The Saeima has adopted and the President promulgated the following laws: For the Government of the Republic of Latvia and the joint force headquarters in Europe, the Commander of the transformation of the memorandum of understanding on the training of "cooperative nugget 2004" in article 1. 2003 December 19, signed by the Government of the Republic of Latvia and the joint force headquarters in Europe, the transformation of the Commander's memorandum of understanding on the training of "cooperative nugget 2004" (hereinafter referred to as the memorandum) this law is adopted and approved. 2. article. The memorandum shall enter into force at the prescribed time and manner, and the Ministry of Foreign Affairs shall notify the newspaper "journal". 3. article. The law shall enter into force on the day following its promulgation. By law to be put to the memorandum in English and its translation into Latvian language. Otter in Riga on 25 May 2004, the memorandum OF UNDERSTANDING (MOU) BETWEEN the Government OF the REPUBLIC OF Latvia AND the headquarters, Supreme ALLIED COMMANDER TRANSFORMATION CONCERNING cooperative nugget 2004 preamble the Government of the Republic of Latvia, represented by the Minister of defence of the Republic of Latvia (MoD) and headquarters, Supreme Allied Commander Transformation (HQ SACT) , hereinafter referred to collectively as the parties: HAVING REGARD to the provision of the "Protocol on the status of International military headquarters set up to the North Atlantic Pursuan Treaty" (Paris Protocol), dated 28 August 1952; HAVING REGARD to the provision of the "agreement between the parties to the North Atlantic Treaty Regarding the status of Their forces (NATO sofa), dated 19 June 1951; HAVING REGARD to the provision of the "Agreement Among the States parties to the North Atlantic Treaty and the Other States Participating in the Partnership for peace Regarding the status of Their forces" (PfP sofa), and including the Additional Protocol to this agreement, dated 19 June 1995; HAVING REGARD to the provision of "Further Additional Protocol to the agreement among the States parties to the North Atlantic Treaty and the other States participating in the Partnership for peace regarding the status of their forces" (Further Additional Protocol), dated 19 December 1997; Having a common interest in achieving compatibility, also, and standardization of practices and doctrine relating to logistics support of the forces of NATO, NATO member Nations, and the PfP member Nations; RECOGNIZING that combined exercises with the fundamentals to achieving the goals that are common to the parties; RECOGNIZING that exercise cooperative Nugget, scheduled for January 2004 (phase I) and March 2004 (phase II), is implementing an element of NATO and PfP principles; CONSIDERING the need to an agreed structure arrang to facilitat this exercise; The parties have REACHED the FOLLOWING UNDERSTANDING: article one DEFINITION For the purpose of this MOU, the following terms have the meaning as indicated: CN04 1.1 (cooperative nugget 2004) — A Combined Joint Command post exercise (CPX) and Computer Assisted exercise (CAX) confined to a classroom location for combined training procedures relating to staff during a NATO-led peace support Operations (PSO) scenario. The term includes: CN04 pre-exercise planning, coordination and conduct of the training exercise, and post exercise assessment. 1.2. — Military and civilian participants personnel from HQ SACT and others in NATO Headquarters and NATO, PfP, Mediterranean Dialogue and the Nations entering the territory for conducting CN04 OK HN. 1.3. the host Nation (HN) —-the Republic of Latvia, being the nation that receive and OK hosts the participants for conducting CN04 phase I and phase II. 1.4. Host Nation support (HNS), the civil and military assistance rendered by the host Nation to the participants as not to conduct CN04 cessary. 1.5. the Force Protection (FP) — All of the measure taken and means used to minimize the vulnerability of personnel, facilities, equipment and operations to any threat and in all situation, so as to preserve freedom of action and the operational effectiveness of the force. 1.6. Joint Implementation (JI) — Through the follow-on document that details the host Nation support required by the participants on the territory and deployed to the HN clarif procedures and others measure cessary to enable not the MoD and HQ SAC or its authorized representative to effectively fulfil the responsibilities identified in this MOU. Article two purpose 2.1. The purpose of this MOU is to establish and implementations that the principles and procedures for the conduct of CN04, including the provision of HNS to the participants. 