Cabinet of Ministers Regulations No. 605 in 2015 (October 20. Nr. 55 21) national and EU aid modalities the European Fund for Maritime Affairs and fisheries measures for "Public-driven local development strategies" Issued under the agricultural and rural development Act article 5, fourth paragraph i. General questions 1. determines the order in which the open project submissions in the form of a competition and State aid in the European Union European Fund for Maritime Affairs and fisheries measures public-driven local development strategy implementation (hereinafter measure) in accordance with the : 1.1. European Parliament and Council of 15 may 2014, the Regulation (EU) no 508/2014 on a European Fund for Maritime Affairs and fisheries (EJZF), and repealing Council Regulation (EC) No 2328/2003, (EC) no 861/2006, (EC) no 1198/2006 and (EC) no 791/2007 of the European Parliament and of the Council Regulation (EU) No 1255/2011 (hereinafter Regulation No 508/2014); 1.2. The European Parliament and of the Council of 17 December 2013 Regulation (EU) No 1303/2013 laying down common provisions on the European regional development fund, the European Social Fund, the Cohesion Fund, the European agricultural fund for rural development and the European Fund for Maritime Affairs and fisheries and general provisions on the European regional development fund, the European Social Fund, the Cohesion Fund and the European Fund for Maritime Affairs and fisheries, and repealing Council Regulation (EC) No 1083/2006 (hereinafter Regulation No 1303/2013); 1.3. Commission 17 December 2014 the delegated Regulation (EU) No 2015/288, the European Parliament and of the Council Regulation (EU) no 508/2014 on a European Fund for Maritime Affairs and fisheries added relating to the inadmissibility of the application period and the start and end of the day (hereinafter Regulation No 2015/288); 1.4. the Commission 18 December 2013 Regulation (EC) No 1407/2013 for the Treaty on the functioning of the European Union and article 107.108. application of the de minimis aid (hereinafter Regulation No 1407/2013). 2. Measures implemented in accordance with the legislation on the national and European aid modalities for public-driven local development strategy preparation and implementation: 2.1. Action programmes for fisheries development in 2014-2020 event Company-driven local development strategy implementation "company-driven local development strategy (hereinafter referred to as the local development strategies) for implementing a specific area; 2.2. According to the case of local action groups and the local development strategy evaluation Committee approved of the local development strategies.
3. the meaning of these provisions: 3.1. innovative project is a project, which is creating new or improved products, processes or methods and meeting local development strategies for innovative solutions in the identification and eligibility criteria for their identification; 3.2. public benefit project is a project in which the purpose is not commercial in nature, which do not qualify as State aid and for which results are not charged. The meaning of this provision of the public good of the project in accordance with Regulation No 508/2014 article 95 paragraph 3 of point "a" to "i" section match the criteria "common interests"; 3.3. joint ventures is a project in which the investments are intended to be used together and which shall be submitted to: 3.3.1. society for at least one year prior to the application of the project in accordance with the registered society and Foundation law, members of which (at least three) business area mainly fishing, aquaculture, or fish, crustaceans and molluscs processing and preservation and the meaning of these provisions is a collective of the beneficiary of the aid in accordance with Regulation No 508/2014 article 95 paragraph 3 of point "a", "(ii)". 3.3.2. the local authority to ensure the fisheries business infrastructure at least two legal persons carrying on economic activities in the fisheries, aquaculture, or fish, crustaceans and molluscs processing and preservation and that the meaning of these provisions is a collective of the beneficiary of the aid in accordance with Regulation No 508/2014 article 95 paragraph 3 of point "a", "(ii)". 3.4. creating jobs – jobs that provided employees with a contract of employment for at least a year, down to a normal working time or self-employed economic activities, or more jobs, seasonal work, in which the total number of hours worked during a calendar year corresponds to normal working time, and are made to the State social security payments. 4. the objective of the measures laid down in Regulation No 508/2014 6. paragraph 4. 5. supports the applicant (hereinafter the applicant) logon, and the conditions for receiving the aid, project submission, evaluation and selection procedures, the adoption of the decision, the conditions of project implementation review evaluation and decision-making procedures for requesting public financing and payment arrangements, project monitoring and sanctions shall also determine the laws on the national and European Union aid, administration and monitoring of the development of the rural and fisheries-2014 – 2020 programming period insofar as they do not conflict with these rules.
