Cabinet of Ministers Regulations No. 258 in 2015 (26 May. No 26) State aid modalities for the implementation of the project within the framework of the Eureka program Issued in accordance with the law of scientific activity article 33, third part i. General questions 1. determines: 1.1. procedures implemented in Latvia and the Eureka programme granted State aid (hereinafter referred to as aid) Eureka programme (hereinafter the project); 1.2. the conditions for the participants of the project support; 1.3. project evaluation and selection criteria. 2. the rules shall have the following terms: 2.1 the Eureka programme-European scientific institutions and commercial companies, international cooperation activities to promote innovative, competitive technology, product or service development and implementation (hereinafter referred to as the program). The program ieviesējinstitūcij is an international scientific non-profit association "Eureka Secretariat", established in Brussels, Belgium; 2.2. the Member State, the European country that has received a certificate of participation in the program (hereinafter referred to as Member States); 2.3. the associated country-a country which is not located in Europe and which has concluded an agreement with the Eureka Secretariat on participation in the programme (associated country); 2.4. the national program funding authority – the body that implements the program in question in the Member State (hereinafter referred to as the national institution). National institutions in Latvia is the Ministry of education and Science (hereinafter the Ministry); 2.5. The Ministerial Conference, the industry Ministry, national institutions and representatives of the European Commission, the meeting of the Member States, in accordance with national legislation and the rules of the programme and make decisions about development strategies. The Ministerial Conference represented Latvia in the Ministry; 2.6. the Eureka high level group (hereinafter referred to as the high level group)-a group of persons, the members of which, high level representatives of the group in accordance with the national law of the Member States nominated by the industry and approved by the Ministry or national institutions. The high level group also includes representatives of the European Commission. The high level Group mandate determined by the Ministerial Conference. The high level group shall draw up a programme of development strategy, based on the decisions of the Conference of Ministers, coordinates the implementation of the programme in Member States, as well as the national authorities of the Member States shall approve decisions about the contests submitted projects. The high level group Latvia represent respectively the nominated representative of the Ministry; 2.7. the national project coordinator, in accordance with the national law of the person nominated, which functions shall be determined and approved by the national authority (hereinafter referred to as project coordinator). The project coordinator will inform the audience of the program terms of the program, advise the company and representatives of scientific institutions, helps build commercial and scientific institutions of international cooperation, participates in the project coordinator meetings, as well as monitor the implementation of projects; 2.8. project coordinators meeting-project coordinator of the Member States of the programme of the meeting, which is coordinated by the promoters of international cooperation and prepare proposals for the high-level group; 2.9. project documentation – Eureka project application (annex 1), the eligible costs of the Eureka project estimate (annex 2) and the staff employed in the Eureka project list (annex 3); 2.10. project participants: 2.10.1. leading aid applicant – the Republic of Latvia enterprise register in the commercial register (hereinafter register) established the merchant with the status of a legal person (hereinafter referred to as the company) or scientific institutions of the Republic of Latvia in the register (hereinafter register of scientific institutions) registered scientific institutions (hereinafter referred to as the scientific authority), who is directly responsible for project preparation, management and implementation and which has been submitted to the Agency in this Regulation referred to in paragraph 25 of the document; 2.10.2. the tenderer – company or scientific institution which is directly responsible for the preparation and implementation of the project and for which the principal applicant has provided support in this provision the Agency referred to in paragraph 25 of the document; 2.10.3. leading project participants – leading aid applicant with which the national education development agency (hereinafter the Agency) has concluded the provision referred to in paragraph 47 of the Treaty; 2.10.4. project participants-aid applicants, with whom the Agency has concluded that provision of the Treaty, paragraph 47; 2.11. small (micro), small or medium company – a company that meets the European Commission 14 June 2014 to Regulation (EU) No 651/2014 (Official Journal of the European Union, 2014 26 June, no L 187/1) to the specified categories of aid compatible with the internal market, the application of the Treaty and article 107.108 (hereinafter Regulation No 651/2014), annex I; 2.12. a large company – a company which complies with the Regulation No 651/2014 article 2, paragraph 24; 2.13. the company is in difficulties-a company which complies with the Regulation No 651/2014 article 2, paragraph 18; 2.14. innovation-a new scientific, technical, social, cultural or other areas, the development of ideas and technologies for the implementation of a product or service. 3. The objective of the programme is to promote international cooperation between companies and scientific institutions, to promote the innovative product, technology or service development.
