No 24 58) procedures for granting national and EU support for rural development, the environment and the improvement of the countryside Issued under the agricultural and rural development Act article 5, fourth paragraph 1. General questions 1. determines the order in which the State and the European Union's support for rural development-environment and rural landscape improvement measures implemented under Council of 20 September 2005 Regulation (EC) No 1698/2005 on support for rural development by the European agricultural fund for rural development (EAFRD) (hereinafter Regulation No 1698/2005).
2. National and European measures to support the environment and the improvement of the countryside are as follows: 2.1 the payments to farmers in areas with handicaps, other than mountain areas;
2.2. Natura 2000 payments and payments linked to Directive 2000/60/EC (hereinafter referred to as the Natura 2000 payments);
2.3. the agri-environment sub-measures: payment 2.3.1. development of organic farming;
2.3.2. the introduction of the integrated horticulture and promotion;
2.3.3. biodiversity maintenance lawns are excluded;
2.3.4. stubble field winter period;
2.3.5. installation of buffer strips;
2.3.6. farm animal genetic resource conservation;
2.4. Natura 2000 payments (forest owners).
3. the specific conditions provided for in the rural development plans of Latvia for the implementation of the rural development programme for 2004-2006 (hereinafter referred to as the rural development plan), implemented according to the Council of 17 May 1999, Regulation (EC) No 1257/99 on the European agricultural guidance and guarantee fund (EAGGF) support for rural development, and some of the amendment and cancellation of the Regulation (hereinafter Regulation No 1257/99). Special conditions for such rural development plan of the "agri-environment" the bottom measures: 3.1 the development of organic production;
3.2. biodiversity maintenance lawns are excluded;
3.3. installation of the watercourse;
3.4. agricultural conservation of animal genetic resources;
3.5. erosion control.
4. the measures referred to in these provisions (with the exception of this rule 2.4. measures referred to in paragraph 1 below) support can get a farmer who meets the requirements laid down by the Council on 29 September 2003 of Regulation (EC) No 1782/2003 establishing common rules for direct support schemes under the common agricultural policy and establishing certain support schemes for farmers, and amending Regulation (EEC) No 2019/93, (EC) no 1452/2001, (EC) no 1453/2001 , (EC) No 1454/2001, (EC) No 1868/94, (EC) No 1251/1999, (EC) No 1254/1999, (EC) no 1673/2000, (EEC) no 2358/71 and (EC) no 2529/2001, article 2, paragraph "a".
5. the measures referred to in these provisions (with the exception of this rule 2.4. measures referred to in paragraph 1 below) of agricultural land can be used to receive support for the applicant who managed agricultural land and is applied to support agricultural land owner or by the lessee legal possessor.
6. the rural support service to take account of the Commission of 15 December 2006, Regulation (EC) No 1974/2006 laying down detailed rules for the application of Council of 20 September 2005 Regulation (EC) No 1698/2005 on support for rural development by the European agricultural fund for rural development (EAFRD) (hereinafter Regulation No 1974/2006), and of the Commission of 7 December 2006, Regulation (EC) No 1975/2006 laying down detailed rules for the for the implementation of Council Regulation (EC) No 1698/2005, as regards the implementation of control procedures as well as cross-compliance in respect of rural development support measures (hereinafter Regulation No 1975/2006), as well as the Commission of 29 April 2004, Regulation (EC) No 817/2004 laying down detailed rules for the application of Council Regulation (EC) No 1257/1999 of the European agricultural guidance and guarantee fund (EAGGF) support for rural development (hereinafter Regulation No 817/2004). According to Regulation No 1974/2006 and article 47 of Regulation No 817/2004, article 39 of the field support service allows deviations from these requirements in these rules the following exceptional circumstances: 6.1 the beneficiary's death;
6.2. support long-term professional incapacity of the beneficiary;
6.3. a large part of the farm expropriation if it could not anticipate the day when received;
6.4. a serious natural disaster that severely affect the farm land;
6.5. livestock breeding for the accidental destruction of the farm;
6.6. the epizootic disease affecting all beneficiaries of agricultural animals or parts of them.
7. If this was a provision referred to in paragraph 6 in exceptional circumstances, the beneficiary or his authorised person for ones in writing within 10 working days (starting from the date when such an opportunity arises) Field informed support regional agricultural administration, in which the area payment application in accordance with the laws and regulations on the procedures is assigned to national and EU support for agriculture direct support schemes, as well as submit a detailed description of the emergency conditions emergency conditions and supporting documents.
