Cabinet of Ministers Regulations No. 57 in 2011 (January 18. 5. § 23) the rules on security of issue of the licence, suspension and cancellation criteria and procedures Issued under the Railway Act 21.8 the second paragraph of article i. General questions 1. determined the security certificate (annex 1) for the issue, suspension and cancellation criteria and procedures.
2. the provisions do not apply to carriers who have received safety certificate part A and B and the corresponding technological processes are certified security certificates part A and B documents.

II. Security certificate required documents 5. 5.7. the safety management system proposed by the possession of existing rolling stock related to the documentation of the process: 5.7.1. document for rolling stock maintenance responsible body;
5.7.2. documents showing the rolling stock repair and maintenance support, as well as news about the traction rolling stock ekipēšan;
5.7.3. documents certifying the design of the rolling stock to be used in compliance with the railway technical operation of law;
5.8. information on the activities of economic operators within the scope of technological processes.
6. The merchant that provides rail service between stations and manoeuvre those stations and stations in the private-use railway infrastructure stations get a security certificate if it has created and maintains the security management system. 6.5. the rolling stock owned by type list, specify the number of rolling stock intended for use;
6.6. the safety management system proposed by the possession of existing rolling stock related to the documentation of the process: 6.6.1. document for rolling stock maintenance responsible body;
6.6.2. documents showing the rolling stock repair and maintenance support, as well as news about the traction rolling stock ekipēšan;
6.6.3. documents certifying the design of the rolling stock to be used in compliance with the railway technical operation of legislation requirements and the suitability of the relevant railway infrastructure;
6.6.4. proof of compliance of the equipment of the rolling stock of the railway traffic speed, as well as communications, control command and signalling systems of the relevant railway infrastructure;
6.7. for information on the contracts concluded by the economic operators to use the services of other operators of individual rail technological process.

7.6. the documents of the processes associated with the staff: 7.6.1. proof of the economic operator rail specialist qualifications comply with the railway technical operation of legislation requirements (also with regard to the certification of the regulated professions and the recognition of professional qualifications, as well as with regard to the transport of dangerous goods);
7.6.2. documents proving the merchant workers ' knowledge about the behaviour of railway accidents (including accidents with dangerous goods);
7.7. the rolling stock owned by type list, specify the number of rolling stock intended for use;
7.8. the possession of existing rolling stock related to the documentation of the process: 7.8.1. document for rolling stock maintenance responsible body;
7.8.2. documents established by the rolling stock related processes;
7.8.3. documents showing the rolling stock repair and maintenance support, as well as news about the traction rolling stock ekipēšan;

