Cabinet of Ministers Regulations No. 80 in 2013 (5 February. 13. § 7) milk and milk products and for the recognition of producer organisations in their operational procedures for supervision Issued under the agricultural and rural development Act, 9. the third paragraph of article i. General questions 1. milk and milk products, producer organisations recognition criteria, recognition procedures and operational conditions, as well as the control of the producer organisation. 2. Producers of milk and milk products is: 2.1. milk producers organisation that meets the Council of 22 October 2007, Regulation (EC) No 1234/2007 establishing a common organisation of agricultural markets and on specific provisions for certain agricultural products (single CMO Regulation) (hereinafter Regulation No 1234/2007) article 126, paragraph 1; 2.2. the rules referred to in point 2.1 of the Dairy Association of producer organisations for which recognition is granted in accordance with the provisions of chapter II; 2.3. interbranch organisation of milk which complies with the provisions of Regulation No 1234/2007 article 126 1. 3. Milk and milk products of recognised producer organisations, the rural support service (hereinafter service). II. Milk producer organisations and their associations and the recognition of activities supervision 4. recognized milk producer organisations may apply for the status of the rules referred to in point 2.1 of the milk producers ' Organization (hereinafter referred to as the producer organization), if the number of participants is at least 10 years and sold the production volume of at least 125 tonnes of raw milk, which bought from the producer organisation to its members for resale or for which the producer organisation, on behalf of their members address the contract negotiations with the milk processor. 5. To recognized producer organisations may qualify the Association status of these rules the Association referred to in 2.2, if the number of participants is at least five years and sold the production volume of at least 625 tonnes of raw milk, which the Association purchased from its members for resale or for which the Association on behalf of their members in the contract negotiations with the milk processor. 6. to qualify for a milk producer organisations recognition of a producer organisation in the form of electronic document or paper submitted in recognition of the services of the application (annex 1) and a copy of the agreement of the participants on the participation of the producer organization. 7. Agricultural Service cooperative society, which the compliance status is granted in accordance with the laws and regulations of agricultural service cooperatives the necessary documents for registration and screening of this society and who claim to be the milk producer organisations recognition, acceptance of the application, (A) in section 1 only point 10, section a.2 of the filling and the rule mentioned in paragraph 6 of document adds society "Latvian Association of agricultural cooperatives" conformity assessment. 8. the Department shall adopt one of the following decisions: the recognition of the application 8.1 and milk producer organisations recognition; 8.2. the rejection of the application for recognition if: 8.2.1. the producer organisation does not comply with this provision (4) and (5) the requirements referred to in; 8.2.2. the examination of the information specified in the application for recognition, determined that it is not true. 9. The adoption of any of the provisions referred to in point 8 of the decision, the Department assessed: 9.1. these provisions 6 and 7 documents listed; 9.2. the Constitution of the producer organisation; 9.3. the producer organisation's registration in the commercial register or the register of enterprises; 9.4. the producer organisation's annual report (on the last year concluded before the application for recognition). Where a producer organisation is established in less than a year prior to the application for recognition, service valued members of the producers ' organisation or participants of the annual report – natural person established in the State revenue service as reviewer, economic activities, annual income statements in accordance with the provisions of annex 1 (A) paragraph 5 of section 1; 9.5. producer organisations and the processing purchased raw milk sales volume as well as its members ' compliance with the milk producers and their status in the raw milk sold by volume. 10. If the application for recognition does not contain all the necessary information, service requests in writing to the producer organisation. The producer organisation shall within 10 working days of receipt of the request, submit the required information. 11. Service every 12 months take Regulation No 1234/2007 article 126, paragraph 4, subparagraph "b" checks. Information about this rule referred to in paragraph 7, the agricultural service cooperatives in compliance with the milk producers organisation for recognition of service obtained from the society, "the Latvian Association of agricultural cooperatives". 