Cabinet of Ministers Regulations No. 481 Riga, 26 May 2009 (pr. No 33 41) amendments to the Cabinet of Ministers of 2 May 2007 the Regulation No 296 "rules on industrial fishing in the territorial waters and economic zone waters" issued under the Fisheries Act, in article 13, first paragraph, point 1 make the Cabinet on May 2, 2007. of Regulation No 296 "rules on industrial fishing in the territorial waters and economic zone waters" (Latvian journal, 2007, 72 no; 2008, nr. 49) the following amendments : 1. Replace the text, the words "fisheries management" (fold) with the words "Fisheries Agency" (fold).
2. Make a point 2 as follows: "2. The Republic of Latvia's territorial waters to fishing for the provision of effective management within the meaning of this provision is a specific part of the waters-coastal-whose depth does not exceed 20 metres, except in shallow areas that are further away than 20 meters izobāt."
3. Add to paragraph 3 after the words "provide for coastal fishing" with the words "unless the water depth does not exceed 20 metres".
4. Express 4.2. the first sentence by the following: "fishing vessels of overall length is 10 m or more, the species fished in the Baltic Sea or the waters of the Gulf of Riga is received additional authorization (permission), which, on the basis of the fishing rights leases in the annual fishing limits laid down by the Protocol and for fishing vessels, approved by the State Agency" Latvian fish resource agency "(hereinafter referred to as the Latvian fish resource agency)."
5. Add to subparagraph 5.1 after the words "the competent institution" with the words "by flying the flag ship".
6. Express 6.1. subparagraph by the following: "in accordance with the established 6.1 fishing limits, which granted each year by the Latvian Agency of fish resources or the relevant local government, taking into account the fishing quotas allocated to Latvia, as well as fishing limits established in coastal waters in accordance with the laws and regulations of the limit on the number of fishing gear or catch limits, and limit the use of these procedures."
7. Make 7. the introductory paragraph by the following: "7. Republic of Latvia's territorial waters and economic zone waters for specific purposes and scientific research purposes may fish on the basis of the fishery law, harmonizing fisheries programs or projects and subject to the following conditions:".
8. Express 7.2. subparagraph by the following: "7. fisheries programmes or projects for which such fishing may allow exceptions to fishing gear and the use of a minimum length of fish, fish catches, the fishing ban time and place;".
9. Express 8.10. subparagraph by the following: "to report to the Latvian Fish 8.10. Resource Agency for highlighted or rare species of fish and birds, and marine mammals (such as harbour porpoises, seals) catching and make the corresponding entries in the log;".
10. Replace the words "paragraph 8.18 port according to the laws of the European Union demands" with the words "fish landing sites".
11. To supplement the provisions of the following paragraph 8.23. with bottom: 8.23. land the "species of fish or the fish catch only the following ports: 8.23.1. Baltic Sea cod caught when their weight is 750 kg on board and more – Pāvilosta, Liepaja and Ventspils port;
8.23.2. In the Baltic Sea and the Gulf of Riga caught sprat and herring unsorted mixed catch, which allowed tolerance in the logbook is not possible to define separate species of fish size, Pāvilosta, Riga – Liepāja and Ventspils port;
8.23.3. the European Community waters outside the Baltic Sea sprat caught, herring and other species of fish in the catch of unsorted mixed – Riga, Liepaja and Ventspils port. This port is also used outside the Baltic Sea for the ocean species of fish (including Greenland halibut, redfish and demersal species) unloading and any unloading of fishing products from third-country ships. "
12. Express section 16.6.1. by the following: "the river Lielupe, the Gauja 16.6.1. and Salatsi River area 3000 meter radius of the mouth;".
13. Make the following introductory paragraph 27:27. Latvian fishery resources, the Agency, pursuant to the laws and requirements in the field of fisheries, as well as on the basis of the scientific advice of the institutions which study the fish resources, and coordination with the Ministry of agriculture and Ministry of environment: ".
14. Express 27.1.4.2. and 27.1.4.3. subparagraph by the following: "on the 27.1.4.2. or rebuilt vessels may not be eligible for a Council of 27 July 2006, Regulation (EC) no 1198/2006 on the European Fisheries Fund specific measures, if a replacement of the vessel or vessels in the list exceeds the tonnage of a vessel in a rebuilt from a fishing vessel to list deleted ship (ship) tonnage by more than 25%;
27.1.4.3. the replacement or rebuilt vessels shall not be eligible for the support of the Council of 27 July 2006, Regulation (EC) no 1198/2006 on the European Fisheries Fund specific measures, if a replacement of the engine power of a vessel or vessels the ship in the list change in engine power exceeding from the fishing vessel list vessel or rebuilt replacements (ship) or the previous engine power of the vessel in the list change in engine power more than about 25%; ".
15. Express section 27.2.2. by the following: "27.2.2. subject to the quotas allocated to Latvia, define the limits of the fishery and to recommend the fish by Exchange of other countries around the Baltic Sea, as well as to define the allowable number of fishing vessels and type (a list of fishing vessels) fishing in the Baltic Sea and the Gulf of Riga, to grant Latvian waters fishermen fishing fishing limits beyond the coastal waters;".
16. To supplement the provisions of the following paragraph 33: "33. Ministry of agriculture national fisheries regulatory approval for the acquisition of vessels (shipbuilding, conversion), the fishing vessel engine replacement with or without the increase in tonnage or engine power increase or not issued until 31 December 2008 in accordance with this provision, is a gas. one year since receiving it under the fisheries administration or extension of approval period set in."
