No 37 29) order in which grant, administered and monitored by national and European Union support for the measure "investments in the expansion of forest cover and forest viability in improving the implementation of" Issued under the agricultural and rural development Act article 5, fourth and seventh part i. General questions 1. determines the order in which grant, administered and monitored by national and European Union support for such measures "investments in the expansion of forest cover and improve the viability of forests" (hereinafter measure) sub-measures : 1.1. "forest regeneration; 1.2. "forest fires and natural disasters destroy stands volume production of renewal"; 1.3. investment in the sustainability of forest ecosystems and enhancing ecological value ". 2. project submissions are evaluated and selected, the decision shall be taken and notified as well as support for the request in accordance with the laws of the State of the European Union and the granting of aid, administration and monitoring of the development of the rural and fisheries-2014 – 2020 programming period. 3. the aid shall be granted in accordance with the (EU) Commission 2014 25 June Regulation No 702/2014, by which certain categories of aid in the agricultural and forestry sectors and rural areas recognised as compatible with the internal market, the application of the Treaty on the functioning of the European Union article 107 and 108 (Official Journal of the European Union, 1 July 2014, no L 193/1). 4. the place of the implementation of the action is a rural area. Support the applicant (hereinafter the applicant): 4.1 under the "forest regeneration" means: 4.1.1. natural person, landowner; 4.1.2. a legal person whose share capital is at least 50 percent private capital and is the owner of the land; 4.2. the sub-measures "investments in forest ecosystem sustainability and environmental values" and "to improve the forest fires and natural disasters destroy stands volume production of renewal" are: 4.2.1. physical person – forest land owner; 4.2.2. a legal person whose share capital is at least 50 percent private capital and is the owner of forest land; 4.2.3. municipality – forest land owner; 4.2.4. a municipal corporation that manages the municipal-owned forest land. 5. the aid shall be granted, subject to the candidate's development and national forest service agreed forest management support plan (hereinafter plan) (annex 1). 6. the amount of support this provision in principle referred to in paragraph 1 for the implementation of this provision is laid down in annex 2. II. conditions for receiving the aid of the Sub-measure "forest regeneration" 7. According to the regulations on reforestation, forest regeneration and plantation forests applicant activities coordinated with the local municipal territory planning documents.  8. One planning period, the applicant may be eligible for up to 10 hectares in area. 9. the Sub-measure "forest regeneration" implemented: 9.1 9.1.1. agricultural land: the land area of the whole unit in which fertility is not greater than 25, and the area of land in which fertility is greater than 25, not exceeding two hectares; 9.1.2. the eroded agricultural land (E2, E3); 9.1.3. the agricultural land on peat soils; 9.2. Bush-land real estate cadastre of the State listed in the Bush group. 10. aid shall be granted for the following activities: 10.1 "forest regeneration and care"; 10.2. "Ingrown stand replenishment and care". 11. Activity "Ingrown stand replenishment and care" implemented in a country where the number of trees is greater than the number of trees that match stands critical šķērslaukum, but less than the number of trees that meet the minimum šķērslaukum. 12. Projects carried out in the territory of the forest regeneration provided for according to the specially protected natural areas conservation plan, do not apply this provision in paragraph 9 above.  13. aid Under mistraudž and pine tīraudž. Christmas trees for plantations; 20.2. the atvasāj and īscirtmet fast growing tree species for energy plantations under the agricultural and rural development Act; 20.3. the plantation forest regeneration, in which the number of trees per hectare is less than the minimum prescribed šķērslaukum legislation for the tree felling in forests; 20.4. the forest regeneration in areas with closed drainage systems; 20.5. the forest regeneration of specially protected natural territories (also European interest in protected natural areas (Natura 2000)), except when it allows the specially protected natural areas and the use of protection or conservation plan; 20.6. the forest regeneration in areas that before 2013 considered biologically valuable grasslands, as well as after 2013 the European Union recognized the importance of natural grassland habitat in part or bird habitats that depend on agricultural activities (hereinafter referred to as the European Union's grass habitats); 20.7. the forest regeneration of specially protected species and to protect habitats of particular habitats, determined in accordance with the legislation on the protection of species and habitats. III. conditions for receiving aid under the "forest fires and natural disasters destroy stands volume production of renewal" 21. aid shall be granted for renewal of the forest area, which according to the State Forest Service opinion has found a fire or natural disaster (vējgāz, vējlauz, snow and ice cause damage), stand is destroyed, so in this area, the forest is renewable. 