BE IT enacted by the Seri Paduka Baginda Yang di-Pertuan Agong with the advice and consent of the Dewan Negara and Dewan Rakyat in Parliament assembled, and by the authority of the same, as follows: part I preliminary short title 1. This Act may be cited as the dental Act 1971.
Interpretation 2. (1) in this Act, unless the context otherwise requires — "Member" means a member of the Dental Council established under section 3;
"registered address" means an address that appears on the certificate of registration issued under section 18;
"registered" means registered under section 12 or 13, as the case may be;

"prescribed" means prescribed by regulations made under this Act;
"dentist" means a dental practitioner registered in part II of the register;
"approval" means a diploma, degree, fellowship, membership, licence, power practice, letters, testimonials, certificate, or other document or status conferred by a College, University, Corporation or other body, or by any Department, or a person acting pursuant to the authority of the Government of a State or place in or outside Malaysia;
"Director General" means the Director General of health, Malaysia;
"Council" means the Dental Council established under section 3;
"dental surgeon" means a dental practitioner registered in part I of the register;
"Registrar" means the Registrar of Dental practitioners referred to in section 10;
"practitioner" means a practitioner of dentistry;
"dental practitioner" means a person registered in the register;
"Director" means the Director of dental services, Malaysia;
"certificate of registration" means a certificate of registration issued under section 18;
"certificate of practice" means the annual practice certificate referred to in section 19;
"public service" has the meaning assigned to it in article 132 of the Constitution and, in addition, it also means a local authority service or services a statutory authority which exercise of the powers conferred upon him by federal law or the laws of the State and the expression "public service" shall be construed accordingly;
"Secretary" means the Secretary of the Council appointed under paragraph 4 of the first schedule;
051b.fm Page 8 Friday, March 31, 2006 11:49 AM 9 Dental "President" means the President of the Council appointed by the Malaysian Dental subparagraph 1 (1) of the first schedule.
(2) a person shall be deemed to practise dentistry within the meaning of this Act if, for profit or otherwise, that person — (a) treat or try to treat or professes to treat, cure, relieve or prevent any illness, lack of or pain in the teeth or jaws of humans;
(b) perform or attempt to perform any surgery on the human jaw or teeth;
(c) insert or try inserting any teeth or tools to restore, organize, or repair teeth or any order related;
(d) carry out any work related to dental radiography or human jaw or mouth cavity;
(e) give any treatment, advice or service to any person in connection with installing or inserts for the purpose of installing or melekapkan teeth or something sumbi or binders or a tool to restore the tooth or jaw or arrange human;
(f) provide any dope associated with any surgery or treatment as referred to above under this subsection; or (g) to submit himself to either directly or indirectly as a dental practice.
PART II DENTAL COUNCIL the establishment and membership of the Council, MALAYSIA 3. (1) a body corporate named Malaysian Dental Council perpetual by having a common seal was established, consisting of — 051b.fm Page 9 Friday, March 31, 2006 11:49 AM 10 laws of Malaysia ACT 51 (a) the Director General;
(b) the Director;
(c) (struck by A982 Act);
(d) (struck by A982 Act);
(e) six of the dental surgeon from among the staff of the Faculty of dentistry higher education institutions in Malaysia to be appointed by the Minister;
(ea) six of the dental surgeon who shall be appointed by the Minister;
(f) six of the dental surgeon who is resident in Peninsular Malaysia which shall be elected by the dental surgeon who is resident in Peninsular Malaysia;
(g) a dental surgeon residing in Sabah who shall be elected by the dental surgeon residing in Sabah;
(h) a dental surgeon who is resident in the State who shall be elected by the dental surgeon who is resident in the State;
(i) a dentist who is resident in Peninsular Malaysia which shall be elected by the dental resident in Peninsular Malaysia; and (j) a dentist who is resident in Sabah or Sarawak shall be selected by dentists residing in Sabah or Sarawak.
(2) No person shall be nominated and appointed as a member under paragraph (1) (e) or (ea) or chosen as a member under any of paragraphs (1) (f) to (j) unless the person i tu is a Malaysian citizen and holds a current practising certificate.

(3) No person shall be eligible to elect one member unless that person holds a current practising certificate.

(5) a person may be nominated and appointed as a member under paragraph (1) (e) or (ea) or chosen as a member under any of paragraphs 1 (f) to (j) even once he has become a member under any of paragraphs within subsection (1) that.
(6) the members referred to in paragraph (1) (e) or (ea) should be named and appointed thereunder for a period of not more than three years.
(7) members elected under paragraph (1) (f) to (j) shall hold office for a term of not more than three years.
(8) a person to be a member pursuant to the provisions of any of paragraphs (1) (e) to (h) may resign his Office at any time by sending a letter to the President.
(9) If a person who is a member in accordance with the provisions of any of paragraphs (1) (e) to (j) die before the expiration of his Office, or resigns, or ceased to be a member by reason of a provision of this Act, a person shall be named and appointed or elected, as the case may be, in its place in accordance with the provisions applicable to the person who died or resigned or ceased to be a member for the remainder of the term of Office that that person may have held the position that if he did not die or does not resign or does not stop being a member: provided that when a member elected under any of paragraphs (1) (f) to (j) dies or resigns within twelve months before the expiration of his Office, a vacancy for the remainder of the term of Office shall not be filled.
(10) the selection of the members referred to in paragraph (1) (f) to (j) shall be conducted in the prescribed manner.
(11) If any body referred to in paragraph (1) (e) to (j) are not named or not choosing, according to the 051b.fm Page 11 Friday, March 31, 2006 11:49 AM 12 laws of Malaysia ACT 51 case may be, a person becomes a member of the Council before or at a specified date, the Minister shall appoint in lieu thereof a person qualified to named or selected as such, as the case may be , and such a person appointed shall be deemed to be a member as if he has been named or elected, as the case may be, the successful completion by that body.