8. Claim to support this provision, the measures referred to in paragraph 2, the applicant throughout the farm aid in respect of agricultural land, good agricultural and environmental conditions in accordance with the laws and regulations on the procedures is assigned to national and EU support for agriculture direct support schemes. Claiming to support this provision 2.1., 2.2., or measures referred to in point 2.3, aid the applicant throughout the farm also comply with minimum organic fertilizers and plant protection products requirements and other minimum requirements, set out in annex 1 of these rules in the legislation.
9. the aid referred to in paragraph 2 of these regulations (other than 2.4) or measures referred to in paragraph 3 may be received only on the agricultural land (in accordance with the provisions of annex 2 of the crops listed in the codes), eligible for the single payment and other area has been logged in a single area payment in accordance with the laws and regulations on the procedures is assigned to national and EU support for agriculture direct support schemes.
2. the aid measure "payments to farmers in areas with handicaps, other than mountain areas" 10. Under "payments to farmers in areas with handicaps, other than mountain areas" for the support given to the territories under Regulation No 1257/99 article 19 must of less favoured areas (annex 3).
11. the applicant may receive aid for the agricultural land this provision 2.1. measures referred to in subparagraph, if the following conditions for eligibility: 11.1. support log on agricultural area located in these rules referred to in paragraph 10, it is applied in the territory of the single area payment, and the agricultural activity is carried out at least one hectare in area, consisting of the field not less than 0.3 hectares;
11.2. a further five years from the first payment of the support, the applicant undertakes to carry out agricultural activities agricultural land located in point 10 of these provisions in that territory, and each year submit to the area payment application;
11.3. aid for permanent meadows and pastures or farm for the permanent grass in arable land may receive support by the applicant – owner of the herd, the property of which is the number of animals, providing the minimum density of cattle-beef at least 0.2 units (annex 4) to one of the eligible permanent pasture or meadow and arable land in the back of the permanent grassland acres farm on average (according to the State agencies "agricultural data centre" data by State on 1 July of the current year. Animals, livestock and accommodation is registered and animals identified in accordance with the laws and regulations on animal, herd and the recording of holdings and identification of the animals). These conditions do not apply to permanent pasture or meadow and arable land in the ranch area of permanent grassland, located in the European interest in the protected natural areas (Natura 2000) or a biologically valuable grasslands and apply for support to this rule 2.2, 2.3.3. or 3.2. measures referred to in support of the applicants, who are the current year 1 July registered a food and veterinary service of the company in the register as apiculture products primary producers or honey packaging companies (natural or legal person).
12. The amount of aid per hectare of agricultural land, on which all the conditions for receiving the aid are the following: 12.1.  1. category-EUR 25;
12.2. category 2 — EUR 40;
12.3. category 3 – EUR 58.3. support measures for Natura 2000 payments "under" 13. Natura 2000 payments support provided for "areas (permanent meadows and pastures), in the European sense of nature conservation sites (Natura 2000) list in accordance with the law" On especially protected natural territories ".

14. the applicant may receive aid for the permanent meadows and pastures, which in paragraph 13 of the rules specified in the territory that has been logged in a single area payment, in which agricultural activity is carried out at least one hectare in area, consisting of the field not less than 0.3 hectares.
15. the amount of the aid for one Permanent grasslands and pasture acres where all the conditions for receiving the aid is EUR 44.4. support measures ' agri-environment payments "Claiming to support 16 of these rules referred to in point 2.3 sub-measures, support the applicant assume voluntary commitments on support for each sub area or log onto animals for five years, starting from the first year of the approval of the payment. Obligations shall enter into force on the date on which the applicant submits to the rural support service of regional agricultural administration, the application of these rules in accordance with the procedure laid down in chapter VI.
17. On that particular area can take only one of these rules, 2.3.1 2.3.2 2.3.3 2.3.4, 2.3.5,,, 3.1., 3.2., 3.3 or 3.5 sub-measures referred to, except that rule 2.3.1. or 3.1. and 2.3.4. sub-measures referred to, which can combine the field level.