22. Support for renewed efforts for the times care plan can receive three times the five-year period. 23. the aid intensity is 100 percent of the amount of the eligible cost.  24. the support of specially protected under the Habitat or especially protected species habitat restoration, as well as specially protected natural area or mikroliegum, the applicant is added to the action plan species and habitat protection, certified expert opinion than allowed reforestation techniques. IV. the conditions for receiving aid under the "investing in the sustainability of forest ecosystems and enhancing ecological value" 25. aid shall be granted for the following activities: 25.1. "coppice thinning and thinning with coppice pruning"; 25.2. "non-productive stands volume production of replacement in accordance with the laws and regulations on tree felling of the forest"; 25.3. "the prevailing tree species replacement baltalkšņ species stands of 30 years old or blīgzn species of trees in stands." 26. under the terms of this Thinning is timely and targeted care stands to increase the sustainability of forested and adaptability possible effects of climate change, as well as the increase in stumpage collected and carbon stocks in the forest stand. 27. aid under the action plan stands in the same five-year period, you can get: 27.1. for coppice thinning – no more than two times under dial plan; 27.2. for coppice with pruning, thinning once; 27.3. grew older thinning-once; 27.4. for the conversion of the undergrowth-once; 27.5. for this rule 25.2 and 25.3.. referred to in thinning stands – change three times.  28. V. submission of the project application and assessment conditions 40. The tenderer in person or electronically (if documents are prepared in electronic form of a document according to the regulations on electronic document design) shall provide support services in the following Fields: 24.9. if submitted personally,-project application in two copies in paper form. Field support service to one project submission paper copies together with proof of registration of the project shall be returned to the applicant (annex 4); 40.2. the plan, which must not be earlier than one year before the application of the draft harmonised national forest service; 40.3. the applicant's statement in accordance with the laws and regulations on the procedures for granting state aid in the European Union for the development of the rural and fisheries; 40.4. forest owners ' cooperative (cooperative society of forestry services) or the forest owner Association issued a certificate, issued not earlier than one month prior to the application of the project and confirms that the applicant is the owner of the cooperative forest (forestry services cooperative society) member or a registered member of the society if the applicant is a society and Foundation registered in the register of associations of forest owners (the society is registered in the register for at least three years); 25.2. the Supervisory Council of forests or forest certification scheme incentive programs provided a copy of the certificate (in compliance with the original certifying the applicant) if forest property certified under sustainable forest management certification schemes; 40.6. document on land quality assessment of the balls, and the degree of erosion where the applicant has prepared the following information; 40.7. If the applicant is: 40.7.1 the project. the municipal corporation, the Corporation's Board decision about participating in the project and information on all the obligations relating to the implementation of the project, the total cost and sources of funding; 40.7.2. local authorities – decision on participation in the project and information on all the obligations relating to the implementation of the project, the total cost and sources of funding. 41. If the tenderer that provision referred to in paragraph 1 provides for the implementation of a number of sub-measures areas, planned activities can be summarized in one project submission. 42. the rural support service project submissions assessed pursuant to project selection criteria (5 and 6) and ranked in descending order according to the project of assessment the amount of points earned. 43. If the evaluation of the amount of points earned is the equal, prefer to get support is to the applicant that the project intends to implement in the territory of a municipality with less area development index according to the laws of the territory's development index. 44. If the project is to implement a number of areas, take into account its municipal territory development index that has the most support in the area applied for. Vi. Forest management support action plan and coordination arrangements of 45. Measures include information on one property. The tenderer plan and 46 of these regulations the documents referred to in paragraph cauraukl (this requirement does not apply if the documents prepared in electronic form of a document according to the regulations on electronic document presentation), and personally, by mail or electronically (if documents are prepared in electronic form of a document according to the regulations on electronic document design) be submitted to the national forest service. 