(13) a practitioner shall not qualify for named and appointed or elected, as the case may be, be ahl i d i under any dar ipada the provisions of paragraph (1) (e) to (j) — (a) if he was found guilty by the Court upon an offence in respect of fraud, dishonesty or moral turpitude or for an offence punishable with imprisonment (sentence of imprisonment only, or in addition to a penalty or in lieu of a fine) for more than two years;
(b) if he is a bankrupt that has not been discharged; or (c) if at any time the name was truncated from the register.
(13A) a practitioner whose name has been suspended from the register or that have been dicela under section 33 are not eligible for named and appointed or elected or appointed, as the case may be, under paragraph (1) (e) to (j) — (a) in the case of a suspension, for a period of six years after the end of the suspension; or (b) in the case of a reprimand, for a period of six years from the date of the sanctions.
(14) If a member has been named and appointed or elected, as the case may be, under 051b.fm Page 12 Friday, March 31, 2006 11:49 AM Dental 13 any of the provisions of paragraph (1) (e) to (j) are no longer eligible to be named and appointed or selected as such by reason of a provision of this Act, shall he deemed to have vacated his seat.
(15) If in the exercise of its jurisdiction under the Act, the Council — (a) appoint a Committee to carry out the initial investigation; or (b) hold a disciplinary inquiry, with respect to any practitioner who is a member of the Council, the practitioner shall be suspended.
(16) the suspension of a member of the Council under subsection (15) shall, if the initial investigation carried out j, will take effect from the date of commencement of the investigation or, if the disciplinary inquiry held, will take effect from the date of commencement of the investigation.
(17) If the initial investigation carried out and at the end of the initial investigation of the Tribunal decided that a disciplinary inquiry shall be held, the period of suspension of a member shall be continued until the conclusion of the disciplinary investigation.
(18) any Council Member who has been suspended under subsection (15) or (16) shall immediately be returned as a member of Council if at the end of the initial investigation or disciplinary investigation, as the case may be, the Council found that there are any offence has been proved in respect of the Member.
(19) any Council member to be returned in accordance with annya keah l i t subsection (18) want to lah, j if the improvements will take effect before the expiration of his Office, returned to hold office for the unexpired period of his Office.
Duties and powers of the Council 4. The Council shall perform such duties and functions and exercise such powers as may be 051b.fm Page 13 Friday, March 31, 2006 11:49 AM 14 laws of Malaysia ACT 51 provided for under this Act or under any regulations made thereunder.
Public Authorities Protection 5. Public authorities Protection Act 1948 [Act 198] shall apply to any action, suit, prosecution or proceeding of the Council or of any Member, officer, agent or servants of the Council regarding any act, neglect or default made or done by him on a nature that is.
Public servants 6. All members of the Council, while performing duties as a member of the Council, shall be deemed to be public servants within the meaning of the Penal Code [Act 574].
The Adoption Of The First Schedule 7. (1) the first schedule shall apply to the Council and its proceedings.
(2) the Minister may from time to time, after consultation with the Council, amend the first schedule by order published in the Gazette.
Minister's power to issue instructions 8. The Minister may, from time to time, issue general instructions that are not inconsistent with the provisions of this Act or with any regulation made hereunder and shall give effect to such directions.
Statement 9. The Council shall give the Minister all returns and information required by it from time to time in respect of its activities.
051b.fm Page 14 Friday, March 31, 2006 11:49 AM Dental 15 PART III REGISTRATION of DENTAL PRACTITIONERS: DENTAL PRACTICE Registrar 10. (1) for the purposes of this Act, there shall be a Registrar of dental Practitioners.
(2) the Director shall be the Registrar.
Express Dental Malaysia 11. (1) the Registrar shall cause to be maintained in the prescribed form a register of Dental Dental practitioner named Express Malaysia shall contain particulars as may be prescribed.
(2) the Registrar is responsible for the maintenance and storage of Register in accordance with the provisions of this Act and the regulations thereunder.
(3) the register shall be kept in two parts as follows: (a) part I is concerned with the person who is registered as a dental surgeon; and (b) part II is concerned with a person who is registered as dentists.
(4) the register shall be deemed to be a public document within the meaning of the evidence Act 1950 [Act].
Person who is entitled to be registered as a dental surgeon 12. (1) subject to the provisions of this Act and the regulations thereunder, a person is entitled to be registered as a dental surgeon when making an application to the Registrar in the prescribed form if he has any of the approval set out in the third column in the second Table given by 051b.fm Page 15 Friday, March 31, 2006 11:49 AM 16 laws of Malaysia ACT 51 of an institution set out in relation to the approval of the second space in the schedule.
(2) the Minister may from time to time, after consultation with the Council, add to, delete from or amend the Second Schedule by order published in the Gazette.
(3) Notwithstanding subsection (1) and subject to the other provisions of this Act and the regulations thereunder, a person who has approval in dentistry (other approval specified in the second schedule to this Act) which is characterized by the Minister as appropriate for registration after consultation with the Council (hereinafter referred to as "approved approval"), is entitled to be registered as a dental surgeon under this Act if he has acquired j experience in dental practice by working in the dental practice to the satisfaction of the Director-General for a period of not less than two years in the post in a public service or more which are determined by the Director General, from time to time, in its discretion, and was given a certificate by the Director General as evidence on that point.

