Provisions of the Ministry of transport no. 12 in Riga, 8 May 2000, the rules on cargo expedition services business certification Issued in accordance with the Cabinet of Ministers of 17 October 1995, rule no. 301 "provisions of the freight forwarder and cargo expedition services" point 7 i. General questions 1. These rules determine the order in which is assigned and issued certificate for cargo expedition services for business, as well as the order in which the certificate is cancelled or temporarily suspended its operation. Provisions do not apply to mail forwarding services.
2. the Forwarder business certification aimed at freight forwarder the professional levels and the provision of assistance to the freight forwarders in the Organization of work in accordance with international market requirements, subject to the legislation of the Republic of Latvia and the international conventions and treaties to which Latvia acceded to the Republic.
3. A certificate for the right to engage in the business of cargo expedition (annex 1) is assigned to the enterprise register of the Republic of Latvia in the registered company, company (hereinafter referred to as the operator), dealing or wish to engage with the Cabinet of Ministers of 17 October 1995, rule no. 301 "provisions of the freight forwarder and cargo expedition services" referred to in paragraph 4, the freight forwarding services related to international transport of cargo.
4. the decision on the award of the certificate, its suspension or revocation shall be taken up by the Ministry of Transport Commission (hereinafter the Commission), which consists of the Ministry of transport, the Latvian National Association of freight forwarder LAFF, Latvian transit business association, the Riga Technical University and the State revenue service the main customs administration.
5. certification document tracking and storage, manufacture and issuance of certificates made the Latvian National Association of freight forwarders of the LAFF.
6. On the certificates granted by the cancellation or suspension of their activities, the Commission notified LATVIA State revenue service and the State revenue service to the main customs administration. Certified freight forwarder list quarterly published newspaper "journal".
II. modalities of the certificate and the date 7. To decide on the award of the certificate, shall be assessed by the Commission: 7.1 or operator's financial position is adequate to ensure the financial operation of the shippers at least the minimum amount, that is, that the entrepreneur available capital and financial reserves, funds, including cash deposits, bank loans or loan, any assets, including property, is not less than $10 000;
7.2. the host of a short work plan developed for the host into an existing market and development of business;
7.3. the host specified natural persons in the company (the company) is responsible for the organisation of the professional level of freight forwarding services, in compliance with the requirements;
7.4. other provisions of paragraph 10 of the mentioned documents and information.
8. the person in charge must prove: 8.1 professional competence: a certificate of Riga Technical University exam, or pass on the other Latvian and foreign learning institutions full training program or course completion that meets Latvian National Association of freight forwarders of the training program developed to LAFF;
8.2. working experience: excerpt from the book, a copy of the employment contract or other documents, such as a certificate from the person responsible for the current or previous jobs with companies (company) the driver's signature on it that this person was working in this company (the company), and its responsibilities related to the provision of services;
8.3. a good reputation: person in charge is not penalized for intentional criminal offences in the area of business for which a responsible person with a personal signature declared in the application.
9. One and the same person may be responsible for more than one company (the company). The Commission is entitled to adopt a decision on one and the same person responsible for the approval of multiple companies, if the person is the owner or co-owner.
10. in order to receive the certificate, the operator is required to submit: 10.1 to shape the application (annex 2);
10.2. LR enterprise register business registration certificate issued in a notarized copy (or copy by presentation of the original of the certificate of registration);
10.3. notarized statement from the Statute (or a copy of the presentation of the original of the Statute), which shows a host of occupation with a cargo expedition services in accordance with the "statistical classification of economic activities in the European Union, NACE", if it is not mentioned in the certificate of registration;
10.4. inquire about entry into the taxpayer's accounting and tax payment, valid for no later than 30 days from the date of issue and shall certify that the operator pays taxes in a timely manner or in the order is registered as a taxable person (if the host has just started its operations);
10.5. the document certifying this provision as referred to in point 8.1 responsible professional competence;
10.6. proof of this rule 8.2. responsible person referred to in the work experience in the field of cargo expedition;
10.7. the document which certifies that the person responsible is the business owner, founder, Manager or other employee whose duties under a contract of employment fall within the freight forwarding services (contract of employment, the statement from the book or document certifying the persons responsible for the status of the owner or founder);
10.8. a certificate by the head of the company and the signature of the accounting officer that the person working in this company and receive a salary that pays social tax for the current year (indicate the social insurance fund of the district);
10.9. the space that our expedition activities and equipped with communication facilities: telephone, fax, etc., property or rental receipt;
10.10. bank certificate for current account opening;
10.11. the brief work plan (annex 3);
10.12. Declaration on the financial position of the company Manager and the Chief Accountant signature (annex 4).
11. the host, which is an international freight forwarder Association Federation of FIAT, the Latvian National Association of freight forwarder LAFF or Latvian transit business association, or a member of another community group, the International Federation of freight forwarder associations of FIAT's Member to get a certificate to those provisions 10.1, 10.2, 10.3, 10.4, 10.7.. and 10.11. the documents referred to in subparagraphs and respective associations or public bodies of that recommendation.