7.8.4. documents certifying the design of the rolling stock to be used in compliance with the railway technical operation of legislation requirements and the suitability of the relevant railway infrastructure;
7.9. information on the contracts concluded by the economic operators to use the services of other operators of individual rail technological process.
8. The merchant that manoeuvre the private use of the railway infrastructure or public-use railway infrastructure within the limits of one station, get a security certificate, if you have created a system that can deliver it to the appropriate business area in the rail sector, in accordance with the railway safety requirements. To get this certificate, the operator shall submit the application to the safety inspection certificate (annex 2). The application shall be accompanied by the following: 8.1. document containing certain merchant organizational structures or officials responsible for the operation of the railway planning, organization, implementation, management and monitoring of traffic safety;
8.2. information on the breakdown of the relevant processes in the rail sector, in determining which activities of economic operators the necessary technological process take and what this operator is transferred to another merchant;
8.3. information about the operator's internal documents (for example, documents issued by the merchant, jointly with other organizations adopted instruments of railway rolling stock manufacturer, supplier and installer of documents on how to use them, repair and maintenance, other documents issued by an organization, documentation relating to the transport of dangerous goods) included rules that match the operator's type of activity and characteristics and are designed in accordance with the laws and regulations of the railway, the railway technical operation of specialist safety and protection and rail;
8.4. Merchant railway employed a specialist post list;
8.5. the documents of the processes associated with the staff: 8.5.1. proof of the economic operator rail specialist qualifications comply with the railway technical operation of legislation requirements (also with regard to the certification of the regulated professions and the recognition of professional qualifications, as well as with regard to the transport of dangerous goods);
8.5.2. documents proving the merchant workers ' knowledge about the behaviour of railway accidents (including accidents with dangerous goods);
8.6. the rolling stock owned by type list, specify the number of rolling stock intended for use;
8.7. the possession of existing rolling stock related to the documentation of the process: 8.7.1. document for rolling stock maintenance responsible body;
8.7.2. documents showing the rolling stock repair and maintenance support, as well as news about the traction rolling stock ekipēšan;
8.7.3. documents certifying the compliance of the design of the rolling stock of railway technical operation of legislation requirements and the suitability of the relevant railway infrastructure;
8.7.4. acknowledgement of conformity of the rolling stock equipment for railway traffic speed, as well as communications, control command and signalling systems of the relevant railway infrastructure;
5.5. information on the contracts concluded by the economic operators to use the services of other operators of individual rail technological process.
9. the economic operator performing railway infrastructure construction, technical equipment for repair or maintenance, get a security certificate, if you have created a system that can deliver it to the appropriate business area in the rail sector, in accordance with the railway safety requirements. To get this certificate, the operator shall submit the application to the safety inspection certificate (annex 2). The application shall be accompanied by: 9.1. a document that has a specific organizational structure part of the economic operator or the officer responsible for the operation of the railway planning, organization, implementation, management and monitoring of traffic safety;
9.2. information on the breakdown of the relevant processes in the rail sector, in determining which activities of economic operators the necessary technological process take and what this operator is transferred to another merchant;
9.3. the information about the merchant's internal documents (for example, documents issued by the merchant, jointly with other organizations adopted instruments, infrastructure equipment manufacturer, supplier and installer of documents on how to use them, repair and maintenance, other documents issued by an organization, documentation relating to the transport of dangerous goods) included rules that match the operator's type of activity and characteristics and are designed in accordance with the laws and regulations of the railway, the railway technical operation of specialist safety and protection and rail;
9.4. the merchant employed railway specialist posts;
9.5. the documents of the processes associated with the staff: 9.5.1. proof of the economic operator rail specialist qualifications comply with the railway technical operation of legislation requirements (also with regard to the certification of the regulated professions and the recognition of professional qualifications, as well as with regard to the transport of dangerous goods);
9.5.2. documents proving the merchant workers ' knowledge about the behaviour of railway accidents (including accidents with dangerous goods);
9.6. the rolling stock owned by type list, specify the number of rolling stock intended for use;
9.7. the possession of existing rolling stock related to the documentation of the process: 9.7.1. document for rolling stock maintenance responsible body;
9.7.2. documents showing the rolling stock repair and maintenance support, as well as news about the traction rolling stock ekipēšan;
9.7.3. documents certifying the compliance of the design of the rolling stock of railway technical operation of legislation requirements and the suitability of the relevant railway infrastructure;
9.7.4. acknowledgement of conformity of the rolling stock equipment for railway traffic speed, as well as communications, control command and signalling systems of the relevant railway infrastructure;
6.1. information on the contracts concluded by the economic operators to use the services of other operators of individual rail technological process.
10. the economic operator performing the rolling stock construction, repair or maintenance, get a security certificate, if you have created a system that can deliver it to the appropriate business area in the rail sector, in accordance with the railway safety requirements. To get this certificate, the operator shall submit the application to the safety inspection certificate (annex 2). The application shall be accompanied by the following: 10.1. document containing certain merchant organizational structures or officials responsible for the operation of the railway planning, organization, implementation, management and monitoring of traffic safety;
10.2. information on the breakdown of the relevant processes in the rail sector, in determining which activities of economic operators the necessary technological process take and what this operator is transferred to another merchant;
10.3. information on the merchant's internal documents (for example, documents issued by the merchant, jointly with other organizations adopted instruments of railway rolling stock manufacturer, supplier and installer of documents on how to use them, repair and maintenance, other documents issued by an organization, documentation relating to the transport of dangerous goods) included rules that match the operator's type of activity and characteristics and are designed in accordance with the laws and regulations of the railway, the railway technical operation of specialist safety and protection and rail;
10.4. the merchant employed railway specialist posts;
10.5. the documents of the processes associated with the staff: 10.5.1. proof of the economic operator rail specialist qualifications comply with the railway technical operation of legislation requirements (also with regard to the certification of the regulated professions and the recognition of professional qualifications, as well as with regard to the transport of dangerous goods);
10.5.2. documents proving the merchant workers ' knowledge about the behaviour of railway accidents (including accidents with dangerous goods);
10.6. the rolling stock owned by type list, specify the number of rolling stock;
10.7. the possession of existing rolling stock related to the documentation of the process: 10.7.1. document for rolling stock maintenance responsible body;
10.7.2. documents showing the rolling stock repair and maintenance support, as well as news about the traction rolling stock ekipēšan;
10.7.3. documents certifying the compliance of the design of the rolling stock of railway technical operation of legislation requirements and the suitability of the relevant railway infrastructure;
10.7.4. proof of compliance of the equipment of the rolling stock of the railway traffic speed, as well as communications, control command and signalling systems of the relevant railway infrastructure;

