Cabinet of Ministers Regulations No. 678 in Riga in 2007 (9 October. No 57 16) procedures for granting state aid in the implementation of projects for research, technological development and innovation Eureka programme Issued in accordance with the law of scientific activity article 33, third part 1. determines the order in which the grant of State aid projects for research, technological development and innovation Eureka programme. 2. The terms used in the following terms: 2.1 supports the applicant company or scientific institution-in the register of registered scientific institution which has submitted to the Ministry of education and science in the application for aid for the implementation of the project;
2.2. The European Eureka program-program commercial and scientific institutions of international cooperation, to promote high technology, new, competitive products and services development and implementation;
2.3. Member-scientific institution or company involved in project implementation;
2.4. national project coordinator-Eureka Member States nominated a person to coordinate the evaluation of the project, with the remaining Eureka national project coordinators, to make decisions about the projects supported, supports the cooperation between the project partners and monitors the implementation of the project. 3. Support under these rules shall be in accordance with the European Commission of 12 January 2001, Regulation (EC) No 70/2001 on the Treaty of the European Community and article 87.88, giving State aid to small and medium-sized enterprises, and with the European Commission on 25 February 2004, Regulation (EC) no 364/2004 amending Regulation (EC) No 70/2001 as regards the extension of its scope to include aid for research and development. 4. qualifying for funding projects that meet the following criteria: 4.1 to provide new, competitive products, technology or services;
4.2. implementation involves participants from two different Eureka Member States programmes;
4.3. the result is a marketable product, service, or technology. 5. Projects funded from the Latvian Government programs "Science" Sub "for membership of the European Union's research and technology development programmes" for the current year allocation to the State budget, which is administered by the Ministry of education and science. 6. the aid granted for the implementation of projects for small and medium sized companies that comply with the European Commission on 25 February 2004, Regulation (EC) no 364/2004 amending Regulation (EC) No 70/2001 as regards the extension of its scope to include aid for research and development. 7. About support of applicants can be registered in the register of scientific institutions, scientific institutions, as well as any small or medium company that is a legal entity and shall comply with the following criteria: 7.1 it is registered in the commercial register;
7.2. it is directly responsible for the preparation and management of projects and project implementation does not act as a mediator;
7.3. it is available in a stable and sufficient sources of funding, qualified scientific personnel and logistical support to commercial activities will not be interrupted during the implementation of the project. 8. The aid can not log on to support the applicant that: 8.1. by a decision of the Court of Justice recognized as insolvent, including reorganisation process is located or in accordance with the information available to business register in liquidation process, or the economic activity it has ended;
8.2. not paid taxes and other State and local government at minimum payments in full and laws within the time limits laid down. 9. project funding for the implementation of national scientific institutions can provide, pursuant to the Commission on 15 December 2006, Regulation (EC) No 1998/2006 of the Treaty establishing the European Community and article 87.88. example of application of the de minimis aid. 10. To apply for aid, aid applicants submit: 10.1. joint submission of aid (annex 1);
10.2. the business plan;
10.3. the project cost estimate calculation (annex 2);
10.4. the performers of the project list (annex 3) and project manager living CV;
10.5. the report of the last year;
10.6. The Republic of Latvia enterprise register or a copy of the certificate of registry of scientific authority a copy of the certificate. 11. Logging support, support applicants can submit: 11.1. Republic of Latvia enterprise register a certificate attesting that the company carries out an economic activity;
11.2. The State revenue service certificate, which certifies that the company has no tax liability, and issued not earlier than 10 days prior to the application of the project. 12. If the applicant submits that rule 11.1. statement, referred to the Ministry of education and science it is produced administrative procedure law. 13. If the applicant submits that rule 11.2. enquiries referred to in support of the applicant with the consent letter (annex 4) empowers the Ministry of education and science to get it during the administrative procedure law. 14. support in the form of straight grants provided within the framework of international cooperation in the implementation of industrial research, design works, as well as technical feasibility studies, if it is performed before the industrial research or design work for a single project. 15. The project will support the following: 15.1 the contractor of the project (scientific staff and auxiliary staff, participating in a scientific project) pay;