II. requirements for the project and support the applicant 4. the project is eligible for support, subject to the following conditions: 4.1 project market demand innovative products, technology or services; 4.2. implementation of the project will involve participants from at least two Member States or one Member State and one associated State; 4.3. the project meets at least one of the priority axis Latvia scientific fundamental and applied research in the field; 4.4. the project involves at least one company – an innovative product, technology or service adopters; 4.5. within a period of three years from the date of completion of the project, project participants provide innovative products developed, technology or service bring to market; 4.6. is designed for business and development plan, which contains information about how to support applicants planning to bring to market innovative products (commercialize) or technology or disseminate fundamental research, industrial research or experimental development activity results, publication of training or knowledge transfer; 4.7. the project is expected to impact on the place (for example, city, municipality), in which the company is registered. 5. the applicant may be eligible if it meets the following conditions: 5.1 it is directly responsible for the preparation and implementation of the project, moreover, the leading aid applicant is directly responsible for project preparation, management and implementation; 5.2. it is available in a stable and sufficient sources of funding, research and technical personnel (operators and technicians) and logistical support, in order to ensure the implementation of the project; 5.3. not subject to recovery orders referred to in Regulation No 651/2014 article 1, paragraph 4, in the "a"; 5.4. under the administration of the State revenue service tax (duty) the debtor of the information available in the database is not a tax or fee debt; 5.5. it by a decision of the Court of Justice has not been declared bankrupt, including not in the bailout process, or the process of legal protection, the economic activity is not terminated or in accordance with the commercial register of the information available, it is not in the process of liquidation (if applicable); 5.6 it is registered in a commercial register or the register of scientific institutions; 5.7. it is not punished for the administrative offences code of the third paragraph of article 189.2 of those administrative offences or are not appropriate for the forced influence of criminal law 280. the funds referred to in the second subparagraph of article of the criminal offence was committed; 5.8. This is not a company in difficulties; 5.9. it has received or intends to receive funding from the State, European Union funds or other financial resources for the same eligible costs or activities; 5.10. If the applicant is a scientific institution which carries out both economic activities and activities which are not economic in nature, it does distinguish between the types of actions and their costs, funding and revenue so as to prevent the cross-subsidisation of economic activity; 5.11. If the applicant is a company, which is also not eligible sectors laid down in Regulation No 651/2014 article 1, paragraph 3, aid may be granted only if the company clearly distinguish between eligible transactions or financial flows, ensuring that activities not eligible sectors do not benefit from aid granted under these rules.
III. eligible activities eligible and non-eligible costs 6. these provisions within the framework of the aid in accordance with Regulation No 651/2014 article 25 as support for research and development projects. Support is provided for projects in all sectors, subject to the provisions of Regulation No 651/2014 article 1, 2, 3, and 5. These constraints. 7. the maximum time limit for the implementation of the project is 36 calendar months. 8. the Support granted from the Ministry of education and science of the State budget programme "70.00.00 other EU policy instruments and measures of the project" 70.06.00 "sub membership of the European Union's research and technology development programmes" for the current year national budget resources available for this purpose. 9. The participants in a project may receive such aid project research and development activity categories of Regulation No 651/2014 2. Article 84, 85, 86 and 87 point.: 9.1 fundamental research, experimental or theoretical work, primarily to acquire new knowledge of the things and phenomena without providing any direct commercial applications or use; 9.2. industrial research: planned research or major research work, to gain new knowledge and skills to the new product, process or service development or already existing products, processes or services essential for improvement. These include the component of complex systems and may include prototype development laboratory environment or an environment with simulated interfaces with existing systems, as well as the creation of the pilot line, if necessary industrial research and in particular proprietary technology validation; 9.3. experimental design (including prototyping) – existing scientific knowledge, technological, business and other relevant knowledge and skills, combining, and use of modelling to develop new or improved products, processes or services. It can also involve, for example, the purpose of which is the new product, process or service definition, conceptual planning and documentation. Experimental design can include prototyping, demonstrations, pilot projects (pilot projects), new or improved products, processes or services testing and validation environment, which reflects real operating conditions, if the main objective is to improve the technical products, processes or services that have not been sufficiently stabilized. It can include any commercially used for the manufacture of prototype or pilot project, which is the final commercial product and where production is too expensive to use it only for demonstration and validation; 9.4. the technical-economic feasibility studies for potential evaluation projects and analyses, in order to facilitate the decision making process, objective and rational in identifying project benefits, disadvantages, opportunities and threats, as well as determining the necessary resources for its implementation and its chances of implementation. 