Cabinet of Ministers Regulations No. 320 in 2016 (24 May. No 25 14) national and European aid arrangements under "investment aid to agricultural activity and development of the" open creation project submissions in the form of a contest Issued under the agricultural and rural development Act article 5, fourth paragraph i. General questions 1. determines the order in which the State and the support of the European Union (hereinafter referred to as aid) measure "investment aid to agricultural activity creation and development" (hereinafter measure) unveiled the project submission contest. 2. funding measures are granted in accordance with the European Parliament and of the Council of 17 December 2013 Regulation (EU) no 1305/2013 on support for rural development by the European agricultural fund for rural development (EAFRD) and repealing Council Regulation (EC) No 1698/2005 (hereinafter Regulation No 1305/2013). Support in the form of grants shall be in accordance with the Commission's 17 December 2014 Regulation (EU) No 651/2014, by which certain categories of aid compatible with the internal market, the application of the Treaty and article 107.108 (hereinafter Regulation No 651/2014). The decision on the granting of aid under these provisions may take up to December 31, 2020. 3. project adoption application launches, project submissions submitted, evaluated and selected, the decision shall be taken and notified as well as support for the request in accordance with the laws of the State of the European Union and the granting of aid, administration and monitoring of the development of the rural and fisheries-2014 – 2020 programming period. 4. the objective of the measure is to promote non-agricultural economic activities and employment in rural areas, as well as a variety of non-agricultural activities, to develop alternative sources of income and increase the level of income in rural areas.
II. conditions for receiving the aid Measures 5. the site is a rural area of the territory of Latvia, except Republican city and County territorial units-cities that have more than 5000 inhabitants. 6. the applicant is: 6.1.-operating farmers performer whose place of residence is in the territory of a field declared as well as the individual businessman or legal person, whose registered office is in rural areas, where they produced agricultural products (the Treaty on the functioning of the European Union referred to in annex I agricultural products, excluding fishery products) and last year concluded from agricultural activities have gained revenue no less than 51 percent of total revenue; 6.2. economic operator whose place of residence is in the territory of a field declared as well as the individual businessman or legal person, whose registered office is in rural areas, where they meet the micro or small enterprise status under Regulation No 651/2014 the definition laid down in annex I. If the applicant is a legal person, its share capital is not less than 75 percent of private capital. 7. supports the applicant prior to the submission of the application, the project has declared to his place of residence or registered company rules referred to in paragraph 5 in rural areas and ensure that all economic activities and the monitoring of the implementation of the project. 8. in determining the applicant's compliance with the aid of micro-enterprises or small business category, related undertakings taken into account in accordance with the laws and regulations on the European agricultural guarantee fund, the European agricultural fund for rural development, European Fund for Maritime Affairs and fisheries, as well as on the national and European aid for agriculture and rural development and fisheries Financing Administration 2014 – 2020 programming period. 9. the aid shall be granted for the following activities: 9.1. non-agricultural activity development – this rule 6.2. aid referred to applicants who have concluded the reporting year and the State revenue service filed individual income tax returns or annual report, and which have, therefore, the systemic nature of the economic activity (at least three transactions for consideration, the financial reporting year). The beneficiary of the existing economic activities developed in the same sector and also the industry that directly complements the existing economic activities and is associated with it, in order to increase the effectiveness of the existing economic activities; 9.2. non-agricultural diversification of economic activities, the provision referred to in 6.1 supports applicants who have concluded the reporting year and the State revenue service filed individual income tax returns or annual report, and which have, therefore, the systemic nature of the economic activity (at least three transactions for consideration, the financial reporting year); 9.3. the activities for the promotion of tourism, this provision of aid referred to in paragraph 6 of the applicants, that is, tourism service providers that have demonstrated the systemic nature of the economic activity (at least three transactions for consideration, the financial reporting year), the existing tourism attraction in carrying out activities targeted tourist interests and needs and gaining revenue from tourist service: 9.3.1. conversions of existing tourist accommodation, renovation and outfitting; 9.3.2. the existing tourist accommodation catering block construction as well as renovation or conversion of buildings and the purchase of necessary equipment; 9.3.3. new mazēk (building, of which the total area affected does not exceed 25 square meters) for the construction, installation and fitting of the campsite territory or territory prepared and well-organized tent, portable cabins, caravan and other lightweight construction structures and object placement and intended for the accommodation of guests; 9.3.4. existing camping and youth tourism accommodation sharing kitchenettes, dining room, toilet and shower room construction and rebuilding, renovation and outfitting it; 9.3.5. the diversification of tourism services. 