15.2. the scientific equipment used in the project and equipment costs. If those around the ratūr and the period of use is longer than the duration of the implementation of the research project for the eligible costs only the depreciation costs corresponding to the duration of the implementation of the research project;
15.3. the building and land use matters clouded. In respect of eligible expenditure for buildings, only the depreciation costs corresponding to the duration of the implementation of the research project. In respect of the eligible believes actual capital costs;
15.4. other operating expenses, including costs of materials, supplies and similar products incurred directly as a result of the research project;
15.5. the patent acquisition and reply to the youth. Funding to cover these costs must not exceed the level of intensity of aid project intended to support the research project, which has obtained the relevant industrial property rights. Are recognized in the following eligible costs: 15.5.1. all costs before the patent filing first-time claims, including claims for submission and review of the preparation, the cost of the application as well as costs preceding the grant of the right in the first jurisdiction;
15.5.2. translation and other costs associated with the granting of intellectual property rights or other legal validation of instances. 16. the support to the applicant within one project the maximum amount of aid of the eligible cost is 91000. 17. the project maximum aid intensity of exploration costs are: 17.1. industrial research-75%;
17.2. the design work-50%;

17.3. technical feasibility studies-75%. 18. where the project involves various stages of research and development, the permissible aid intensity shall be determined according to the respective permissible aid intensities weighted average value calculated in accordance with the relevant eligible costs. 19. in the implementation of joint projects, each receiving the maximum amount of aid may not exceed the permitted aid intensity, calculated on the basis of a particular beneficiary of the total of eligible expenditure. 20. The maximum aid intensity for the project apply to the total amount of aid if the beneficiary at the same time provide from national and European Union funds. 21. The aid must not be combined with funding for other research support program or individual aid project. Other research support programs or individual aid project cost financing may not be used in this study support programme. 22. the decision on the application of project approval or rejection shall be taken at the Ministry of education and science established a Commission. The Commission shall examine the application and amendment of draft agreements, if the project has already started. The Commission works for the Ministry of education and Science approved the Charter. The Commission is made up of the Ministry of education and science, Ministry of Economic Affairs and the Latvian Science Council representatives. The meetings of the Commission in an advisory capacity may invite the Latvian Academy of Sciences and the Latvian employers ' Confederation. 23. Each project provides scientific and economic expertise, leveraging the evaluation of each project's two scientific and economic experts. The Commission shall evaluate the projects according to the criteria for the evaluation of the project (annex 5) and a month from the date of receipt of the draft decision on the application or project to support the rejection of the application. Project application support, if it meets all of the criteria, which shall be valued with "Yes" or "no", and all the common assessment of experts has won at least 300 points (out of a maximum possible of 400 points) criteria, which shall be valued with points. 24. After the approval of the project Eureka national project coordinator of the meeting, the Ministry of education and science of the applicant concluded with the support of the implementation of the project (annex 6). 25. project launched by the Ministry of education and science in support of costs to the applicant the amount of the advance, which shall not exceed 40% of the total cost of the project. 26. Support is provided by all sectoral projects except project: 26.1. military sector;
26.2. related to the company's export volumes of goods distribution to the establishment and operation of the network or company running costs for export operations;
16.3. to give priority to the use of domestic goods by limiting the use of the imported goods;
26.4. the coal industry, to which the European Council of 23 July 2002, Regulation (EC) No 1407/2002 on State aid to the coal industry. 27. before the Ministry of education and Science funding national project coordinator of the project, the European Commission is sought if the amount exceeds the following limits: 27.1. Eureka project total eligible costs incurred by all companies participating in the project are at least EUR 40 million-equivalent in dollars;
27.2. for one or more of the individual companies for the gross grant equivalent of at least EUR 10 million to the equivalent in local currency. 28. The rules referred to in paragraph 27 projects may be implemented only after the European Commission decision on individual aid that the project complies with the Treaty establishing the European Community and do not distort trade conditions, contrary to the common interest. 29.