18. the beneficiary throughout the commitment period can extend up to 20% of the area of the commitments from the areas on which he committed the first commitment period of the year. If the current year obligations found in the area by more than 20% of the area of the commitments on which he committed the first commitment period of the year, the beneficiary begins a new five-year commitment period.
19. the commitment period, the beneficiary must not change the location of the field for which he or she has undertaken, pursuant to Regulation No 1975/2006 paragraph 6 of article 10, except that provision 2.3.2. or at the bottom of paragraph 2.3.4 Sub-measures which beneficiary is undertaken for a total commitment of the area and the location of the farm field may change.
20. the beneficiary may terminate the obligations of this provision 2.3. measures referred to in subparagraph before the end of the commitment period. In that case the applicant shall reimburse the aid commitment period, all previously received the support of part of the area or animal for which the obligations are suspended, including the previous owner.
21. If the beneficiary of all or part of the holding is transferred to another person, which is the rural support service customer, that person can take over the obligations of the beneficiary in accordance with the provisions of paragraph 23. If the commitment is not taken over, the beneficiary shall repay all advance commitment period the support received.
22. Regulation No 1974/2006 article 44 paragraph 2 of "a" in the cases specified in the commitment period the support is not required to repay, if the commitment is terminated in fourth or fifth year of commitments and obligations of the transferee within 10 working days (starting from the date when such an opportunity arises) by the rural support service regional agricultural administration encountered a situation explanation and supporting documents.
23. commitments and transfer takes over each of these provisions referred to in paragraph 2.3 below measure separately, without affecting the other sub commitment period, and subject to the following conditions: 23.1. If there is no relation of the successor and he takes over the obligation from one commitment, the commitment of the transferor to the transferee undertaking the commitment continues to take over the end of the period;
23.2. If the transferee is not a relationship of respect and he takes on the commitment of a number of obligations, then the obligations of traitors successor begins a new five-year commitment period;
14.5. If the successor already has commitments and he takes commitment from one or more of the obligations of the transferor, the transferee starts a new five-year commitment period.
24. If the area of the commitments in the current year decreases by more than 3%, the period of the support received for the reduced commitment of beneficiary areas do not require repayment.
4.1. support for the Sub-measure "organic development" 25. these provisions Support the bottom referred to in paragraph 2.3.1, you can get support in principle the applicant producing organic products or who are in transition to organic production of agricultural products.
26. the applicant may receive support for agricultural land, which are grown in culture eligible (annex 2), provided the following conditions for eligibility: 26.1. in agricultural activities, using organic methods, farm field on eligible agricultural land of at least one hectare of the area of the field, not less than 0.3 hectares;
26.2. the next five years from the first payment of the annual approval of the commitment not to cut aid to the area declared, the master according to the bottom of the support measures, do not change the location of the field and each year submit to the area payment application;
26.3. manufactures and distributes organic products under legislation on organic farming, which represents the food and veterinary service in accordance with the legislation on organic production monitoring and control arrangements approved inspection bodies (hereinafter referred to as the control authority), providing the rules referred to in annex 8. Before filling out the form of the opinion of the audit institution shall verify that aid the applicant is registered as a taxable person and in accordance with the State revenue service annual reports submitted or the income statement for the previous year is concluded the minimum revenue from sales of agricultural products. Minimum income from sales of agricultural products does not include subsidies that paid as State aid, agriculture, or the European Union's support for agriculture and rural development. The State revenue service submitted a report or annual declaration of income support for the control authorities, the applicant presented when it surveyed the farm, or provide copies of relevant control authorities to submit, no later than 1 July of the current year. Support the applicant is subject to the following minimum revenue from sales of agricultural products, which shall be calculated in relation to the previous year in the areas declared to support (this provision does not apply to aid applicants who have not previously logged on to support): 26.3.1. this rule 27.1. aid referred to at least 50 dollars per hectare in meat livestock farms or at least 100 Lats per hectare available holdings bark;
26.3.2.27.2. these provisions referred to support – at least 130 Lats per hectare;
26.3.3. This provision 16.3. or 27.4. the bottom of the aid referred to in paragraph 1 for at least 1000 dollars per hectare;
26.3.4. This provision referred to in paragraph 17.1. support – at least 2000 dollars per hectare, excluding outdoor plantings, not more than three years.