(4) No person is eligible to be appointed in the employment referred to in subsection (3) if — (a) he has at any time is found guilty of an offence in respect of fraud, dishonesty or moral turpitude or for an offence punishable with imprisonment (whether imprisonment only, or in addition to a penalty or in lieu of a fine) for a term of two years or more; or (b) he has been found by the Council, after conducting a reasonable investigation, guilty for behaving badly from anything in terms of profession or otherwise do not have names and good behavior, and when the investigation is carried out, the person charged with on bad behavior that is entitled to appear before the Council and be heard personally or by counsel.
051b.fm Page 16 Friday, March 31, 2006 11:49 AM Dentistry 17 (5) the Director General, if satisfied that a person who holds an approval approved has had experience in the practice of dentistry not less in terms of scope and duration of the experience referred to in subsection (3), may exclude that person from the requirements of experience referred to in subsection (3).
(6) a person who holds an approval, which approval shall be deemed to be registered under this Act to the extent necessary — (a) to enable it to started and run employment referred to in subsection (3); and (b) during the period of such employment, for the purpose of any written law or for any other purpose, as directed by the Minister by order published in the Gazette, but not for any other purpose.
(7) any person employed under subsection (3) shall, during the period of that employment, be deemed to be public servants within the meaning of the Penal Code.
(8) the Registrar shall publish every year in the Gazette as soon as may be after one day of January each year, a list of all persons engaged in the practice of dentistry under subsection (3), together with the approval of them and the date they start the job; and publication of the list shall be prima facie evidence of the details contained therein.
(9) Notwithstanding anything to the contrary contained in this Act anyone can be registered as a dental surgeon under this Act, subject to such restrictions and conditions as may be prescribed by the Minister, provided that the person to be registered under this section have approval in dentistry and the Minister is satisfied, after consultation with the Council, that the approval is sufficient.
051b.fm Page 17 Friday, March 31, 2006 11:49 AM 18 laws of Malaysia ACT 51 Persons entitled to be registered as dentists 13. (1) subject to the provisions of this Act and the regulations thereunder, a person is entitled to be registered as a doctor of dentistry under this Act when making an application to the Registrar in the prescribed form if — (a) immediately before this Act comes into force he has been registered — (i) as a dentist in part two in the register maintained under Dentist Registration Ordinance 1948 Peninsular Malaysia [P.T.M. 7 1948]; or (ii) as a dentist pursuant to paragraph 7 (1) (c) and (d) Dentist Registration Ordinance Sarawak [Chapter 111] da lam daf ta r maintained under the Ordinance; or (b) he has faithfully worked, as the livelihoods of its sole, in the practice of dentistry in the State of Sabah for the next three years continuously immediately before this Act comes into force and he satisfaction of the Council that he is running dental practice in circumstances not harm to public health, that he has sufficient knowledge in the practice of dentistry, and that he is a fit and proper person to carry out dental practices.
(2) every person applying to be registered under subsection (1) shall make application for registration within six months after this Act comes into force, and shall give evidence pertaining to the good behavior, the satisfaction of the Council.
Certificate of practice while 14. (1) Notwithstanding anything to the contrary contained in this Act, the Council may, upon written request, issue to a person who is registered as a dental surgeon aboard a temporary certificate to practice as a dental surgeon, subject to such conditions and restrictions 051b.fm Page 18 Friday, March 31, 2006 11:49 AM Dental 19 as set out by the Council in the certificate , for a term of not more than three months.
(2) the holder of the certificate of practice in the meantime shall, while the certificate remains in force and subject to the restrictions and conditions specified in the certificate, be deemed to be a registered dental surgeon.
(3) the Council may at any time cancel a certificate of practice while given under this section and when cancelled, luputlah the certificate.
Evidence of approval shall be granted prior to the entry made in the register of 15. (1) no such degree or approval may be recorded in the register, either on registration the first time or in addition to the registered name, unless the Registrar is satisfied by any evidence he deems fit that people who claimed to have a degree or the approval is entitled to it.
(2) every person registered under this Act who obtain an approval of dentistry, in addition to the approval which has enabled him to be registered, may apply to the Council so that Express the extent amended relating to the approval of the person, and on the application of the Council shall, if satisfied that the applicant is entitled to approval in respect of which the application is made and that approval would have sufficient status to be recorded in the register , cause to Express the amended accordingly by inserting in it the approval details.
(3) the Council has the power to decide an additional approval and a high degree of what is acceptable to recorded in the register.
Application for registration 16. (1) a person who is entitled to be registered under this Act may make an application to the Registrar to be registered accordingly.
051b.fm Page 19 Friday, March 31, 2006 11:49 AM 20 laws of Malaysia ACT 51 (2) an application to be registered shall be made in any manner or form and shall be accompanied by any documents, photographs, details and costs as may be prescribed by the Council, and evidence of the introduction of the satisfaction of the Registrar shall be also given.
Restrictions on registration 17. (1) If a person applying for registered — (a) found guilty at any time on an offence in respect of fraud, dishonesty or moral turpitude or for an offence punishable with imprisonment (whether imprisonment only, or in addition to a penalty or in lieu of a fine) for a term of two years or more; or (b) obtained by the Council, after conducting a reasonable investigation guilty for behaving badly from anything in terms of profession or otherwise do not have names and good behavior; or (c) is found by medical review panel, which shall consist of two medical practitioners and one dental surgeon appointed by the Council, after conducting a reasonable investigation as not qualified to perform his professional duties by reason of his physical or mental state, the Council may direct the Registrar to enter the person's name in the register.
(2) the Registrar shall immediately notify in writing the person concerned i tu t Council regarding not allowing the person's name entered in the register.
(3) when an investigation is carried out under paragraph (1) (b), the applicant shall be entitled to appear before the Council and be heard personally or by counsel.
051b.fm Page 20 Friday, March 31, 2006 11:49 AM 21 Dental certificate of registration 18. (1) when a person has been registered, the Council shall issue to him a certificate of registration in such form as may be prescribed.
(2) in respect of a person who is registered under section 13 a photos of the registered person shall be attached to the certificate of registration.
Certificate of practice annual 19. (1) any person registered to practice as a dental practitioner after December thirty-one in a given year shall, not later than one day of December in the year, make an application in the prescribed form and shall pay the prescribed fee for a certificate to practice as a dental practitioner in the following year.
(2) upon receipt of the application and the fee, the Council, if satisfied that the premises in which and circumstances in which the applicant carries on the practice of dentistry is suitable to practice that, shall direct the Registrar to issue a certificate (named "certificate of practice annual") which allows the applicant's practice as a dental practitioner in the year for which the certificate was issued.
(3) subject to the provisions of this Act, the annual practice certificate shall become effective until thirty-one day of December in the year for which the certificate was issued.

