Cabinet of Ministers Regulations No. 415 in Riga 5 May 2010 (pr. 22. § 16) rules on Civil Aviation Security quality control programmes Issued in accordance with the law "on the air" in article 57, the fourth part 1. determines the Civil Aviation Security quality control programme of the European Parliament and of the Council of 11 March 2008, Regulation (EC) no 300/2008 on common rules in the field of civil aviation security and repealing Regulation (EC) No 2320/2002 (hereinafter Regulation No 300/2008) within the meaning of article 11.
2. the terms used in these provisions in Regulation No 300/2008. used terms.
3. the rules apply to persons and objects, referred to in Regulation No 300/2008 of the article 2 (1).
4. European Union law and national legislation for the national civil aviation security quality control programme for the implementation of the monitoring measures laid down in the field of civil aviation security (compliance monitoring) provides the national agency of Civil Aviation Agency "(hereinafter referred to as the Civil Aviation Agency).
5. Civil Aviation Agency approved by the persons entitled to carry out compliance monitoring (hereinafter referred to as the Auditors), fixing them with the requisite qualifications and duties, if they be: 5.1 of Regulation No 300/2008 annex II, paragraph 15 of these requirements.
5.2. category have received special permission for access to State secrets or have an appropriate certificate issued by the European Union for access to classified information.
6. Civil Aviation Agency inspectors, complying with the rules referred to in paragraph 5, are to be considered as auditors.
7. A separate compliance monitoring activities for the Civil Aviation Agency may call upon the countries of the European economic area, the relevant authorities of the auditors who issued this rule 5.2. the certificate referred to in point.
8. Compliance monitoring within the Agency for Civil aviation experts may invite the national civil aviation security programme referred to representatives of public authorities, which conform to the provisions referred to in paragraph 5.
9. If the compliance monitoring within the Civil Aviation Agency has recruited these rules 7 and 8 of the persons referred to in the paragraph, it shall issue the persons concerned the power to certify that a person performing a security audit, inspection or test of the Civil Aviation Agency.
10. Civil Aviation Agency take the airport operator and the holder of the right (hereinafter Aviation Organization) compliance monitoring, checking and evaluating: 10.1. security structure of the Organization;
10.2. the obligations of the persons responsible, right and responsibility for civil aviation security measures implementation and maintenance;
10.3. the ability to monitor safety procedures implemented;
10.4. the staff involved in the implementation of the measures of adequacy, the relevance of the qualifications of its tasks and personnel training process;
10.5. the use of security equipment, systems and infrastructure the adequacy and compliance with Regulation No 300/2008 of the requirements referred to in annex I.
11. Civil Aviation Agency each year up to December 30, prepare compliance monitoring plan for next year. The plan indicates: 11.1. planned security audit, inspection or test number and date;
11.2. Aviation Organization that planned to implement this provision referred to in 11.1. compliance monitoring activities;
11.3. the required number of Auditors this provision in paragraph 11.1, pursuant to those measures;
11.4. security audit and inspection tested security measures.
12. in addition to the provisions referred to in 11.1. compliance monitoring activities, the Civil Aviation Agency, taking into account safety risk assessment can take unscheduled security audits, inspections or tests.
13. Civil Aviation Agency can make planned Aviation Organisation security audit, inspection or tests if: 13.1. security during the test found that aviation security measures are not in accordance with the Civil Aviation Agency approved aviation security requirements;
13.2. received information to the effect that the organisation of aviation security measures are not in accordance with the Civil Aviation Agency approved security program requirements;
13.3. received information about an increased danger of civil aviation security, which is evaluating the adoption of the decision on the need to change the procedures of security measures;
13.4. incident linked to illegal activity or its rehearsal and affect or may affect the security of civil aviation.
14. Civil Aviation Agency each year up to January 15, inform the Aviation Organization of the calendar year of the planned security audit, indicating the dates with them.
15. Civil Aviation Agency does not inform the Aviation Organization of planned inspections or tests, except in the case referred to in Regulation No 300/2008 annex II, point 7.3.
16. Aviation Organization 10 days after notification of the planned security audit you can inform in writing the Civil Aviation Agency about the need to fix other security audit dates substantiated.
17. Civil Aviation Agency in accordance with Regulation No 300/2008 annex II, paragraph 6 of the said requirements: 17.1. operator airports and air navigation service provider scheduled security audits at least every 24 months;
17.2. other aviation organizations planned a security audit at least once every five years.
