BE IT enacted by the Seri Paduka Baginda Yang di-Pertuan Agong with the advice and consent of the Dewan Negara and Dewan Rakyat in Parliament assembled, and by the authority of the same, as follows: short title and application 1. (1) this Act may be cited as the registration of Criminals Act and the undesirable 1969.
(2) this Act shall apply throughout Malaysia.
Interpretation 2. In this Act, unless the context otherwise requires — "verification officer" means — (a) an officer of the public prosecutor, who is responsible for validating the results of a case when the conclusion of the case if someone is charged with an offence can express;
(b) the police officer in charge of the final step for the removal out of exile and Federal for confirming the deportation;

(d) an immigration officer or police officer who is responsible for the final step of the expulsion of people expelled from the Federation or of any State in the Federation and for confirming the expulsion; or (e) in relation to a person who has been sentenced to imprisonment for a period because of an offence can express, any prison officer (within the meaning of any written law in the Federation in relation to prison), which is responsible for confirming the imprisonment;
"verify" means execute the functions of an official verification as may be prescribed by this Act;
"the exile" means any person who commanded to exile from United under any written law in the Federation relating to deportation;
"those expelled" means any person who commanded to diusirkan of the Federation or of any State in the Federation under any written law in the Federation relating to immigration;
"the State is disabled person" means any person who commanded dinyahkan from United under any written law in the Federation relating to deportation;
"fingerprint" includes cap hand thumb, cap and cap toe;
"the fingerprint form" means any form prescribed by the Chief of police in accordance with section 15 for the purpose of recording or verify fingerprints and details can check another;
"officers recorded" means — (a) a police officer;
(b) an officer of customs or excise the rights (within the meaning of any law 7B. (c) a prison officer (within the meaning of any written law relating to federal prison) in addition to a prison officer who is also an official confirmation; or (d) an immigration officer that its function is to prevent or prosecute any offence can register under any written law in the Federation relating to immigration;
"register" means the register to be kept and maintained under section 7;
"Registrar" means — (a) the Registrar of criminals; and (b) any person or other officer appointed under section 3;
"errors can express" means any offence can be registered under this act as may be specified in the first and second schedules;
"details can express" means — (a) the particulars of any conviction or sentence in respect of an offence can express;
(b) details of any order relating to the person in exile, the State is disabled, people evicted or limited;
(c) the name, description, photographs and fingerprint or fingerprint classification for any person who is convicted of an offence can express, or for any person removed State, person is disabled state, people evicted or limited;
(d) the particulars deemed by the Minister as details can express under paragraph 4 (1) (a);

"restricted person" means any person who commanded to placed under restricted residence under any written law in the Federation in relation to residential limited.
Appointment of officers 3. The Yang di-Pertuan Agong may appoint by notification published in the Gazette for the purposes of this Act — (a) a Registrar of Criminals for the Federation;
(b) the Deputy Registrar and Assistant Registrar of Criminals for the Federation or any part of the Federation; and (c) any other officer for the Federation or any part of the Federation to carry out any or all of the functions of the Registrar.
The Minister may declare the whole or such other particulars as details can express 4. (1) the Minister may from time to time by order published in the Gazette — (a) described for the purposes of this Act the details (which are submitted to the Registrar) of the person convicted of any offence (whether an offence can register under this Act or otherwise) in any country or details of the person who banished, dinyahkan or expelled from any country or from any part of a country outside the Federation as details can express; or 7B. FM Page 8 Monday, March 27, 2006 12:23 PM registration of Criminals and Unwanted People 9 (b) declare for the purposes of this Act any details (other details can check described in paragraphs (a) to (d) in the definition of "details can express") as details can express.
(2) an order made under paragraph (1) (a) may generally in respect of such particulars or error or may specially with respect to any country or any part of a country or in respect of persons of a particular class of persons or in respect of any offence.
The functions of officer recorded 5. Recording officer in charge of a case shall take or cause to be taken and recorded fingerprints, photographs and details can check other fingerprint form on any person (other than the details of any conviction, sentence or other order of the Court in respect of an offence can express while the conclusion of the case) — (a) when a person is arrested because an offence can express; or (b) (i) where a person is convicted of an offence can express unless details can be daftarnya that have been taken under paragraph (a); and (ii) where a person, other than convicted a kesa land bo. daf ta r, d ihukum with imprisonment for a period;

The verification officer functions 6. An official confirmation shall confirm the fingerprint form — (a) while the conclusion of the case if a person — (i) released and discharged from an offence can express;
(ii) is found guilty of an offence can express without recorded conviction under any court order to require the accused bail so well-mannered, by placing the accused under trial or placing the accused under any such other order made by the Court found the accused guilty of an offence can express but mengecualikannya from an order of conviction; or (iii) convicted of an offence can express;
(b) when a person discarded the State eventually carried out of the Federation;
(c) when an order of pengenyahan passed on to one person is disabled state;

Shall be kept express about details can express 7. (1) subject to section 12, the Registrar shall keep and maintain: (a) a register containing details can express relating to Peninsular Malaysia, Sabah and Sarawak in the capital city;