(4) a person registered who do not apply for a certificate of practice annual in the manner and within the period specified in subsection (1), may, upon application in the form and settle the surcharge as may be prescribed, be given a certificate of practice of the year for the following year, if the application is made in the month of December in any year, or for the balance of the year, if the application is made on or after a day of January in each year.
051b.fm Page 21 Friday, March 31, 2006 11:49 AM 22 laws of Malaysia ACT 51 (5) Notwithstanding the provisions of the previous section, if a person registered to apply for certificate of practice of the year for the first time after obtaining registration under section 12 or section 13, the application shall be made in the prescribed form and may be made at any time of year i tu , and the applicant shall, upon payment laskan menje d i te tapkan, d iber i certificate of practice of the year for the balance of the year in which the application is made.
(6) a certificate of adoption of annual and an application for the certificate shall state the address of the principal place of practice and all the other practices of the applicant, and any Exchange about the address i tu shall diberitahukan by practitioners to the Registrar and a ca ta tan about per Exchange i tu in the annual practice certificate obtained from the Registrar within thirty days after the Exchange.
(7) if the Council is of the opinion that a person dissatisfied with practitioners dental dental practice is in any premises or under a situation characterized by the Council as unfit to carry out the practice, the Tribunal may direct that an annual practising certificate is cancelled, and practitioners with such directions, the certificate shall cease to have effect and nothing further annual practice certificate can be issued to the practitioner either for the remainder of the year or any other year except as provided in subsection (8).
(8) If a person whose certificate of its annual practice was cancelled under subsection (7) and he made the application and pay the prescribed fee, the Council may, after considering the matter, directing that a certificate of practice annual issued to that person.
(9) a registered dental practitioners who practice dentistry and that — (a) does not have a certificate of practice annual effect for himself;
(b) share with a person registered who do not have the certificate;
051b.fm Page 22 Friday, March 31, 2006 11:49 AM Dental 23 (c) have worked with it a registered who do not have the certificate; or (d) employed to carry on the business of a person practising dentistry on behalf of a person who does not have the certificate, shall be guilty of an offence against this Act and he shall not be entitled to claim any costs, salaries, financing or cost at the do while he or any person suited as is mentioned earlier does not have certificate of practice annually.
Publication of the list of registered dental practitioners to whom issued the certificate of practice annual 20. (1) the Registrar shall as soon as may be after one day of January every year prepare and publish in the Gazette, appoint one or several lists containing your name, address, approval, approval date, and the date of registration of all persons to whom the certificate of practice annual for that year has been issued.
(2) the publication of the list shall be prima facie evidence of the details contained therein.
(3) the absence of the name of any person from the list shall be prima facie evidence that the person is given the certificate of adoption and are not allowed to practice as a registered person.
(4) a certificate signed by the Registrar of the details contained in the register in respect of a person shall be conclusive evidence of the details of that.
Notification of change of address of permanent residence or 21. Every person registered shall notify any change of permanent address of residence or practice to the Registrar within thirty days after the Exchange.

If the Council is satisfied that a person whose name is included in Express dead or no longer practicing dentistry in Malaysia, the Council shall make appropriate entries with her name appearing in the register.
Stop registration 23. (1) where — (a) the Registrar is satisfied that any person who is registered under this Act inserted or detained in a mental hospital under the provisions of any law; or (b) any person registered under this Act has been certified by a medical review panel, which shall consist of two medical practitioners and one dental surgeon appointed by the Council, as not qualified to perform his professional duties by reason of his physical or mental state, that person shall thereby cease to be registered as such, and an entry shall be made accordingly appearing with his name in the register.
(2) a person ceases to be registered under this Act in accordance with subsection (1) shall not be registered again unless he is proved and the Council is satisfied that his physical or mental state, as the case may be, allowing he is registered again.
Changes in the register 24. (1) the Registrar shall, from time to time, enter into Express — (a) any changes which may be known by him about the name or the address of a person who is registered under this Act;

(2) the Registrar shall, from time to time, delete from the register the name of any person who is required to be deducted under this Act.
Privileges for registered persons and the inability of the person not registered 25. (1) every person who at the time have its name in the register as registered under this Act shall be entitled, in accordance with his approval, practice dentistry under the provisions of this Act and the claim in the course of law reasonable charges due assistance, advice, and professional visits, surgery or dental service and the value of any dental appliance given or made or supplied by him to his patients , provided that at the time of doing the Act she had an annual practice certificate in force.
(2) subject to section 14, no person shall be entitled to claim in any court any charges referred to in subsection (1) unless on the date such charges accrued he was a registered dental practitioner and has a certificate of annual practice in force: provided that this subsection shall not apply to any person registered medical practitioners full under any written law relating to the registration of medical practitioners.
Dental certificate 26. No certificate or other document required by any written law so that signed by a qualified dental practitioner accordingly and provided after this Act comes into force may be valid unless signed by a registered dentist.

The word "dental practitioner qualified in law" or "qualified dental practitioners with appropriate" or any word which means a person recognized in law as a qualified dental practitioner shall be construed as meaning a dental surgeon, when used in any written law in respect of that person.
Body corporate dental cover 28. (1) a body corporate may carries on the business of dentistry if — (a) it does not carry on any business other than dentistry or something related to the dental; and (b) all directors and employees of registered dental practitioner is pengendalinya.
(2) except as mentioned earlier, it is not lawful for any body corporate carrying on any business of dentistry, and if any body corporate carrying on any business of dentistry in contravention with this section, t iap-every Director or Manager, shall be guilty of an offence under this Act unless he proves that it was committed by not cognisant.
(3) every body corporate that carries on the business of dentistry shall, in every year on time, send to the Registrar a statement in the prescribed form containing the address of the premises and the name and address of everyone who becomes a Director or Manager of the body corporate, or that is running dental work in connection with the business of the body corporate, and if the body corporate fails to do so , it shall be deemed to be carrying on business of dentistry in contravention with this section.

of any kind (including an institution for patients-outpatient-only or a dispensary or a clinic), or for any dental school, approved for the purposes of this section by the Council.
(5) this section shall not apply to — (a) a body corporate which hold a dental treatment for employees by a dental practitioner registered except to acquire profits;
(b) a local authority that conducts dental services through someone registered dental practitioners;
(c) a trustee in bankruptcy who runs through a person managing dental practitioners dental dental practitioners registered person bankrupt;
(d) the trustees or personal representatives of the estate of a person registered dental practitioner who carries on the business of Dentistry of the deceased through someone registered dental practitioners; or (e) any body corporate which the Minister may, after consultation with the Council, by order published in the Gazette exclude from this section.
Shows the certificate of registration and certificate of practice annual 29. (1) every registered dental practitioner shall cause to be shown in a place that is easily seen at any premises where he is running dental practices except as an officer in the public service certificate of registration and certificate of adoption of current year's issued to him.