10. the eligible costs of the project are the following: 10.1 the project direct costs: 10.1.1. project personnel costs-remuneration, as well as other regulations determine workers the right to mandatory payments to staff employed on the project, including the national employers ' compulsory social insurance contributions; 10.1.2. with the implementation of the project the project related to the staff employed in the travel and travel costs, in accordance with the laws of the order in which the recoverable costs associated with missions; 10.1.3. the scientific equipment and equipment (fixed assets) costs according to their intensity of use and duration of the project. In respect of eligible costs is to be considered as commercial land transfer costs or actual capital costs; 10.1.5. purchased and the cost of the materials used – the project to inventory, instrument and materials (components, chemicals, laboratory and medication) acquisition and delivery costs, which are listed under the accounting regulatory regulations and are directly attributable to the performance of the project; 10.1.6. subcontracting, consultancy and other outsourcing costs that are directly related and necessary to the implementation of the project and the achievement of the objectives of the project, provided that the cost does not exceed 25 percent of the project total eligible costs; 10.1.7. other direct costs not specified in this provision, 10.1.2, 10.1.3 10.1.1..., and in 10.1.5.10.1.6, that is, a patent license cost of Regulation No 651/2014 article 25 paragraph 3 of section "d", if such a license purchase is required to direct project objectives. These costs must not exceed 25 percent of the project total eligible costs; 10.2. the indirect costs of the project that the project participant encountered in implementing the project, and no more than 20 percent of the direct costs of the project amount: 10.2.1. deductions for maintenance of infrastructure: 10.2.1.1 utilities payments, including electricity, space rental or rent, water supply and sewerage, heating (thermal) and gas, garbage; 10.2.1.2. communications services (mail, internet, telephone); 10.2.1.3. Office expenses (Office supplies, datorprec and copy services); 10.2.1.4. common-use equipment maintenance, maintenance and repair costs; 10.2.1.5. the space, including the sharing of premises, maintenance and repair; 10.2.1.6. holding materials; 10.2.1.7. transportation expenses; 10.2.1.8. technical personnel and administration fees; 10.3. the project other indirect costs; 10.4. the project's external audit costs. 11. Project staff employed in the wage rates, taking into account the Central Administration of statistics data about the average wage rates in Latvia research and development projects for employees, not including the employer State social security payments, are as follows: 11.1 scientific project manager who will plan and manage the project and is responsible for its implementation in General, – up to 18 euros per hour; 11.2. main artist responsible for a specific part of the project and its execution – to 14 euros per hour; 11.3. the project performers who perform certain tasks in the project, up to 11 euros per hour. 12. One project participant's maximum total amount of aid from one financial year to the eligible cost is about 60 000 euros. The financial year of the project is to be considered as the one-year period from this provision in paragraph 47 of the date of conclusion of the contract, as well as the next one-year period, counting from the previous one-year period ending date. 13. The eligible cost intensity (intensity) for each project participant pursuant to Regulation No 651/2014 article 25 paragraph 5 below: 13.1. fundamental research – up to 100 percent; 13.2. industrial research: up to 50 percent; 13.3. the design for experimental – up to 25 percent; 13.4. the technical economic feasibility studies, up to 50 percent. 14. in accordance with Regulation No 651/2014 article 25 paragraph 6 of the industrial research and experimental development the aid intensity may be increased up to a maximum aid intensity of 80% of the eligible costs: for 14.1 percent 10-medium companies and 20 percent – the small commercial companies; 14.2.15 percent, if any of the following conditions: 14.2.1. the project involves one of the following effective cooperation between commercial companies: 14.2.1.1., of which at least one is small (micro), small or medium company or project implemented in at least two Member States of the European Union or a Member State of the European Union and the European economic area agreement of the Contracting Parties and no individual company does not cover more than 70 percent of the eligible costs; 14.2.1.2. between the company and one or more research and knowledge dissemination, covering at least 10 per cent of the eligible costs and has the right to publish the results of their research; 14.2.2. the results of the project are widely disseminated in conferences, publications, free repositories or using the free or open source software. 