act be deemed to be withdrawn and the license is not valid.
(2) the person in question may apply to be registered under this Act if he holds to do so under this Act.
PART VII SUPPLEMENTARY PROVISIONS for the PURPOSE of NATIONAL Purpose and length of this section into force 41. (1) this Division declared that is made for the purpose of the country.
(2) this section shall remain in force for a period of five years from the date this section comes into operation.
Notice to the registered person so served as a veterinary officer in the public service 42. (1) every person who obtains registration under section 12 may, once he is registered or at any time subsequently, presented to him a written notice issued by or on behalf of the Director General which requires the person so held the position that suits his approval in the public service and at any date, in each case is, as stated in the notice.
(2) a person who presented to him a notice under subsection (1) shall comply with the notice and if he fails to do so he commits an offence against this Act.
Veterinary surgeons 33 (3) as soon as a charge under subsection (2) or section 43 proved in court against a person, the person's registration under section 12 shall be deemed to be void, and the Registrar shall deduct the person's name from the register.
(4) if the name of a person cut from the register under subsection (3), the person's name cannot be placed back into Sign except on the instructions given by the Minister, and the Minister may give such directions upon written request made to him by the person whose name has been deducted from the Check, and something of such instructions may be made subject to the fulfilment of such terms and conditions as the Minister thinks fit to impose , and the terms and conditions that may include terms and conditions requiring such person serves as veterinary officer to the satisfaction of the Director-General for a period of constant of not less than two years in one or several positions in any one or more of the public service as determined from time to time by the Director General in his discretion; While the person fulfilling the terms and conditions imposed under this subsection he shall be deemed to be registered to the extent necessary to meet the terms and conditions imposed under this subsection and for any other purpose as may be directed by the Minister, but not for any other purpose; and when the terms and conditions imposed under this subsection have been met he is entitled to a certificate issued by the Director General as evidence about it.
(5) the decision of the Minister on an application made to him under subsection (4) in order to be allocated a name to the register shall be final and shall not be questioned or reviewed in any court whatsoever.
(6) where a notice under subsection (1) has been served upon the person to be served on him a notice of the Director-General may, at any time revoke the notice and, if he thinks fit, cause to a further notice under subsection (1) is delivered to him.
Length of service in accordance with the notice under subsection 42 (1) 43. A person who joined in a position in the public service a notice issued in accordance with the laws of Malaysia ACT 14734 under subsection 42 (1) shall continue to serve in that position then or later in one or several other position either in the civil service or in other public service as determined from time to time by the Director General in his discretion for a continuous period of not less than two years to the satisfaction of the Chief Of Directors; and someone who does not make that period without any reasonable reason commits an offence against this Act.
Power of Minister to give a reduction, exemption or postponement of a period of service under section 43 44. (1) the Minister may, by order published in the Gazette — (a) in respect of a particular person;
(b) generally with respect to any class of persons within such period as may be specified by him;
(c) generally with respect to everyone in such period as may be specified by him, give any reduction as he thinks fit or full exemption from length of service required under section 43.
(2) the Minister shall, on application in writing is made to him by a person who have to undergo a period of service required under section 43, giving that person the postponement of the start of the service for a period he deems appropriate if he is satisfied that it is fair and reasonable for him to do so.
(3) the decision of the Minister on an application made to him under subsection (2) shall be final and shall not be questioned or reviewed in any court whatsoever.
The Minister may make rules 45. The Minister may make rules to carry out the objects and purposes of this part.
Veterinary surgeons 35 FIRST SCHEDULE [section 7] ADDITIONAL PROVISIONS on the COUNCIL President of the Council 1. (1) the Director General shall be the President of the Council.
(2) the President, if present, shall be the Chairman at the meeting of the Council: provided that if the President is not present in a Council meeting, the members present at the meeting shall elect one from amongst themselves to act as Chairperson of the meeting.
Meetings Of The Council 2. (1) the Council shall meet at the time and place set by the President, provided that a minimum of two meetings will be held in a year.
(2) where not less than five members serve a written request to the President of that Council convene a meeting then President shall convene the meeting within one month after the request is received.
(3) a quorum for a meeting of the Council was six, and the decisions of the Council shall be on the advantages of the voice of the members present and voting.
(4) in a meeting of the Chairman shall be entitled to give one vote and also, if the number of votes on a question of equal, a casting vote.
(5) when a vacancy occurs among the members, the Council shall as soon as reasonably practicable, take the necessary action to fill the vacancy.
(6) shall be paid to the members of the Council who is not a public officer of any payment due to attend meetings of the Council or of a Committee appointed by the Council and any expenses travel and living allowances reasonable attend such meeting and because travel is done in exercise of their duties under this act as may be approved from time to time by the Minister.
(7) subject to the provisions of this Act, the Council may generally make command fixed arrange its own procedure, and, in particular in relation to the holding of the meeting, the notice shall be given of the meeting, the proceedings of the meeting, keeping and care, the production and inspection of such minutes.