10. Regulation No 651/2014 article 1 point 3 "referred to in subparagraph (a)" fisheries and aquaculture sector, article 1, paragraph 3 referred to in subparagraph "b" primary agricultural sector regulation No 651/2014 article 2, paragraph 9, and article 1, paragraph 3, "c" in the cases referred to in (a) and agricultural products processing and marketing sector, Regulation No 651/2014 article 2, 8 and 10 in the cases referred to in paragraph; 12.3. Regulation No 651/2014 article 1 point 5 of that law, in the event of infringements; 12.4. Regulation No 651/2014 "a" of article 13 in the sectors referred to in point: 12.5.1. the steel sector pursuant to Regulation No 651/2014 article 43, paragraph 2; 12.5.2. coal sector according to Regulation No 651/2014 article 2, paragraph 13; 12.5.3. the shipbuilding sector; 12.5.4. synthetic fibres sector pursuant to Regulation No 651/2014 article 44, paragraph 2; 12.5.5. in the transport sector (as well as the associated infrastructure) in accordance with Regulation No 651/2014 article 45, paragraph 2 (NACE Rev. 2. H), except taxi services (NACE Rev. 2 section of class H 49.32), individual freight services (NACE Rev. 2 section of class H 49.42), pipeline transport (NACE Rev. 2 Group H section 30.8) and space transport (NACE Rev. 2 section class 51.22. H); 12.5.6. energy production, distribution and infrastructure sector; 12.6. Agriculture (NACE Rev. 2 section of Chapter 1) and the agricultural products processing industry (NACE Rev. 2 section C. 10 and 11). 13. One project submission (annex 1) includes one of the provisions referred to in paragraph 9. 14. supports the applicants in the framework of the project, at least one of the following objectives and ensure its implementation throughout the project monitoring: 14.1. create at least one new job; 14.2. save existing jobs; 14.3. developing economic activity. 15. new job creation within the meaning of these provisions means that in addition to the already existing places of work creates a new normal time jobs according to the legislation on labour relations sector project implementation. IV. Application procedures and the documents to be submitted to apply for aid for 25, support the applicant in accordance with the laws of the State of the European Union and the granting of aid, administration and monitoring of the development of the rural and fisheries-2014 – 2020 programming period of rural support service shall submit the following documents: 25.1. application for the project (annex 1) in two copies on paper and a copy thereof in electronic form, which is recorded on an external disk (if it does not submit to the rural support service Electronic login system or electronic document under the electronic document Act). Field support service to one project submission paper copies together with proof of registration of the project shall be returned to the applicant; 25.2. the applicant's declaration in accordance with the laws of the State of the European Union and the granting of aid for the development of the rural and fisheries; 25.3. a declaration of conformity of the small companies (undersized) or the average of the company according to the laws and regulations of the company declaration procedure pursuant to the small (tiny), or the average of the company; 25.4. the land registered in the long-term lease of copies (the original show); 25.5. procurement procedures supporting documents in accordance with the laws and regulations on the procurement procedure and the application of a Subscriber-funded projects. If an applicant is entitled not to apply the laws and regulations on the procurement procedure and the application of the principals of the funded projects, it shall submit a description of free-form, showing how the price was determined, and information about the entrepreneurs surveyed. The provisions referred to in paragraph 31 of the condition shall be considered satisfied if the applicant: 32.1. Field support service has submitted a receipt card copy (showing original) or a construction or a copy of it (the presentation of the original) and completions with the būvvald mark on the design conditions are fulfilled; 32.2. has purchased at least one of the project assets, the value of which at least 10 percent of the estimated asset acquisition; 32.3. in other cases are contracted and paid an advance of at least 20 percent of the transaction amount. V. public the nature and extent of funding 33. Planning period one with support applicants to the Group of persons eligible cost total amount does not exceed eur 200 000. 