BE IT enacted by the Seri Paduka Baginda Yang di-Pertuan Agong with the advice and consent of the Dewan Negara and Dewan Rakyat in Parliament assembled, and by the authority of the same as follows: part I preliminary short title 1. This Act may be cited as the Act Institute of the Malaysian agricultural research and development, 1969.
Interpretation 2. In this Act — "the Director General" and "Deputy Director-General" means the Director General of the Institute and any Deputy Director-General of the Institute appointed under subsection 4 (1);
"Minister" means the Minister responsible for agriculture and agro-based industries;
"mixed farming" means a plantation system that involves all the crops (except cocoa), livestock and fisheries, integrated way.

Agricultural Research and Development Institute of Malaysia or MARDI (hereunder referred to as "the Institute") was established and its function is — (a) to carry out research in terms of science, engineering, economics and social respect of — (i) the production, use and processing of all crops (except rubber, oil palm and cocoa), livestock and food; and (ii) mixed farming;
(b) serve a Centre for collecting and disseminating information and advice with respect to matters of science, engineering and Economics in relation to industrial agriculture, agro-based industries and food industry through any means including official reports, periodicals and papers relating to it, and organizing exhibitions, conferences, syarah and seminars;
(c) be as a centre which provides specialist services in the industry of agriculture, agro-based industries and food industry, such as consulting services, laboratory analysis, quality assurance and research and development services contract;
(d) provide training in any way for the advancement of industrial agriculture, agro-based industries and food industry;
(e) providing assistance for the purpose of research and development in terms of science, technique and economy type of social work and applied in respect of industrial agriculture, agro-based industries and food industry;
(f) always hold a relationship with other organizations, whether public or private, domestic or overseas that participate in research in terms of science, engineering, economics and 011b.fm Page 6 Monday, March 27, 2006 12:45 PM Institute the Malaysian agricultural research and development in respect of social 7 industry agriculture, agro-based industries and food industry;
(g) conduct research and commercial production;
(h) developing, promoting and exploiting research findings; and (i) provide service expansion to industrial agriculture, agro-based industry and food industry.
The Director General and Deputy Director General of the Institute 4. (1) for the purposes of this Act shall have a Director-General of the Institute and such number of Deputy Director General to be, who shall be appointed by the Minister.
(2) the Director General and Deputy Director-General shall each be appointed for a term specified in the letter of their appointment and shall be eligible for reappointment.
(3) the Director General and the Deputy Director shall be appointed on such terms as provided in the letter of their respective appointments.
(4) the Minister may at any time revoke any appointment made under subsection (1); and any person so appointed may at any time resign his Office.
(5) the Director General shall be the Chief Officer of the Work of the Institute and shall be assisted by a Deputy Director-General in the exercise of powers and obligations with respect to administrative functions and techniques Institute; provided, however, the Board as established under in i bo. find all the tapkan of power and RCEs j ipan l a in which he deems fit for the Director General and Deputy Director General.
(6) If during a period of General Director unable to perform the functions of his Office for a reason or, if the Director General becomes vacant, the Minister shall appoint a Deputy Director to carry out the powers and execute the duties of Director-General until a new Director-General appointed under subsection (1).

(1) for the purposes of administering the Institute established the Board of Governors of the Institute of the Malaysian agricultural research and development (in this Act referred to as the "Board") which is a body incorporated perpetual and have an official seal, and who can sue and be sued upon his name, and subject to this Act and also for the purpose may enter into contracts and also powerful acquire and hold any kind of movable property , immovable property and intangible assets, and disposes of it or in other, make any arrangement in respect.
(2) the Board shall consist of the following members: (a) the Chairman;
(aa) The Director-General;
(b) a representative of the Ministry of agriculture and agro-based industries;
(c) a representative of the Ministry of finance;
(d) a representative of the Ministry of plantations industries and commodities;
(e) a representative of the Economic Planning Unit, Prime Minister's Department;
(f) a representative of the Ministry responsible for science, technology and environment;
(g) not more than five members who are experienced in agricultural research, agricultural development, industrial agriculture, agro-based industry and food industry.
