The Cabinet of Ministers of the Republic of Latvia, 1998 February 17 rules no. Riga, 5 5 (7.21) rules on industrial fishing in the territorial waters of the Republic of Latvia, the economic waters and the Gulf of Riga were issued under the Fisheries Act article 13 i. General questions 1. These rules determine the order in which the Latvian and foreign natural and legal persons conducting industrial fishing in the territorial waters of the Republic of Latvia, the economic waters and the Gulf of Riga (hereinafter marine waters) , as well as industrial fishing in the fish resource and protection e s logged conditions.
2. 3. 5. the Sea Fishing is allowed, if it is presented in the following documents: 5.1 legal persons — if the fishery is a license to conduct business, but the fishermen — individual workers — if they are registered for the protection of the environment and Ministry of regional development in the management of the marine environment (Marine administration);
5.2. 6. foreign natural and legal persons (hereinafter referred to as foreign fishermen) fishing by Latvia's economic waters and the Gulf of Riga, on the basis of the current year the agreement protocol signed under the binding international agreements.
7. fishing in sea waters are allowed: 7.1. in accordance with the fishing limits laid down each year by matching with the protection of the environment and regional development Ministry and, taking into account the International Baltic Sea Fishery Commission allocated catch quotas for Latvia and the Latvian Institute of fisheries research recommendations, established the Ministry of agriculture in the national fisheries authority (hereinafter referred to as the fish's aimniecīb authority);

8. the marine waters of scientific and other specific purposes (fish farming, acclimatization, kontrolzvej, melioratīv and other types of fishing), after coordination with the fisheries management and environmental State Inspectorate issued the relevant fishing permits (licenses) of the date of receipt of specialized research vessels or other vessels and floating means. II. obligations of the Fishermen 9. General responsibilities: 9.1. fish with vessels included in the lists approved by the fisheries administration, and not to exceed the limits of fishing;

9.4. in ascending order to collect data on catches by fish species in each fishing sub-area or coastal fisheries and fisheries management in accordance with the approved report form to submit relevant information in the management of the marine environment: 9.4.1. Latvian fishermen, not later than the month following the reporting month, the sixth date;
9.4.2. foreign fishermen, not later than the month following the reporting month twentieth date;
9.5. the fisheries management, environmental State Inspectorate or the management of the marine environment of the request to provide information, which describes the fishing waters of the sea, and messages related to ship and boat identification and characteristics;

9.12. allow national inspection of the environment and the management of the marine environment of the authorised officers to examine every board room, to present a test fishery, fish caught and treated, finished products, fishing gear and fishing-related documents and allow extracts from them, as well as to provide inspection not needed., p
10. the captains and Assistant captains (the guard's) responsibilities, as well as through fishing, fish processing and transportation: 10.1 to take on board and transfer to other ships and the environmental State inspection management of the marine environment of the authorising officers, who shall perform the duties, at their request;
10.2. allow national inspection of the environment and the management of the marine environment of the authorised officers, who perform their duties, free stay on the offshore vessels;
10.3. free to broadcast from a ship of State environmental inspection stations and marine environmental management officials notified the service of messages;

12. in paragraph 11 of these rules and 3. gear referred to in the annex are not considered ready for use if: 12.1. trawl door is securely fixed to the falšbort internal or external parties or trawl the circles and veijer and cables disconnected from or reels;