12. following the decision of the Commission the certificate is granted for a period of between one and five years. If the host is registered in the commercial register of LATVIA less than one year or if the person cannot prove that its experience in the field of the expedition is over one year, then the certificate is granted for one year.
13. If the host is unable to provide this rule 10.5, referred to by the Commission shall be entitled to assign the host request temporary certificate for a period of up to four months. When the operator shall submit the rule 10.5, referred to a temporary period of validity of the certificate is extended for a full term in accordance with the provisions of paragraph 12.
14. To extend, in accordance with paragraph 12 of these regulations, the assigned to the period of validity of the certificate, the operator, not later than one month before the existing certificate expires, the Certification Commission submitted that rule 10.4, 10.8 and 10.12. the documents referred to in points, but this provision in paragraph 11 of this operator certificate renewal of those provisions referred to in paragraph 11 of the Association or the public bodies of the recommendations and the provisions referred to in section 10.4.
15. Regardless of the period of validity of the certificate, in case, if the person no longer works for the company or where the company reorganization (legal status change, name change, new structures), the operator within 30 days of written notice of the Certification Commission and submit documents to a new certificate.
16. A change in the host address or phone number, then traders must have 10 days to notify the Certification Commission of the means of communication.
17. the certificate Exchange or its validity in the event of termination, the old certificate shall be transferred to the Latvian National Association of freight forwarder LAFF, where it is stored for one year and are then destroyed, by drawing up legislation.
18. in the event of the loss of the certificate, the operator shall immediately notify the Certification Commission published information about it in the newspaper "journal". After publication in the Official Gazette the host receives a new certificate in accordance with the requirements of this regulation.

19. at the hearing the Commission the question of the granting of the certificate or extension of the term of validity is considered the host agent (responsible person or Manager), but this provision, paragraph 13, in the case referred to in the question under consideration without the presence of a representative of the host.
20. certification the Commission may refuse to grant a certificate to the operator: 20.1. if failure to observe the requirements of this Regulation: 20.1.1. those responsible for professional competence;
20.1.2. of good repute;
20.1.3. requirements for the Organization of work;
20.1.4. financial position;
20.2. If not submitted all the required documents;
20.3. the false news provision.
21. the award of the certificate of the reasons for the refusal are recorded in the minutes of the Commission of certification, and the operator upon request within 15 days of being informed in writing of the reasons for the refusal.
III. Certified Business control, certificate suspension and cancellation 22. Certified Business controls are carried out by the Ministry of transport and the other notified bodies of the Ministry, which controls the business and international goods transport-related legislation.
23. the forwarder, through a contract with the operator, proves its right to carry out the activities of the expedition, by presenting a certificate if required by the host.
24. the Commission has the right to suspend the operation of the certificate for a period of up to three months: 24.1. If the person no longer works for the company, for which the host is informed in advance;
24.2. If the Commission has information that the operator stopped the action, changed its name or registered address, etc., and with the host cannot be contacted at the address indicated or to the indicated communication means;
15.1. If the Commission does not take time to clarify the infringement in accordance with the provisions of paragraph 25.2.
25. The Commission is entitled to consider the question of the withdrawal of the certificate: 25.1. If the operator submitted the messages that do not match reality;
25.2. failure to comply with the legislation of the Republic of Latvia, international conventions and treaties, which the Republic of Latvia is a member of the governing freight forwarding services, and the Commission recognises that it is proved that the freight forwarder has knowingly violated the above legislative requirements;
25.3. If an operator withdraws or is excluded from the international freight forwarder Association Federation of FIAT or from these terms referred to in paragraph 11 of the Association or public body;
25.4. If the host is not taken out a certificate three months after it was granted;
25.5. If the host does not follow that rule 15 of the rules.
26. For cancellation of the certificate, the operator is informed in writing not later than 10 days after such decision, and 15 days after the receipt of the certificate shall be forwarded to the Commission. The Commission may consider the question of the granting of the certificate again not earlier than three months after the cancellation of the certificate.
27. the host claims for refusal to grant a certificate or the suspension or cancellation of the Ministry of transport of the appearance that the decision may be appealed to the law in a certain order.
28. On the issue of the certificate of manufacture, inventory, database maintenance, as well as the Certification Commission of the Latvian National Association of freight forwarding agents charged the LAFF pay $25 per certificate.
IV. Closing questions 29. Regulations shall enter into force from 1 October 2000.

31. If the operator certificate granted before the entry into force of these regulations, then this certificate is valid until the end of the period. After the certificate expires, a new certificate is assigned in accordance with the requirements of this regulation.
