Cabinet of Ministers Regulations No. 559 Riga 2014 (23 September. No 50 28) requirements for real estate appraisers professional qualifications and vocational qualifications certificate procedure Issued in accordance with the law "About the regulated professions and the recognition of professional qualifications" article 32 of the sixth and mortgage bonds Act article 15 i. General questions 1. Rules lays down the requirements for a real estate appraiser's professional skills and procedures to be issued a certificate of professional qualification of real estate evaluation (hereinafter referred to as the certificate). 2. A certificate of professional qualification of the person to determine the real market value of the property, shall be issued by the institution that is accredited by the national accreditation body in accordance with the laws and regulations on assessment of conformity assessment bodies, accreditation and supervision (hereinafter referred to as a certificate authority), or another Member State of the European Union, Turkish or European economic area country accredited certification body that implement the requirements laid down in these provisions. The national accreditation body shall publish its official website information on accredited conformity assessment bodies. 3. the certification body registers persons prescribed in these provisions is assigned to a certificate (hereinafter referred to as the certified person), certified personal log (Journal). Log entries are public, and any person is entitled to receive free of charge information about the certified person – name, surname, it assigned certificate number and expiration date. The certification authority shall ensure the availability of the information in the journal on its Web site.
II. Requirements for real estate appraisers professional qualifications 4. A Person is eligible for a certificate if it meets the following real estate appraisers professional qualifications requirements: 4.1 a person has acquired higher education fifth level professional qualification in real estate valuation (professional code 3142 12 "real estate expert") or higher education fifth professional qualification in related field, which is related to real estate , and acquired the real estate assessor profession requires expertise in the professional continuing education program accredited; 4.2. the real property is assessed according to the requirements in the legislation of certain professions in the real-estate evaluator's profession (professional standard); 4.3. the person is at least three years of work experience in the real estate valuation, and this time it is assessed at least 20 real estate objects. 5. The Person is not at least three years of work experience in the valuation of real estate, but who has gained at least real estate appraiser Assistant profession (profession code 3142 15 real estate appraiser Assistant ") the necessary higher education qualifications to the fourth level, is right before the certificate to get a real estate appraiser Assistant status. 6. in paragraph 5 of these rules the person certificate authorities, examination real estate evaluation theory examination (hereinafter examination). If a person has successfully passed the exam, certificate authority the person recorded on the real estate appraiser Assistant (Assistant). 7. Assistant professional activities according to the requirements of this Regulation take the certificate authorities only confirmed the supervisor's control. The supervisor can be certified by a person chosen by the Assistant of the certified list. One practice Manager at the same time must not be more than three assistants. 8. the Assistant shall have the same rights and duties as a certified person, except the right to unilaterally sign a real estate assessment and to issue it to a third party. Assistant developed real estate assessment is valid only if it is approved with the signature of the supervisor. 9. the supervisor is responsible for the approved Assistant real estate assessment. 10. Assistant after three years of work and the status of Assistant 4.1. education referred to in the certificate are eligible. 11. The right to obtain a certificate is not the person prosecuted for offences against the State, natural environment, property, General Security and public order, administrative order, jurisdiction and the economy.
III. Documents to be submitted 12. A Person who qualifies for a certificate (hereinafter the applicant) or Assistant status, submit a certificate authority (in person, presenting the identity card, or by sending by registered mail): 12.1. applications; 12.2. a copy of the document (the presentation of the original or notarized copy), which shows that a person's education meets this provision in paragraph 4.1 or paragraph 5 the requirements; 12.3. Description of professional activities; 12.4. the supervisor confirmed the previous three years in real estate valuation (hereinafter referred to as the assessment); 12.5. the Assistant-Supervisor's recommendation for a certificate; 12.6. personal proof that the person is not punished for this rule referred to in paragraph 11 crimes. 13. The rules referred to in paragraph 12 of the application and the documents annexed thereto a certificate authority can be submitted electronically, if the electronic document was made according to the regulations on electronic document design. If the rules referred to in paragraph 12 of the document submitted electronically or by registered mail, prior to the evaluation and examination of the work of defending the sort or person applicants who claim to be the Assistant's status, presented identity documents. 14. a Person who qualifies for the status of the Assistant, this rule 12.3, 12.4 and 12.5. referred to in documents submitted. 15. Certificate Authority within three working days after receipt of the application, examine the documents submitted and shall inform the person concerned, if not submitted all of the regulations set out in the information or the information supplied is incomplete, as well as the reasonable deadline for correcting the deficiencies found, which may not be less than five working days.