18. Civil Aviation Agency not later than 20 working days prior to the commencement of audit of Security Aviation Organization pirmsaudit sent a questionnaire.
19. the aviation organizations of safety responsible person fills in a questionnaire and pirmsaudit not later than five working days before the first day of the security audit submitted to the Civil Aviation Agency.
20. Civil Aviation Agency in accordance with Regulation No 300/2008 annex II, point 7 of these requirements not less than once in every 12-month period, carry out scheduled inspections of aviation organizations.
21. Civil Aviation Agency in accordance with Regulation No 300/2008 annex II, point 8 of these requirements at intervals not exceeding 12 months planned tests to verify no 300/2008 of the regulation laid down in annex I, the effectiveness of the security measures.
22. Civil Aviation Agency if necessary for reasons of security, of safety tests in due time inform the national civil aviation security programme in that country.
23. The national legislation of the national civil aviation security program that State institutions can perform aviation security test if the test plan is consistent with the Civil Aviation Agency. The authorities referred to in this paragraph, the security test may appoint persons who are not approved for Auditors, but conforming to the rules in paragraph 5.
24. The provisions referred to in paragraph 23 of the test plan for the Civil Aviation Agency submitted not later 10 working days before the scheduled test date. Test plan indicate the following: 24.1. the purpose of the test;
24.2. the test date and time;
24.3. the Aviation Organization name that will take the test (specify units, which will check);
15.2. Description of the action to be taken during the test;
15.2. the name, surname and title, which will participate in the test and during the test, a description of the tasks to be performed;
24.6. during the test, the subject and the material to be used;
24.7. other information that the preparer of the test plan is considered important.
25. Aviation organizations are obliged to provide the Auditors with all the necessary information and documentation, access to the Organization's infrastructure, facilities and security systems, as well as the availability of staff.
26. the Auditor security audit, inspection or test fills the Protocol in accordance with Regulation No 300/2008 annex II, paragraph 10.2., and in paragraph 11. The minutes shall be signed by the auditor and aviation organizations about the safety of the person in charge.
27. If the aviation security test is carried out in this rule referred to in paragraph 23, the working days during the complete protocol 26. these provisions in accordance with the procedure laid down in paragraph 1 and a copy of the minutes submitted to the Civil Aviation Agency.
28. If the security audit, inspection or test of that discrepancy prevention requires immediate action, the auditor is entitled to give orders to the Aviation Organization will immediately remove the detected non-compliance or take compensating measures immediately, which is a temporary action and guarantee the security of civil aviation until the full non-compliance found.
29. An Auditor who used the rule in paragraph 28 of the said rights shall immediately inform the Director of the Civil Aviation Agency.
30. Civil Aviation Agency within 10 working days of the security audit, inspection or test report according to Regulation No 300/2008 annex II, paragraphs 10 and 11 of these requirements and shall send it to the Aviation Organization, which has carried out a security audit, inspection or test. The report shall be signed by the Director of Civil Aviation or its authorized person.

31. the Civil Aviation Agency that the procedure laid down in article 30, shall draw up a report and send it to the relevant Aviation Organization, if this provision in the Protocol referred to in paragraph 27 contains the discrepancies found during the test.
32. Aviation Organisation 20 working days or 30 of these regulations referred to in paragraph 31 of the report, if it contains discrepancies, submit to the Civil Aviation Agency resolve plan. Non-compliance with the prevention plan indicate the corrective measures in the security audit, inspection or test the resolve and their deadlines.
33. If compliance with the prevention plan specified in the corrective measures or the deadlines do not ensure compliance with Regulation No 300/2008, the Civil Aviation Agency within five working days after non-compliance with the prevention plan shall inform the applicant of the need to make changes to resolve plan.
34. Civil Aviation Agency checks the aviation organizations resolve the deadlines for implementing the plan, as well as carrying out the inspection in accordance with Regulation No 300/2008 annex II, point 9.
35. Civil Aviation Agency opinion to the Aviation Organization, if all the required corrective measures are met in non-compliance with the time limits laid down in the plan of prevention.
36. the Aviation Organisation can extend the resolve of the deadline laid down in the plan, in coordination with the Civil Aviation Agency.