(3) members of the Board shall be appointed for a term specified in the letter of their appointment by the Minister and be eligible for reappointment, unless he sooner resigns or the appointment is revoked or his Office becomes vacant.
011b.fm Page 8 Monday, March 27, 2006 12:45 PM Agricultural Research and Development Institute of Malaysia 9 (4) If by reason of illness or any other reason the Chairman is unable to execute its functions, the Board must choose between a member of the Acting Chairman who will exercise and execute the duties of the Chairman under this Act.
Alternate member of 5A. (1) the Minister may, in respect of each Member of the Board appointed under paragraph 5 (2) (b), (c), (d), (e) and (f) appoint one alternate to be a member to attend, in lieu of the Member, Board where a member is unable to attend due to any reason whatsoever.
(2) when attending meetings of the Board, a member of the alternate shall for all purposes be deemed to be a member of the Board.
(3) an alternate member shall, unless he sooner resigns or his Office first revoked, cease to be a member of an alternate if the Member for which he became an alternate member is no longer a member of the Board.
Functions Of The Board 6. (1) Notwithstanding subsection 5 (1) the Board has the following additional functions as:

(a) subject to the directions of the Minister, prescribing the administrative policy Institute;
(b) establish a procedure with respect to the appointment, promotion and termination of appointment of the Institute's employees and servants, excluding the Director General and Deputy Director General;
(c) with the consent of the Minister, approve the budget or estimates of expenditure for the Administration and operation of the Institute;
(d) issuing administrative rules with regard to the daily administration of the Institute;
011b.fm Page 9 Monday, March 27, 2006 12:45 PM 10 laws of Malaysia ACT 11 (e) ascertain and assign the grant assistance to organizations or agencies conducting research; and (f) to approve the selection of scholarship recipients and issue an award or grant travel shall be borne by the Institute.
(2) (struck by A1160 Act).
(3) the provisions of the Schedule shall apply to the Board.
The power to participate in the equity participation or joint venture 6A. The Board may, with the approval of the Minister and the consent of the Minister of finance, to participate in the equity participation or joint venture with any industry event participation or joint venture that it appears to him to be required, appropriate or beneficial for or in connection with the implementation function of the Institute.
The extra power Board 6B. (1) the Board may, with the approval of the Minister and the approval of the Minister of Finance — (a) carry out any activity that is commercial in nature and in the opinion of the Board is necessary, beneficial or appropriate for or in connection with the implementation function of the Institute; or (b) to organise incorporation of companies under the companies Act 1965 [Act 125] for the purpose of carrying out or engage in any activities planned or undertaken by the Board in connection with the implementation function of the Institute.
(2) a Memorandum of Association company incorporated under paragraph (1) (b) shall be approved by the Board prior to the incorporation of such a company.
011b.fm Page 10 Monday, March 27, 2006 12:45 PM Institute the Malaysian agricultural research and development 11 (3) Notwithstanding subsection (1), the Board may not without the approval of the Minister and the approval of the Minister of Finance — (a) invest in the shares of any company; or (b) dispose of all or any part of its assets or equity invested in any subsidiaries.
Appointment of officers and servants Institute 7. The Board may from time to time appoint and employ to pay such remuneration and upon such conditions as may be prescribed by rules, officers, servants and consultants as may be deemed necessary by the Board to implement this act properly.
Discipline of officers and servants 7A. (1) a Disciplinary Board shall be held Committee consisting of two members who shall be elected by and from the members of the Board, one of whom shall be elected as Chairman, and the Director-General appointed under subsection 4 (1).
(2) the disciplinary authority in respect of every such officers and servants of the Institute, in addition to the Director-General is the Disciplinary Committee the Board established under subsection (1).
(3) the disciplinary authority in respect of the Director-General was the Disciplinary Committee which shall consist of the Secretary General of the Ministry of agriculture and agro-based industry as the Chairman and two members who shall be elected by and from the members of the Board.