15. in accordance with Regulation No 651/2014 article 25, paragraph 7 of the technical-economic feasibility studies, the aid intensity may be increased by 10 percent on average companies and 20 percent for small companies. 16. If the participant of the project planned activities include a variety of eligible research and development work in the category of Regulation No 651/2014 2. Aid shall not be granted if the project participants will work on a project or an activity project started before the Eureka project application (hereinafter application) to the Agency for submission under Regulation No 651/2014 article 6 paragraph 2. 19. project participants shall ensure the implementation of certain projects relating to the financial transactions of the revenue and expenditure accounting records according to the regulations on the procedures the financial statements reflect the State, local, foreign, European Union, other international organisations and institutions, financial aid (financial assistance), donations and donations in cash or in kind.
IV. The draft invitation to tender and project submission 20. Program and projects managed by the Agency. 21. Project tender issued by the Agency, publication of a notice of the Agency's homepage (http://viaa.gov.lv). 22. the communication of the design contest: 22.1. the invitation to tender concerned available aid funding; 22.2. the deadline for the submission of project documents, which shall be no less than 30 working days from the day of promulgation; 22.3. the submission of project documents and procedures; 22.4. homepage, which published documents used for the preparation of the draft; 22.5. other information, which the Agency considers it necessary to specify in the notice. 23. Of the design contest notice shall be published no earlier than one month from the date of entry into force of the provisions. 24. the applicant in the project announced the contest you can submit one application (annex 1). 25. To apply for aid, a leading aid agency, the applicant shall submit the following documents: 25.1. completed and all supporting the applicant signed application (annex 1); 25.2. each applicant fill in support of the applicant's receipt of the aid (annex 4); 25.3. the eligible costs of the Eureka project for each support the applicant (annex 2); 25.4. the staff employed in the project list for each support the applicant (annex 3), as well as the scientific leader of the project's life and work curriculum description (CV); 25.5. each aid applicant's financial statements for the last two financial years, if the applicant is a company; 6. each applicant supports public reporting of scientific operations for the last two years, the report concluded, if the applicant is a scientific institution. If the scientific authority was founded less than two years ago, submitted to the public accounts for the accounting years closed its registration in the register of scientific institutions. 26. The leading support of 25 of these rules, the applicant referred to documents submitted to the Agency by using one of the following ways: 26.1. paper form in four copies (one original copy marked "original" and the three copies marked "copy"). All the documents placed in closed packaging and sealed; 26.2. in the form of electronic documents in accordance with the legislation on electronic document design: 26.2.1. they must be designed in DOC, xls or PDF file format; 26.2.2. document, as well as the original copy must be signed by the individual author's secure electronic signature and confirm with the time stamp before the end of the design contest. If additional documents are copies of documents, they are certified in each individual to the project the applicant secure electronic signature and a time stamp prior to the submission of the project application. 27. each aid applicant may submit to the Agency, in a single copy in paper form: 27.1. the certificate of registration issued by the commercial register the copy, if the applicant is a company, institution or scientific registry issued a copy of the registration certificate, if the applicant is a scientific institution; 27.2. The State revenue service issued a certificate attesting that the applicant does not show taxes and levies, and issued no earlier than 20 working days prior to the rule referred to in paragraph 25 of the document the date of referral to the Agency; 27.3. the commercial register of the issued certificate attesting that the applicant by decision of the Court is not recognized as insolvent, including not in the bailout process, or the process of legal protection, the economic activity is not terminated or in accordance with the commercial register of the information available, it is not in the process of liquidation (if applicable). 28. If the applicant submits that rule 27. documents referred to in paragraph 1, the Agency obtained by the laws on administrative processes. 29. In the event of a dispute concerning the time of the project, the Agency shall, within two weeks from the date of receipt of the applicant's written submissions of support and accompanying documentation that attests to the fact that the applicant submitted the draft within the time specified in these regulations, examine the application and inform the applicant of the aid agency's decision with respect to the project.