34. Vi. Eligible and ineligible costs 38. Event to the following eligible costs: 38.1. new production and service provision the necessary assets (equipment, facilities, and equipment, including computer software) acquisition cost, to directly ensure the production process or the provision of services in the sector of the project, as well as one-time costs associated with the installation of machinery and equipment, the operation of; 38.2. the new construction or renovation project cost according to the intention of the planned construction and engineering group, on the basis of contracts with third parties who are responsible for carrying out the work, but without exceeding the maximum eligible costs (annex 5); 38.3. the acquisition cost of the building, based on the accept or support the construction plan drawn up for the construction work, if the applicant has būvvald issued the memorandum (a receipt card), but without exceeding the maximum eligible costs (annex 5); 23.9. General costs (development costs according to the construction plan for the construction of the regulatory laws, including architects and engineers, services, fees, inspection, building and autoruzraudzīb), but no more than seven percent of them in the construction of the eligible cost, without exceeding the total of 5000 Euro. Construction costs are eligible, if the project is for the eligible costs of the building construction, building renovation or alteration; 38.5. expenditure on the purchase of mobile machinery subject to registration by the road traffic safety Directorate or the State technical supervision agency, if this mobile technique in accordance with Regulation No 651/2014 article 13 ' a ' section is not intended for commercial use. Mobile equipment within the meaning of these provisions is: 38.5.1. motor vehicle (a device that can go on the road and is intended for the carriage of passengers or goods or for the performance of work) and its equipment; 38.5.2. towed vehicle (vehicle without engine and intended for travel in connection with the vehicle) or trailer and its equipment. 39. If the applicant does not provide public funding for installation, it is to be installed and put into service according to the regulations for installation and use procedures. Public funding of relevant equipment receives only after their commissioning and supporting documents of the Field support service. 40. Where a project is only intended for the construction, including regional planning, cost, but not for the building and equipping of premises, equipment and installations and setup costs, the beneficiary of the final request for payment shall be submitted in the rural support service after the building and outfitting of premises, equipment and installations and Setup when possible functional space and use of the territory, and the production or delivery of the service. The event is not defined eligible costs: 46.1. interest payments, money transfers, Currency Exchange Commission payments and exchange rate fluctuations suffered damage; 46.2. fines, penalties and costs of legal proceedings; 46.3. the subcontracting, which artificially and unduly increase the cost of the project and the fee is fixed as a percentage of the total cost of the project; 46.4. the costs associated with the supply of any services or work which does not implement an appropriate procurement procedure in accordance with the laws and regulations on the application of the procurement procedure; 46.5. the existing premises and territory maintenance costs; 46.6. for maintenance, spare parts and operating costs; staff remuneration; 29.0. 29.1. taxes and fees (excluding value added tax for those applicants who are not registered as a value added tax payer); 46.9. General-purpose vehicles (including with internal combustion engines) costs that are not specifically tailored to specific functions, except for the costs of specialised vehicles, which are constructive and only industrial manufactured in special interest for the carriage of goods or the performance of specific work and have set up specific tasks for machines; 46.10. investment in equipment, the acquisition of machinery and equipment for agricultural production; 46.11. This provision as referred to in point 9.3 for the implementation of the activity-cost of technique with an internal combustion engine; 46.12. tack inventory costs. Tack the equipment within the meaning of this provision is that the inventory value is less than the amount of the fixed assets of the applicant, the aid according to its accounting methodology, which is not listed in the inventory and where life is less than one year; 46.13. costs incurred prior to the application of the project; 46.14. costs incurred after the implementation deadline of the project; 46.15. other costs that are not eligible under Regulation (EC) no 1305/13.47. Costs at the field support service evaluation exceed average market prices, as well as the implementation of the activities and objectives of the time period specified by the schedule of costs considered eligible costs. 48. funding is not granted, if the applicant has assisted in the implementation of the activity started before the application Field of the project support services. 49. Of the funds set out in these rules eligible costs can be combined with other aid schemes or individual aid project funding, including de minimis aid, provided that this provision within the funding allocated, together with other support programs or individual aid project funding does not exceed the maximum intensity of regional funding: 61.1. small (micro) or small business operators – 55%; 61.2. medium businesses-45%; 38.1. large economic operators – 35%. 62. the combined support with other support for initial investment and launch a project only after all the participating institutions have decided to provide support for the investment project. 63.