2.2. This MOU and its supporting documents serve as a basis for the development, planning, and execution of the HNS, not between the MoD and cessary, HQ SACT or CINCWESTLAN, as it is the authorised representative during CN04. Article three scope AND GENERAL ARRANGEMENTS 3.1. HN, as defined in this MOU and specified in the Jia, will commenc with the entry of the advance teams of the participants into the HN territory and will continue throughout the exercise until the last Participant leaves the HN territory. 3.2. The HNS will provide support to the participants within it is deployed for CN04 fulles the capacity to do so and in the considerations of the practical limitations of circumstanc that exist or during the execution phase CN04. Article four LEGAL issues 4.1. The status of the participants will be determined in accordanc with NATO and/or the PfP sofa and the Paris Protocol, as applicable. 4.2. The status of the participants of the Nations which are not States parties to the above mentioned treats will be determined in accordanc with legislation and in international law or any HNS other arrangements between the Nations involved. 4.3. The HNS will: (a) main) Participating foreign personnel from border tax and visa requirements at entry/exit into/from HN territory; (b) Participating foreign personnel from HN) procedures for registration and control of foreigner upon arrival/departure from its territory, however this shall not be considered as acquiring any right to permanent residence or domicile of the on the territory of the HN; and (c)) equipment, supplies, products, and materials imported into and exported from OK HN territory in connection with CN04, from all duties, taxes, fees and toll. 4.4. The HNS will make arrangements to either reimburs HQ SAC or its authorized representative or make direct payment to the designated supplier for all taxes and duties on goods purchased for the conduct of CN04. 4.5. Upon entry/exit from the HN territory the following documents shall be presented by the participants upon request: (a) the Identity card/passport) issued by the national authorities, showing the name, date of birth, rank and service number (if any), and photograph; and (b)) the Individual or collective movement order or warrant of NATO travel in the language of the nation and respectiv in English. 4.6. All participants may import and export cash or cash instruments in accordanc with HN legislation. Criminal and disciplinary jurisdiction over 4.7. Nato/PfP participants with respect of the offenc committed by them on the territory of the HN and punishabl is under its laws will be settled according to the NATO/PfP sofa. 4.8. A ll claims, other than contractual claims, arising as a result of CN04, during the deployment, redeployment exercise and their period and from the exercise area, will be processed according to the NATO/PfP sofa. 4.9 C lime or omission arising from acts of NATO/PfP participants, done in the performance of their official duty and causing damage on the territory of the HN to third parties, other than NATO Nations participating in PfP or CN04, shall be processed in accordanc with article VIII of NATO sofa. 4.10. HQ SACT may, in support of CN04, establish bank accounts in any currency and shall have the capacity to conclud a contracts, make a purchase and dispos of property for the purpose of the exercise in accordanc with HN, legislation and the Paris Protocol. The Latvian point of contact will assist, sharp not cessary. 4.11. Personnel with authorized to wear uniforms while participating in CN04. Participants in the note shall have the CN04 right to have and carry arms and ammunition during their stay in the Republic of Latvia. Article five force PROTECTION 5.1. Comprehensive and effective FP will be planned for NATO's static headquarters, operations, training and exercises, and will be detailed in the OPLAN, EXP and a Supplementary agreements, as appropriate. FP will be implemented in accordanc with NATO policy and procedures and in a manner consistent with the NATO/PfP sofa. The under of the FP will circumstanc required or provided be contrary to the NATO/PfP sofa or HN law. 5.2. As appropriate, the HN will inform the NATO Commander of DSB and its proposed measure FPS, limitations and restriction. 5.3. As appropriate, each SN is responsible for identifying and providing it for FP requirements and limitations to the HN and NATO Commander. 