27. The amount of aid per hectare of agricultural land, on which all the conditions for receiving the aid, is as follows: 27.1. permanent meadows and pastures, not ktāraug: EUR 138;
27.2. the summer wheat, winter wheat, rye, barley, summer, winter barley, au zas, Triticale, buckwheat, summer rape, winter rape, peas, field beans sweet lupins, flax oil, flax, different mixes of the above named arable crops, sugar beet, the other on arable land, arable land crops on the farm, the permanent lawn grass seed, cereals and legumes harvested green and silage, corn and silage, green fallow – EUR 108;
27.3. vegetables, herbs, kitchen garden: EUR 357;
27.4. potatoes, starch potatoes – EUR 318;
27.5. fruit trees, berries – EUR 419.28. If the change to organic production-related indicators (such as market price, yield), the Ministry of agriculture through appropriate legislative commitment period can change that rule 26.3. referred to the minimum amount of revenue from sales of agricultural products.
4.2. support for the Sub-measure "integrated horticulture and promoting the implementation of the ' 29. Support this provision 2.3.2. bottom sub referred to in paragraph 1 eligible applicants who take the agricultural integrated production.
30. the applicant may receive support for agricultural land, which are grown in culture eligible (annex 2), provided the following conditions for eligibility: 30.1. in agricultural activities in accordance with the requirements of the integrated cultivation on eligible agricultural land of at least one hectare of the area of the field, not less than 0.3 hectares;
30.2. the next five years from the first payment of the annual approval of the commitment not to cut aid to the area declared, the master under sub-action support conditions and each year submit to the area payment application;

30.3. in respect of the integrated agricultural products growing requirements in accordance with the laws and regulations on the integrated production of agricultural products, storage, labelling and control procedures, which represents the record State plant protection service of the integrated cultivation of agricultural products.
31. commitments cannot be held for areas for which support the applicant in 2006 or in 2007, entered into an agreement with Field support services and undertaken five years to manage the areas concerned through integrated farming methods.
32. The amount of aid per hectare of agricultural land, on which all the conditions for receiving the aid are the following: 32.1. Apple trees, PEAR-EUR 390;
32.2. cherries, plums, raspberries, blackcurrants, redcurrants, blueberries, cranberries, strawberries, berries, Spike krūmcidonij-EUR 278;
32.3. cabbage – EUR 24;
32.4. the cauliflower, carrots, beetroot, cucumber, onion, garlic, EUR 70.4.3. support for the Sub-measure "maintaining biodiversity tend to" 33. Support this provision 2.3.3. point in the bottom of the Sub-measure eligible applicants who managed meadows and pastures of the permanent set of valuable as organic lawns.
34. the applicant may receive support for agricultural land, which are grown in culture eligible (annex 2), defined as biologically valuable grasslands, if aid is subject to the following conditions: 34.1. in agricultural activities on eligible agricultural land of at least one hectare of the area of the field, not less than 0.3 hectares;
34.2. a further five years from the first payment of the annual approval of the commitment not to cut aid to the area declared, the master according to the bottom of the support measures, do not change the location of the field and each year submit to the area payment application;
21.3. biologically valuable grasslands for grazing each year by 0.4-0.9 cattle units per hectare (calculating the beef unit in accordance with the provisions of annex 4 shall be disregarded in fattening pigs, breeding male pigs or sows, gilts, piglets, rabbits, šinšill, ostrich, quail, turkeys, geese, ducks, pheasant) or mow at least once from 1 august to 15 September, flat grass is harvested and taken away from the field or grind;
21.4. If biologically valuable grasslands for grazing, but: 34.4.1. number of animals on the biological value of the lawn, the quantity per hectare per application for intensive grazing in specified area of intended hectares;
34.4.2. animals are not owned by the applicant, the aid aid applicants with the animal owner shall be the subject of a written agreement on the biological value of over-grazing and submit it to the grass Field support regional agricultural administration with this rule 57.1. application referred to;
34.5. biologically valuable grasslands not cultivated, ploughed, not used in fertilizer.
35. The amount of aid per hectare of biologically valuable grasslands, where all the conditions for receiving the aid is EUR 123.4.4. support for the Sub-measure "stubble field winter period" 36. support rules referred to in paragraph 2.3.4. below, you can get support in principle the applicant engaged in agricultural activities of agricultural land in the area.