48. If the information in the documents submitted by the applicant are not accurate or planned activities does not meet the reforestation requirements of regulatory legislation, the national forest service to request additional information in writing. The applicant within 10 working days of receipt of the request submitted to the national forest service for additional information. 49. the national forest service month all of these provisions referred to in paragraph 46 of document receipt check property, shall take a decision on the alignment of the plan, not reconciliation or rejection and inform the applicant.  50. If not forking copse (applies to coppice with pruning to thinning). 56. National forest service this rule 25.2. the activities referred to in the plan, if the area applied for aid meets the criteria of non-productive stands in accordance with the laws and regulations of the felling of trees in the forest. 57. the national forest service to this rule 25.3. activities referred to in the plan, if the support in the area applied for is located, at least 30 years old baltalkšņ species stand or stand where the prevailing tree species is blīgzn. 58. the applicant may submit a project application to the stands, even if the replacement is received by the national forest service issued assurances the tree felling, but has not yet taken a stand on the job. 59. the national forest service in the event of disagreement, the plan, if the applicant is administratively punished in accordance with the code of administrative offences, 57.1, 67, 67.1, 66.4.71.68, or article 71.1 and has not paid the administrative penalty. 60. changes to the plan in accordance with the applicant State forest service and one month after the written arguments submitted by the field coordination support service plan revisions, if the intended change of renewable or ieaudzējam tree species or measures execution time, or both of these parameters. 61. the national forest service plan of action without further enquiry, if specified in the implementation of the applicant's activities in the area are different from the national forest service data (including this information in the plan), but the change does not exceed the total initial implementation of activities in the area. VII. the conditions for granting support 62. conditions for receiving the aid stands for renewal (replacement) or regeneration: 62.1. used planting material produced under the legislation on forest reproductive material requirements: 62.1.1 pine-with the category. "qualified" or "tested"; 62.1.2. other species – with the category of the "selected", "qualified" or "tested"; 62.2. the proportion of trees planted in the updated (ieaudzēt) stands (except "forest regeneration under" activity "Ingrown stand replenishment and care") exceeds 50 percent of the minimum (for regeneration) to restore the required number of trees; 38.7. stand is considered updated (changed) or ieaudzēt, if it meets the criteria laid down in the regulations on reforestation, forest regeneration and plantation forests, and is thin. 63. the conditions for receiving the aid of thinning stands volume production: 39.2. restore or ieaudzēt stand in which the average predominant species of tree height not exceeding two metres in the prevailing tree species in accordance with the laws and regulations on reforestation, forest regeneration and plantation forests meet the forest type and the thin number of trees, around which within a radius of at least 50 centimeters is released growth (plants and competing tree height not exceeding half of the stands of the renewed or ieaudzēt tree height) is not less than the minimum required number of reconstituted wood or ieaudzēt (including forest plantations). For competing trees do not consider conifer, oak, os, Carroll, Elm, maple, beech and hornbeam; 39.3. restore or ieaudzēt stand in which the predominant tree species are the average height of two meters, meets the following criteria: 63.2.1. stand expanded according to the regulations on reforestation, forest regeneration and plantation forests established criteria; 63.2.2. stand in which the prevailing tree species is baltalksn, Aspen, willow or blīgzn, meet the expanded stand criteria, if the number of trees under the ruling species of medium height trees: 63.2.2.1. stands on the first floor is not more than the normal number of trees per hectare, in accordance with the laws and regulations on forest and forestry national registry (willow and blīgzn in normal tree count value corresponds to the normal number of Aspen tree value); 63.2.2.2. not less than the minimum of šķērslaukum according to the laws and regulations on tree felling (willow and the minimum number of trees blīgzn value corresponds to the minimum number of Aspen tree value); 63.2.2.3. If the prevailing species expanded copse of trees of average height exceeds 10 meters, meets the criteria of the times care, in which the ruling species of tree height of at least 10 metres; 63.2.3. not less than one hectare in around 500 trees have been released in the growing area of at least two metres, retināto trees being considered not competing; 63.2.4. the future tree branches are thin, and forking is at least one third of the height of the tree; 63.2.5. the thin tree corresponds to the measures set out in the plan, if it provides for different treatment. 