IV. the status of the certificate or the granting of Assistant

16. the certification body shall establish a Certification Commission. The Certification Commission is responsible for scoring the work bidders and aptitude test. The Certification Commission is made up of at least three certified property valuation professionals. The certification authority in accordance with the Certification Commission has taken a decision on granting, cancellation of the certificate, the certificate or the suspension of the certificate carried out by a qualified person and Assistant monitoring, as well as decide on granting the status of Assistant or withdrawal if the Assistant does not comply with these rules. 17. After the documentation submitted by the applicant for Certification Commission at random from a list submitted by the applicant shall select the assessment examination three jobs over the previous two years and three working days, inform the applicant in writing. The Certification Commission after receiving the opinion of the reviewer on the positive evaluation of the work of the compliance with the standards of the profession to determine the evaluation work and defended its advocacy and communicate it to the applicant. 19. To ensure that the evaluation referred to in paragraph 18 of the advocacy and work of examination, certification, the Commission will establish the independence of the Commission. The examination Commission shall consist of at least three certified property valuation professionals. Certification Commission members do not participate in the evaluation of the applicant's work and defend the exam. 20. The examination Commission shall take a decision on the evaluation of the effective advocacy work, if the answers to the questions asked of applicants found the direct participation in the preparation of the assessment work defended. Examining Board decision on the evaluation of the results of the work of defending the five working days following the valuation work advocacy Announces Certification Commission. If the assessment work advocacy has been successful, the certification authority shall immediately notify the applicant when it can sort the exam. If a person is eligible to obtain the status of Assistant, certificate authority within three working days following receipt of all required documents to the person, when it can organize examination and informs that the decision for the Assistant's status or the refusal to grant an Assistant's status will be taken and notified within 15 working days after the examination. If the certificate authority within that period, the person concerned of the decision of the Assistant's status is not stated, it is considered that the certification authority has granted the status of assistants under the freedom to provide services to the default law principle. 23. the minimum number of points required for a successful completion of the examination is 75 points out of a maximum of 100 points acquired. 24. The examination Commission within 10 working days of the exam assesses progress exam answers and assessment shall be submitted to the Certification Commission. 25. the certification body in accordance with the Commission's assessment of certification within 15 working days after the examination, shall decide on the granting of the certificate or a refusal to grant a certificate or the decision of the Assistant's status or on the refusal to grant the status of Assistant. 26. the certification authority's compliance with the requirements of these rules monitor the three public institutions – the Ministry of Economy, Ministry of finance and the State land Department: authorized representatives (hereinafter referred to as the Supervisory Board). Representatives of the Supervisory Board are entitled to participate, without the right to vote and the certification bodies the Certification Commission meetings during the meetings point to weaknesses in certification authorities and certification request for the work of the Commission and its prevention, as well as to familiarize yourself with the certification authority and certification decisions taken by the Commission and all documents used in the decision-making of the Certification Commission. 27. the certification body at least three working days before the meeting shall inform the representatives of the Supervisory Board of certification authorities and Certification Commission meeting time and location, as well as the representatives of the Supervisory Board scheduled the meeting agenda. 28. the Supervisory Board appeal procedure appeals for certificate authorities decision on refusal to grant the status of Assistant or a certificate of cancellation of the certificate, the certificate suspension or refusal to grant a certificate. 29. If the Supervisory Board has established Certification Authority irregularities, deciding on refusal to grant the status of Assistant or a certificate of cancellation of the certificate, the certificate suspension or refusal to reassign the certificate, it cancels the decision and instructs the certification body immediately to prevent any irregularities. 30. The Certification Commission, examining Board and of the Supervisory Board does not participate in the evaluation work of the applicant, respectively, exam answers and complaints about certificate authority decisions, if the applicant is the Certification Commission, examining board or the Supervisory Board Member's spouse, his or her spouse's relatives in a straight line in all degrees, side line up to the fourth degree or affinity up to the third degree or certification, the Commission is examining board or supervisory board members or guardianship, or his spouse in custody. Certification Commission, examining Board and of the Supervisory Board does not participate in the evaluation of the applicant's work, exam answers or complaint about the certificate authority decisions, even if you are personally or property directly or indirectly interested in the outcome, or there are other circumstances that cause reasonable doubt as to his impartiality. In such cases, the Certification Commission, examining board or the Supervisory Board of the circumstances notify the Certification Commission, examining board or the Supervisory Board, which shall take a decision, the Member concerned shall not participate in the evaluation work of the applicant in question, answer exam or complaints.