10.8. information on the contracts concluded by the economic operators to use the services of other operators of individual rail technological process.
11. the rolling stock maintenance responsible body (merchant) will receive a security certificate if it ensures the safe operation of the rolling stock, using the maintenance system. This structure (the merchant) ensure that rolling stock management under the rolling stock maintenance and repair records, laws and regulations for the construction of rolling stock modernization, restoring service, conformity assessment and the acceptance of service, as well as according to the technical specification of interoperability requirements. To get this certificate, the operator shall submit the application to the safety inspection certificate (annex 2). The application shall be accompanied by: 11.1. a document that has a specific organizational structure part of the economic operator or the officer responsible for the operation of the railway planning, organization, implementation, management and monitoring of traffic safety;
11.2. the merchant employed railway specialist (if any) in the list of posts and their formal qualifications;
11.3. the rolling stock type list, specify the number of rolling stock;
11.4. documentation demonstrating the rolling stock maintenance system and its management, including the rolling stock maintenance system management procedures;
11.5. information about the operator's internal documents (for example, documents issued by the merchant, jointly with other organizations adopted instruments of railway rolling stock manufacturer, supplier and installer of documents on how to use them, repair and maintenance, other documents issued by an organization, documentation relating to the transport of dangerous goods) included;
11.6. information about the rolling stock maintenance and repair performance, including information on the contracts concluded by the economic operator to the rolling stock maintenance and repair used other merchant services.
12. the rolling stock maintenance responsible body (merchant) may be of the rail infrastructure, rolling stock builders, repairers or service processor or rolling stock.
13. If the safety certificate trader submitted copies of documents in paper form, that certifies their conformity with the original. The inspection has the right to require the original documents. If the copy is a deliverable to multiple pages, they must be numbered and cauršūt (caurauklot).
14. Electronic documents will be prepared for submission to the economic operators in accordance with the laws and regulations on electronic document design.
15. If the holder wishes to continue the operation of the rail sector, not later than two months before the security certificate received for the action, it shall submit the application for inspection of new security certificate. The application shall be accompanied by documents related to the previously received security certificate in terms of the changes, and a statement that the other conditions of the security certificate is not changed.
16. If the holder intends to change the security specified in the certificate or the scope of specialization or change that rule 5.1, 6.1 or 7.1. documents referred to, it shall be submitted in the application of the new inspection security licence (regardless of the existing security licence expiry date). The application shall be accompanied by documents related to the previously received security certificate in terms of the changes, and a statement that the other conditions of the security certificate is not changed.
17. the merchant who received the rule referred to in paragraph 5 of the rail infrastructure security certificate, shall immediately inform the inspection, if it has done significant changes to the infrastructure, signalling or energy supply system or to the operation and maintenance principles. In the month following receipt of the inspection will assess how significant is the merchant's changes, and, if they affect the security regulatory framework, ask the merchant for a month to make the change in the security management system of the rail infrastructure or regulations.
18. If a merchant changes this rule 6, 7, 8, 9, 10 or 11 (excluding 6.1 or 7.1) security certificates referred to operational conditions, this month in writing notify the authorities. This information is recorded as inspecting merchant security licence conditions for the operation of the Exchange.
19. If the holder changes the address or other security specified in the certificate properties, this month it shall notify the Office, adding the communication security certificate of the original and copies of the documents (the original show), showing the changes.

