No 13, 25) rules for foreign electrical and electronic equipment manufacturer registration procedures and obligations Issued under the waste management Act, the fourth subparagraph of article 20.2 1. Rules provide foreign electrical and electronic equipment manufacturer registration procedures and obligations in relation to the provision of information on the Latvian market of electrical and electronic equipment quantity and categories, as well as collected, reused, recycled, recovered and exported waste electrical and electronic equipment in quantity and categories. 2. the rules apply to foreign producers of electrical and electronic equipment (hereinafter referred to as the foreign manufacturer), carrying out the waste management law transactions with a category 5 electrical and electronic equipment (lighting equipment) according to the legislation on electrical and electronic equipment categories. 3. the register of foreign manufacturers of electrical and electronic equipment manufacturer in the register (hereinafter register) according to the legislation on electrical and electronic equipment producer registration order. 4. To register a foreign manufacturer, the company is registered in the register of waste electrical and electronic equipment of the establishment's niekotāj, which entered into a contract with the Ministry of environment on waste electrical and electronic equipment management system application and provide the waste electrical and electronic equipment making, according to the law on waste management (hereinafter referred to as the operator) shall submit an application in the register, if the foreign manufacturer shall meet the following requirements: 4.1 foreign manufacturer of electrical and electronic equipment are imported and sold electrical and electronic equipment distributors or end users in the territory of the Republic of Latvia;
4.2. the foreign manufacturer has entered into with the operator of a contract for a foreign manufacturer and the Latvian market of electrical and electronic equipment waste management;
4.3. the manufacturer of the foreign operator has issued a notarized a speciālpilnvar to act on behalf of the foreign manufacturer to meet all these rules laid down by the foreign manufacturer. 5. The rules referred to in paragraph 4, the application fills in the appropriate legislation on electrical and electronic equipment manufacturers. In addition, the following information and documents: 5.1 information on foreign manufacturers (firm registration number, the register in which the foreign producer is recorded, legal address);
5.2. the mandate of the applicant for registration, if the application for registration is submitted by a person who is not entitled to represent the economic operator;
5.3. the provisions referred to in point 4.3 of the powers;
5.4. electrical and electronic equipment manufacturer with a list of foreign producers of electrical and electronic equipment waste management operations referred to in the Act (specify the merchant company, registration number in the register of companies, legal address);
5.5. the operator of a signed proof of that: 5.5.1 the foreign manufacturer has entered into with the operator of such provisions of the agreement referred to in point 4.2;
5.5.2. the application and attached documents to the specified information is complete and true and all documents submitted to the derivatives of the original document. 6. The operator according to the regulations for electrical installations and to Alec ronisk waste management shall be submitted for inclusion in the register necessary information on foreign manufacturers offered the Latvian market of electrical and electronic equipment (weight and number) and category, as well as information about collected, reused, recycled, recovered and exported waste electrical and electronic equipment (weight and number) and category. 7. register of information submitted For accuracy and truthfulness is responsible niekotāj to the establishment. 8. The operator shall, within 14 days, notify the registry of any changes in the news contained in the register by submitting a respective application. The registry holder provides the information contained in the registry for the updating of the five working days after the receipt of the notification. Register holder is entitled to update the information included in the register on the basis of publicly available from other national information systems of the information received. 9. the holder of the register within three working days after the receipt of the application, the operator exclude foreign manufacturers from the registry and sends the information to the operator about it and foreign producer. 10. the register of foreign manufacturer shall include the following information: 10.1 foreign producer firm, registration number in the national register of companies and the legal address;
10.2. foreign manufacturers on the market of electrical and electronic equipment, Kate, the crews and the numbers according to the legislation on electrical and electronic equipment;
10.3. the foreign manufacturer of the Latvian market of electrical and electronic equipment the quantity (weight or number);
10.4. the collected, reused, recycled, recovered and exported for processing outside Latvia, the foreign manufacturer of electrical and electronic equipment waste (weight or number) and categories according to the legislation on waste electrical and electronic equipment management;
10.5. the operator's company and registration number;
10.6. the electrical and electronic equipment manufacturer and distributor company and registration number, with which the foreign producer has entered into contracts for electrical and electronic equipment on the market (this information indicates the manufacturer and dealer affiliates). 11. This provision 10.1, 10.2 and 10.5. below information referred to in paragraph 1 is in general available (URwww.elektroregistrs.lv). This provision 10.3, 10.4 and 10.6. information referred to in paragraph (a) is deemed to be a public, if the operator has given written consent to its publication. The information contained in the registry for individuals, State and local authorities are provided free of charge. 12. foreign manufacturer that entered into with the operator of such provisions referred to in paragraph 4.2 below, the agreement has the following responsibilities: to ensure timely 12.1 operators with all the necessary information to the operator could adequately perform the obligations laid down in these provisions. A procedure for the provision of information and responsibilities, the Parties shall determine in the contract;
12.2. the operator shall submit an overview of the Latvian market of electrical and electronic equipment (weight and number) and categories (hereinafter report). The report has examined and issued an opinion that the person in the Member State concerned accepted the statutory audit of accounting documents. 13. the rules shall enter into force on 1 April 2009.