IV. Fishing gear characteristics and allowable number 15. If the networks of mesh size less than: 15.2.1. cod 105-mm; 15.2.2. flounder fishing in the subregion — 120 mm 26; 15.2.3. flounder fishing in subdivision 28-110 mm; 15.3. trawls, the mesh if step is less than the specialized fishing for specified the following dimensions : 15.3.1. herring fishing in the subregion — 16 mm 26.15.3.2. herring fishing; 28. subregional-14 mm for fishing for sprat 15.3.3.26 and 28. subregional-8 mm 15.4. specialized in fishing gear, the mesh if a step does not meet the following dimensions: 15.4.1. herring and smelt fishing with nets and riser: from 14 to 25 mm; 15.4.2. sprat for fishing with nets, from 10 to 15 mm. lucīš fishing with 15.4.3 lucīš pots — from 16 up to 20 mm (excluding consist tail);
15.5. salmon and sea trout in directed fishing for: 15.5.1. drift nets and anchored floating nets, if of mesh size less than 157 mm; 15.5.2. use one fishing vessel more than 600 drifting and floating anchored nets, taking into account that the length of each net not exceeding 35 metres, measured along the augšvir;
15.5.3. simultaneous use of one fishing vessel drifting or anchored in long lines, which together have more than 2,000 hooks;
15.5.4. keep on one ship more than 100 reserve nets and 200 Reserve hooks;
15.5.5. use hooks that the shortest distance of the spires to stalk is less than 19 mm. coastal fisheries: 15.6 15.6.1. individual networks if it exceeds 100 m; 15.6.2. fish and eel traps (sīkzivj) herring fixed gear if it exceeds 600 m back; when network 15.6.3 mesh step is less than 40 mm (except this rule 15.4. in the cases referred to in (a));
15.6.4. fish traps and fish towed cables if the mesh at any step of the construction elements, except cod is less than 30 mm lucīš pots 15.6.5. If it exceeds 2 m in height or length exceeds 30 m Ranch; 15.6.6. eel traps (sīkzivj), if the mesh is less than 16 mm or greater than 18 mm, but the ranch – less than 18 mm or greater than 30 mm 15.6.7. bait fish towed cables If the length exceeds 10 m wingspan and mesh step is less than 6 mm or greater than 12 mm. 16. Specialized in fishing for cod shall be prohibited to have on board the fishing gear, the mesh size of which is smaller than the cod fishing gear allowed in size.
V. Prohibition of fishing times and locations 17. Prohibited: 17.1. flounder fishing specialist, from 15 February to 15 may;
17.2. any fishing of turbot, the processing or storage of vessels and other floating means, from 1 June to 31 July;
17.3. the herring fishery in the Gulf of Riga with trawls, from 12 May to 10 June;
17.4. all types of fishing gear throughout the year, Daugava, Gauja Salatsi, River Lielupe and Venta River estuary areas 1000 m radius from the mouth, while the rest flows into the river and Canal areas — 200 m radius from the mouth;
17.5. the coast with all types of gear: 17.5.1. from 1 May to 31 May, except for herring and lucīš specialized fishing. During the said barring the directed fishing of flounder with Danish seines allowed, starting with the May 16;
17.5.2.1 o ktobr to 15 November, except in specialized fishing flounder with flounder and herring seines specialized fishing with the herring nets;
10.9. lucīš fishing: 17.6.1. trawling — throughout the year.
17.6.2. specialized fishing with traps, from 1 October to 30 April;
17.7. z Veja with Danish seines all year Riga Sea Bay flounder fishing, except in the area of Oviš Horn to Horn of Kolka and fishing with bait fish cord;
11.1. flounder fishing with towed cables in places where the depth does not exceed 5 m; 11.1. specialist sprat fishery in the Gulf of Riga with trawls throughout the year;
17.10. trawling in areas where the depth does not exceed 20 m, as well as Partridge Strait between the lines that connect the Oviš Lighthouse (57 ° 34,1234 21 ° 42,9574 '; ') with the Load of the lighthouse (57 ° 21 ° 58,2789 ' 57,4760 ';) West and kolka Horn (57 ° N 22 ° 45,60 '; 36,40 ' E) with Kāvinin Lighthouse (57 ° N 22 ° 36,80 59,00 '; ' E) in the East, and 187, 194.201. fishing and square (annex 1);
17.11. trawling if they attached gruntrop, the Gulf of Riga — throughout the year.

17.13. transhipment of cod at sea to other ships or floating means.
18. Salmon and sea trout fishing is prohibited in the specialized: 18.1 with drifting nets and anchored floating nets from 1 June to 15 September;
18.2. with drifting and moored in line — from 1 April to 15 November;
18.3. with drift nets, anchored floating nets and drift or anchor in the longline fisheries in the Gulf of Riga and sea coast — throughout the year.
18.4. to all types of fishing gear on the coast, from 1 October to 15 November.
19. Ð o rule 15, 16, 17 and 18 of the said fishing is considered specialized if: 19.1 is made of a given fish species fishing with this fish species to the fishing gear and fish species and fishing gear are recorded in the fishing licence (the licence);

Vi. the minimum length of the fish and non-target volumes 20. It shall be prohibited to exceed the provisions mentioned in paragraph 22 of the undersized fish by-catch, as well as to accept, handle, transport, store and sell the following species, if their size is less fresh than: 20.1. sprat (sprattus sprattus baltic), 10 cm; 20.2. smelt (Osmer to eperlan): 11 cm; 20.3. herring (Clupea harengus Membri): 20.3.1. The Gulf of Riga and its coast — 11 cm; 20.3.2. sea and its coast-13 cm; 20.4. perch (Perca fluviatilis) — 17 cm 20.5. lucīt (zoarces viviparus)-20 cm; 20.6. flounder (platichthys flesus trachurus): 21 cm; 20.7. Vimbai (Vimb-vimb)-29 cm; 12.9. Norman (abramis Brama): 29 cm; 20.9. ālant (id Leucisc)-29 cm; 20.10. turbot (Psett maximum) — 30 cm 20.11. whitefish (Coregonus lavaretus) — 35 cm; 20.12. cod (Gadus morhua callari) — 35 cm 20.13. eel (Anguilla Anguilla) — 45 cm 20.14. Zander (Stizostedion lucioperc) — 45 cm 20.15. Pike (Esox Lucio) — 45 cm. sea trout to 20.16 (Salmo trutta) — 50 cm; 20.17. salmon (Salmo salar) 60 cm.