II. conditions for receiving the aid Measure under the 6 local development strategy to support the following activities: 6.1. added value and innovation in all fisheries and aquaculture products; 6.2. the diversification of activities in the fisheries sector and in other marine sectors of the economy; 6.3. environmental reproduction or use, as well as mitigation of climate change; 6.4. the fishing or sea cultural heritage promotion. 7. The applicant: 7.1 these terms 6.1. and 6.2. activity referred to in subparagraph a legal or physical person. The local authority for the applicant can only be this rule 3.3.2. joint venture; referred to in subparagraph 7.2. this rule 6.3 and 6.4. activity referred to in subparagraph is a legal person (including local government). 8. activities for which other European Maritime Affairs and Fisheries Fund measures regulatory laws, this event does not support, except for the activities in accordance with the legislation on the national and European aid arrangements under "add value, product quality and the use of undesirable catches" and the legislation on the national and European aid arrangements under "fishing and aquaculture products". 9. Public funding conditions: 9.1 the project complies with the local development strategy; 9.2. the project implementation of the local development strategy. If the project is intended to buy this provision referred to 26.10. mobile equipment, the applicant must be registered or his declared residence (if the applicant is a natural person who performs or intends to start economic activities as a self-employed person) must be in the local development strategy. Project monitoring during the mobile technique can also be used outside of the local development strategy; 9.3. the applicants in the framework of the project, reaches this rule referred to in paragraph 4; 9.4. the applicant does not replace the existing fixed assets (does not apply to this rule 3.2. projects referred to); 9.5. If to support the development of the economic activities of qualifying merchant, farmers or fishermen, agricultural or natural person, the applicant in the application for the project its economic viability. Economic viability is positive cash flow of the project in the year of application, all project implementation years and years after the implementation of the project. Cash flow statement cash balance at the end of each year is positive. The project attached to the application of the cash flow statement, the production volume and cost of the project in the year of application, in all the years of implementation and a year after the implementation of the project acknowledge the possibility to implement the project and achieving project goals. An applicant who intends to carry out an economic activity, in addition to its economic viability, planned production volume and cost estimates for two years after the implementation of the project; 9.6. after the implementation of the project have achieved at least one of the following indicators or targets: 9.6.1. if eligible for support 6.1 these rules or 6.2. activities referred to in subparagraph (except local authority or the applicant, forming a new company, the first report or tax year has not yet ended), the applicant: creates at least one 9.6.1.1. a new job; 9.6.1.2. at least 10 percent compared to last year, concluded before the submission of the project to increase the production or net annual turnover; 9.6.1.3. net change in the year increased by at least 30 percent of the invested amount investment; 9.6.2. if eligible for support 6.1 these rules or 6.2. activity, referred to in subparagraph a tenderer, forming a new company, of which the first reference or taxation year is not yet over: 9.6.2.1. create at least one new job; 9.6.2.2. net annual turnover reached at least 30 percent of the the investment volume; 9.6.3. if eligible for support local authorities that rule 6.1 or 6.2. activity, referred to in subparagraph a of these rules referred to in point 3.3.2 of the joint venture participants (other than local), individually: causing at least one 9.6.3.1 of new jobs; 9.6.3.2. at least 10 percent compared to last year, concluded before the submission of the project to increase the production or net annual turnover; 9.6.3.3. annual net turnover increase by at least 30 percent of the invested amount investment; 9.6.4. If the aid qualifies this rule 6.3. activities referred to in subparagraph a, the applicant: 9.6.4.1. reduce impact on the environment; 9.6.4.2. reduce the impacts of climate change; 9.6.4.3. improve the environmental resource use or reproduction; 9.6.5. If these provisions shall be eligible for support referred to in subparagraph 6.4. activity, the applicant foster: 9.6.5.1. preservation of cultural heritage; 9.6.5.2. access to culture; 9.7. the implementation of the project the applicant reaches the indicators established under the local development strategy and to meet the objective of the project. 10. If the applicant is a society, this provision and paragraph 9.6.1.3 9.6.1.2. mentioned the increase of the average bill for all members of the society. 11. if eligible for support person, who started business operations and obtain a self-employed person, it achieves both these provisions and 9.6.2.1 9.6.2.2. indicators referred. 12. This provision 9.6. the majority referred to a planned value and 9.7. the indicators referred to in the applicant reached the conclusion no later than the third year of implementation of the project and it lowers all future surveillance period. 13. For fixed assets is not considered a substitution: 13.1. new construction, construction, installation, rebuilding and restoring parking; 13.2. a fixed asset acquisition project capacity, yield or payload is at least 25 percent larger than the existing assets of the applicant's production capacity, yield or payload; 13.3. the fixed asset acquisition project that significantly changes the nature of the production or technology; 13.4. additional acquisition related to assets that are older than 10 years. Adding to existing fixed assets of less than 10 years, they must be retained for at least five years from the submission of the project or up to 10 years for depreciation of the fixed asset.
