Cabinet of Ministers Regulations No. 120 in Riga in 2007 (13 February. No 12 35) solely of cereals and seeds trade rules Issued in accordance with the law of the movement of the Seed article 2 1, point "a" section i. General questions 1. determined solely and cereals seed.
2. the following rules apply to the cereal species whose cultivation for agricultural production: Rye (Secale cereale l.), wheat (Triticum aestivum l., Triticum durum Desf., Triticum Spelta l.), barley (hordeum vulgare l.), oats (Avena sativa l.), Triticale (Triticosecale Wittm), buckwheat (Fagopyrum esculentum Moench) and maize (Zea mays l.), with the exception of the uzplīstoš and sweet corn (seed).
 
II. categories of seed 3. Seed shall be divided into the following categories: 3.1 random seed (IR);
3.2. pre-basic seed (PB);
3.3. basic seed (B);
3.4. certified seed (C).
4. A random seed (IR) is a small quantity of seed, ensuring preservation of characteristics for the variety to be several generations. The breeder or maintainer of the variety of this seed, the maintenance of the variety subject to the scheme. After the breeder or maintainer of the variety of initiatives can make a random seed certification to determine their actual quality.
5. Pre-basic seed (PB) is a seed that: 5.1 grown from a random seed breeder or maintainer of the variety in the monitoring, in accordance with generally accepted practices for the maintenance of the variety;
5.2. for basic seed and certified seed (B), (C) for the production of seed of the category;
5.3. meet basic seed in these rules or in accordance with special reference also pre-basic seed;
5.4. throughout the seed production and preparation period is the national plant protection service control.
6. Pre-basic seed divided into two generations: the first generation of 6.1 pre-basic seed (PB1) obtained from random seeds;
6.2. the second generation of pre-basic seed (PB2), derived from the first generation prior to basic seed or from a random seed.
7. Basic seed (B) (excluding cereal species hybrid seeds) are seeds which: 7.1 from pre-basic seed or directly from random seeds;
7.2. grown varieties of the breeder or maintainer of supervision, in accordance with generally accepted practices for the maintenance of the variety;
7.3. for certified seed (C) for the production of seed of the category;
7.4. meet basic seed in these provisions;
7.5. throughout the seed production and preparation period is the national plant protection service control.
8. Hybrid basic seed of varieties (B) (rye, wheat, oats, barley and Triticale self-pollinating) is a seed: seed of hybrids for 8.1;
8.2. conform to these rules to basic seed;
8.3. throughout the seed production and preparation period is the national plant protection service control.
9. (C) "certified seed (rye, as well as wheat, barley, oats, maize, buckwheat and self-pollinating Triticale hybrids) means seed: 9.1 produced directly from basic seed (by the breeder or a breed Representative wishes, if not by variety of the breeder-maintainer desires – from the higher category seed);
9.2. complies with those rules for certified seed;
9.3. not intended for the production of seed;
9.4. throughout the seed production and preparation period is the national plant protection service control.
10. Certified wheat, barley, oats and Triticale seed is not a hybrid, is two generations: 10.1. certified seed of the first generation (C1);
10.2. certified seed, second generation (C2).
11. the certified seed of the first generation (C1) (wheat, barley, oats and Triticale, which is not a hybrid) seeds: 11.1. grown from basic seed (by the breeder or a breed Representative wishes, if not by variety of the breeder-maintainer desires – from the higher category seed);
11.2. these provisions meet the certified seed of the first generation;
11.3. the second generation intended for the production of certified seed or other purposes;
11.4. throughout the seed production and preparation period is the national plant protection service control.
12. certified seed, second generation (C2) (wheat, barley, oats and Triticale, which is not a hybrid) seeds: 12.1 grown from certified seed of the first generation (by the breeder or a breed Representative wishes, if not by variety of the breeder-maintainer desires – from the higher category seed);
12.2. these provisions meet the second generation of certified seed;
12.3. is not intended solely for the future;
12.4. throughout the preparatory period and solely is the State plant protection service control.
 