(3) where a registered dental practitioners in breach or not comply with t subsection (1) or (2) he shall be guilty of an offence against this Act.
(4) any person who shows or permits be shown any premises of a certificate of registration or a certificate of practice annual or a certified copy of any one certificate i tu bearing the name or picture fotonya at any time while its name is not available in the register or while he does not hold a certificate of practice annual valid, as the case may be, shall be guilty of an offence against this Act.
Practitioners who practice in a number of places shall give details of practitioners in every place of practice 30. If a dental practice dental practitioners in some areas he shall give to the Registrar of the name, address, approval and details of the certificate of registration and certificate of adoption of current year and any other information as may be prescribed in respect of the dental practitioners in each of the practice areas, and if he fails to do so, he shall be guilty of an offence against this Act.
Inspection of premises used for dental practices 31. (1) there are valid for — (a) the Director General; (b) the Director; (c) the officer responsible for the administration of medical and health services in any State; or 051b.fm Page 28 Friday, March 31, 2006 11:49 AM Dental 29 (d) of any public health authorities approved by the Minister for the purposes of this section, appoint examiners for the purposes of this Act and to authorise the examiner, with the writing — (i) to enter and inspect at any time any premises used or intended for use or in respect of which there is reasonable cause to believe that it is being used to practice dentistry; and (ii) to investigate and report back to the person or authority who appointed them on the State in which the dental practice is being or proposed to be conducted.
(2) an inspector appointed shall show the power of writing given under subsection (1) if requested by any person, when enter or inspect any premises.
(3) a report made by an inspector under subsection (1) shall be made in the prescribed form and shall be the duty of the authority that the inspectors have appointed sends the report to the Council not later than thirty days after the date of the examination.
(4) no any inspection under this Act shall be carried out at the premises of any dental surgeon, except with the specific written authority from the President.
(5) Premises used for the practice of dentistry by a registered dentist shall be examined at least once a year and there are no any annual practice certificate can be issued to a person registered dentists unless a report in the prescribed form has been received by the Registrar within twelve months ago stating the purpose of that premise and condition of the registered dentist practice is satisfactory.
(6) any person who willfully obstruct an officer duly authorized inspectors accordingly 051b.fm Page 29 Friday, March 31, 2006 11:49 AM 30 laws of Malaysia ACT 51 enter and inspect the premises shall be guilty of an offence against this Act.
PART IV DISCIPLINARY PROCEEDINGS disciplinary jurisdiction 32 Council. (1) the Council shall have disciplinary jurisdiction over all persons registered under this Act.
(2) the Council may exercise disciplinary jurisdiction over someone registered — (a) has been convicted in Malaysia or in any other place upon an offence punishable with imprisonment (whether imprisonment only, or in addition to a penalty or in lieu of a fine);
(b) has been guilty for behaving badly from anything in terms of the profession;
(c) obtain registration with fraud or misrepresentation;
(d) shall not be entitled to be registered at the time he registered; or (e) the name was removed from the register of dental practitioners maintained outside of Malaysia, or from express any dental College or licensing body recognized by the Council.
Disciplinary punishment 33. (1) in the exercise of its jurisdiction, the Tribunal may impose any of the following penalties: (a) order that the name of the registered person cut from the register;
(b) order that the name of the registered person suspended from the register for such period as he thinks fit;
051b.fm Page 30 Friday, March 31, 2006 11:49 AM Dental 31 (c) order the registered person dicela; or (d) make an order as aforesaid but suspend implementation, subject to such conditions as the Council may think fit, for a or several period amounting to not more than two years, and may, in any case, make such order as the Council thinks fit with respect to the payment of the cost of the Registrar and the cost of a person of the complainant or the cost of the registered person , and any costs awarded may be claimed as a civil debt.
(2) if the name of the registered person ordered by the Council so that the cut or suspension from register, that person shall within five days after such order made lodge with the Registrar a certificate of its current annual practice including any certificate of adoption of new annual that may have been obtained from the Registrar and also a certificate of its registration: provided that if such person or his attorney not to appear before the Council at the time the order is made , The Registrar shall notify such person in writing of an order made by the Council and asked in the notice s u p a y a o r g i a n t u m e y e r a h k a n k e p a d a n y a p e r a k u n s registration and certification of its annual practice of including any certificate of adoption of new annual that may have been obtained from the Registrar in seven days after the time notice is deposited at the registered address, or at his final known if the address is different from the registered address and if in the opinion of the Registrar the basis-giving will be more effective.
(3) if the registered person does not deliver the certificate of adoption of its current te includes any certificate practice t ahunan new possible t e l i n e p a r o l e n y a d a r i p a d a P e n d a f t a r d a n j u g a p e r a k u n s pendaf tarannya within the time provided in subsection (2) , he is guilty of an offence against this Act.
(4) the Registrar shall publish in the Gazette the name of the person that is removed from the register or suspended from practice under this section either — 051b.fm Page 31 Friday, March 31, 2006 11:49 AM 32 laws of Malaysia ACT 51 (a) upon the expiry of one month laid down in section 34, if that person does not make an appeal against the decision of the Council; or (b) immediately after the decision is made by the High Court to support the decision of the Council, if the person making the appeal against the decision of the Council, as the case may be.