V. project and support the applicant evaluation and decision-making 30. The Agency provides each project's scientific and economic expertise, leveraging its evaluation of at least two independent scientific experts and two independent economic experts (experts).

Decisions on approval or rejection of the project as support compliance of the applicant, on the granting of aid or of their refusal to grant aid, as well as the intensity and volume shall adopt the Agency's programme to create the Evaluation Commission (hereinafter the Commission). 33. the Commission, acting in accordance with the Agency's development and after coordination with the Ministry of education and Science approved the Statute of the Commission. The Commission is made up of the Ministry of education and science, the Ministry of Economy, Ministry of finance and agency officials, as well as the Latvian Science Council representatives. To participate in the sessions of the Commission in an advisory capacity may invite other sectoral ministries, as well as scientific institutions and commercial representative organisations. 34. the Commission within three months of the rules referred to in paragraph 25 of document received 32 of these provisions shall be adopted. the decisions referred to in paragraph 1. If an expert assessment of the overall project is different from any other expert assessment of the project by more than 50 percent, the Commission organised an expert discussion to agree on project submission evaluation, or evaluation of the project attracts additional expert; 35.2. evaluate compliance with this provision of the project referred to in paragraph 4; 35.3. assess the scope of the project costs, aid intensities for the various eligible research and development activities, as well as the increase in the categories of options. 36. the Commission assesses aid applicants with: 36.1. commercial or scientific status; 36.2. the provision in paragraph 5 above, on the basis of this provision, and 27, paragraph 25 referred to documents and certificates. 37. the Commission shall adopt a decision on supporting the project: 37.1. when the project complies with all the rules referred to in annex 6 of the criteria assessed with "Yes" or "no", and the project overall average of all expert assessment has gained at least 300 points (out of a maximum possible of 400 points) criteria, which shall be valued with points; 37.2. the rejection of the project, if a project is examined under this rule 6. criteria referred to in the annex, which shall be valued with "Yes" or "no", and all the project expert the total average rating of at least 300 has acquired points (out of a maximum possible of 400 points) criteria, which shall be valued with points. 38. the Commission shall decide on the eligibility of the applicant for support or non-compliance with this provision in paragraph 5 of the said conditions. 39. The Commission shall take a decision: 24.3. grant support support applicants, if a decision is taken on the draft decision on the advocacy and support of compliance with this provision the applicant 5. the conditions referred to in points; 24.4. the refusal of aid applicants to grant aid: 39.2.1. If the project is already underway, the Commission considers that amendments to the rules of the agreement referred to in paragraph 47. 41. the applicant, in respect of which the Commission has adopted the rules referred to in paragraph 39 of the decision on the granting of aid, coupled with aid from the project applicants participating Member States completed: 25.5. form of the project "Eureka project Form", which is downloaded from the Eureka Secretariat Rams homepage www.eurekanetwork.org; 41.2. all Member States involved in the project to support the candidates of the cooperation agreement for the implementation of the project and its results (hereinafter referred to as the agreement). 42. If the leading support is also a project manager, it electronically project coordinator: 42.1. the completed and signed form of the project "Eureka project Form" copy; 26.2. a copy of the contract of cooperation. 43. project coordinator documents electronically to the Secretariat for inclusion in the Eureka project database in electronic projects coordinator of the Member's homepage (http://npc.eureka.be). 44. If the supervisor is from another Member State, the leading support of these provisions, the applicant referred to in paragraph 42 documents electronically sent to the project coordinator of the Member State concerned. 45.