III. requirements for Solely 13. each sēklaudzētāj can grow one or more varieties of seeds of the category, or if you have the appropriate facilities and opportunities to ensure that the different varieties or categories of seed not mixing.
14. Crop species and varieties of volumes only deploys solely for suitable priekšaug. Cereal seeds can also be grown in fields that produced the previous year, of the same variety in the same or higher category, but not the seeds can be grown in fields that the previous two years raised other cereal of the same species breed. 15. If sēklaudzētāj holds and organic farm (or its part) and holding (or part thereof) which produces conventional farming seed in cereals, organic farm produces seeds of the same variety as the conventional agricultural holding (or part thereof) where: 15.1. have met the Council of 24 June 1991 regulation (EEC) No 2092/91 on organic production of agricultural products and indications referring thereto on agricultural products and foodstuffs (hereinafter referred to as the Council Regulation No 2092/91);
15.2. sēklaudzētāj current year submit legislation on organic production monitoring and control procedures set by the control authorities in the Declaration referred to in Council Regulation No 2092/91 annex III General provisions of paragraphs 1 and 3.
16. the minimum distance between the individual volumes of the varieties of this provision are laid down in annex 1.
17. the fields of Solely allowable number of infected plants are set out in annex 2 of these rules.

18. Sēklaudzētāj sorts the field of history, indicating the field placement scheme and information about a given field used seeds, fertilisers and plant protection products.
19. the national plant protection services in the framework of the Organisation for economic cooperation and development (OECD) scheme: cereals 19.1. ensure that inclusion in the OECD list of varieties to be submitted to those varieties which are included in the catalogue of the Latvian plant and comply with the requirements of the OECD Scheme for cereals;
19.2. provides information for maintainers of varieties;
19.3. cooperate with providers of varieties;
19.4. conclude written agreements with other notified bodies on seed propagation, in accordance with the OECD schemes for the varietal certification of seed movement on the international market;
19.5. in Latvia the original supply of seed of varieties samples of propagating varieties kontrollauciņ sow with genuine seed varieties;
12.2. supply the official descriptions of the varieties, propagating the hybrid varieties, inbred component descriptions;
19.7. recognises the reproduced seed identity.
 
IV. field of view Solely 20. to assess the overall field solely State conformity to the rules laid down in chapter III requirements and specific varietal purity in accordance with the provisions of section 3 of the requirements set out in the annex, take the field.
21. the field shall be made public by the plant protection service officers (hereinafter service inspectors).
22. 23.2. assess whether the variety may be applied to make field inspections;
23.3. check that sēklaudzētāj is registered to a license for the use of the protected variety.
24. before the review of the field service officer familiar with the quality of seed, the supporting documents and records in the history of the field.
25. 27. the inspector shall decide to refuse a field guide and volume of solely for unusable before the field inspection, about three working days written notice if the sēklaudzētāj: this rule 27.1. in paragraph 25 of the deficiencies are not remedied within the time limit specified;

31.1.6. ergot infected plants per 200 m2 only Triticale;
31.1.7. with straw of smutty infected plants per 200 m2 only Triticale;
31.2. rye, buckwheat and pollinated Triticale (except hybrid) volumes:

31.2.1. variety no corresponding to the number of plants of 200 m2, describing their characters at the official description of the variety;
31.2.2. other cereal species grow to 200 m2;
31.2.3. with the blade of the number of infected plants smutty (except buckwheat) to 200 m2;
31.2.4. ergot infected plants (except buckwheat) to 200 m2;
31.2.5. with putoš of infected plants the smutty per 200 m2 only Triticale;
31.2.6. with hard smutty infected plants per 200 m2 only Triticale.
32. A field that size does not exceed 10 ha, look at least 10 sites, viewing 1 x 20 m large rectangles (20 m2) volume-specific locations perpendicular to the direction of the vehicle. 34. solely in the fields of cereals not tolerated the presence (of Avena fatua, Avena sterilis) and Ludovik oatmeal (Avena ludoviciana) presence.
35. If the presence of field notes solely (Avena fatua, Avena sterilis) or Ludovik of oats (Avena ludoviciana), professional inspector can instruct in writing the izravē sēklaudzētāj or separate part of the field with the colonies of plants harvested separately.
36. If, during a field inspection or verification of seed sown, finds this misconduct or non-compliance with the volume's estimate for a category of seed, the seed Inspector of the service category shall be reduced to the appropriate category in the light of these provisions for the acquisition of seed of the category. If the deficiencies are impossible to prevent, at the service of instructions of the Inspector's field inspection carried out repeatedly, but not later than five days after the previous field surveys.
37. If the volume does not comply with the provisions in chapter III and varietal purity requirements, professional inspector declared solely for volume unusable. The resulting harvest shall not be included in the further evaluation of the seed.
38. If a field inspection found that the volume meets the requirements of this regulation, the service's inspector shall decide on its conformity with the relevant categories of seed production.
39. After the last field in the view, based on the results of the inspection, the Inspector of the service within three working days, shall take a decision on the conformity of the breed volume seed and prepare the field inspection protocol, in duplicate, in accordance with the provisions of annex 5. The first copy shall be issued by the sēklaudzētāj, the second copy will remain on the national plant protection service.
40. Sēklaudzētāj service Inspector on field inspections in accordance with the law of the movement of the Seed article 8 may be challenged within three working days of the administrative process of regulatory legislation.
41. A Person wishing to make a variety of cereal volume registration in the current year to 1 June shall be submitted by the national plant protection services in a variety of cereal volume registration application (hereinafter registration application volume) in accordance with the provisions of Annex 8. National plant protection services by volume of the date of receipt of the registration application to the varieties of cereal volume registration of varieties for which a national plant protection services is the official description of the variety. Service Inspector: 25.5. assuming volume registration application, check whether it contains all the rules set out in annex 8;
41.2. If the volume is not specified in the application for registration in the required information, within three working days, inform the person in writing, including shortcomings and deadlines for the correction of deficiencies;
41.3. assuming volume registration application after the deadline, consider whether the plant is not reached e. g., phenology, such development phase, when it is no longer possible to find varieties of different morphological features;
25.7. decide to refuse the registration of the variety in the volume if it finds that it is no longer possible to determine the varieties different morphological features, and three working days, inform the person in writing.
42. the volume of registration of the variety, in agreement with the person, in each individual case by the Inspector of the service.
43. the volume of the variety registration office Inspector first make sure that the volume of the existing identity (compliance with the official description of the variety). If varietal identity does not match the name of the variety for the Inspector to specify the volume of cereal variety registration Protocol (hereinafter referred to as the volume registration Protocol) in accordance with the provisions of Annex 9. 44. Volume registration service Inspector determines the actual: 44.1. volume stocking level;
44.2. varietal purity;
44.3. the purity of the species;
27.6. infected with diseases.
45. Volume the volume during registration shall be made on at least 10 positions, considering 1 x 20 m large rectangles (20 m2) volume-specific locations perpendicular to the direction of the vehicle.
46. Volume registration Protocol shall be drawn up in duplicate. One copy within three working days after registration, issue the person a volume, the second copy will remain on the national plant protection service.
47. the decision on the identity of the variety and volume of actual compliance with varietal purity can be a challenge or appeal the administrative process of regulatory legislation.
 
V. assessment of the quality of the seed and the seed of Sēklaudzētāj 48. traders shall provide the registered party in the register the national plant protection services in the average seed sampling, analysis and application of manufacture of labels in accordance with the provisions of annex 10.
49. the seed samples removed by professional inspector, who has won the national plant protection service seed strippers or qualifications of the international seed testing Association (ISTA) seed remover.
50. the Inspector to assess the quality of the seed removes a sample from each batch of seeds produced. Seed removed from uniform seed lot. If there is evidence that the seed lot is not sufficiently uniform and do not meet the international seed testing Association (ISTA) rules, assessment of the seed lot refuses.

