Cabinet of Ministers Regulations No. 1159, Riga, 21 December 2010 (pr. No 74 25) procedure for granting and payment of the retirement pension in the corruption prevention and combating Bureau officials Issued under the corruption prevention and combating Bureau officers retirement pension Act article 8 sixth 1. defines the procedure for the grant and payment of the retirement pension in the corruption prevention and combating Bureau (hereinafter the Office) officials, who under the law are entitled to a retirement pension.
2. to receive a retirement pension, retirement pension claimant in any State social insurance agency (hereinafter Agency) the chapter shall submit a request for retirement pension and then add: 2.1. documents certifying the retirement seniority, which give entitlement to a retirement pension;
2.2. a statement of the applicant's retirement pension the retirement period worked in the Office that gives the right to retirement pension (annex 1);
2.3. certificate of retirement pension applicant's dismissal and pay Office (annex 2);
2.4. the payroll tax.
3. If the applicant is not the retirement pension shall submit the rule 2.2. and 2.3. documents referred to the Agency's request, the necessary information from the Office.
4. the Office within 10 working days of the receipt of the request for information is prepared and forwarded to the Agency: 4.1. certificate of retirement pension claimants the periods worked in the retirement Office, which gives entitlement to a retirement pension (annex 1);
4.2. certificate of retirement pension applicant's dismissal and pay Office (annex 2).
5. If the applicant for the retirement pension application for retirement pension is not added to the documents, which according to the corruption prevention and combating Bureau officers retirement pension Act article 3 2, 3, 4 and 6 point confirm the days and years of service, the Agency required information from the relevant authorities.
6. the total retirement pensions retirement seniority of a claimant shall be expressed in years, months and days. If the applicant's retirement pension in favour of the retirement seniority periods overlap the retirement seniority only one period in which retirement pensions more favourable to the applicant.
7. in determining the right to a retirement pension, retirement seniority taken into account the number of complete years, not counting the months and days. Determining pay, from which a retirement pension, take into account the years, months and days.
8. the decision on the grant of a retirement pension or a refusal to grant a retirement pension unless the corruption prevention and combating Bureau officers retirement pension Act and these rules, the above requirements, the Agency shall adopt and notify the retirement pension of the administrative procedure the applicant within the time limit set by law and order.
9. retirement pensions retirement pension granted to the recipient, the Agency shall check the payroll tax.
10. The Agency retirement pensions retirement pension payable to a beneficiary could apply to the law "on personal income tax" in certain individual income tax relief, supplementary retirement pension beneficiary submit agency payroll tax, which the record for individual income tax additional relief.
11. the Agency's retirement pension is paid each month from the fifth to the twenty-fourth. Retirement pension after retirement pension beneficiary's demand to credit institutions of the Republic of Latvia or mail account or payment systems delivers the retirement pension beneficiary's residence for a fee, deducted from its delivery to the retirement pension expenditure under the national budget in the annual statutory fee for pension, benefit or compensation delivery.
12. beneficiaries of the retirement pension to which the amount of the retirement pension shall be reduced by the amount of the retirement pension granted, the difference between the amount of the retirement pension and old-age pension paid at the old-age pension.
13. Delivery of part of the retirement pension and old-age pension the retirement pension beneficiary's residence, the pension Agency's delivery charges deducted from the pension recipient's payment as payment for one delivery.
14. The retirement pension paid off by next month, when the Agency has become aware of information on corruption prevention and combating Bureau officers retirement pension law in the second paragraph of article 2 of the cases referred to.
15. Retirement Pension cost of the corruption prevention and combating Bureau officers retirement pension Act article 9, second paragraph the cases end with the day when this occurred.
16. If the payment of the retirement pension corruption prevention and combating Bureau officers retirement pension Act, article 9, paragraph 1, second subparagraph in case discontinued, it based on the retirement pension beneficiary application for renewal, the retirement pension shall be restored by day, when the emerging right to the payment of the pension.
17. If the payment of the retirement pension stopped corruption prevention and combating Bureau officers retirement pension Act article 9 paragraph 2, second subparagraph in case the retirement pension agency renewed the next day after the cost of unemployment benefits stop.
18. Be declared unenforceable in the Cabinet of Ministers of 19 May 2009. Regulation No 442 "procedure for the granting and the retirement pension payable in the corruption prevention and combating Bureau officials" (Latvian journal, 2009, no. 81).
19. the rules shall enter into force on January 1, 2011.