(5) No person whose name has been removed from the register under this section is entitled to subsequently apply so that registered as a dental practitioner under the provisions of this Act, but the Council may, if he thinks fit in any case, upon the application of the person concerned, order that person's name to the register; and if the person's name has been suspended from the register for limited period only, that person shall be entitled after the expiry of such period, but not before i t tu, apply so that the certificate of registration and certificate of practice annual (if the period for which it was issued are still unexpired) returned to him.
(6) an application under subsection (5) shall be made in such manner or form and accompanied by such documents, photographs, details and costs as may be prescribed.
Appeal against the order or decision of the Council 34. (1) any person aggrieved by an order made therefor by the Council in the exercise of its jurisdiction or by a decision of the Council in the proceedings related to it under subsection 12 (4) or subsection 17 (1) or subsection 33 (1) or with the issuance of its name from the register under any of the provisions of this Act except part VII or with any refusal or failure of the Council register or re-enter your name to the register (unless the production the failure or refusal, caused by failure of such person to get a certificate of practice or due to the cancellation of the certificate) may appeal to the High Court, and the Court 051b.fm Page 32 Friday, March 31, 2006 11:49 AM Dental 33 can, when the appeal is made, confirm, reverse or vary the order or decision appealed against or may give such directions as he thinks fit in the matter; the cost of the appeal shall be up to the discretion of the High Court.
(2) the decision of the High Court on the appeal shall be final.
(3) the procedure relating to an appeal shall be subject to the rules of the applicable court in the High Court: provided that the High Court did not have authority to hear appeals against an order made under section 33 unless notice of the appeal was given within one month from the date the order is made or, if the proviso to subsection 33 (2) applies , within one month after the order is delivered as specified in the proviso.
(4) any person aggrieved by the refusal of the Council to issue to him a certificate of practice or the cancellation of the annual practising certificate at its annual may appeal to the Minister and the decision of the Minister shall be final, and no such action or proceeding may be maintained in any court in respect of the refusal or cancellation.
Part V GENERAL Registration fraud 35. Every person who obtain or try to obtain by fraud that him or any other person to be registered by making or submit, or cause to be made or produced, any false declaration or statement or fraud, whether orally or in writing, shall be guilty of an offence against this Act.
051b.fm Page 33 Friday, March 31, 2006 11:49 AM 34 laws of Malaysia ACT Offences 51 36. (1) a person who is not registered or is not exempted from registration under this Act — (a) bersengaja and false pretending as registered under this Act or as qualified to practice dentistry;
(b) bersengaja and in false wearing or using the name or title of doctor of dentistry, dental surgeon, dentist holds, the doctor of dental surgery, Professor of dentistry, dental surgeon;
(c) bersengaja and in false wear or use a name, title, addition or description that giving to understand that he is registered under this Act, or that he is recognised in law as a dentist or dental surgeon or that he holds to cure or treat toothache either by way of knowledge of dentistry or by any other means;
(d) bersengaja and in false wear or use a name, title, addition or description, or using a tool, intended to induce a person to believe that he is qualified to practice dentistry;
(e) the practice of dentistry;
(f) use the word "dental clinic dispensaries" or "teeth" or "dental hospital" or a word that is equivalent to this word in any other language on signage at the point of application in practice by purporting to practice dentistry as a person registered under this Act; or (g) use a symbol designed by the Council for the use of dental practitioners registered only, shall be guilty of an offence against this Act.
051b.fm Page 34 Friday, March 31, 2006 11:49 AM Dental 35 (2) for the purposes of subsection (1) — (a) the application or use of the word "dental surgeon" or "physician" or "dental holds a doctor of dental surgery" or "Professor of dentistry" or "dental surgeon" or "dentists" or "dental clinic dispensaries" or "teeth" or a word that is equivalent to this word in any other language in relation to practice dentistry shall be deemed to be the application or use of a name , title, addition or description intended to induce a person to believe that he is qualified to practice dentistry unless the contrary is proved;
(b) the use by a person in practice any dentistry or dental tool used specifically by those qualified to practice dentistry shall be deemed to be the use of a tool that is intended to induce a person to believe that he is qualified to practice dentistry unless the contrary is proved;
(c) if any person, other than a dental practitioner or a medical practitioner, or a trader appliance and tool of medicine and dentistry, has in his possession any one or more of the following tools and equipment commonly used in the practice of dentistry, namely, dental chairs, dental, engine ketur, dental, dental syringe clip dentistry, dental mirror, or a dental prob, he shall be deemed to be bersengaja and false pretending as registered under this Act and as qualified to practice dentistry.
Prohibition of the practice of dentistry by a person not registered 37. (1) subject to subsection 38 (4) No person shall, in addition to dental practitioners, dental practice can run: 051b.fm Page 35 Friday, March 31, 2006 11:49 AM 36 laws of Malaysia ACT 51 provided that nothing in this section may in effect prohibits a registered medical practitioner and others in public service who work directly under the command and supervision of someone registered dental surgeon , from extracting teeth to relieve pain or from using drugs for that purpose.
(2) any person who commits acts in contravention with this section commits an offence against this Act.
Under 38. (1) any registered dental practitioner that allows someone who is not registered dental practice premises used by or under the control of the registered dental practitioners in carrying out his professional duties commits an offence against this Act.
(2) any registered dental practitioner with his presence, it's supportive, his counsel, pertolongannya, or kerjasamanya has knowingly allow a person who is not registered, whether alleged as an Assistant or otherwise, practice dentistry, be guilty of an offence against this Act.
(3) any registered dental practitioners who practice dentistry in premises in which a person not registered dental practice known by the registered dental practitioner commits an offence against this Act.
(4) Nothing in this section may in effect prohibits a person in the public service who are employed for the purpose of carrying on the practice of dentistry lankan tacara who immediately thereupon ta te includes da lam penger t ian practice dentistry if the procedure is carried out within the person's work and under the supervision of a dental surgeon in the public service.
Penalties for registered dentists who describes his career in false 39. A doctor of dentistry are registered or deemed to be registered under section 13 may not use 051b.fm Page 36 Friday, March 31, 2006 11:49 AM describes his career 37 Dental in any word other than the word "registered dentist". Prosecution