(4) the Director General shall not be a member of the Disciplinary Committee in any proceeding before the Committee in which he became the complainant; the place shall be taken by a member shall be elected by and from the members of the Board.
(5) in the exercise of its functions, the Disciplinary Committee shall have the power to impose 011b.fm Page 11 Monday, March 27, 2006 12:45 PM 12 laws of Malaysia ACT 11 what disciplinary punishment as provided under any regulations that may be made under section 25A.
(6) the Disciplinary Committee may, subject to subsection (7), delegate any functions, powers or duties to any of its committees officers or servants of the Institute, in respect of any officer or certain servants Institute or in respect of any class or category of officers or servants of the Institute, and the Committee to which has been delegated functions, powers or duties of such shall perform, carry out or he fulfilled under the direction and control of the Disciplinary Committee shall have the power to repeat the study , delete or amend any decision or finding of such Committee.
(7) no delegation shall be made under subsection (6) to allow an officer or servants of the Institute became a member of a Committee may exercise such disciplinary authority over the officials or servants rank higher from it.
(8) a decision of the Disciplinary Committee established under subsection (1) shall be appealable to the disciplinary Appeal Board established under section 7B.
(9) a decision of the Disciplinary Committee established under subsection (3) shall be appealable to the Minister.
(10) the disciplinary Appeal Board or the Minister can confirm, reverse or vary the kepu tusan Disciplinary Committee.
(11) the decision of the Disciplinary Appeal Board or the Minister under subsection (10) is final and conclusive.
The Establishment Of A Disciplinary Appeal Board 7B. (1) a Disciplinary Appeal Board held that the Board shall consist of the following members: (a) the Chairman of the Board, who shall be the Chairman of the Disciplinary Board of Appeal and shall have a casting vote; and 011b.fm Page 12 Monday, March 27, 2006 12:45 PM Institute the Malaysian agricultural research and development 13 (b) three members of the Board, who is not a member of the Disciplinary Committee whose decision is the matter of the appeal, which shall be appointed by the Chairman of the disciplinary board of Appeal with the approval of the Board for the purposes of appeal.
(2) when the disciplinary Appeal Board considers an appeal made under section 7A, a member of the Disciplinary Committee against appealed from who is also member of the Board may not be present on or in any way participate in any proceedings in respect of the appeal.
Termination in the public interest 7C. (1) where the Board found or if the representations made to the Board that proper service of an officer or termination of the servants in the public interest, the Board may request the full report of the senior officer or officers servants against whom the representation is made which shall contain details relating to work and conduct officer or the servants.
(2) where, after considering a report received under subsection (1), the Board is satisfied that, having regard to conditions of service, usefulness of the servants or officers, work and conduct officer or the servants and all other circumstances of the case, desirable in the public interest to do so, the Board may terminate the service of officials or servants of the effect from a date to be determined by the Board.
(3) the legally binding laws for Disciplinary Committee to recommend to the Board such that the service of an officer or termination of the servants in the public interest even if disciplinary proceedings have not been carried out under this Act and the Board may terminate the service of officials or servants of the same.
(4) Notwithstanding anything in this Act and any other laws to the contrary, in terminating the service of an officer or servants in the public interest under this section, the officer or the servants need not be given any opportunity to be heard and 011b.fm Page 13 Monday, March 27, 2006 12:45 PM 14 laws of Malaysia ACT 11 an officer or servants that his service was terminated in the public interest under this section shall not be deemed to have been dismissed , regardless of whether termination of service of officials or servants that involves an element of sanction in connection with conduct relating to his Office which is considered by the Board unsatisfactory or should be blamed.
PART IV SCIENCE COUNCIL Science Council 8. (1) for the purpose of determining that the plan technique Institute has the quality and impact of the best established Science Council of the Institute of the Malaysian agricultural research and development (hereinafter called "the Council of science").
