No 70 37) order granting authorization to market, for a limited period, seed which does not satisfy the minimum germination capacity requirements Issued under the law of the seed chain 16. the second paragraph of article 1. determines the order in which according to the European Commission, February 8, 2006, Regulation (EC) No 217/2006 laying down rules for the application of Council Directives 66/401/EEC, 66/402/EEC, 2002/54/EC, 2002/55/EC and 2002/57/EC as regards the authorisation of Member States to permit temporarily the marketing of seed that does not meet the minimum germination capacity requirements (hereinafter referred to as Commission Regulation No 217/2006), issue licences at the time of marketing of seed which does not satisfy solely and seed regulatory laws set the minimum germination capacity requirements (hereinafter licence). 2. the rules shall not apply to categories of pre-basic and basic category seed. 3. the authorization shall be issued by the national plant protection service (hereinafter service), if the temporary difficulties in the supply of seed and Latvia missing grasses, cereals, beet, vegetable, seed of oil and fibre plants respectively. 4. to obtain permission, the service held in the crop monitoring information system of national Sēklaudzētāj and seed dealers registered person (hereinafter person) shall provide the service in the application. The application specifies the following information: 4.1. responsible institution-the national plant protection service;
4.2. the sēklaudzētāj, the seed establishment, packer or the merchant's name, address, telephone number and registration code Sēklaudzētāj and seed dealers register;
4.3. the species;
4.4. the variety;
4.5. number of the seed lot;
4.6. the size of the seed lot;
4.7. the actual seed germination (%);
4.8. the results of the evaluation of the seed number;
4.9. the date of filing, the applicant's signature (those document properties blank when the document is drawn up according to the law on electronic document design). 5. a Person in the service of submitting: 5.1 on the marketing of fodder plant, cereal, summer vegetables, beet, oilseeds (except winter rape and winter Rep) and fibre species seed-by 1 March of the current year;
5.2. for Winter Canola and colza seed of winter-by 1 august of the current year;
5.3. for winter crops of cereal seed-5 for the year to September. 6. Service within three working days following that rule 5. the period referred to in paragraph summarizes the information submitted, and inform by electronic means the national plant variety Board, specify the total number of applications, broken down by species and varieties, and volumes, as well as the actual seed germination (field crops-permissible viability). 7. The national plant variety Board within five working days after the receipt of the information evaluated by breed seeds and the required quantity of seed market of Latvia, as well as the cultivation and use of the variety features and provide suggestions for the service: 7.1 the minimum germination capacity of seeds;
7.2. the quantities of seed;
7.3. the reasons that affected the Latvian market in insufficient support you with seed variety concerned (if necessary, giving the regions);
7.4. the period of time for which the authorization is requested;
7.5. varieties of substitution possibilities. 8. Service on the basis of the person's application and the national plant variety Board proposals, within three working days after the national plant variety Board proposal receipt shall take a decision on the Latvian market with insufficient security of the seed of the variety concerned and send the application to the European Commission and the Member States of the European Union, the competent authorities in accordance with Commission Regulation No 217/2006, article 2 (1). 9. 9.2. Decides on the conformity of the breed, if it is proposed that other variety;
9.3. inform the European Commission and the European Union, the competent authorities of the Member States shall, in accordance with Commission Regulation No 217/2006.10. According to the European Commission decision of the rules referred to in point 8, the application service: 10.1 shall take a decision on the authorisation for marketing of seed which does not satisfy the minimum germination capacity requirements;
10.2. within three working days shall notify the person of the decision;
10.3. If the positive decision taken, to the person a certificate of seed shall be issued in accordance with the legislation on the marketing of seed and solely on the basis of the services provided by the report on the results of the evaluation of the seed. The certificate shall contain the seeds of additional indication of the reduced germination of seeds. Seed maturity of the certificate complies with this provision specified in paragraph 7.4. 11. If the European Commission granted permission for the quantity of seed smaller than is requested, the variety Department: 11.1. authorizations shall be issued, beginning with the batches of seed germination is highest;
11.2.