12. If this provision 11. the checks referred to in paragraph 1 or by society "Latvian agricultural cooperative association" information service provided establishes that the producer organisation does not comply with these rules 4, 5 and 7 of Regulation No 1234/2007 article 126, paragraph 1 of the said requirements, the producer organisation shall not prevent compliance within 30 days after receipt of the results of the checks. If non-compliance with the time limit does not prevent, cancel service recognized milk producer organisations status. 13. the producer organisation shall have the right to request again the milk producer organisations recognition not earlier than three months after the date of the decision on recognition status. 14. the service within five working days after the decision on milk producer organisations recognition or recognition status by the competition Council informed about: 14.1. milk producer organisations recognition of supplying these rules (A) of annex 1, 2 (A) and (B). 2 3 of the information referred to in section; 14.2. recognised producer organisations of the milk status under this provision 12, 17 and 22. 15. The producer organisation on the changes in the statutes and, if it relates to the provisions in the annex provide information, in writing, inform the service within five working days after you make these changes. 16. Service within 10 working days after this paragraph 15 of the rules of receipt of the information referred to evaluate and inform the manufacturer in the Organization, if found to be in non-compliance with the requirements for recognition. 17. The producer organisation shall within 10 working days after this provision in paragraph 16 of this disclosure eliminates the discrepancy found. If the discrepancies are not remedied within the time limit set, the service cancels recognized milk producer organisations status. 18. the producer organisation shall be entitled to address Regulation No 1234/2007 126. c 1 negotiations referred to in paragraph (hereinafter referred to as contracts) of its members holding raw milk produced in the delivery contract. 19. The producer organisation Regulation No 511/2012 article 2 1 and 2 of the notifications referred to in the raw milk sales, which are subject to contractual negotiations, notify the service at once by calling for recognition, indicating the quantity of these rules in the application referred to in paragraph 6 (B) of section 2, or before the contract negotiations, sending electronic service information in accordance with the provisions of paragraph 6 (B). the application referred to in section 2. 20. the service within five working days evaluate these rules referred to in paragraph 19 of the information provided in the notice of compliance with Regulation No 1234/2007 article 126 2 "c", "d" and "e" claims, paragraph applies this rule is set out in annex 2 to the seasonality factors, and shall inform the producer organisation, if found to be in non-compliance with the requirements for recognition. 21. the service within five working days after the rules referred to in paragraph 19 of the receipt of the notification the amount of milk shall inform the competition Council. 22. the competition Council, in accordance with Regulation No 1234/2007 126. (c) article has the right to request the producer organisation shall review the contract terms of the negotiations or terminating the contract negotiations and on the negotiating termination or change conditions that inform the competition Council and staff within 15 working days of receipt of the request. If, within 15 working days to comply with the requirements of the competition Council, service cancels recognized milk producer organisations status. 23. producer organisations authorised person within five working days after the conclusion of the contract the agricultural data centre services in the electronic system for reporting and data center provides the following information: 23.1. contract number; 23.2. the duration of the contract; 23.3. the contractual amount of milk purchased and delivery period; 23.4. the other Contracting Party, the name and the registration number; 14.6. the manufacturer's code for the person (natural person) or a registration code (a natural person to whom economic activity) or registration number (legal person), if the other Contracting Party shall be the buyer in accordance with the legislation on milk quotas and the contract concluded between the producer and the buyer. 24. the producer organisation to which the producer organisation is recognised at the date of grant is the existing milk supply contracts, give written notice to the service this provision 23. information referred to in paragraph 1 within five working days after the entry into force of the decision on the recognition of a producer organisation of milk. 25. The rules referred to in paragraph 14.5. Contracting Party: 25. at the request of the agricultural data centre confirms the existence of such a contract and agreement of truthfulness; 25.2. within five working days after the termination of the contract shall inform the service and agricultural data centre. III. recognition of interbranch organisations and 26 On supervising recognised interbranch organisation status of milk qualifies this rule 2.3. interbranch organisations referred to in paragraph (a), registered according to the law of associations and foundations, and of Regulation No 1234/2007 article 126b of the conditions, as evidenced by its statutes. 