51. the weight of the seed lot from which the samples are taken to mean, not greater than: 51.1.  30000 kg, rye, wheat, barley, oats and Triticale;
51.2.10000 kg, buckwheat;
51.3.40000 kg for maize.
52. The maximum weight of a seed lot size may not exceed more than 5%. If the weight of the seed lot exceeds this provision in paragraph 51 of the specified size, it divides the number of seed lots.
53. From these provisions of the seed lot 2 species, except for buckwheat, having an average sample weighing no less than 2300 g, and is used as follows: 53.1. qualitative determination of characteristics of seed-1000 g;
53.2. seed-1000 g for follow-up;
53.3. seed moisture and pest infestation detection – 300 g (placed in hermetically sealed containers).
54. The average mass of the sample is not less than 1500 buckwheat grams, and is used as follows: 54.1. qualitative determination of characteristics of seed-600 g;
54.2. seed-600 g for follow-up;
54.3. seed moisture and pest infestation detection – 300 g (placed in hermetically sealed containers).
55. the seed samples for quality indicators of national plant protection services in at least a year. Follow-up sample of seed remaining stores, to complete the sample.
56. qualitative indicators of seed, including seed purity and germination of seeds of other plant species: the content of this provision are listed in the annex. Sclerotia (Claviceps purpurea) and smutty (Tilleti cars) admixture quantity set out in annex 12 of these rules.
57. All categories of seed moisture content must not exceed 15%, but do not store seeds ventilated metal silos, to 14%. Setting the seeds the period of validity of the certificate for three months, all categories of seed moisture content must not exceed 16.5% (storing seeds not ventilated metal silos, – 15.5%). Winter crops of seeds with the vintage year, the permissible moisture content must not exceed 17%.
58. If pre-basic category (PB) or the base category (B) seed lots of seed germination identified in the analysis do not meet these rules laid down in annex 11. minimum germination capacity of seeds, a person may submit to the national plant protection services in the application for authorization to market, for a limited period, seed which does not satisfy the minimum germination capacity requirements (hereinafter referred to as the application), in accordance with the provisions of annex 13, adding seed quality supporting document copy.
59. the national plant protection service in until 1 September, summarizes the submissions for the winter crops, until 1 April – summer and inform the national plant variety Board, specify the total number of submissions by species and varieties, the number of lots, the total amount of seed and established the minimum germination.
60. The national plant variety Board within five working days after the national plant protection service information, considering the variety concerned for the security of the Latvian market, make proposals on the lowest germination, which can allow for time to market the seed does not satisfy the minimum germination capacity requirements.
61. the national plant protection service, on the basis of a person's present mu and the national plant variety Board proposals provided, shall take a decision on the authorisation or refusal of the marketing of seed which does not satisfy the minimum germination capacity requirements. The decision taken within three working days notify the person.
62. the decision on the refusal to issue a permit for the marketing of seed which does not satisfy the minimum germination capacity requirements can be a challenge or appeal the administrative process of regulatory legislation.
63. If a State plant protection service has adopted a decision to allow for time to market the seed does not satisfy the minimum germination capacity requirements, then the seed of the seed packs Packer label with special labels indicating the seed germination, seed lot number as well as the merchant's name, surname (legal person – name) and address.

71. If the cereal variety is genetically modified, it shall be indicated on the label, as well as any other seed quality supporting document.
72. If the certification process defined in the seed lot quality does not meet the requirements of and is not a demonstration with a certificate of seed, the seed lot labels eliminates the State plant protection service of the.
73. If the seed is treated with biopreparāt, plant protection products or chemicals, this is indicated by the label.
74. If the label ordered and delivered before the packer of seed seed packing and seed removal, professional inspector check the use of labels by checking the packaging size and number of roots. If the service determines that the Inspector: 74.1. seed lots storage space is less than the package ordered, service tag Inspector gives the unused labels and make up for it;
74.2. where seed lots stored in labelled, is more than the ordered packaging labels, professional inspector seed does not remove until you have separated the extra packaging units.