(2) Science Council shall consist of the following members appointed by the Minister: (a) the Director General of the Institute as the Chairman;
(b) a Deputy Director General;
(c) three representatives from the Ministry of agriculture and agro-based industries;
(d) a representative of the Ministry of plantations industries and commodities;
(e) not more than six persons from industry, agriculture, agro-based industries and food industry, which in the opinion of the Minister, be able to contribute for a perfect trip and should Science Council;
(f) two people from any public higher educational institutions in Malaysia as determined by the Minister; and (g) a representative of the financial sector or investment.
011b.fm Page 14 Monday, March 27, 2006 12:45 PM Agricultural Research and Development Institute of Malaysia 15 (3) where by reason of illness or any other reason the Chairman is unable to execute its functions, the Council shall elect an Acting Chairman between members who will exercise and execute the duties of the Chairman under this Act.

(5) every Member of the Science Council, unless he sooner resigns or the appointment is revoked or his Office becomes vacant otherwise, shall hold office for a term as specified in the letter of appointment and shall be eligible for reappointment.
The Function Of Science Council 9. Notwithstanding subsection 8 (1), Science Council shall have the following additional functions as: (a) provide advice with respect to organize and to repeat the study plan Research Institute;
(b) provide advice with respect to the priorities for the Institute's research and development plans to have the quality and impact of the best;
(c) always hold a relationship with overseas organizations, whether in the public or private, and always hold a relationship with the research needs of agriculture;
(d) provide guidance in development or research facilities including the selection of the place and laboratory facilities and supervision equipment specialists on important thing;
(e) provide advice regarding the procedures to assess the abilities and the work of professional staff to be appointed under this Act, including promotion on the basis of professional merit;
(f) providing advice in respect of work mail library and Institute.
011b.fm Page 15 Monday, March 27, 2006 12:45 PM 16 laws of Malaysia ACT 11th Council meeting Science 10. Science Council shall meet at least four times each year and, in addition, shall meet when called by the Chairman of the Science Council or the Secretary his work.
The Results Of The Science Council 11. A Science Council decisions shall be decided in accordance with the voice over of the members present and voting.
Minutes 12. Travel records of all meetings of the Council shall be kept by the Institute of Science and a copy thereof shall be sent to the Board.
The Procedures Of Science Council 13. Subject to the provisions of this Act and any rules made thereunder, the Science Council may regulate its own procedure.
Part V FUND And ACCOUNT Fund 14. For the purposes of this Act shall be established the Fund of the Malaysian agricultural research and development (hereunder referred to as "the Fund") to be administered by the Board in accordance with the provisions of this Act and — (a) any special Cess tax that may be imposed or collected in accordance with section 20 shall be payable to him;
(b) any provision of assistance to the Institute by the Federal Government or the State Government shall be paid to him;
011b.fm Page 16 Monday, March 27, 2006 12:45 PM Institute the Malaysian agricultural research and development 17 (c) any money from any cause, any contributions, donations, grants or grant permanent bequests that may be given to or for the Institute shall be payable to him;
(d) all expenses relating to the administration of the Institute, the Board and the Council of science and any other expenses that may be paid in accordance with this Act shall be paid therefrom;
(e) any costs incurred in making provision for the welfare of the officers and servants of the Institute with the approval of the Minister shall be paid from it.
Act statutory bodies (accounts and annual reports) 1980 15. Act statutory bodies (accounts and annual reports) 1980 [Act 240] shall apply to the Board.