37. the beneficiary may receive aid for agricultural land, which are grown in culture eligible (annex 2), provided the following conditions for eligibility: 37.1. in agricultural activities on eligible agricultural land in at least 10 hectares in area, which consists of a field of not less than 0.3 hectares;
37.2. a further five years from the first payment of the annual approval of the commitment not to cut aid to the area declared, the master under sub-action support conditions and each year submit to the area payment application;
37.3. after harvest leave the field until March 1 of the following year did not allow for crops (winter wheat, winter wheat, barley, barley, rye, Triticale, oats, buckwheat, summer rape, winter rape, peas, field beans sweet lupins, flax oil, flax, different mixtures of those crops, cereals and legumes harvested green and silage, corn and silage harvested green, not ktāraug) successive residues, stubble;
37.4. post-harvest stubble in the field do not use plant protection products and fertilizer.
38. The amount of aid per hectare of stubble, which satisfies all the conditions for receiving the aid shall be EUR 87.4.5. support for the Sub-measure "of the watercourse" 39. This provision 2.3.5. sub-measures referred to in subparagraph provides support provided for particularly sensitive areas, determined in accordance with the laws and regulations on water and soil conservation of the agricultural activity in pollution by nitrates.
40. the applicant may receive aid for the establishment and management of the watercourse, which are grown in culture of eligible, provided the following conditions for eligibility: 24.9. in agricultural activities on eligible agricultural land of at least one hectare of the area of the field, not less than 0.3 hectares;
40.2. the next five years from the first payment of the annual approval of the commitment not to cut aid to the area declared, the master according to the bottom of the support measures, do not change the location of the field and each year submit to the area payment application;
40.3. create agricultural land surface of ūdensobjekt buffer strips or farm buffer strips for a field that is not less than 0.3 hectares in the watercourse, installing a permanent grassland, permanent pastures and grazing, arable land in the back or the permanent lawn grass seed;
40.4. managed buffer strips of the created surface ūdensobjekt or farm buffer strips, reap at least once in the period from 1 august to 15 September, flat grass is harvested and taken away from the field or grind;
25.2. the continuous buffer strips at least 100 metres in length;
40.6. farm buffer strips in width of at least 4 metres;
40.7. the watercourse width of surface ūdensobjekt is as follows: 40.7.1 long water, within the national drainage system and water bodies, which is spoguļlaukum less than 5 hectares, at least 10 feet from the shoreline, but standing for pamatkrast, from the top edge;
40.7.2. long ditches (except the kontūrgrāvj, the susinātājgrāvj and the road elements-ievalk and road ditches, which perform the functions of collection and segregation, but do not act as another object in the waters of the arresters) – 4 meters from the edge of the ditch, which includes sharing and one property drainage system;
25.4. ūdensobjekt buffer strips along the surface of the water, which is part of the national drainage system, only when the field is in a block of less than 10 metres from the shore of kant (channel excavation, ūdensnotek) or the shoreline from the water (natural rivers and water reservoirs) at least 100 meters of continuous phases.
41. not be in field buffer strips, which declared a permanent meadows and pastures, arable land on the back lawn or the permanent grass seed, set aside.
42. Where, in accordance with the conditions for receipt of the aid may be provided for surface ūdensobjekt buffer strips, not eligible for aid the establishment of buffer strips of arable soil.
43. the commitment cannot take on the area, which already has commitments this rule 3.3. Sub referred to in subparagraph.
44. This provision 2.3.5. sub-measures referred to shall be financed from the State budget sub 21.01.00 "subsidies to agricultural producers."
45. the support shall be determined and the aid shall be paid once it is accepted by the European Commission decision on the aid's compatibility with the common market. Support the applicant declares that he wishes to continue the commitment this provision 2.3.5. bottom sub referred to in paragraph 1, if, after the decision of the European Commission are changed under the conditions of implementation.
4.6. support for the Sub-measure "agricultural genetic resources" 46. support rules referred to in paragraph 2.3.6 bottom Sub-measure eligible applicants who are monitoring the herd owner.
47. the applicant can get support for such a farm animal genetic resources in the territory of Latvia: 29.3. Brown cow breed animals;
47.2. the blue cow breed animals;
47.3. the white pig breed animals;
47.4. the Shepherd of tumšgalv;
29.5. the horse breed of SUV type;
29.6. the local goat breed animals.