5.4. In addition to those detailed responsibilities in NATO FPS FPS policy and procedures, the NATO Commander is responsible for coordinating all required and provided HN and SN as appropriate to the FPS protection of the force. Article six responsibilities 6.1. The HN will: (a)) Specify a point of contact regarding implementation of this MOU including HN support of the exercise; (b)) provides the required logistics support and services as mutually determined under this MOU and in the relevant JIU, taking into account national requirements and actual availability; (c)) provides a representative to assist participants with clearance through Immigration and customs at the times of arrival and departure; (d) make or conclud of) those requested and not arrangements with appropriate cessary sources/agencies (including civil and commercial sources) on behalf of HQ SAC or its authorised representative to effect timely and efficient support to the participants. HQ SACT may provide direct payment to individual vendors or reimbursemen or other authorised representatives for HNS requirements provided for CN04. The Latvian point of contact will assist, sharp not cessary [a1]. 6.2. HQ SACT (CINCWESTLAN) will: (a)) Us with care items on loan and facilities provided for use by HN and will return them in the same condition in which they were received, except for normal wear and tear. (b)) provides a list of personnel by name and nationality, date of birth, number of the passport or identity card (if any), rank and also information on the scheduled time of arrival, airline, Aerial port of Entry and departure from later than fifteen twenty days prior to the date of the commencemen exercise. (c) to give timely notice) of any change in the relevant circumstanc to the HN. d) a point of Designat contact for any issue in connection with the implemention of this MOU or relevant JI. Article seven FINANCIAL PROVISION 7.1. The price charged for supplies, services and facilities from civilian sources will be at the actual cost of each service or supply without any element of profit on the part of the MoD. In the event of the price charged will be greater than the most favourabl rate applicable to the HN Armed forces. Military supplies, services and facilities will be provided at from the charge. 7.2. The HNS will keep the administrative and financial records do not establish the cessary to the CWD and reimbursemen will provide authenticated "cop to such records of their HQ SAC, or its authorized representative, in English. 7.3. Medical and dental support provided by civilian medical personnel/facilities the HN Participating personnel will be paid by the individual/sending the nation concerned. Such support must include the availability of intermediate and intensive care facilities which meet the NATO medical support standards. 7.4. Medical and dental support provided by HN military personnel, including the use of military facilities/equipment, will be at no cost to participants. Article eight language 8.1. English is the working language for the purpose of this MOU and while conducting CN04. 8.2. This MOU is prepared in the English language in two original cop. Article nine, DURATION AND TERMINATION 9.1 COMMENCEMEN. This MOU will come into force on the date of the last signature. 9.2. This MOU will remain valid until the final Participant to leave the territory of the host Nation and all issues relating to the obligation of the and the settled CN04. Article ten. DISPUTATION AND Any AMENDMENTS arising of the dispute a 10.1 in connection with this MOU shall be immediately resolved by mutual consultation between the parties involved, without recourses to outside jurisdiction. 10.2. Upon request of either Party the provision of this MOU may be amended or supplemented by written agreement that shall be approved and signed by both parties.

The term includes: CN04 before training planning, coordination and training, export and training after training. 1.2. Members — military and civilian personnel from HQ SACT and other NATO Headquarters and NATO, PfP, and Mediterranean countries for temporary entry into the territory of CN04. HN 1.3. The host country (HN), the Republic of Latvia is a country that captures and temporarily housed CN04 members I phase and phase II. 1.4. The host country support (HNS) — civilian and military assistance that members provide execution host CN04. 1.5. the force protection (FP) — all the means used and the measures taken to reduce personnel in any situation, building, equipment, facilities, and operations risk, force freedom of action and operational effectiveness. 1.6. The joint implementation (JI) agreement — additional documents that detail down the host country deployed members the necessary host country support and clarify the procedures and other necessary measures to promote the protection of the Prime Minister of the Republic of Latvia and the HQ SACT or their authorised representatives under this memorandum of understanding for more effective enforcement of liability. The second article objective 2.1 the objective of this memorandum of understanding is to establish and implement policies and procedures for export, including CN04 host country support to the participants. 