Cabinet of Ministers Regulations No. 866 Riga 2010 September (14. No 47 34 §) rules on "operational programme infrastructure and services" Appendix 3.2.1.5. activity "public transport outside of Riga" issued under the European Union's structural and cohesion funds act 18 paragraph 10 of article i. General questions 1. determines: 1.1. procedures for implementing the action programme ' infrastructure and services ' Appendix 3.2. Priority Areas and the availability of "reach" UR3.2.1.pas "contributes to accessibility and transport systems development" activity "public 3.2.1.5. transport outside Riga" (hereinafter referred to as the activity);
1.2 project submission evaluation criteria;
1.3. the requirements of the project the applicant (hereinafter referred to as project applicant);
1.4. the responsible authority.
2. The purpose of the activity is to promote the development of public transport outside Riga as an alternative to private car use.
3. the activity exercised limited project application selection.
4. within the framework of the project the applicant activity is national and local corporations, providing public transport services.
5. the project will be implemented up to august 31, 2015. This period must be completed for all project activities and for all payments made within the project.
II. Activity and one project available for the European Regional Development Fund funding and permitted aid rate. activities implemented in the framework of 6 projects co-financed by the European regional development fund. Activity within the available public funds are the European regional development fund funds 14 056 080 lats. Private funding within the framework of the activity of not less than 2 480 485 lats.
7. Private funding by project. The project funding of the applicant not less than 15 percent of the project's total eligible costs.
8. maximum European regional development fund co-financing amount per project from the project total eligible costs are 7 028 040 dollars. European regional development fund shall not exceed 85 percent of the project's total eligible costs.
III. The responsible authority 9. functions performed by the responsible authority of the Ministry of transportation. Responsible authority: 9.1 implement its functions and competence ensure appropriate, not to be exceeded this rule 6, paragraph activities available for the implementation of the European regional development fund;
9.2. provide activities and project monitoring and control, including the Council of 11 July 2006, Regulation (EC) No 1083/2006 laying down general provisions on the European regional development fund, the European Social Fund and the Cohesion Fund and repealing Regulation (EC) No 1260/1999, article 93 1 and 2 of the principle referred to in the performance of the activities and project level, controlling the project financing plan.

11. the eligible costs of the project are: 11.1. building project development costs;
11.2. the cost-benefit analysis development costs;

11.5. the underground communications rebuilding costs no more than five percent of the project total eligible costs if they are directly linked to the implementation of the project and the construction process in the public service for the provision of the necessary infrastructure at risk of deterioration: 11.5.1. public service infrastructure (water, sewage, heating) rebuilding costs;
11.5.2. gas, electricity and telephony communications infrastructure rebuilding costs, not changing their specifications;
11.6. building costs;
7.3. the costs of autoruzraudzīb;
11.8. the rolling stock acquisition costs;
7.4. the rolling stock reconstruction costs;
11.10. environmental compliance costs;
11.11. with fire safety and other requirements of the security-related costs;
11.12. publicity activities, in so far as it provides for the European Union structural funds and the cohesion fund management regulatory laws, not more than 0.1% of the project total eligible costs;
11.13. the value added tax, which is directly related to the project, if a project applicant cannot recover it according to the laws and tax policy;
11.14. land acquisition costs up to 10 percent of the project total eligible costs if they are necessary for the implementation of the project;
11.15. expenditure for contingencies this provision, 11.5, 11.8 11.4 and 11.9. referred to cover not more than five percent of the eligible costs of the project, not including these provisions in 11.13 and 11.12 11.15., referred to.
12. This rule 11.1, 11.2, 11.6 and 11.7. the costs referred to in subparagraph apply no more than 10 percent of the project's total eligible costs.
13. not eligible costs of the project are: 13.1. costs incurred prior to the entry into force of these rules, except that rule 11.1. costs referred to in (a);
13.2. costs not justified by relevant source documents;
13.3. the underground communications conversion costs if their crew capacity by transfer or conversion is increased;
13.4. in paragraph 11 of these rules, the costs, if they occur, making the relationship work.
14. the project cost does not include administrative costs of the project.
15. the project can include only 11 and 13 of these regulations, paragraph.
16. in the implementation of Projects not eligible costs incurred or costs in excess of the contract for the implementation of a project for the attributable costs, shall be borne by the beneficiaries of their own funds in accordance with the agreement on the implementation of the project.
V. project application form and annexes 17. submission of project financial calculation in LCY.
18. the project applicant project application shall be accompanied by the original of the accompanying document or law in the order certified copies.
19. the project application shall be accompanied by the following supporting documents:

