Cabinet of Ministers Regulations No. 559 Riga 2014 (23 September. No 50 28) requirements for real estate appraisers professional qualifications and vocational qualifications certificate procedure Issued in accordance with the law "About the regulated professions and the recognition of professional qualifications" article 32 of the sixth and mortgage bonds Act article 15 i. General questions 1. Rules lays down the requirements for a real estate appraiser's professional skills and procedures to be issued a certificate of professional qualification of real estate evaluation (hereinafter referred to as the certificate). 2. A certificate of professional qualification of the person to determine the real market value of the property, shall be issued by the institution that is accredited by the national accreditation body in accordance with the laws and regulations on assessment of conformity assessment bodies, accreditation and supervision (hereinafter referred to as a certificate authority), or another Member State of the European Union, Turkish or European economic area country accredited certification body that implement the requirements laid down in these provisions. The national accreditation body shall publish its official website information on accredited conformity assessment bodies. 3. the certification body registers persons prescribed in these provisions is assigned to a certificate (hereinafter referred to as the certified person), certified personal log (Journal). II. Requirements for real estate appraisers professional qualifications 4. A Person is eligible for a certificate if it meets the following real estate appraisers professional qualifications requirements: 4.1 a person has acquired higher education fifth level professional qualification in real estate valuation (professional code 3142 12 "real estate expert") or higher education fifth professional qualification in related field, which is related to real estate , and acquired the real estate assessor profession requires expertise in the professional continuing education program accredited; 4.2. the real property is assessed according to the requirements in the legislation of certain professions in the real-estate evaluator's profession (professional standard); 4.3. the person is at least three years of work experience in the real estate valuation, and this time it is assessed at least 20 real estate objects. 5. III. Documents to be submitted 12. A Person who qualifies for a certificate (hereinafter the applicant) or Assistant status, submit a certificate authority (in person, presenting the identity card, or by sending by registered mail): 12.1. applications; 12.2. a copy of the document (the presentation of the original or notarized copy), which shows that a person's education meets this provision in paragraph 4.1 or paragraph 5 the requirements; 12.3. Description of professional activities; 12.4. the supervisor confirmed the previous three years in real estate valuation (hereinafter referred to as the assessment); 12.5. the Assistant-Supervisor's recommendation for a certificate; 12.6. personal proof that the person is not punished for this rule referred to in paragraph 11 crimes. 13. The rules referred to in paragraph 12 of the application and the documents annexed thereto a certificate authority can be submitted electronically, if the electronic document was made according to the regulations on electronic document design. V. refusal to grant a certificate or the status of Assistant 31. Certificate Authority shall refuse the grant of a certificate, if the applicant does not meet: 31.1. the provisions referred to in paragraph 4, the professional qualification requirements; 31.2. the Certification Commission for verification of the selected evaluation work does not meet the standards of the profession; 31.3. the applicant unsuccessfully defended the assessment work; 19.5. the applicant has not received the exam this provision in paragraph 23 the minimum number of points; 31.5. the applicant repeatedly without justification, not come to the Certification Commission. 32. the certification body shall refuse to grant the status of Assistant, if the person who lays claim to Assistant status: 32.1. does not meet the rules set out in paragraph 5 of the professional qualification requirements; 32.2. the exam is not received this rule in paragraph 23 the minimum number of points; 32.3. If, without justification, the Certification Commission has not arrived for the hearing. 33. If the certification body shall decide on the refusal to grant a certificate or the status of the Assistant (the refusal), it shall notify the applicant of the decision or the person who lays claim to Assistant status, notification in accordance with the procedure prescribed by law. 34. If the applicant or the person who lays claim to obtain the status of Assistant, has received a refusal, he has the right to re-submit an application for the granting of the certificate or Assistant status only after all refusal reason specified in the resolution. 35. If the applicant received a rejection of these rules, or 19.5 19.4 19.4..., in the case referred to in subparagraph or the person entitled to obtain the status of Assistant – this rule 32.2. in the case referred to in subparagraph, they shall have the right to re-submit an application for the granting of the certificate or Assistant status not earlier than after six months, but no more than three times in two years.

Paper form issued certificate indicates the following: 38.1. certification authority's full name; 38.2. the certified persons name, surname and personal code; 38.3. the action to be certified; 23.9. the first certification date; 38.5. date of award of the certificate; 24.0. period of validity of the certificate; 36.6. certificate registration number; 24.1. the certification authority's stamp and signature of the head of the certification body.
VII. the receipt of certificate, certificate suspension, the status of the certificate or the cancellation of Assistant and recognition of void 39. the certification body shall have the right, after the certificate had expired certified person shall issue a new certificate (hereinafter certificate again) to a new five-year term. A warning about the suspension of the certificate shall, if the person is certified incorrectly assessed the real estate profession in breach of the requirements laid down in the standard. 45. the certificate is suspended in the following cases: 45.1. a certified person is repeatedly misjudged the real estate profession in breach of the requirements of the standard, and already has received a warning about the suspension of the certificate; 45.2. you have received a demand of the person certified for good reasons to temporarily suspend the operation of the certificate. 46. the certificate shall be cancelled in the following cases: 46.1. certified person has made the real estate appraisal when it granted the certificate were suspended; 46.2. the certified person is repeatedly misjudged the real estate profession in breach of the requirements of the standard, also those which gave rise to the suspension of the certificate granted; 46.3. the certified person intentionally provided false certificate; 46.4. the certified person for more than a year has not taken real estate appraiser; 46.5. the certified person is received the request to revoke the certificate. 47. the status of the Assistant shall be cancelled in the following cases: 29.3. Assistant no longer than a year carried out by the real estate appraiser Assistant jobs; 47.2. knowingly provides false information assistant status; 47.3. the Assistant request has been received to revoke the status of the Assistant. 48. VIII. Closing questions 57. Be declared unenforceable in the Cabinet of Ministers on 9 December 2002, Regulation No 534 "procedures for receiving a certificate of professional qualification of real estate evaluation" (Latvian journal, 2002, nr. 185.; 2003, nr. 103.206. no; 2009; 13, no. 168). 58. the certificate issued in accordance with the Cabinet of Ministers on 9 December 2002 the regulations no 534 "procedures for receiving a certificate of professional qualification of real estate evaluation", are valid until their expiry date. 59. in paragraph 2 of these regulations shall also apply to the certification authority, in accordance with the laws and regulations in the field of conformity assessment national agency "Latvian National Accreditation Bureau accredited until July 1, 2009.