III. Public funding, and about 14. Aid intensity is up to 50 percent of the project's eligible costs, with the exception of: 14.1. innovative projects for implementing this rule 6.1 and 6.2. the activity referred to in subparagraph and that the aid intensity is up to 70 percent; 14.2. the project, which is linked to coastal fisheries in accordance with Regulation No 508/2014 article 95 paragraph 4 and annex I, and that the aid intensity is up to 80 percent; 14.3. the merchant that is not small (micro), small or medium-sized enterprise and the aid intensity is up to 30 percent; 14.4. the public good a project intended to implement this rule 6.3 and 6.4. activity referred to in subparagraph and that the aid intensity is up to 90 percent; 14.5. joint projects for implementing this rule 6.1 and 6.2. the activity referred to in subparagraph and that the aid intensity is up to 80 percent. 15. conformity of Small Firms (micro), small and medium businesses in rural support service shall be determined in accordance with regulations No 1303/2013 article 28, paragraph 2. 16. The applicant, in accordance with paragraph 15 of these rules is not small (micro), small or medium-sized enterprise support for fisheries and aquaculture products processing in the measure is not granted. 17. one of the measures to be supported in the eligible cost of the project, the maximum amount is up to eur 100 000:17.1. If the investment in the construction of the business infrastructure is at least 70 percent of the eligible costs of the project amount; 17.2. to 400 000 euros public good projects, if the applicant is a local authority;
17.3. to 50 000 euro for other projects. 18. Local action group of local development strategies can determine the amount of support and strength. 19. aid Measures not related to fisheries, aquaculture, or fish, crustaceans and molluscs processing and curing, or support for the project, which is not a public benefit project, provided in accordance with Regulation (EC) No 1407/2013.20. If support is provided in accordance with paragraph 19 of these rules: 20.1. aid granted during the last three fiscal years does not exceed the Regulation No 1407/2013 article 3 (2) the maximum size of one single company level pursuant to Regulation No. 1407/13 paragraph 2 of article 2 laid down in one single definition for a company; 20.2. support shall not be granted in the sectors of economic activity and the actions referred to in Regulation No 1407/2013 article 1 paragraph 1; 20.3. subject to the provisions of Regulation No 1407/2013 article 5 (1) and (2), de minimis aid may not be cumulated with other de minimis aid until Regulation No 1407/2013 article 3 paragraph 2 or other de minimis aid laid down in the relevant regulation limit and may be cumulated with other State aid in respect of the same eligible costs or other public aid for the same venture funding measure If this cumulation leads is not exceeded the maximum aid intensity or aid amount laid down in another State aid programme or the European Commission decision; 20.4. the applicant and also works in the sectors referred to in Regulation (EC) No 1407/2013 article 1, paragraph 1, "a", "b" or "c", this ensures that industry or the cost of separation in accordance with Regulation No 1407/2013 article 1, paragraph 2; 20.5. the applicant information on de minimis aid provided is maintained for 10 fiscal years from the date on which, under this measure, the last granted aid; 20.6. in accordance with Regulation (EC) No 1407/2013 the aid granted up to 30 June 2021; 20.7. aid shall not be granted if the applicant has been declared by a Court of insolvency proceedings or the judgment of the Court is the legal protection process, or by a decision of the Court of Justice is an out-of-court redress process, the previous bankruptcy, or the restoration of a suitable composition or economic activity has ended, or it meets its national legislation the criteria for the application of the creditor, at the request of the insolvency proceedings.
