Law No. 2001-007 authorizing the ratification of the Development Credit Agreement of 22 May 2001 between the Republic of Madagascar and the International Development Association on the financing of the Community Development Project - CDP (Credit No. 3498- MAG).
EXPLANATORY MEMORANDUM According to the Credit Agreement (Credit No. 3498-MAG) dated 22 May 2001, the Republic of Madagascar has contracted with the International Development Association, a credit for EIGHTY FIVE MILLION TWO HUNDRED THOUSAND SPECIAL DRAWING RIGHTS (SDR 85.2 million).
This appropriation is intended to finance the Community Development Project.
I - PROJECT DESCRIPTION:
The project is administered by the Fund Intervention for Development (FID) in agreement with the International Development Association (IDA) and the Government.
It includes three main components: Component
"COMMUNITY PROJECTS" Project D evelopment - Community finance priority projects included in the Municipal Development Plan through associations of beneficiaries.
Eligible projects include social and economic infrastructure and extend over the whole territory.
Component "DIRECT FUNDING OF COMMONS ': the project - Community Development transfers money directly to municipalities to enable them to r o achieve projects and priorities of their Municipal Development Plan. This component is an exp erience driver, but the common interests of the six autonomous provinces of Madagascar.
Component "CAPACITY": it aims to improve - service quality of the Development Intervention Fund partners, namely: i) common, ii) associations ENEFICIARIES b, iii) provider organizations services that small businesses and increase their ability to respond.
The Project closing date is June 30, 2007. II - ADDITIONAL LOAN FINANCIAL CONDITIONS:
Price: EIGHTY FIVE MILLION TWO HUNDRED THOUSAND - SPECIAL DRAWING RIGHTS (SDR 85.2 million);
Total time: 40 years including 10 years grace -
Repayment of principal: in semiannual installments payable on 01 May - and November 1 of each year from 01 May 2011. The final maturity
is payable on November 1, 2040.
each installment to the November 1, 2020 included, is equal to one percent (1%) of such principal and each installment thereafter shall be two percent (2%) of the main.
Commitment (due on the principal of non withdrawn cr ed edict) rate - annual one half of one percent (1/2 of 01%) per year, e payabl May 1 and November 1 each year;
Commission services: the rate of three-quarter of one percent (3/4 - 1%) on the principal of the Credit withdrawn and outstanding from the 01mai payable semi-annually and November 1 of each year.
Under Article 82 3, paragraph VIII of the Constitution: "The ratification or approval ..., treaties or agreements ..., involving the finances of the state ... must be authorized by the law ".
This is the purpose of this Act.

The National Assembly and the S Enat adopted in their respective session dated 03 July 2001 and 23 July 2001, the Act which reads as follows:
ARTICLE I: Is authorized the ratification of the Agreement Development Credit concluded May 22, 2001 between the Republic of Madagascar and the International Development Association on the financing of the Community Development Project - CDP (Credit No. 3498 - MAG), amounting to 85.2 million SDR ( EIGHTY FIVE MILLION TWO HUNDRED THOUSAND SPECIAL DRAWING RIGHTS).
ARTICLE 2: This law will be published in the Official Gazette of the Republic. It shall be enforced as State law.
