(B) 467/2000] enacted by the Parliament of Malaysia as follows: short title and commencement 1. (1) this Act may be cited as the Port Workers Act (regulation of employment) (Dissolution) order 2000.
(2) this Act shall come into force on such date as the Minister may, by notification in the Gazette.
Interpretation 2. In this Act, unless the context otherwise requires — "the Government" means the Federal Government;
"Board" means the Board of Labour Penang port established under sections 3 and 4 of the Act the port workers (regulation of employment) Act 1965 [Act 419];
"Minister" means the Minister charged with the responsibility for human resources;
Laws of Malaysia ACT 6076 "federal lands Commissioner" means the federal lands Commissioner appointed under federal lands Commissioner Act 1957 [Act 349];
"due date" means the date specified by the Minister under subsection 1 (2).
Abolition and liquidation 3. Act of port workers (regulation of employment) 1965 repealed and the Board established under the Act should be abolished.
The transfer of the powers, rights, etc.
4. All the powers, rights, privileges, duties, liabilities and obligations immediately before the appointed date was powers, rights, privileges, duties, liabilities and obligations of the Board shall, from the date that, down to the Government.
The transfer of ownership of property 5. (1) the land immediately before the appointed date vested in the Board shall, on the appointed date, vested in the Commissioner of the federal lands for the purpose of Government.
(2) all property and assets other than land immediately before the appointed date vested in the Board or in any person or body acting on his behalf shall, at that date, vested in the Government.
Money transfers 6. All funds on, or payable to, the Board shall, on the appointed date, be transferred or payable to, and vested in the Government.
Trust Accounts 7. (1) Money referred to in section 6 shall be kept in a trust account operated by the Ministry of human resources to settle all debts of the Board of port workers (regulation of employment) (Dissolution) 7 has not been settled and for the payment of any expenses incurred by the Government in administering the Affairs of the Board following the dissolution of the Board.
(2) the trust account shall be operated for a period approved by Minister of finance and any balance of the money held in the trust account at the end of that period must be transferred to the Government.
Existing contracts, etc.
8. all deeds, bonds, agreement, instrument and work arrangements that existed immediately before the appointed date and touch any property or money transferred under sections 5 and 6 shall have effect and the full effect, whether against or in favour of the Government, and can be enforced fully and effectively as if Government has named it and has become a party to it , and not the Board or any person or body acting on his behalf.
Continuation of proceedings 9. (1) any proceedings (whether civil or criminal) or cause of actions pending or existing immediately before the appointed date by or against the Board or any person or body acting on his behalf may be continued or commenced by or against the Government as it may be continued or commenced by or against the Board or any person or body so if this Act has not been approved.
(2) any appeal brought, or any permission to appeal applied, on or after the appointed date, against a decision given before the date specified in any legal proceedings in which the Board became a party can be brought by or against the Government as it can be brought by or against the Board if this Act has not been approved.
Laws of Malaysia ACT 6078 Continuation law, etc.
10. (1) subject to this Act, all applicable law, including subsidiary legislation, affecting or for protection of the Board and in force immediately before the appointed date shall, until amended or cancelled by the relevant authorities having power to do so, continue to have effect and be construed as if this Act had never approved.
(2) any reference in any law specified in subsection (1) of the Board shall, unless the context otherwise requires, be construed as a reference to the Government and phrases bring such pronunciation meaning shall be construed accordingly.
Prevention of difficulties or anomalies 11. (1) where any difficulty or anomalies arises in connection with the implementation of this Act, the Minister may by order make such modifications to any of the provisions of this act as it considers necessary to eliminate or prevent difficulties or anomalies that but the Minister cannot exercise the powers conferred by this section after the expiration of three years from the date specified.
(2) in this section, "modifications" includes amendment, addition, deletion, replacement, adjustment, alteration, alteration and ketakpakaian of any of the provisions of this Act.