IV. Eligible and ineligible costs 21. Event is set to the following eligible costs: 21.1. new fixed asset and software acquisition and installation, as well as Museum exhibits; 21.2. the construction of a new building, rebuilding, installation (construction civil engineering Assembly, or to hold the base-or design), parking (construction of prefabricated constructions Assembly of ready elements intended to shed, not constructing foundations or foundations deeper than 30 centimeters) and the restoration costs (including customization of renewable energy or energy efficiency) on the basis of contracts with third parties who are responsible for the execution of the work; 21.3. the new acquisition cost of building materials, on the basis of a construction building permits checked in on the design conditions, or those drawn up by the applicant, if the applicant būvvald issued a memorandum or a receipt card; 21.4. regional planning costs, such as asphalt paving or other covering, the construction of the fence decking, lawn, permanent plantings and external lighting; 13.4. If the applicant is a society and to implement joint projects envisaged, – the local product marketing costs: 21.5.1. ad spending for local action groups in the territory; 21.5.2. the creation of the internetveikal; 8.5. General costs, including architects, engineers and consultation fees, inspection, building and autoruzraudzīb services, legal services, feasibility study, lease the land registry for registration, as well as patents and licences cost and energy efficiency audit preparation costs directly linked to the preparation or implementation of a project and not more than seven percent of the rest of the rules referred to in paragraph 21, the total amount of the eligible costs, including : two percent of 21.6.1. this rule 21.1 21.4 and 21.5. the costs referred to in subparagraph; 21.6.2. seven percent from 21.2. these provisions and 21.3. costs mentioned in points. 22. the Deal is for value added tax, if it is not legal to deduct from taxes payable to the State budget amounts as input to the laws on value added tax. 23. the meaning of these provisions with the recovery of construction costs shall apply, if the production is made in the shipbuilding technical or functional improvements in the energy efficiency of buildings, space alteration or adaptation without changing the size of the construction or structural elements of the performance. After the construction of the project restoration costs include the value of the fixed asset (capitalized). 24. only projects Eligible are those of building materials and the costs that are directly associated with a specific project the achievement of the objective. 25. If the applicant does not provide public funding for installation, that public funding of these facilities only receive after their commissioning and supporting documents of the Field support service. 26. the following Activities are not eligible: 26.1. interest payments, money transfers, Currency Exchange Commission payments and exchange rate fluctuations suffered damage; 26.2. fines, penalties and costs of legal proceedings; 26.3. the subcontracting, which artificially and unduly increase the cost of the project and the fee is fixed as a percentage of the total cost of the project; 26.4. the costs associated with the supply of any services or work for which there is no appropriate procurement procedures carried out in accordance with the laws and regulations on the application of the procurement procedure; 26.5. existing structures, fixed assets and purchased software maintenance costs; 16.5. the purchase of property or shares; 16.6. maintenance, spare parts and operating costs; 16.7. the remuneration of personnel; 26.9. duties and taxes, except for this provision, paragraph 22; 26.10. expenditure on the boat (boat equipped with engine) and the ship, as well as machinery, moped, motorcycle, motor tricycle, quadricycle, bus, car and truck purchases, excluding expenditure on general purpose vehicles tailored to specific jobs and who have set up specific functions, and equipment which is a mobile service or for fishing and aquaculture production or trade; 26.11. any actions abroad; 26.12. costs incurred prior to the application of the project, except that rule 8.5. referred to costs; 26.13. local road construction and alteration; 26.14. the other costs that are not eligible under Regulation (EC) no 508/2014, including Regulation No. 508/2014 activities referred to in article 11. 27. the costs incurred by the rural support service exceeds the average costs of the assessment, as well as the implementation of the activities and objectives of the time period specified by the schedule of costs considered eligible costs. 28. in support of the measure for a specified period shall be granted to the applicant, which is an offence under Regulation No 508/2014 and article 10 of Regulation No 2015/288 g. Application procedures and the documents to be submitted the draft application 29. adoption takes place and lasts for at least 30 calendar days after receipt of the application. 30. Local action group no later than one month before the beginning of the adoption of draft submissions to a field support service of the following information that the rural support service on its tīmekļvietn: 18.7. project adoption and application projects; 30.2. the respective round and local development strategies and relevant actions contained in the action plan for the aid, action description and the corresponding provisions referred to in paragraph 6, the name of the activity; 30.3. the project evaluation criteria and evaluation of the project, the necessary information to be provided by the submission of the project under "additional information to be provided in accordance with the local development strategy", and the minimum score that you want to give the project a positive opinion on each of the local development strategies action plan includes actions in which the project application to the adoption; 18.9. the local action groups, the name and address where you can get acquainted with the local development strategy and to submit project applications in paper form as well as contact information (contact name, phone number, e-mail address). 