V. refusal to grant a certificate or the status of Assistant 31. Certificate Authority shall refuse the grant of a certificate, if the applicant does not meet: 31.1. the provisions referred to in paragraph 4, the professional qualification requirements; 31.2. the Certification Commission for verification of the selected evaluation work does not meet the standards of the profession; 31.3. the applicant unsuccessfully defended the assessment work; 19.5. the applicant has not received the exam this provision in paragraph 23 the minimum number of points; 31.5. the applicant repeatedly without justification, not come to the Certification Commission. 32. the certification body shall refuse to grant the status of Assistant, if the person who lays claim to Assistant status: 32.1. does not meet the rules set out in paragraph 5 of the professional qualification requirements; 32.2. the exam is not received this rule in paragraph 23 the minimum number of points; 32.3. If, without justification, the Certification Commission has not arrived for the hearing. 33. If the certification body shall decide on the refusal to grant a certificate or the status of the Assistant (the refusal), it shall notify the applicant of the decision or the person who lays claim to Assistant status, notification in accordance with the procedure prescribed by law. 34. If the applicant or the person who lays claim to obtain the status of Assistant, has received a refusal, he has the right to re-submit an application for the granting of the certificate or Assistant status only after all refusal reason specified in the resolution. 35. If the applicant received a rejection of these rules, or 19.5 19.4 19.4..., in the case referred to in subparagraph or the person entitled to obtain the status of Assistant – this rule 32.2. in the case referred to in subparagraph, they shall have the right to re-submit an application for the granting of the certificate or Assistant status not earlier than after six months, but no more than three times in two years.
Vi. the period of validity of the certificate and the certified personal journal and the paper issued certificate information appearing in the

36. the certificate is granted for a period of five years. 37. The certified person log for each certified person shall bear the following information: 37.1. certified persons name, surname and personal code; 37.2. the action to be certified; 37.3. first-time certification date; 37.4. date of award of the certificate; 37.5. the period of validity of the certificate; 23.4. the registration number of the certificate; 37.7. certificate of start and end dates; 23.5. the cancellation of the certificate. 38. the certification institution of certified written request of the person receiving it shall be issued certificates in paper form. Paper form issued certificate indicates the following: 38.1. certification authority's full name; 38.2. the certified persons name, surname and personal code; 38.3. the action to be certified; 23.9. the first certification date; 38.5. date of award of the certificate; 24.0. period of validity of the certificate; 36.6. certificate registration number; 24.1. the certification authority's stamp and signature of the head of the certification body.