20.4. observations on malfunctions and deficiencies, suggestions to improve the operation of the railway.
III. Consideration of the application and the issuing of the safety certificates for 21. Railways technological process, subject to safety has been certified if the merchant has entered into a written agreement for the implementation of this process with the other economic operator, which has concerned the security certificate process.
22. The inspection shall examine the application of the security certificate and the documents attached to it and, if it finds that the documents submitted do not meet the requirements of this regulation if they are incomplete or inaccurate, requiring the operator to further information. Merchant shall provide the information requested within 10 working days.
23. when considering the application of the provisions of this paragraph 6 security specified in the certificate, inspection of the five working days following the submission, and that provision referred to in paragraph 6 shall submit the receipt of documents for the public-use railway infrastructure manager, for his opinion about the rolling stock operator's technical and operational characteristics of the compliance with the conditions of railway infrastructure, except in the case where the operator is the railway infrastructure managers concerned.
24. public-use railway infrastructure manager within 14 days after the rules referred to in paragraph 23 of the document submitted to the receiving Office opinion on rolling stock technical and operational characteristics of the compliance with the conditions of the railway infrastructure. If the inspection does not agree with this opinion, it bases its views on the case in the decision taken.
25. The decision on the security issue of the licence or a refusal to issue a safety certificate inspection adopted within one month of the application and this provision 5, 6, 7, 8, 9, 10 or 11 of the document referred to in the paragraph.
26. The decision on the refusal to issue a certificate of inspection of security adopted in the following cases: 26.1. If the operator does not comply with the technical operation of the railway by the laws or regulations on railway traffic safety requirements;
26.2. If inspection does not have all the required documents submitted and the additional information requested by the Inspectorate in accordance with the requirements of this regulation;
16.3. If the trader during the year before the application has been revoked security certificate.
27. the inspection within three working days after the decision of the operator to notify and publish your website on the internet (URwww.vdzti.gov.lv).
28. If the security certificate is lost or damaged, not renewable inspection upon receipt of the application within 10 working days of the issue of a duplicate certificate of safety.
IV. Security licence suspension and cancellation 29. Decision on security certificates or security certificate specified in the scope of suspension, the Inspectorate adopted the following cases: 29.1. If the merchant is unable to operate in the field of commercial activities in the rail sector, subject to the safety requirements of these rules 5, 6, 7, 8, 9, 10 or 11 of the system;
29.2. If the merchant is not renewed security licence conditions for the operation of that rule 17 or 18 in accordance with the procedure laid down in point and, therefore, no longer meets the security conditions of the activity licence.
30. the decision on security certificates or security certificate specified in the scope of the cancellation of inspections shall be adopted in the following cases: 30.1. If the security certificate is issued to the holder of the new security certificate in the form prescribed in these provisions;
30.2. If the security certificate the holder has provided false information or concealed essential facts;
30.3. If within six months after a security certificate or a security certificate contains the areas of activity of the holder is stop remedy identified deficiencies;

18.9. If the safety certificate or safety certificates in scope during the year has been stopped repeatedly for the same type of deficiencies;
5. If the holder has taken action on any of the security certificate specified in the activity at a time when it was stopped;

31. Reversed the original security certificate to the merchant passes the inspection within five working days after the entry into force of the decision on withdrawal of the security certificate.
32. If a decision on security certificates, suspension or withdrawal, it shall send the economic operator of the inspection and shall publish on its homepage on the internet (URwww.vdzti.gov.lv).
V. concluding questions 33. security certificate issued to the date of entry into force of the provisions shall be valid until the end of the term if the economic operator has not changed the safety certificate functioning conditions. The security certificate is valid up to the expiry of the term of the transaction, even if the economic operator has provided inspection information on security conditions for the operation of the certificate, but in accordance with paragraph 16 of these terms was not required to obtain a new security certificate.
34. This provision is referred to in paragraph 11 of the security certificate for the rolling stock maintenance body responsible (the merchant) must be received within two years following the entry into force of these regulations.

3) Commission of 27 November 2009. directive 2009/151/EC of European Parliament and Council Directive 2004/49/EC as regards common security indicators and common methods of accident damage.

2.3.7. the legislation, which provides for additional requirements for the rules of procedure, to be adopted by economic operators;
2.3.8. the laws and regulations on the requirements for staff directly related to rail traffic, including the personnel selection criteria, health, vocational training and certification as far as these issues are not necessarily interoperable technical specifications;
2.3.9. the laws and regulations on railway accidents investigation and classification of the accounting procedures;
2.4. the procedures of the applicable regulations, the documentation standards and other specifications for compliance with the life-cycle of equipment and operations;
2.5. the procedures and methods for the assessment of risks and the hedging measures if the operating conditions or other material creates a new operational risk factors;
2.6. staff training programmes and systems assurance staff competences and duties;
2.7. the operator measures the movement of inside information (in some cases, the movement of information between traders operating in the same railway infrastructure);