64. the conditions for receiving aid: 64.1. this rule 30.1. the activities referred to in point-up to 10 metres high below the stands grew older thinning canopy, expanded the proportion of area of stands the stand exceeds 50 per cent of the total area according to the action plan; 64.2. this rule 30.2. the activities referred to in point – the conversion of undergrowth in areas prohibited clear cut, the type of forest tree species, number of trees, which grow under the canopy of trees, is at least 1/3 of the updated stand qualifying number of trees in accordance with the laws and regulations on forest renewal. 65. Some specific areas not allowed to include an assisted area, if they do not exceed 0.1 hectare and their total area does not cover more than 10 percent of the nogabal area. VIII. examination of the activities carried out during the year 66. action taken by the State Forestry Department checks the month after the aid beneficiary on the regeneration of the stands, restoration (replacement) or care has provided: 66.1. report (in duplicate) of the results of the implementation of the project activities (annex 7); 66.2. the origin of the plant material and the purchase of a copy of an identity document, if the forest is ieaudzēt or renewed (replaced); 66.3. sketch (project area of the external border of the graphic image with the stig, the route, the landmark, the trench, the edge of the clearing) in the scale of 1:5000, 1:10 000 or 1:2000 binding does not specify if at least one of the external borders of the areas (peaks) are given in coordinates LK-92 reference system. Sketch may also prepare and submit an electronic document. 67. During the examination of the implementation of the project area is clearly marked external border in nature and activities are identifiable.  68. the national forest service after receipt of check ieaudzēt report, renewed (replaced) or a thin stand: 68.1. the area determined with an accuracy of +/-2.5 x P/10000, where P is the perimeter of the landfill in metres. If the report shows the area differs from examination in certain areas, exceeding the allowable error, 69 of these rules. indicate in the report referred to in paragraph uzmērīt of the area of the examination; 68.2. finds, or the situation naturally comply with the action plan, and to take a decision, or stand meets the conditions for granting support. 69. If the stand was recognized as ieaudzēt, update (change) or thin, the national forest service decision on eligibility conditions, this decision includes a report on the results of the implementation of the project (annex 7) and 10 working days: 69.1. one copy of the report shall be submitted to the rural support service; second report of the EB 69.2. to transmit or communicate it to the applicant in accordance with the notification law. 70. the rural support service to 30 working days by this provision the report referred to in paragraph 69 of the receipt of the aid shall be paid to the beneficiary of the aid activities. IX. Monitoring and control 71. After the project the applicant at least one of the following objectives: to encourage carbon storage 71.1. and Association: 71.1.1. performing forest regeneration; 71.1.2. making or thinning stands for low stand replacement; 71.1.3. the forest restoration; 71.2. the conservation of biological diversity, and the increase in reforestation. 72. Five years after the plan indicated in the implementation of the national forest service has the right to ieaudzēt, expanded or renewed stands test runs. 73. If ieaudzēt, expanded or renewed stands test five years after the end of the project, it is found that the ieaudzēt, expanded or updated number of species of trees is less than the number of trees under the critical šķērslaukum, it is the responsibility of the beneficiaries during the year by the national forest service or the rural support service of the decision on the area of non-compliance with the conditions for receiving the aid to supplement the number of trees up to at least a minimum number or to repay the aid received. 74.73. Aid shall not be paid and obligation ceases if the beneficiary is not in full compliance with the conditions and complied with the obligations contained in the plan of measures within the prescribed period and extent or if these checks in these rules or in the rural support service submissions of non-compliance with the project goals and achievable indicators or irregularities in connection with the implementation of the project. 77. the aid repayment is determined by the laws on the national and European Union aid, administration and monitoring of the development of the rural and fisheries-2014 – 2020 programming period.