2.2. This memorandum of understanding and its supporting documents serves as a base for planning, development, and support of the host country, which required between the MoD and the HQ SACT or Western Atlantic area commander in Chief (CINCWESTLAN), which is the authorized representative CN04. The third article scope and general provisions 3.1. Host State aid laid down in the memorandum of understanding and a joint implementation agreement specified, beginning with the Member unit from entering the territory of the host country and will continue during training until the last participant leaves the territory of the host country. 3.2. The host State shall provide the members support deployed CN04 in full and given practical limitations and conditions that exist during the execution phase CN04. Article 4 legal issues 4.1 forces status shall be determined in accordance with the NATO and PfP sofa and/or the Paris Protocol, and applicability. 4.2. the Participant Nations not participating in the above agreements, shall be determined in accordance the laws of the host country and international law or any other agreements between the participating countries. 4.3. Host country released: a. foreign personnel participating, from the border crossing and visa, arriving/leaving the territory of the host country; b. foreign personnel participating, from the host country of the existing registration and control of aliens, the entry/departure from the territory, but it does not give any right to permanent residence or acquisition of autonomous residence in the territory of the host country; and (c) of all duties, taxes, charges and fees in connection with the Road temporarily imported and exported CN04 equipment, raw materials and products. 4.4. The host State shall take steps to reimburse each HQ SAC or its authorized representatives, or making direct payment provider specified for all tax and duty Affairs CN04 acquisition. 4.5. Upon arrival in the territory of the host country and leaving it, the sender State personnel upon request shall be subject to the presentation of the following documents: a. the public authorities issued ID card/passport, which contains the name, date of birth, rank (if any) service card number, service and photography; and (b) the individual or collective movement order or NATO travel order or the country concerned in English. 4.6 in accordance with host country laws and regulations all members may be imported or exported for the money or the means of payment. 4.7. Criminal and disciplinary jurisdiction over members of the NATO/PfP over the offences which they have committed in the territory of the host country and which is punishable under its laws, are implemented, according to the NATO/PfP sofa. 4.8. In case of need each Sūtītājvalst will assume responsibility for their own protection force requirements and constraints to the development and submission of the host country with the NATO commander. 5.4. in addition to the NATO force protection policies and procedures included in the force protection duties, with which NATO commander is to ensure force protection, he coordinates the necessary host country and Sūtītājvalst the requested and provided force protection. The sixth article responsibilities 6.1. The host State shall keep the official administrative and financial documents needed to establish the cost of repayment for the host country, and ensuring that the documents authentic copies of the SAC HQ or his authorised representative in the English language. 7.3. Medical and dental support provided by the host country's civilian medical personnel/staff of the authority who participates, in the individual pay/sūtītājvalst. Such support includes access to the medium and the intensive care facilities that meet NATO standards of medical aid. 7.4. Medical and dental support provided by the host country's military personnel, including the military/the use of equipment is free of charge to participants. The eighth article language 8.1 for the purposes of this memorandum of understanding and training during working CN04 language is English. 8.2. This memorandum of understanding has been drawn up in two originals in the English language. The ninth article of the entry into force, duration and termination 9.1. This memorandum of understanding shall enter into force on the date of the last signature. 9.2. This memorandum of understanding shall remain in force until the last participant leaves the territory of the host country and all issues and commitments relating to CN04 is settled. The tenth article dispute and amended 10.1 any dispute that originate in the context of this memorandum of understanding, is immediately resolved between parties mutual consultation, without the involvement of external jurisdiction. 10.2. at the request of a party, the conditions of this memorandum of understanding may be amended or supplemented by the written agreement, which is approved and signed by both parties.