VII. the receipt of certificate, certificate suspension, the status of the certificate or the cancellation of Assistant and recognition of void 39. the certification body shall have the right, after the certificate had expired certified person shall issue a new certificate (hereinafter certificate again) to a new five-year term. Before the certificate is issued after a random check of the person certified in the previous two years of the three evaluation work carried out compliance with the standard requirements of the profession. 40. The certified person no later than one month before the expiry of the certificate, the certification authority shall, in the application for the issuance of the certificate again and add this rule 12.3., 12.4 and 12.6. documents referred to. 41. the certification authority within three working days after receipt of the application, examine the documents submitted, and inform the certified person if the information supplied is incomplete, a reasonable period of time, but not less than five working days, to prevent the deficiencies found, as well as inform the certified person that the decision on the grant of the certificate or a refusal to grant a certificate will be accepted again within one month after receipt of all required documents. 42. If the certificate authority 41 these provisions within the time limit referred to in paragraph has not notified the person of the certified decision, considered that the certification authority has granted the certificate in accordance with the law of freedom to provide services the default referred to in principle. 43. a repeated number of the certificate, the certificate does not change. Repeated certificate is valid starting the day after the certificate had expired. 44. A warning about the suspension of the certificate shall, if the person is certified incorrectly assessed the real estate profession in breach of the requirements laid down in the standard. 45. the certificate is suspended in the following cases: 45.1. a certified person is repeatedly misjudged the real estate profession in breach of the requirements of the standard, and already has received a warning about the suspension of the certificate; 45.2. you have received a demand of the person certified for good reasons to temporarily suspend the operation of the certificate. 46. the certificate shall be cancelled in the following cases: 46.1. certified person has made the real estate appraisal when it granted the certificate were suspended; 46.2. the certified person is repeatedly misjudged the real estate profession in breach of the requirements of the standard, also those which gave rise to the suspension of the certificate granted; 46.3. the certified person intentionally provided false certificate; 46.4. the certified person for more than a year has not taken real estate appraiser; 46.5. the certified person is received the request to revoke the certificate. 47. the status of the Assistant shall be cancelled in the following cases: 29.3. Assistant no longer than a year carried out by the real estate appraiser Assistant jobs; 47.2. knowingly provides false information assistant status; 47.3. the Assistant request has been received to revoke the status of the Assistant. 48. The certification bodies designated certified real estate appraiser certificate authority before taking a decision on any certified check or Assistant of information received, which may become the basis for this rule 44, 45 and 46, paragraph. the making of the decision. Assigning real estate assessor for inspection, compliance with this provision, paragraph 30. 49. any natural or legal person is entitled to lodge a complaint about the certification body certified personal work or inform the certification authority for this rule 44, 45 or 46, paragraph. the irregularities that are done in a certified person. 50. the certification body shall consider the complaint and in the month after its receipt, respond in writing to the complainant, as well as in writing inform the certified person. 51. A Person whose certificate has been suspended or whose certificate is revoked, or who has received a refusal on the certificate, the certification authority has the right to register and to work as an Assistant Supervisor. 52. The Person real estate assessment is carried out in accordance with the provisions of paragraph 51 and whose activities are detected in this rule 44, 45 and 46, paragraph. threats, not be eligible for a suspended certificate renewal or a new certificate. A duplicate of the certificate validity period is the same as the original issued certificate. 55. Information on the certificates granted and withdrawn, as well as the suspension of the certificate certificate authority within three working days after the decision is published on their website and make appropriate amendments to the journal. 56. the certification body's decision on the refusal of the grant of a certificate, certificate revocation, certificate suspension or refusal to reassign the certificate can challenge the certification authority's Supervisory Board. The decision of the Supervisory Board may be appealed to the Court of Justice of the administrative procedure law.
VIII. Closing questions 57. Be declared unenforceable in the Cabinet of Ministers on 9 December 2002, Regulation No 534 "procedures for receiving a certificate of professional qualification of real estate evaluation" (Latvian journal, 2002, nr. 185.; 2003, nr. 103.206. no; 2009; 13, no. 168). 58. the certificate issued in accordance with the Cabinet of Ministers on 9 December 2002 the regulations no 534 "procedures for receiving a certificate of professional qualification of real estate evaluation", are valid until their expiry date. 59. in paragraph 2 of these regulations shall also apply to the certification authority, in accordance with the laws and regulations in the field of conformity assessment national agency "Latvian National Accreditation Bureau accredited until July 1, 2009.