31. Local action group after coordination with Field support services available in the local development area of the implementation of the strategy, insert the project information on the acceptance of the application according to the local development strategy, pointing to the respective round and local development strategies and actions contained in the action plan for the amount of the aid and that rule 30.1. and 18.9. referred to information as well as a reference to the rural support service tīmekļvietn, and an indication of the field support service Electronic login system and field support service e-mail address in which the project application can be submitted in the form of electronic document under the electronic Act. 32. If the course lasts more than 30 calendar days from the date of implementation of the projects applied for the public funding reaches 80 percent of the available funding, the rural support service and the local action group in its tīmekļvietn the insert statement on the application of the deadline and continue to accept project submissions for at least 30 calendar days, it will sum up and line up according to the local development strategy specific to certain project evaluation criteria. 33. To apply for aid this provision referred to in point 6, for the implementation of activities in support of the applicant in accordance with the laws of the State of the European Union and the granting of aid, administration and monitoring of the development of the rural and fisheries-2014 – 2020 programming period the local action group or field support services shall submit the following documents: 33.1 an application project (annex 1) in two copies on paper and electronic copy on an external disk If it does not submit to the rural support service Electronic login system or electronic document under the electronic Act. Local action group one copy of the application to a project in paper form together with proof of registration of the project shall be returned to the applicant; 33.2. If real estate in which to implement the project and to set up fixed assets, support the applicant lease or loan, lease or loan contract copy (lease or loan contract concluded for a period of at least seven years from the date of submission of application). If for new construction, construction, alteration, installation or position, and real estate in which to implement the project, the applicant, the applicant supports the lease together with the project application or before the commencement of the project submitted to the long-term lease that land which is registered in the rental period is not less than nine years from the date of submission of the application. If some facilities, stationary advertising or billboard installation or the acquisition of which is not fixed, unless placed in the project's planned activities will not implement in a specific space, support the applicant instead submits lease agreement with property owners on individual facilities, stationary advertising or billboard installation or placement of fixed or storage (reconciliation with the owner of immovable property concluded for a period of at least seven years from the date of submission of application); 33.3. the procurement procedure documents – the subject of the procurement technical specification and all suppliers submitted tenders in accordance with the laws and regulations on the application of the procurement procedure; 33.4. the new construction renovation, construction, installation, placement and rebuilding projects, according to the intention of the planned construction and engineering group in addition to submit the following documents: a copy of the building permit or 33.4.1. the explanatory memorandum or a receipt card with a copy of the būvvald mark for the construction of the acceptance of the idea; 33.4.2. the construction, if according to the intention of the planned construction of a building permit būvvald issued to the applicant and made the tag for the design conditions are fulfilled; 33.4.3. complement the building permit copy with the būvvald mark for the commencement of the construction works conditions – together with the project submission, or nine months after the decision on the application of the project approval date of entry into force; 33.4.4. prepare a construction cost estimate, if according to the planned construction of the būvvald applicant's conception has issued a memorandum or a receipt card; 33.4.5. purchase of building materials (if būvvald is according to the intention of the planned construction is not issued a memorandum or a receipt card) – a construction or a copy thereof, and the construction permit with a būvvald mark on the design conditions are fulfilled; 33.5. If the applicant is subject to the provisions of the conditions referred to in paragraph 19, the form of de minimis aid received in accordance with the laws and regulations on de minimis aid and the procedure of accounting and accounting forms; 20.9. If farmers eligible for support or fishermen, merchant or person, a declaration of conformity of the small companies (undersized) or the average of the company according to the laws and regulations on the procedures a company declares their conformity with the small (tiny) and the average company status; 20.9. to support this rule 6.1 or 6.2. the activity referred to in subparagraph qualifies the society, the Member list; 21.0. If is implemented this provision in the joint