40. (1) Prosecution for an offence against this Act may be carried by — (a) the President or an officer appointed by him or by the Council for that purpose in writing;
(b) the officer responsible for the administration of medical and health services in a given State or of an officer duly appointed for that purpose by writing; or (c) public health authorities referred to in paragraph 31 (1) (d) or an officer nominated by the authority in that behalf in writing.
(2) in respect of an offence against section 37, any police officer may arrest without warrant any person who, as a person who is not a surgeon or doctor of dentistry, dental practice or dental practice believed in any street or public place.
Exemption 41. (1) there is nothing in this Act shall be in force prohibits a person medical practitioners registered in 051b.fm Page 37 Friday, March 31, 2006 11:49 AM 38 laws of Malaysia ACT 51 under any written law relating to the registration of medical practitioners from practice medicine or surgery.
(2) there is nothing in this Act shall be in force prohibits nurses from dental practices receive training under the supervision of a person registered in the dental surgeon of a hospital, clinic, or dental school approved for that purpose by the Minister.
(3) Notwithstanding anything to the contrary contained in this Act, shall the law for someone to follow a course of study dentistry or dental surgery in any university or University College established by universities and University Colleges Act 1971 [Act 30], to conduct, in the course of the study, investigate dental examination, dental or dental treatment of patients in any hospital , a clinic, health centre, or other institution approved by the Minister for the purposes of this section through the provider's news in the Gazette, provided that an investigation, inspection or treatment is carried out by that person under the control and supervision of a dental surgeon who holds a certificate of adoption valid current year.
(4) Hospital, clinic, health center, or other institution approved by the Members i under subsection (3), or the owner, shall not be liable for any loss or damage, disaster of civil type happens to any patient or other person solely by reason of any investigation, examination or treatment of a patient under subsection (3) by a person who is pursuing a course of study dentistry or dental surgery in a university or University College established by the University Act and University Colleges Act 1971, provided that there is nothing whatsoever contained in this subsection shall be construed as giving those who follow such course of study, or college or University College in which that person is to follow the course of study or any officer or employee of the University or College of the University, any immunity from any liability for the disaster, the loss or damage.

(1) any person guilty of an offence against this Act for which no specific penalty is provided shall, on conviction, be liable — (a) for the first offence, to a fine not exceeding ten thousand dollars; and (b) for a second or later, a fine not exceeding two thousand ringgit or to imprisonment for a term not exceeding three years or both of each.
(2) in respect of an offence continues that person shall be liable to a further penalty of fifty dollars for each day the offence continues in addition to the penalties under paragraph (1) (a) and (b) the respective.
PART VI regulations, SAVINGS and REPEAL of regulations 43. (1) subject to the provisions of this Act, the Council may, with the approval of the Minister, make regulations for prescribing anything that is required to be prescribed under this Act, and, generally, to carry out the objects and purposes of this Act.
(2) in particular and without prejudice to the generality of the powers i n t t e unanimously rdahu lu, pe ra tu ran-pera tu ran i tu bo consequences set — (a) the duties of the Registrar;
(b) the form of register, the manner in which it is maintained and also its contents;
(c) payment shall be paid on application and proceedings under this Act and on certification and other documents issued under this Act and provide for 051b.fm Page 39 Friday, March 31, 2006 11:49 AM 40 laws of Malaysia ACT 51 any exception thereof as it deems fit by the Council;
(d) the form and manner in which applications for registration and for the annual practice certificate shall be made;
(e) the form of a certificate or other document required to carry out the purposes of this Act;
(f) the methods of proof approval in dentistry;
(g) property management Council and auditing its accounts;
(h) duties shall be exercised by the Secretary;
(i) the issuance of a certificate of dental toothache;
(j) procedures with respect to the selection of the members of the Council;
(k) the manner in which the Council seek legal advice, it organised a legal adviser for the Council, approval and the functions of the legal adviser and the remuneration to be paid to them;
(l) the receipt of complaints or information about a disciplinary matter can be investigated by the Council and the establishment of a Committee named an initial Investigation Committee to conduct a preliminary investigation in respect of complaints or information about a matter which can be investigated by the Disciplinary Council and to decide whether or not an inquiry should be held by the Council;
(m) the prohibition of a member of the Preliminary Investigation Committee, which also became a member of the Council, from attending a meeting of the Council when the Council conduct an investigation in respect of a complaint or information, in which he took part in the initial investigation; and (n) the procedures to be followed in respect of — 051b.fm Page 40 Friday, March 31, 2006 11:49 AM Dental 41 (i) submitting a complaint and information to the Preliminary Investigation Committee;
(ii) the initial investigation of any complaint or information by the Preliminary Investigation Committee;
(iii) constitute a charge arising out of complaints and information;
(iv) the reference to the Council by the Preliminary Investigation Committee of cases arising out of complaints and information;
(v) the disciplinary inquiry held by the Council.
Saving of 44. (1) every person who immediately before the commencement of this Act has been — (a) registered under Registration Ordinance Dentist 1948 Peninsular Malaysia; or (b) registered under Registration Ordinance Sarawak Dentist; or (c) employed in Sabah by the Government of Malaysia or the Government of the State of Sabah as a Dental Officer, and have one or more approval set out in the Second Schedule shall, when this Act comes into force, be deemed to be a dental surgeon registered under this Act and shall be deemed to have a certificate of practice of the year for the remaining years of this Act comes into operation , except that on a person to whom paragraph (a) or (b) apply such person shall be deemed to have such certificate only if there is effective about it immediately before this Act comes into operation a certificate of practice issued under the annual Registration Ordinance 1948 Peninsula Dentist or Dentist Sarawak Registration Ordinance, as the case may be, or if he has been exempted from obtaining a certificate of annual practice pursuant to the provisions of any one of the Ordinance applies in respect of : 051b.fm Page 41 Friday, March 31, 2006 11:49 AM 42 laws of Malaysia ACT 51 provided that in respect of a person practising dentistry who immediately before this Act comes into force are exempted from registration pursuant to paragraph 24 (a) Dentist Registration Ordinance of Sarawak, he shall be entitled upon making application to the Registrar to be registered as a dental surgeon under this Act, subject to such terms and conditions as may be directed by the Council.
(2) every person who immediately before this Act comes into operation conducted a job under subsection 5 (1) Dentist Registration Ordinance 1948 Peninsular Malaysia shall be deemed to carry on that occupation under subsection 12 (3) of this Act; and any employment suffered by a person under subsection 5 (1) of the said shall be deemed to have suffered under subsection 12 (3) of the said that.
(3) every person who immediately before this Act comes into operation has been registered under the provisions of section 5B Dentist Registration Ordinance 1948 Peninsular Malaysia shall be deemed to be registered under subsection 12 (9) of this Act are subject to restrictions and conditions as determined under section 5B utter.
The abolishment of 45. Dentist Registration Ordinance 1948 Peninsular Malaysia and Sarawak Dentist Registration Ordinance is hereby repealed.
PART VII SUPPLEMENTARY PROVISIONS for the PURPOSE of NATIONAL Purpose, commencement and duration of this section 46. (1) this part is made for the purpose of the country.