21. The rules referred to in paragraph 20 of the fish size is determined by measuring the fish from the muzzle end (closed mouth) to the end of the tail fin. If processed (salted, smoked or dried) fish, a particular size is reduced by 4%.
22. the level of by-catch fish volume: 22.1. by herring and cod fishing for sprat shall not exceed 10% of the total weight of the catch, except that rule 22.8. referred cases. Undersized cod may not be more than 5% of cod by-catch;
22.2. undersized cod, flounder and turbot by-catches should not exceed 5% of the species concerned one or network hauls the catch weight;
22.3. undersized herring and sprat catch catch of each species listed must not exceed 15% of their number one, except the first hauls hauls, after which, if the by-catch exceeded certain interest, fishing must stop or change the location;

14.1. the rest of the undersized fish that are not mentioned in this rule 22.1, 22.2, 22.3, 22.4..., 22.5 and 22.6. in point total by-catches should not exceed 5% of the total catch weight;
22.8. After some fish species fishing limit full learning by doing other specialized fishing fish species may not exceed 5% by-catch of this species from the total weight of the catch.
23. Not allowed: 23.1. undersized salmon and sea trout catches;
23.2. the by-catches of turbot fishing ban period.

24. If catches exceed this rules 22 and by-catches laid down in paragraph 23, the quantity of fish released immediately and make the relevant entries in the logbook, considering that: 24.1. by-catches of the species is considered to be the particular role of fish for which fishing is prohibited during the period, place, or with the appropriate gear, as well as small fish and fish for which fishing is not for fishing permission (licence);

VII. 25.4. subject to the International Baltic Sea Fishery Commission for Latvia allocated catch quotas, establish fishing limits and catch fish volume of exchanges provided for in the protocols signed in the framework of intergovernmental agreements, as well as to define the allowable number of fishing vessels and fishing type marine waters, and to divide the fishing limits for fishermen.
26. The fisheries administration is right not to conclude commercial fishing rights lease, as well as the right not to grant additional fishing limit and not to issue new fishery business licence if the purchase of a fishing vessel or structure not previously matched by the fisheries administration.
27. the functions of the environmental State and insp marine management authorised officers have the following rights and obligations: 27.1. to issue fishing permits (licences) and determine their procedures for the issuing and extension, as well as fishing regulations test before a fishing permit (licence) issued and register the fishermen — the individual Installer;
27.2. the infringement cases, suspend or withdraw a fishing authorisation (licence) and inform the relevant fisheries management or coastal municipalities;
27.3. stay on board fishing vessels and floating means of space ship, caught and processed fish products, fishing gear, fishing and fishing-related documents, as well as write the required information from the document referred to in the nt;
27.4. to request from the fishermen on fishing information;
27.5. upon arrival of a vessel at the port of unloading fish and make the first sales documents and records;
17.1. to collect from the fishermen received messages for the current month and the month following the reporting month, the 15th date of the fisheries management and Fisheries Research Institute of Latvia to submit a report on the fish catch in the previous month.
VIII. Liability for non-compliance with these rules 28. natural and legal persons, irrespective of the administrative penalty imposed or criminal sanctions is bound in accordance with the provisions of annex 5 of the damages caused to the fish resources as a result of these regulations.
29. irrespective of the administrative penalty imposed or criminal penalties if these rules are breached again, the environmental State inspection and management of the marine environment of the authorized officials entitled to withdraw a fishing authorisation issued (license). The fishing regulations may result in the refusal to grant the s limit next year or lease fishing rights for breach of contract.
30. 31. Environmental State inspection and marine environmental management officials at the request of the authorised fishing gear and floating means used in fishing, the absence of such provisions, as well as the fish caught up to their sales or take the place of storage of the offending provisions.
IX. Transition issues 32. Lucīš the prohibition of the use of fishing gear that is defined on this provision in 15.4.3, shall enter into force by 1 January 1999.

1.5. String that connects the fishing gear and buoys should be from sinking or weight-bearing material;

1.6. displayed must be at least 1.5 m above the water level. Flags must be rectangular and each edge of the flag, not shorter than 40 cm. Distance between two flags along the vertical must be at least 20 cm. Distance between the flag and the surface of the water must be at least 80 cm. Flag, which is a fishing tool, both ends must be the same colour (other than white) and with the same size. Top of the mark must be spherical (round) 25 cm in diameter and with fluorescent tape. These marks may be used instead of the spherical ra d arreflektor. For fluorescent tape must be at least 6 cm wide. The light must be yellow and flashing with a five-second intervals and the visibility of at least two nautical miles away. 2.