ventures 3.3.2. in the case referred to in subparagraph, Member of the joint venture agreement: applicant certifies 33.8.1. right to represent the party in the joint venture to submit project applications, to implement the project and to receive aid; 33.8.2. determines that the joint venture participants for a period of five years following the last payment in respect of a beneficiary State legislation and European Union aid for rural development and fisheries, as well as the commitments they have entered into a period of supervision; 21.1. the national environment service regional environmental management issued a statement about the polluting activities will be carried out when implementing the project, and what permission-category (A) or (B) the authorization of a pollutant or pollutants in category C activities – proof the applicant is required to obtain (if this requirement applies to the applicant in accordance with the laws and regulations on polluting activities). 34. If the tenderer real estate in which to implement the project, in accordance with the provisions of this subparagraph do not rent 33.2. or loaned, or not submitted a reconciliation with the owner of the real property, the real property is in the possession of the applicant, and the entry in the land register. If the applicant is a local government and real estate in which to implement the project, it shall, in accordance with this rule 33.2. point does not lease or loan, or reconciliation with the submitted property owners, then real estate is local government property, and the record in the land, or real estate is owned by local authorities. 35. when Claiming for financing new construction, building restoration, installation, parking and the building or conversion of fixed installations and equipment purchase, construction or technology specified in subparagraph 20.8. these provisions referred to in the construction documents (except this rule 33.4.3. referred to) as well as purchase documents related to construction costs, submitted together with the application or the project six months of Field support the decision on the application of the project approval date of entry into force of the but no later than five working days after the completion of the procurement procedure. 36. If an applicant for aid is used in the invoice prepayment according to legislation on the national and European aid, administration and monitoring of the development of the rural and fisheries-2014 – 2020 programming period, that this rule 20.8. the documents referred to in point (except this rule 33.4.3. referred to) as well as purchase documents related to construction costs, Field support services shall be submitted together with the invoice prepayment request. 37. If the applicant is Association or Foundation, that in addition to the provisions referred to in paragraph 33 of the document submitted to the Executive Board approved the decision on the implementation of the project and the resulting obligations, indicating the total cost of the project and the funding sources. 38. If the applicant is a local government, that in addition to the provisions referred to in paragraph 33 of the document submitted to the local authority's decision on participation in the project and the project for the implementation of the required funding.
Vi. Project evaluation and decision 39. Local action group in the month following project submission closing date or, if the round lasts more than 30 calendar days, the month following each round of concerned at the end of the month: 24.3. assess the adequacy of the draft local development strategy pursuant to: 39.1.1. local development strategies action plan contained in the respective action. If the project does not meet local development strategies action plan contained in the respective action, it does not continue to rate; 39.1.2. local development strategy set out in the project evaluation criteria. The project is granted a certain number of points for each evaluation criterion that determines the eligibility of the project for the local development strategy. Project evaluation criteria is the minimum number of points that must be obtained for the project, so that it would be appropriate for a local development strategy, and the minimum number of points proportional to the maximum number of points that the project can get the project evaluation criteria; 24.4. the evaluation of the project in accordance with the provisions of section 24.3. each local development strategies action plan includes action in the relevant individual establishes a list of projects, listing of project submissions by the number of points earned, and shall draw up opinions, signed by the local action group paraksttiesīg. If several projects have got the same number of points, with priority given to support the tenderer who has obtained the largest number of points according to the local development strategy set out in the specific criterion. For projects that do not obtain the minimum number of points scoring criteria that determine the conformity of draft local development strategy, local action group gives a negative opinion and indicate the reason for rejection of reasonable; 39.3. project list indicates for each action calls for public funding support of the euro, the name of the applicant, the name of the project, the project site (the smallest territorial unit), project submission public funding granted to the project application to the number of points and indicating whether it is positive or negative; 24.5. these rules 24.4. referred to the list of projects and the opinions of the authority a copy of the minutes of the hearing together with the project submissions and the documents attached to them, as well as the rules referred to in paragraph 31 of the publication copy within five working days of the field support service.