Surcharges 17A. (1) if it appears to the Board that any person who is or has been employed by the Institute — (a) has failed to collect any money owed at the Institute of pemungutannya became its responsibility;
(b) who is or was responsible for any payment of money out of the Fund which should not be made or for any payment of money is not properly certified;
(c) which are or have been responsible, directly or indirectly, for any deficiency in, or destruction of, any money, stamps, securities, storage or other property Institute;
(d) as, or ever be as accounting officers, fail or has failed to keep proper records or account;
011b.fm Page 17 Monday, March 27, 2006 12:45 PM 18 laws of Malaysia ACT 11 (e) has failed to make any payment, or have been responsible for any late in payment, money from the Fund to any person to whom payment is to be made under any contract, agreement or arrangement made between the person with the Institute, the Board shall deliver a written notice to him requesting show cause why he should not be disurcajkan , and if that satisfaction is not provided, within the period of fourteen days from the date of delivery of the notice referred to earlier, to the Board with respect to the failure to collect payment should not be made, payment is not verified properly, lack of or destruction of, or failure to keep proper records or accounts, or failure to make payment, or late in making payment, the Board can mensurcajkan a sum of money against the person which does not exceed the amount of any such amount not collected , any costs, lack of, or loss or the value of the property destroyed, and with respect to the failure to keep proper records or accounts, or failure to make payment, or late in making payment, the Board can mensurcajkan any amount of money against the person as the Board may think fit.
(2) the Chairman shall cause the Director General notified of any surcharge made under subsection (1) and the Director-General shall thereupon notify the person who disurcajkan it.
(3) the Board may at any time withdraw any surcharge in respect of which a satisfactory explanation has been received or if it turns out otherwise that no surcharge should be made, and the Chairman shall immediately cause the Director-General to be notified of the withdrawal.
(4) the amount of any surcharge made under subsection (1) and not withdrawn under subsection (3) shall be a debt due to the Institute from the person against whom a surcharge is made and can be sued and recovered in any court on a legal Institute and can be recovered through a deduction — 011b.fm Page 18 Monday, March 27, 2006 12:45 PM Institute the Malaysian agricultural research and development 19 (a) from the salary of the person who disurcajkan if the Board directs such; or (b) the pension of people who disurcajkan if the Board so directs, with equal monthly instalments not exceeding one quarter of the total monthly salary or pension, the person.
PART VI SUPPLEMENTARY borrowing Authority 18. With the approval of the Minister and the approval of the Minister of finance, the Board may from time to time borrow or obtain payment of any money required by it to carry out its functions properly under this Act.
Investment 19. The Institute's assets may be invested by the Board in investment for the time allowed by law for the investment of trust fund: provided that the Board shall not make any investment in securities issued or registered or in other property situated outside Malaysia except with the approval of the Minister of finance.
Tax ses 20. Notwithstanding the provisions of any written law with respect to the import and export of agricultural products, the Minister of finance may, for the purposes of this Act, and in consultation with the Minister imposes a special tax on ses agricultural products it deems fit for the purpose of agricultural research.

Board Member, Science Council, Committee or any other person (who is not an officer or the Board's servants fall within the jurisdiction of this Act in respect of the terms and conditions of service applicable to the case) shall be paid such remuneration or allowance as determined by the Minister.
Protection of members of the Board and Council of science against liability 22. None of the Board or a member of Council for science can be liable himself for any loss or damage caused by any act or omission in managing or conducting the Affairs of the Institute, the Board or Council for science, unless the loss or damage caused by an act or omission is wrong accidentally in his place.
Property in research findings 23. (1) a property in respect of every research finding or every program undertaken by the Institute is fully funded by the grant made to the Institute by the Federal Government or any State Government, shall be vested in the Board.
(2) property in respect of every research finding or every program undertaken by the Institute funded an enterprise or private organisation, shall be vested in the Board and the private organization the enterprise or in association, subject to any agreement between the Board of enterprise or private organisation it is.
Access to the findings of research and facilities 23A. (1) the Board may, subject to conditions, restrictions and limitations as may be specified by him, authorize any person to get access to the findings of the Institute's research and facilities.

(2) for the purposes of this section, "facility" includes equipment, laboratory, experiments, parcel database and collection germplasma.
The power to impose fees 23B. The Board may impose fees, royalties or any other payments he deems fit for any research, investigation, testing, training, advice or other services provided by the Institute, or for the use of any of the property or its facilities.
The Directions Of The Minister 24. The Minister may from time to time issue general instructions that are not inconsistent with this Act to the Board, and the Board shall give effect to such directions.
