Cabinet of Ministers Regulations No. 894 Riga 2007 December 18 (Mon. No 70 30) procedures for establishing and maintaining environmental management and audit system and recorded in the registry, the Organization Issued in accordance with the Environmental Protection Act 39. the third paragraph of article i. General provisions 1 the questions determines the order in which environmental monitoring national Office (hereinafter the Office): 1.1. establish and maintain environmental management and audit system (System);
1.2. the register of public and private law entity (except individuals) (hereinafter referred to as the Organization) to the system registry or decide on the refusal of registration. II. System registry establishment and maintenance of the system of the register is the national information system, which is the Office Manager. The system registry contains the following information: 2.1. Organization registration number in the system registry and the registration date;
2.2. Organization name, address and contact person;
2.3. the Organization's operating code, according to the general classification of economic activities (NACE) and number of employees;
2.4. the environmental verifier shall-first name, last name or company name and registration number;
2.5. status of the Organization in the system registry. 3. The Office shall update the information contained in the registry of the system after changes or additional information is received. The system registry contains information is freely available on the internet home page of the Office. III. Organization registration 4. To register in the system registry, the Organization, which introduced the system of the European Parliament and of the Council of 19 March 2001 of Regulation No 761/2001 allowing voluntary participation by organisations in a Community eco-management and audit scheme (hereinafter Regulation No 761/2001), the application shall be submitted to the Office. The application shall be accompanied by the following: 4.1 information about other certified environmental management systems in the Organization;
4.2. permissions and copy, if any organization issued by the environmental protection authorities. 5. the Office within three months of submission of the appearance, if necessary, obtain further information from other State and local government authorities or the national registry of the administrative procedure law and in the light of Regulation No 761/2001, shall take a decision on the organization registration, or decide on the refusal of registration. 6. If there is a reasonable suspicion about the adequacy of the information submitted, or completeness, the Office is entitled to require the State Department of the environment to take the extraordinary inspection organisation that submitted the application for registration in the system registry. 7. If the application or additional information shows that the organisation's environmental management system and the Organization's activities do not comply with the provisions of Regulation No 761/2001 and in article 6 1, 2, 3, 6 and 7 contained in the annex, requirements, or it is determined that the environmental verifier shall not perform work pursuant to Regulation No 761/2001, the Office shall decide on the requirements of registration. 8. The decision taken in accordance with these rules, the Office shall be communicated in writing to the Organization, the national environmental service of the regional administration of the environment, local government and national agency "Latvian National Accreditation Bureau". 9. If the system registry organization in respect of Regulation No 761/2001 of the requirement, it temporarily or completely excluded from the system registry. The Office shall examine the question of the Organization's exclusion from the system registry when the application is received, that the organisation violated environmental laws, regulations or administrative provisions, the requirements laid down in the field of the environment or the Organization submitted an updated environmental statement. 10. the Office will send the Organization a written statement saying that will be addressed the question of its exclusion from the system registry, and shall state the reasons. Organization in the month following receipt of the notification shall be submitted to the Office in the explanation and documents proving that the organization complies with environmental laws and regulations to the requirements in the field of the environment, and restore the environmental statement. 11. the Office a month from this provision 10. expiry of the period referred to in paragraph 1 shall examine the question of the Organization's exclusion from the system registry and adopt appropriate decisions. 12. The decision of the Office shall be entitled to create inter-institutional Commission by environmental authorities concerned and the experts. 13. If an explanation explaining the reasons for the discrepancy include a plan for the prevention of non-compliance and wants to keep the registration, the Office shall take a decision to exclude from the system registry for a period of up to one year. 14. If by the end of the period during which the Organization has temporarily excluded from the system registry in the Office, the documents are not submitted, demonstrating organizational compliance with Regulation No 761/2001, the Office shall decide on the requirements of the Organization's exclusion from the system registry. 15. the Bureau, in preparation of the decision on registration of the organisation or the organisation banned from the system registry on time or in full consultation with national environmental authorities or local authorities. VI. final question 16. Be declared unenforceable in the Cabinet of Ministers of 20 April 2004, Regulation No 320 "procedures for establishing and maintaining environmental management and audit system and recorded in the register of organizations" (Latvian journal, 2004, 65 no; 2005, nr. 84).
