2. To supplement the provisions under point 4.3 as follows: "4.3. legal person dairy sector, if at least 51 percent of its shares, the shares or of shares belongs to one or more eligible cooperatives, but the other part of the shares or shares owned by one or more persons engaged in milk production, or one or more of the cooperatives, which combines dairy producers, and if part of the shares of the owners of the shares or the total supply within the quota amount disposed of the last of the milk quota year concluded there are at least 70 000 tonnes (by setting the the amount of milk cooperatives, is taken into account in the delivery of their members within the quota amount disposed of milk) (hereinafter referred to as new milk processing company). "

4. Express 10.3 and 10.4. subparagraph by the following: "certifying the company's 10.3. economic viability in the years after the project implementation (meet all of the provisions referred to in 10.2);
10.4. establishing new refineries or new dairy economic viability – just a year after the project implementation (according to the rules referred to in point 10.2 indicators). "
5. To supplement the provisions under paragraph 12.1, as follows: "12.1 the new milk processing companies that enroll in the European economic recovery plan under the public funding for the restructuring of the milk sector and which projects the expected final product is mentioned in the Treaty on the functioning of the European Union annex I, the amount of the aid determined in accordance with the company's category: 12.1 1. micro, small and medium-sized companies category is determined in accordance with the Commission's august 6, 2008, Regulation (EC) No 800/2008 to admit certain categories of aid compatible with the common market in application of articles 87 and 88. 18. Delete paragraphs 21, 22 and V.