Method 25. With the agreement of the Minister, and on paragraph (a) and (b) subject to the agreement of the Minister of finance, the Board may make rules for all or any of the following — (a) set the salary scales and conditions of hiring officers and servants of the Institute, including the provision of loans to officers and servants thereof;
(b) establish and manage a fund savings bercaruman for officers and servants of the Institute or to pay pensions, allowances or gratuities to officers and the servants upon retirement or when stopped in Office;
(c) the principles and procedures regarding the appointment, promotion and termination of appointment in the Institute, excluding the Director General and Deputy Director General;
(d) the principles and procedures for the evaluation of the abilities and professional staff employment Institute; and (e) any other matter that may be prescribed under this Act.
011b.fm Page 21 Monday, March 27, 2006 12:45 PM 22 laws of Malaysia ACT 11 Power makes discipline 25A. (1) the Board may, with the approval of the Minister, make any disciplinary regulations as he may deem necessary or expedient to provide disciplinary officers and servants of the Institute.
(2) Disciplinary Rules made by the Board under this section may contain provisions on hold the work with reduction of salary or other remuneration, or provide for suspension of the work without pay or other remuneration of an officer or servants of the Institute pending disciplinary proceedings have been completed.
(3) the Disciplinary Rules made under this section shall create any offence tatatert ib and provide about any disciplinary punishment as may be thought fit by the Board, such allotted and the sentence may include dismissal or demotion.
(4) Disciplinary Rules made under this section shall, in establish a procedure for disciplinary proceedings, giving person against whom disciplinary proceedings taken the opportunity to make representations against the disciplinary charge made against him before the decision was reached by the Disciplinary Committee, except in the case of the following: (a) If an officer or the Institute servants dismissed or lowered promoted by reason of the conduct in respect of which a criminal charge has been proved against him;
(b) if the Board, on the recommendation of the Minister charged with the responsibility for internal affairs, is satisfied that in the interest of the security of Malaysia or any part thereof is not expedient to carry out the requirements of this subsection;
(c) if it has been made against an officer or servants of the Institute of any detention order, supervision, residential limited, banishment or deportasi, or if there has been imposed on an officer or servants Institute any form of restriction or supervision by bond or otherwise, 011b.fm Page 22 Monday, March 27, 2006 12:45 PM Agricultural Research and Development Institute 23 Malaysia under any law relating to the security of Malaysia or any part thereof , crime prevention, preventive detention, residential limited, banishment, immigration, or protection of women and girls.
(5) Disciplinary Rules made under this section shall provide on the procedure for the hearing of an appeal against the decision of the Disciplinary Committee.
(6) for the purposes of this section, "officer" includes the Director General.
TABLE [section 6] meetings of the Board 1. The Board shall meet at least four times each year and, in addition, shall meet when called by the Chairman.
Quorum of 2. The presence of four members being a quorum in any Board meetings.
Board Minutes 3. Minutes of all meetings of the Board shall be kept and a copy thereof shall be presented to the Minister.
The Seal Of The Board 4. The seal of the Board shall be kept in the custody of the Director General or any other person authorized by the Board, and shall be authenticated by the Director General or the authorized person and an officer authorised by one of them in writing; and all deeds, documents and other instruments purporting to be sealed with the seal, authenticated as specified in this paragraph shall be deemed to have been validly executed until the contrary is proved.

The appointment of the Committee 6. (1) the Board may appoint such committees for any purpose arising from or in connection with any of the powers, duties and functions under this Act; any Committee so appointed shall include not less than one member of the Board, and may be appointed to the Committee any other persons as the Board may think fit.
(2) any such Committee appointed shall meet any instructions given to him from time to time by the Board, and the Board may at any time discontinue or modify the membership of any Committee appointed such.
(3) the Board or Committee, respectively, may invite any person who, in his opinion, have special knowledge beneficial to him, to attend any meeting of the Board or Committee and the person invited shall be entitled to vote at any such meeting.
Power requires 7. The Board may require any person presenting any information which, in the opinion of the Board, it is necessary to carry out its functions under this Act.