Refusal to sign the fingerprint form is an offence 8. (1) every person whose particulars can express about it taken in accordance with sections 5 and 6 shall sign the fingerprint form or if the person cannot sign he shall lose cap head jarinya in the form, and the form must be signed by an officer of response or confirmation record according to the requirements of the situation.
(2) every person who refused to order that such particulars can express about it or refuses to sign the fingerprint form or lose cap head jarinya in the form when the 7B. FM Page 11 Monday, March 27, 2006 12:23 PM 12 laws of Malaysia ACT 7 are required to do so by an officer recorded the legal or official confirmation shall be guilty of an offence and shall on conviction be liable to a fine not exceeding five hundred dollars or to imprisonment for a term not exceeding three months or to both.
(3) an official record or verification officer can in accordance with section 5 and 6 using violence as are necessary or reasonable.
The return of the fingerprint form upon release, etc.
9. (1) except as otherwise provided in subsection (2) and (3), the Registrar or the police officer, according to the needs of the circumstances shall be — (a) If a person released and discharged from an offence can register, forthwith submit fingerprints, pictures fotonya and negative picture of that photo to that person upon application; or (b) If a person is found guilty of an offence could express, without noting his conviction, submit fingerprints, pictures fotonya and negative picture of that photo to that person upon application, upon the expiry of the probation period or periods on bail so that behave well or any other period under any such other order made by the Court found the accused guilty of an offence can express (but mengecualikannya of an order conviction) unless the accused is again found guilty an offence can express during that period.
(2) if there are any application under subsection (1) is made within three months from the date of the release and p e l e p a s a n a t o r h a b i s n y a t e m p o h y a n g d i s e b u t d a l a m subsection (1) the Registrar shall destroy the fingerprint form , photographs and negatives of the photographs.
(3) where under paragraph (1) (b) the person is again found guilty of an offence can express within the period referred to in that paragraph, then the Registrar shall 7B. (4) subject to section 13, subsection (1) and (2) shall not apply to any person in exile, the disabled or people evicted.
Evidence of fingerprints and convictions formerly 10. (1) subject to subsection (2) every — (a) a fingerprint form if confirmed by reasonable verification officers;
(b) the certificate, document or extract (whether in relation to fingerprints or otherwise) which — (i) based on entries appropriately from the register; and (ii) certified by the Registrar as such appropriately; or (c) a certificate signed by the Registrar that — (i) a person's fingerprint has been compared to other fingerprints taken previously or subsequently; and (ii) the fingerprint has been compared the fingerprints of that person as well, shall be admissible in evidence in court and be sufficient evidence of the matters described therein unless the akasnya proved.
(2) where any declaration referred to in paragraph (1) (c) (i) tu is accepted as evidence in court, the Court or the accused can sue the Registrar as a witness and if the accused to do so he shall give notice to the Prosecutor not less than ten days prior to the commencement of the trial.

(1) a conviction which was formerly in a given country or in any part of a country (of which an order has been made under section 4) outside the Federation can be proved by the production of a declaration made by an officer in authority who certifies that the fingerprint an accused person has been compared to fingerprint any person convicted previously and that the fingerprint was fingerprints of that person as well.
(2) for the purposes of this section "officer in authority" means a person or authority as may be allowed by the Government of the country or the Government of any part of a country to store and maintain fingerprints and other details deemed details can check in accordance with section 4.
(3) any certificate issued by that authority shall, unless the contrary is proved, be evidence of the akasnya on all matters described therein including the signature and any officer that it's powerful.
Inspector General of police can exclude certain matters from the provisions of this Act 12. (1) the Chief of police may direct that any person other than a person in exile, displaced, disabled state or persons which — (a) convicted of an offence can express specified in the second schedule;
(b) the conviction has been imposed a punishment of a fine not exceeding one hundred dollars;
(c) on conviction not subject to a sentence of imprisonment for a period that is not a sentence of imprisonment for non-payment of the fine; and (d) were previously not registered under this Act or under any written law to the Peninsular Malaysia, Sabah or Sarawak deals 7B. FM Page 14 Monday, March 27, 2006 12:23 PM registration of Criminals and Unwanted People 15 registration of criminals before the commencement of this Act, are exempt from the provisions of this Act.

(2) the Registrar shall, upon the instructions given, store details can express about a person convicted is for one year from the date of conviction and shall, subject to subsection (3), destroy it immediately.
(3) the Chief of police may, pursuant to subsection (1), revoke the directive before the expiry of such period and with it the Registrar shall record the particulars can express about the convicted person pursuant to section 7 and inform the person of the cancellation.
(4) this section does not apply to subsection 9 (3).
(5) any person aggrieved by such revocation may appeal to the Minister within thirty days from the date notified about the revocation.
The Minister may order the removal of details of the person in exile, etc.
13. The Minister may, by order published in the Gazette order that eliminated details can express about any person removed State, disabled state or people limited (not convicted of an offence can express) upon the expiry of the order of deportation or the pengenyahan or the next or when the order of deportation, pengenyahan or the cancelled residential limited.
Regulations 14. The Minister may make regulations to give effect to the purposes and provisions of this Act.
The table and the form 15. (1) the Minister may by order published in the Gazette amend the first and second schedules.

Repeal and transitional 16. (1) the law specified in part I of the third schedule was repealed laws and law set out in part II of the third Schedule to the extent described it as amended is hereby amended accordingly.
(2) any revocation shall not interfere with the persistence standard, effective travel or any rules, regulations, orders, approvals, instructions, forms, records, check, fingerprints, photographs, certificates, documents or details of criminals, the exile, the State is disabled, expelled, limited or other person taken, recorded, used, entered, stored or maintained by or under any written law repealed before the commencement of this Act.