(2) this part shall cease to have effect if Parliament, by a resolution approved by each Council Parliament and published in the Gazette, provided that this section shall not be in effect again.

(1) every person who obtains registration under section 12 may, once he is registered or at any time thereafter, presented to him a written notice issued by or on behalf of the Director General which requires the person so held the position as a Dental Officer in any positions in any of the public service and at any date, in each case this , as specified in the notice.
(2) a person who presented to him a notice under subsection (1) shall comply with the notice and if he fails to do so he commits an offence under this Act.
(3) as soon as a charge under subsection (2) or under section 48 is proved in court against any person, the person's registration under section 12 shall be deemed to be void, and the Registrar shall deduct the person's name from the register.
(4) if the name of a person cut from the register under subsection (3), the person's name cannot be placed back into Sign except on the instructions given by the Minister, and the Minister may give such instructions when written request made to him by the person whose name has been deducted from the register.
(5) any direction given by the Minister under subsection (4) in respect of any person may be made subject to the fulfilment of such terms and conditions as the Minister thinks fit to impose, and terms and conditions that may include terms and conditions require that person i tu served as dental officer to the satisfaction of the Director-General for a period directly-menurus amounting to not less than three years in any position in any one or more of the public service as determined from time to time by the Director General in his discretion.
(6) while the name placed back under subsection (4) fulfilling the terms and conditions imposed under subsection (5) he shall be deemed to be registered 051b.fm Page 43 Friday, March 31, 2006 11:49 AM 44 laws of Malaysia ACT 51 to the extent necessary to meet the terms and conditions imposed under subsection (5) and for any other purpose as may be directed by the Minister , but not much more than that; and when the terms and conditions imposed under subsection (5) has been fulfilled, he shall be entitled to obtain a certificate issued by the Director General as evidence of the fulfillment.
(7) the decision of the Minister on an application made to him under subsection (4) in order to be allocated a name to the register shall be final and shall not be questioned or reviewed in any court.
(8) where a notice under subsection (1) has been served on any person may be served upon him the notice, the Director-General may, at any time, m e m b a t a l k a n n o t i s i t u d a n, j i k a d i f i k i r k a n n y a p a t u t , cause to be delivered to that person a further notice under subsection (1).
Length of service in accordance with the notice under subsection 47 (1) 48. A person who joined in a position in the public service in accordance with a notice issued under subsection 47 (1), shall continue to serve in the post or in any position other then in the public service in the same or in any other public service as determined from time to time by the Director General in his discretion for a period of constant direct-not less than three years to the satisfaction of the Director General and if he fails to do so he is guilty of an offence under this Act.
Power of Minister to give a reduction, exemption or postponement of a period of service under section 48 49. (1) the Minister may, by order published in the Gazette — (a) in respect of any particular person;

(c) generally with respect to everyone in such period as may be specified by him, give any reduction or she thinks fit or full exemption from length of service required under section 48.
(2) the Minister shall, on application in writing is made to him by any person to be undergoing the period of service required under section 48, giving that person a reprieve from the start the service for such period as it thinks fit if he is satisfied that it is fair and reasonable to do so.
(3) the decision of the Minister on an application made to him under subsection (2) shall be final and shall not be questioned or reviewed in any court.
The Minister may make rules 50. The Minister may make rules to carry out the objects and purposes of this part.
The FIRST SCHEDULE [section 7] ADDITIONAL PROVISIONS RELATING to the COUNCIL of the President of the Council 1. (1) the Director General shall be the President of the Council.

Meetings Of The Council 2. (1) the Council shall meet at the times and places as may be prescribed by the President, provided that at least two meetings shall be held in a year.
(2) where not less than five members wrote to the President asking him to convene a meeting of the Council, the President shall call the meeting within one month after the request is received.
(3) a quorum for a meeting of the Council is seven, and the decision of Ma-jlis shall be on the advantages of the voice of the members present and voting.
(4) when a vacancy occurs among the members, the Council shall, as soon as possible, take the necessary action to fill the vacancy.
(5) in a meeting of the Chairman is entitled to provide a vote and also, if the number of votes on a question of the same number, a casting vote.
(6) the members of the Council who is not a public officer shall be paid such payment for attending meetings of the Council or of a Committee appointed by the Council and any expenses travel and living allowances reasonable due to attend such meeting and because travel is done in exercise of their duties under this act as may be approved from time to time by the Minister.
(7) subject to the provisions of this Act, the Council may generally make command fixed arrange its own procedure, and, in particular in relation to the holding of the meeting, the notice shall be given of the meeting, the proceedings of the meeting, keeping and care, the production and inspection of such minutes.
Council Committee 3. (1) the Council may from time to time established by the Board from among its members one or several committees as the Council shall think fit and may delegate to them of any of the functions of Council the Council may think fit.
(2) the quorum for a meeting of the Committee is three, unless specified otherwise by the Council.
The Secretary Of The Council 4. President may appoint an official from the Ministry of health be the Secretary of the Council.