75. If the seed lot is labelled with the seed package labels, but having quality certification after the certificate had expired or extending the period of validity of the certificate, it is found that seed lot quality does not meet the requirements of this regulation, service: 75.1. the inspector shall forthwith notify the holder of the seed lot and check the movement of the seed lot;
75.2. ensure the destruction of the labels used and makes up for it.
76. If the lots of seed labelled repackaged different packaging units or carry out seed lot chemical treatments, professional inspector provides a labelled party labels and make up for it.
77. the mixture of seeds are packed and labelled in accordance with the provisions of chapters VI and VII. The information on the label correspond to those provisions laid down in annex 16.
78. The seed that is not fully certified, but who: 78.1. OECD was grown and harvested in a Member State participating in the scheme and cereals meeting the OECD seed schemes and the cereal chain law article 7 requirements, can fully certified in Latvia. Seeds are packaged and labelled in accordance with the requirements of the OECD;
78.2. grown and harvested in a Member State of the European Union or in a country where the European Union allocated to the equivalence of field inspections and for the production of certified seed, be fully certified in Latvia. Seeds are packaged and labelled in accordance with the law of the movement of the seed and the requirements of these regulations;
78.3. harvested in Latvia and intended for certification in another Member State of the European Union, wrapped the State plant protection service of the. Seeds are packaged and labelled in accordance with the law of the movement of the seed and the provisions of chapters VI and VII. The label must be affixed to the packaging of seed and add accompanying document (annex 17);
78.4. harvested in Latvia the same agricultural holding, but intended for certification in another agricultural holding in Latvia, wrapped in national plant protection services. Seeds are packaged and labelled in accordance with the law of the movement of the seed and the provisions of chapters VI and VII. The label must be affixed to the packaging of the seeds in the seed that is not fully certified.
79. in paragraph 78 of these provisions, the requirements laid down for packaging and labelling do not apply to the cases for which a national plant protection service agreed with the other public body.
 
VIII. 80. Marketing of seed, the marketing of seed permitted after being duly recognised as pre-basic (PB), base (B) or (C) certified seed.
81. Latvia has permitted different varieties of cereals and pulses of different cereals and of seed mixtures of species in trade, if the variety concerned is included in the catalogue of plant varieties of Latvia and it does not have specific comments on the specific characteristics of the variety, which does not allow you to create blends. Before the preparation of the seed mixtures shall evaluate its components conformity with the relevant categories of seed quality.
82. After the last seed in the user request has the right without wrapping to sell certified categories of wheat, rye, Triticale, barley and oat seed, by affixing a label to the container of the seed.
83. the national plant protection service is controlled by the Latvian market imported seeds according to the movement of the seed regulatory laws and requirements.
84. food and veterinary service of sanitary border inspection controls the importation of seeds in Latvia.
85. In Latvia, during another European Union Member State certified seed, cereals require the Member State concerned, the notified bodies in the official approval (certificate) that the presence of ' Avena fatua ' in the field of view and impurities of one kilogramme of official seed or three kilos of official seed is not found.
 
IX. Sēklaudzētāj, a seed producer, Packer, importer and dealer registration 86. State plant protection service registers seed establishments, sēklaudzētāj, Packer, importer and dealer, and sēklaudzētāj and seed dealer shall issue the certificate of registration.
87. To register Sēklaudzētāj and seed merchants in the register (hereinafter register), and the national plant protection services of the person submitting the inclusion of Sēklaudzētāj and seed merchants in the register (hereinafter registration application) in accordance with the provisions of the annex and 18 depending on the occupation, was accompanied by the following documents: 87.1. sēklaudzētāj: 87.1.1. field intended solely plans, indicating the area (ha);
87.1.2. information about the history of the sort field;
87.2. the seed and Packer-establishments of facilities description, specifying its membership. Establishment of seed mixtures also adds information about the preparation of seed mixtures, which will ensure the finished mixture is uniform; the seed
101.8. seed dealer and importer, information concerning the origin of seed intended for marketing, including cooperation partners.
88. If all these rules referred to in paragraph 87 of document not submitted or the information supplied is incomplete, the inspector shall determine the term of service failures.
89. the national plant protection services: 89.1.  within 10 working days of registration of the application and assess the documents annexed thereto and shall take a decision on the person's registration in the register;
89.2. the decision shall inform the person within five working days after the decision. If the decision is positive, issue Sēklaudzētāj and seed merchants register a certificate of registration in accordance with the provisions of article 19;
89.3. each person granted registration code. The first two characters indicate the address of the person (the district's postal code is the first two digits), the other characters – serial number;

Special label indicates seed germination, seed lot number as well as the merchant's name, surname (legal person – name) and address.
97. the period of validity of the certificate of seeds, seed germination, from the date of completion of the analysis are the following: 60.3.12 months – the seed of all species, including mixtures thereof;
97.2. three months – seed infested with ticks or other parasites that live in the seed to die during storage;

98. If the period of validity of the certificate of seed wants to extend the seed before the certificate expires, repeat the inspection of seed germination and pest infestation.