27. Regulation No 1234/2007 article 126b point "c" within the meaning of subparagraph a significant part of economic activity include: 27.1. the sale of raw milk not less than 500 tonnes in the last 12 months – cross-members of the Association of milk producers; 27.2. dairy not less than 5000 tonnes in the last 12 months-members of an inter-branch organization, of which one of the sectors of activity is the processing of milk and milk-based products; 27.3. sales turnover of at least 100 000 lats last 12 months – for each Member of the interbranch organisation, having one of the sectors of activity are dairy products (including raw). 28. In order to qualify for recognition of interbranch organisations of milk, the inter-branch organisation's electronic document or paper submitted in recognition of the services of the application (annex 3) and interbranch organisations the Member a copy of the agreement for participation in cross-sectoral organization. 29. the Department shall adopt one of the following decisions: 29.1. recognition of interbranch organisations in the application approval and recognition of interbranch organisation; 29.2. the rejection of the application for recognition if: 29.2.1. the inter-branch organisation does not comply with this provision in paragraph 26 and 27 of these requirements; 29.2.2. verify the information specified in the application for recognition, determined that it is not true. 30. The adoption of any of the provisions referred to in paragraph 29 of the decision, the Department assessed: 30.1. these rules of application referred to in paragraph 28; 30.2. the statutes of the interbranch organisation; 30.3. the inter-branch organization registration in the register of associations and foundations; 18.9. the inter-branch organisation's annual report (on the last year concluded before the application for recognition). If the inter-branch organization is established in less than a year prior to the application for recognition, service valued members of the interbranch organisation annual accounts or the annual income declaration participants; 5. interbranch organisations the Member purchased, sold and the amount of the processed raw milk, as well as the retail turnover. 31. If the application for recognition does not contain all the necessary information, service requests in writing to the interbranch organisation. The inter-branch organization is 10 working days following receipt of the information requested on the presented services. 32. Service every 12 months take Regulation No 1234/2007 article 126b of paragraph 3 referred to "b". 33. If this rule 32. the checks referred to in point service finds that the inter-branch organisation does not comply with the provisions of paragraph 26 and 27 and Regulation No 1234/2007 article 126b of the requirements for milk interbranch organisations, inter-branch organisation does not prevent compliance within 30 days after receipt of the results of the checks. If non-compliance with the time limit does not prevent, cancel service recognised interbranch organisation status of milk. 34. The inter-branch organisation about changes in its activities that affect or may affect its compliance with the milk of the interbranch organisation for recognition, writing to the service within five working days after the change occurred. 35. Service within 10 working days after this Regulation referred to in paragraph 34 of the receiving and evaluate and inform the interbranch organisation, if found to be in non-compliance with the milk of the interbranch organisation for recognition. 36. The inter-branch organisation within 15 working days after the rules referred to in paragraph 35, the receipt of information eliminates the discrepancy found. If non-compliance with the time limit does not prevent, cancel service recognised interbranch organisation status of milk. 37. the service within five working days after the decision on milk interbranch organisations recognition or recognition status by the competition Council informed about: 37.1. milk interbranch organisations, providing also that rule 3 (A) of the annex. 2, 3, 4 (A) (A). and (B) the information referred to in section; 37.2. the recognised inter-branch organisations in the dairy status under this rule 33, 36 and 39. 38. The competition Council to find infringements of competition law recognized interbranch organizations in action 10 working days after the finding of an infringement shall inform the service. 39. the service after this provision in paragraph 38 of this disclosure cancels recognised interbranch organisation status of milk. 40. An interbranch organisation shall be entitled to request again the dairy recognition of interbranch organisations not earlier than three months after the date of the decision on recognition status. The Producer Organisation's Compliance With The Milk Producers ' Organisation For Recognition Important! 1. in accordance with the Cabinet's February 21, 2012 rules no 137 "rules for agricultural service cooperatives the necessary documents for registration and screening of this society" assess agricultural service cooperative society only in this part (A) of section 10, paragraph 1. In this case, the application must be accompanied by the Latvian Association of agricultural cooperatives received letter of assessment. 2. The recognition of associations of producer organisations of milk does not fill in this part, (A) sections 1, 2, 3, 4, 5, 6, 8 and 9.
A.1.