48. the applicant may receive support for this rule 45, paragraph breeders concerned, provided the following conditions for eligibility:

29.9. following five years from the first payment of the annual approval of the commitment not to sell for animals eligible, do not bestow and remove, except in special circumstances (gone to productive age animals, the animal does not meet the tribe work programme requirements, sickness, accidents, in which the animal is partly hurt and not curable), and each year submit payment of the aid application. For each livestock support the applicant takes individual commitment period;
48.2. animal meets the farm animal genetic resource conservation criteria under the livestock breeding program of varieties, which represent the breeders ' organisation recognised in Latvia in accordance with the laws and regulations on breeders ' organization eligibility criteria and the breeders ' organisation status. The variety of opinions issued not more than 550 varieties of animals concerned.
49. The commitments can not accept and support shall not be granted for animals for which these provisions have already been undertaking the sub-measures referred to in subparagraph 3.4.
50. This rule 2.3.6. referred to in principle financed from State budget sub 21.01.00 "subsidies to agricultural producers."
51. the amount of the down payment of the aid and the aid shall be paid once it is accepted by the European Commission decision on the aid's compatibility with the common market. 5. support measures for Natura 2000 payments (forest owners) the ' 52. Support the applicant this provision 2.4. measures referred to in the context of a natural or legal person of private equity capital is 50% or more and which is the ground of the forest owner.
53. Natura 2000 payments, forest owners can get on forest lands (excluding wetlands) areas of European interest located in the protected natural areas (Natura 2000) list in accordance with the law "About specially protected natural areas" and set any of the following operating limitations: 53.1. forestry in prohibited activities;
53.2. prohibited the main harvesting and thinning hair;
53.3. prohibited the main harvesting;
53.4. compensation is prohibited.
54. the minimum area for which aid is granted is one hectare, comprising the field of not less than 0.5 hectares. The applicant shall identify the nature of the aid in support of the proposed area boundaries.
55. the applicant may receive aid for the area, which is located in this rule referred to in paragraph 53, where the aid is subject to the following conditions: 55.1. support the applicant the application year is not called to administrative responsibility in accordance with the Latvian Code of administrative offences, 66.3, 66.4 57.1, 67, 67.1, 68, 71, 71.1 and article 81 (under the Ministry of Interior Information Center data by State on 1 January of the following year);
55.2. in the year of the application the applicant supports laws duly has paid fines for this rule 55.1. the infringements referred to in subparagraph I by woods and damages, if forest land owner imposed fines for violations of forest management, or his fault the forest suffered damage;
55.3. support log in area of forest inventory carried out in accordance with the laws and regulations on forest inventory procedures;
55.4. support for the area concerned, the applicant has not received compensation under the law of the land owner the right to compensation for the operating limits of the specially protected natural areas and mikroliegumo "about this rule referred to in paragraph 53 operating restrictions, except the compensation for the care shelter prohibition;
55.5. to the application a year has changed aid applied for forest landowners.
56. The amount of aid per hectare of forest land in which all of the conditions for receiving the aid is EUR 60.6. Support procedures for applying for and granting of 57. To request aid, the applicant shall submit a Field support regional agricultural administration: 57.1. the completed application (area payment application form in accordance with the laws and regulations on the procedures is assigned the national and European support for the direct support schemes for agriculture) along with the support service provided by agricultural land map that marked managed agricultural land area, if you want to get this provision 2.1., 2.2., 2.3. aid referred to in point (except this rule 2.3.6. bottom of the measures referred to in point) – up to 15 May of the current year;
57.2. completed application (area payment application form in accordance with the laws and regulations on the procedures is assigned to national and EU support for agriculture direct aid scheme) together with the application specified in the real estate cadastre of the State land service unit issued land boundary plan with wooded land plan in support of the selected forest land area, if you want to get this provision 2.4. aid referred to in paragraph to the current year, May 15;

7. Special conditions for rural development measures for the plan of "agri-environment" 69. 74. the beneficiary may terminate the obligations of this provision the measures referred to in paragraph 3 before the end of the commitment period, repayment of the aid received in the period of the commitment on the part of the area or animal for which the obligations are suspended, including the previous owner.
75. If the area of the commitments in the current year decreases by more than 3%, the beneficiary of the aid the aid commitment period for reducing the area of the commitments does not require repayment.
