BE IT enacted by the Seri Paduka Baginda Yang di-Pertuan Agong with the advice and consent of the Dewan Negara and Dewan Rakyat in Parliament assembled, and by the authority of the same, as follows: short title 1. This Act may be cited as ministerial functions Act 1969.
The function and the name of the post of Minister 2. (1) the Yang di-Pertuan Agong may by order in the Gazette to notify — (a) that a person has been given any function or has been charged with any responsibility of a Department or a particular thing or that something functions or responsibilities that have been transferred to the one other Minister;
(b) that a name designation was given to a Minister (with the exception of the Prime Minister) or that the name of the position was changed.
002b.fm Page 5 Monday, March 27, 2006 11:50 AM 6 laws of Malaysia ACT 2 (2) an order made by the Yang di-Pertuan Agong under this section — (a) could provide regarding the transfer of any property, rights or liabilities held, enjoyed or performed by any Minister in respect of any function conferred or transferred it; and (b) may contain such other provisions as may be necessary and expedient to give effect to the order.
The evil of the transfer function and name change to position 3. If an order is made by the Yang di-Pertuan Agong under section 2 something into, or made before the order comes into operation by or under the authority of the Minister of the functions and responsibilities have been transferred or the name of his Office that changed can be continued or completed by the Minister.
References in law 4. Any reference in any law or any instrument, contract or proceeding at law against a person the Minister by name his post unless the contents of the lines requires another meaning shall be construed as a reference to the Minister for the time being given functions or charged with that responsibility or to the Minister for the time being given the name of the post.
Repeal and saving 5. Ordinance (Transfer Function) Federal Government Ministers 1951 [No. 15 1951] are hereby repealed: provided that orders made under the Ordinance i tu or any laws re th l i s l a in relation to the transfer of the functions of a Minister or a public officer in force immediately before the Act was first 002b.fm Page 6 Monday, March 27 , 2006 11:50 AM ministerial functions 7 in force shall be deemed to have been made under this Act and shall remain in force, and may be amended or revoked accordingly.