19.1. the decision of the Board of Directors of the Corporation, the Corporation is prepared to implement the project. Draft decision the applicant shall indicate the amount of private financing, which it will invest in project implementation;
19.2. a copy of the contract for the provision of public transport services in the municipality;
19.3. a certificate attesting that the applicant has not been declared bankrupt, is being wound up and the economic activity it is not paused or stopped, and it is not in any analogous situation similar to procedure defined by the law of the Republic of Latvia;
19.4. such specialist dzīvesgait descriptions (curriculum vitae): 19.4.1. civil engineer with at least three years of experience in the construction of transport infrastructure;
19.4.2. Project Manager with at least three years of experience in the management of transport infrastructure projects;
19.4.3. accountant financiers with at least three years experience in financial accounting;
19.5. the projects in accordance with the laws and regulations on environmental impact assessment is not necessary for environmental impact assessment, add one of the following documents: 19.5.1. regional environmental management issued a copy of the technical regulation;
19.5.2. regional environmental management issued a copy of the certificate that the technical provisions are not required;
12.2. the local government issued assurances that the project planned activities comply with the municipal territory planning (if the project is a tram line reconstruction and construction);
19.7. the cost-benefit analysis a copy of the calculation. Applicant project analyzes the costs and benefits and the European regional development fund contribution calculations pursuant to annex 1 of these rules. 12.4. documents certifying the degree of readiness of the project (if the project is a tram line reconstruction and construction): planning and architectural 19.9.1. copy of a task, if not designed for construction;

19.9.3. a copy of the construction according to the construction of laws and regulatory requirements (construction of coherent and accepted būvvald);
19.10. signing of formal rights of the person who signed the application for the project;
19.11. real estate in which to make investments, ownership or possession of the documents or a statement by the applicant that the investment made by the owner of the property will be closed or agreed under article 3 of the law on construction;
19.12. If the project is intended for the provision referred to in paragraph 11.5.1. investments: 19.12.1. certified civil engineer examination of the opinion, which found that the project planned investments in certain areas, it is not possible to avoid this provision 11.5.1. infrastructure referred to transmission or damage;
19.12.2. a copy of the contract for the public service that meets the business supports the control law 21.1 the requirements set out in article;
19.13. 21.3. the duration of the contract;
21.4. the provision of public transport services;
13.4. public transport service provider assigned exclusive or special rights;
21.6. opportunities to receive compensation (compensation) payments, investment in public services, infrastructure and conditions of remuneration (compensation) payment calculation, control and review, as well as compensation (compensation) payment and repayment of the overpayment.
Vi. application and submission of the draft selection 22. Responsible Authority application round project is implemented on all activity in the funding available.
23. If the project application selection round all available funds are not learned, the responsible authority may organise a second round of project submissions for the remainder of the funding.
24. Each project within the framework of the activity, the applicant may submit only one project submission. Project applicants who do not submit the project application to the responsible authorities within the time specified in the invitation, or which project application in the previous round rejected, the competent authority may invite to participate in the next round of project submissions.

25. the responsible authority shall, not later than three months after the entry into force of these rules, send a letter to invite the applicant to submit these draft regulations under the draft submission.
26. the applicant shall submit a project application to the responsible body within a time limit which it shall specify, for not less than 30 days from the date of dispatch of the invitation.

29. the project submission in paper form shall be submitted in triplicate (one original and one copy).

VIII. Decision-making and reporting results of responsible authority 37. project application is approved if it meets all the rules referred to in annex 2 of the assessment criteria.

39. the responsible authority shall reject the application for the project if it does not match any of the rules referred to in annex 2 of the evaluation criteria, which do not allow for the approval of the application, the project on condition.
40. Where the application does not comply with any of the rules referred to in annex 2 of the evaluation criteria, which do not allow the application to the approval of the project, the responsible authority for the project assessment of the application terminated.
41. the decision on the approval of the project application, approval or rejection provided the determining authority within five working days after the decision has been forwarded to the project applicant.
42. the decision on the application for the approval of the project provided the conditions contained in the project applicant 15 working days of notification of the decision.
43. Within five working days after the conditions for receipt of the supporting documents, the Commission shall evaluate compliance with the conditions contained in the decision and the responsible authority shall draw up the opinion.
44. Where the applicant has complied with the decision on the application for the approval of the project provided the conditions contained in the project application is considered and approved by the responsible authority within five working days after that rule 43. the expiry of the period referred to in paragraph 1 shall send to the applicant, project a positive opinion on the conditions contained in the decision.
45. IX. conditions for the implementation of the project. the project applicant, 47 submitted to and implementation of the project, the partnership is not.

49. The beneficiary in accordance with the signed agreement for the implementation of a project to the responsible authority provides full information about the implementation of the project (including project progress reports and yearly – project implementation reports (pēcprojekt reports)).
50. The beneficiary in its homepage on the internet (if available) is placed up to date information on the progress of the implementation of the project, if the project's total cost exceeds 350 000 lats.
51. following the agreement on the conclusion of the project the responsible authority, if it is available in the State budget, provides funding for the requested advance payment according to the regulations on the procedures foreseen in the State budget to fund the European Union co-financed the project implementation, as well as make payments and preparation of declarations of expenditure.
52. If the project is a violation of the regulations on control of business support, the responsible authority shall assess the violations and decide on project funding granted to the reduction in proportion to the seriousness of the infringement.
53. the provisions of this decision referred to in paragraph 52, the responsible authority shall notify the beneficiary within five working days after the decision.
54. the responsible authority five years after completion of the project, but no later than the operational programme ' infrastructure and services ' closing provides the revenue generated by the project, including the withholding of revenue recovery or that were not taken into account in the calculation of project available in the European regional development fund.
